guthrie and hoda kotb, live from studio 1a in rockefeller plaza. and welcome to "today." thank you for joining us on this tuesday morning. last night was a blowout if you were worried about staying up late and missing the ending. >> yes. you didn't. roll tide rolled over. sad alabama fans this morning, but congrats to clemson. we're going to get right to our top story. president trump delivering a prime time address tonight in the midst of what is now the second longest government shutdown ever. we do have complete coverage. we're starting with nbc's peter alexander at the white house. hey, peter. good morning. >> reporter: hoda, good morning to you. president trump in a speech to the nation tonight will cast the situation at the southern border as a crisis. but his critics say the real crisis is an economic, political and human one. hundreds of thousands of federal employees out of work as this government shutdown stretches on, and today many are challenging the president's credibility on the border issue after the white house has repeatedly misrepresented the facts.

tonight a presidential pitch in primetime. president trump's first oval office address. the immigration speech part of a one-two pr punch with a trip to the border set for thursday. both designed to highlight what the president calls a humanitarian and national security crisis. president trump warning he might declare a national emergency going around congress to get his border wall built. >> we're looking at a national emergency, because we have a national emergency. >> vice president pence says no decision has been made so far. democrats pushing back. >> declaring an emergency on our border to build a wall is probably the worst public policy idea i've heard in about ten years. >> reporter: ongoing negotiations to fund the wall remain the crucial sticking point in the partial government shutdown now in its 18th day. this despite the president's repeated campaign promise that mexico was going to pay for the wall. >> who's going to pay for the wall? >> mexico!

>> reporter: and his more recent claims that mexico is already paying for that wall indirectly through new trade deals. this morning new numbers contradict the white house's argument for a wall to combat the threat of terrorism. >> we have terrorists coming through the southern border because they find that's probably the easiest place to come through. >> we know that roughly nearly 4,000 known or suspected terrorists come into our country illegally, and we know that our most vulnerable point of entry is at our southern border. >> i know this statistic, do you know where those 4,000 people are captured? airports. >> not always. >> reporter: in fact, between october 2017 and march 2018, agents at the southern border encountered only six immigrants listed in a terrorist screening database according to figures provided to congress last spring first reported by nbc news, and that doesn't mean they were necessarily terrorists. the white house now trying to redefine what a means by a border wall. in this letter to democrats framing it as a physical barrier made of steel, not concrete.

helplessly watching the stalemate, 800,000 federal workers, many of them set to miss a paycheck this week. among other things, food stamps and federal housing could be impacted if the shutdown drags on, and with concerns that tax refunds won't go out on time. overnight the irs promised it will begin processing those tax returns by the end of this month, and will pay out the refunds as scheduled. hoda and savannah? >> peter alexander at the white house. peter, thanks. also this morning -- the vice president is out speaking to nbc news about this ongoing shutdown, and his role in negotiations to try to bring it to an end. nbc's chief white house correspondent hallie jackson sat down with him just moments ago. hallie, good morning. what did you hear? >> reporter: savannah, good morning to you. i asked the vice president specifically about the president's comment that the those federal workers peter talked about should make adjustments, but the vp could not offer specifics on what he thought those workers should do. he also made very clear that the possibility of declaring a national emergency is on the

table. >> the president is speaking tonight in a prime time address. is he going to declare a national emergency? is that your expectation? >> what i expect the president will do tonight is explain to the american people that we have a humanitarian and security crisis at our southern border. 60,000 people are now attempting to come into our country illegally every month. that's more than 2,000 a day, but what's unique about it, hallie, and why "the washington post" has even called it a bona fide emergency is because the vast majority of those people now are families and unaccompanied children, and it simply is overwhelming the ability of our customs and border patrol to address it, and so the president will take those facts to the american people.he people with criminal records that we've apprehended at our border. he'll explain the need not just to build a wall, which he's determined to do, but also to

provide our border patrol with additional resources, humanitarian and medical assistance, new technology, but the democrats need to come to the table and start negotiating. tonight the president will take that case to the american people. >> i heard you use the word "crisis." i heard you use the word "emergency" citing this "post" piece. is this a signal that the president will declare one at some point perhaps this week? >> well, as he has said, it's something that he's looking at and considering. >> which former presidents told president trump as he said that he should have built a wall? all their representatives have denied that that was the case. >> well, you -- i know the president has said that that was his impression from previous administrations, previous presidents. i know i've seen clips of previous presidents talking about the importance of border security, the importance of addressing the issue of illegal immigration. and, look -- >> that's different from telling the president, though, right? >> look, honestly, the american

people -- the american people want us to address this issue. >> reporter: so to clarify here, a national emergency is something that constitutes a threat to the health and safety of americans. for example, it is not clear if the president will declare one tonight. i'll tell you, in that interview, the vice president repeated that claim that has been debunked as misleading about the number of suspected terrorists or immigrants coming across the southern border. but he did make clear that the president is feeling resolved in his stance. democrats are, too, which means that unless somebody starts to give in, this shutdown could stretch even longer than it's already gone on. savannah? >> all right, hallie, thank you. we should mention that nbc news will have live coverage of the president's oval office address to the nation tonight at 9:00 eastern. another big story this morning, a winter storm is rolling into the northeast, and there could be a second potential storm right on its heels. al's here with what we can expect on this. al, good morning. >> good morning, guys. in fact, i just saw a salt truck

guy by here on 49th street. we're watching some snow making its way through new england, rain throughout the region, but it's moving off. we're going to see more coming as you mentioned. 11 million people under winter weather advisories or winter storm watches from michigan all the way into new england. here's what we're looking at, one low pressure system pushes off. that's the one that's bringing the snow and the rain in the northeast. the next one comes in. it's bringing some rain, also winds behind it. as it pushes in, it draws in colder air back from canada, and that's going to create lake effect snow emergencies developing as this system pushes through. so snowfall forecast, through thursday from houghton, michigan into travers city, western new york, also, western pa, anywhere from 6 to 12 inches of snow. the heavier snow going to be from the tug hill plateau in upstate new york into northern new england with upwards of 12 to 16 inches of snow. guys, we're going to also be watching a possible mid to late-week storm that may cause even more problems. we'll have more on that a little bit later. back to you. >> see you later.

now to a dramatic day in a nantucket courtroom for actor kevin spacey pleading not guilty to sexual assault. nbc's morgan radford was at the courthouse and has the latest. morgan, good morning to you. >> reporter: savannah, good morning. kevin spacey has officially been arraigned on a felony count of sexual assault that's actually named at indecent assault and battery. the entire arraignment only lasted about ten minutes inside this courtroom. his defense lawyers filing documentation that said he's not only pleading not guilty but he's also challenging accusations that he groped a then 18-year-old boy. flying in by private jet, and hounded by cameras, two-time oscar winning actor kevin spacey appearing in court expressionless as he listened to the charge that could land him behind bars. >> indecent assault and battery on person 14 or over. >> reporter: during the ten-minute arraignment on nantucket island on monday,

spacey was ordered not to have any contact with his accuser who says the actor groped him inside a popular bar two summers ago when he was 18 years old. >> our request simply specifically is to stay away. >> reporter: according to the criminal complaint, the young man who was not present in court was working as a busboy at this bar where he alleges spacey bought him several drinks before fondling him for several minutes. his mother former boston news anchor heather unruh describing her shock when she spoke to nbc in 2017. >> i don't think he ever thought of the possibility that in his lifetime he would be the victim of a sexual assault. >> reporter: in a new court filing, spacey's defense attorneys say unruh's son claimed he was a 23-year-old college student and did not object to the alleged touching. adding that a snapchat video the accuser sent to his girlfriend does not show anything that could be remotely described as assaultive behavior.

the judge ordering the prosecution to save all messages and videos from that night after a request from the defense. >> all i'm asking for is just to put a bubble around that data so it doesn't get destroyed. >> reporter: in a statement monday, the civil attorney for the accuser said in part, my client is a determined and encouraging voice for those victims not yet ready to report being sexually assaulted. spacey's lawyers entered a not guilty plea on his behalf to the felony charge of indecent assault and battery. >> mr. spacey -- >> reporter: a real-life drama putting kevin spacey once more center stage. >> and morgan, what's this about kevin spacey actually getting pulled over not long after that court hearing? what happened? >> reporter: that's right, savannah. he was pulled over for speeding after he landed in washington, d.c. he was let off with a verbal warning. meanwhile, when it comes to this case, he has a preliminary hearing scheduled for march 4th, although the judge said he does not actually have to physically appear in person. savannah. >> all right.

morgan, thank you. we turn to craig with another story we've been following closely. >> yeah. indeed. later today a funeral will be held for jazmine barnes, that 7-year-old girl who was shot and killed in texas. this as we learn more details about the suspects in that death. gabe gutierrez is in houston this morning. good morning to you. >> reporter: craig, good morning. this has been a heartbreaking story, one that has shaken many people around houston. today there are many unanswered questions, even as jazmine's funeral gets under way. [ chanting ] >> reporter: this morning, a community is preparing to honor jazmine barnes, the 7-year-old shot and killed her mother says while the family was on an early morning coffee run. >> nobody knows the pain of losing a child! >> reporter: her more was shot in the arm and rallied supporters this weekend just hours before the case took a dramatic turn.

two suspects now in custody. eric black jr. charged with capital murder is being held without bail. >> the evidence is turning to eric black as the driver of the getaway vehicle in the shooting of jazmine. >> reporter: the alleged shooter has not been charged in the case, but jazmine's family attorney citing law enforcement sources identify him as larry woodruffe who was arrested over the weekend. >> it's our understanding this was a case of mistaken identity. that they fired in the vehicle believing it was retaliation for an altercation that happened earlier in the night. >> after a manhunt that initially focused on a pickup truck and the wrong man in this composite sketch, there are unanswered questions. shawn king, the activist who helped raise a $100,000 reward and received a tip that help cracked a case now tweeting, something's not right. key details are missing in the story. i no longer trust the timeline. overnight he told nbc news he thinks there's much more to this story, and details are quickly unfolding. the sheriff, meanwhile, has repeatedly backed up the mother's story.

how did you learn about it? >> i learned about it because i knew something was wrong at that point, and i knew that why am i in the hospital? it's not usual for someone at 4 years old all the time to be in the hospital. so i'm like there's something got to be wrong, and so i'm just trying to like what's going on? and i figure that nobody's going to tell me because i'm 4 years old, and i probably don't understand and so then i'm just like, okay. and then i find out what's actually going on, and then it's just i have to go through that and i can't change that because it's already there so. >> and did you -- devon, i look at you and i see a big hulking football player, the strongest guy in the room, and i know all you wanted to do is protect your little girl. >> right. >> when you learned the news that this little beautiful girl

had this illness that could have been devastating, what did you think? >> you know, it broke my heart. it turned my world upside down because i remember the day she was born, and i made that promise that we're going to do everything we can to protect our children. i felt like when i found out she had cancer i broke that promise because i couldn't protect her from this disease. >> well, i got to tell you, you battled through that, and i remember seeing you in the hospital, seeing both of you, and i was always struck by how strong you both were. >> right. >> did you ever cry in front of your dad? >> no, i really didn't. it's just like i didn't want to because i knew that if i did my whole family would cry, and i didn't want that because i knew that i didn't want them to go through like i did, and so i just didn't want them to cry like how i cry, and so that's

why when i'm around my dad, well, when i was i didn't cry in front of him. both of us didn't cry in front of each other. >> you didn't cry in front of her either, devon? >> that's probably one of my biggest regrets is not being vulnerability in front of her. i didn't know she was experiencing the same emotions i was going through. when we would get off facebook i would start crying, and i found out that she would go into the bathroom in the hospital and cry because we just tried to stay strong for each other. >> everything turned around. you got the news that you were cancer free. i'll never forget that phone call we had. i'll never forget how i learned about it. how did you guys learn? >> we were pulling up from the hospital, which was really crazy because we were just there when we went home, we got a call, and we literally just pulled up at the door, didn't even park yet, and so then we get a phone call and i'm like who's that.

and then my dad answers the phone, and he's like, mm-hmm, mm-hmm, mm-hmm. mm-hmm. and i'm like, dad, am i cancer free? am i cancer free? am i cancer free? >> he didn't answer because he was on the phone, and i'm like please answer me. i need to know. and it's just like when he got off the phone, he's just like and then we're like. and then he's like you're in remission. i'm like, yes! and then all three of us start hugging. it was just like a happy day. >> it must have been incredible. now what i love about this book, devon is you're using this to help other people, and you're reaching out. you guys have come out on the other side, and i see videos of you in hospitals. this book is filled with inspiration. that was a simple decision to dive right back into that situation with other families? >> honestly i never planned on writing a book. i just felt like one day it was

an assignment i had to get my testimony out there. there's a lot of people who are going through some struggles right now in their life and they're not sure how they can get back into the game. i felt like throughout all the struggles i faced in my life, god gave me a play book that other people can use to get off the sidelines and get back into the game. >> your faith is such a big part of this. the book is amazing. leah, you've met so many young kids who are going through cancer. if you were to say something to them, what would be advice if a child asked you? >> i would say stay strong, and it doesn't matter what's on the outside. it matters what's on the inside, and you're not fighting this alone ever. >> you all are such an inspiration. your book is incredible, so are you devon. leah, you're going to keep coming back and seeing us, okay? love you honey. for that. when i look at the people who have gone before who never got a chance to do the things i'm doing. you know what i mean? i look at the back of my life, i've had family members and different people who were like one day, man, i wish i could have, and they never did. all they did is tell you. and i was like that's not going to be me. >> what's the special sauce? how did you get that courage? >> it starts with little small things, the little chances that you take, the little victories. i always tell everybody it's really about, you know, starting small but thinking big. for me it was like the one -- you know, a perfect example. my mother was very, very strict because flint, michigan, was very rough. she wouldn't let me do talent shows. she wouldn't let me perform. i said, ma, how about i host a talent show. let me tell you something, i hosted my high school talent show. i never saw that i would be hosting the biggest talent show in the world. >> that's like full circle. >> i'm trying to tell you it starts small.

it's these kind of things that you don't know, but you have to risk it. you have to take the chance to get out there and try it. i call myself unembarrassable because the deal is if you mess up, you know what? hey, i messed up a word. i did this. people didn't care, but you know what? no one remembers your failures. they only remember the success. >> what do family members, friends who knew you when you were little terry crews and they see you, what do they think of your success? >> i get nothing but love. you want to do your people proud. nobody does this alone. you just don't. i am a series of happy accidents, you know what i mean? people who believed in me. terry crews, i'm going to give you that shot. you just come over here. i'm going to pay you for that. these people now look at me like, oh, my god. i got an e-mail from my first grade teacher ms. sullivan back in flint, michigan, she was like i knew you were going to make it. i knew it. you was literally welled up. i was in tears because you go

you are doing it for them. it's not just you because these people put things into you that all of a sudden you can make -- you can make their world better. you know what i mean? it's great. >> you're doing so much. i literally have two pages of things. you also have brooklyn nine-nine. you're into design. you've got it all going on. tell me about brooklyn nine-n e nine-nine. the series was rescued and now it's on nbc, which i just think is awesome. >> we're a zombie show. we were killed. it was over. i'll never forget, it was done. we were ghosts. we were like, oh, my god. what just happened, and 30 hours later nbc picked us up and it's been better than ever. let me tell you something, we usually went on in the fall, but now that we're coming on in the winter, people have had a chance to binge watch, and fans are like let me hear about this show, and then they love it. i'm trying to tell you, our fan base is rabid.
