radar this morning, as of the 6:00 a.m. hour, it gets started, rain moving through overnight and it is heavy and causing accidents. good morning, everyone. thank you for joining. us. i'm scott mcgrew in for marcus washington. >> and i'm laura garcia. breaking traffic news this morning, it's been a mess on northbound 101 near mckee in san jose. >> yes, that's not the only problem for the south bay and also involving the radar we're talking about the rain. it did travel through the area, so i'm talking about the wet roadways down here in the south bay. if you look at the rest of the bay, everything else moves smoothly. the metering lights are on at the bay bridge no, surprise. it is down here with the big problems here. you see the whole section. we've had a series of crashes in this portion of san jose, right around alum rock, berryessa, and now we see the build for 87, as folks use that as an alternate to get past that backup, causing more problems for folks coming up 85 and south county. as we zoom over here, as laura
6:01 am
said, the closure of almost all lanes, only one lane of northbound 101 is open here at mckee and over here at 680, there's a crash at berryessa, combined with a crash clearing north 280, one of the other routes out of the backup causing this entire area to continue with the build for north 101 coming up toward 280, 680 and the rest of the area. here is 680, we have our live camera with ethan, our photographer, who got out of there. only the right two lanes look like they may be open. your left lanes are blocked traveling through the area and bob redell is over there on 101. he's been covering the deadly crash. bob, the latest over there near mckee? >> reporter: good morning to you, mike. yes, three lanes, three right lanes of northbound 101 still shut down here just north of mckee. we've got two issues with regard to the overturned truck. one was removing the person who was killed in this accident, the other issue is getting this truck right side up, so they can
6:02 am
remove it from the roadway. it's taking some time. this accident happened around 3:45 this morning, according to chp, the driver of this box truck fell asleep, drifted off of the lanes of northbound 101, and wrecked, as you can see right here, north of mckee. the driver did survive, was able to explain to the chp that he had fallen asleep. unfortunately his passenger was killed. >> driver fatigue is a major issue for us. it's almost on par with drunk driving, because sleepy drivers do appear to be the same as drunk drivers to us. so we encourage people, if they're feeling tired, to not continue their journey to pull over. take a nap. take a rest. >> reporter: the driver taken to the hospital with major injuries but is expected to survive. the brake lights are headed northbound on 101 in the far left lane, the only lane that is open right now. the three other lanes, as i mentioned, are shut down.
6:03 am
the road was shut down completely at one point. my point is, there is a tremendous backup here. if you have business here in this section of san jose, you do want to find an alternate route, as mike inouye has been pointing out to us. again, it's going to take some time for the coroner to finish their job and get this box truck right side up and removed from the freeway. reporting live here in san jose, bob redell, "today in the bay." >> thank you. >> very tragic accident out there. you see slick roads as well. want to check the radar with meteorologist kari hall, that storm that's hit the bay area. how long are we going to see it sticking around? >> for at least the early afternoon, and we're seeing some of the heavier rain now concentrated across the north bay, as we get a closer look for much of sonoma and napa counties, as you head out this morning, we're also seeing a pocket of some heavy rain, right there on 101, near marinwood and as you head through the south bay, the rain say lot lighter, it's starting to taper off from some of the heavier rain we had earlier this morning. this is a part of a larger storm
6:04 am
system and there will be another one headed in time for the weekend. we have the lingering gusty winds. the wind advisory continues until 10:00 this morning. so you do need to drive carefully, not only because of the wet roads, but the wind as well. i'll be tracking all of this, we'll talk about what's ahead over the next couple of days coming up in the next microclimate forecast. >> sounds good. we'll check back with you, kari. it is 6:04. we are expecting new details in a deadly shooting that shook up the bay area when it happened aboard a b.a.r.t. train. in 2016, 19-year-old carlos romero was shot on a train as it was approaching the west oakland b.a.r.t. station. the images police released were taken aboard a tri delta bus servicing the central valley. b.a.r.t. police say romero and the suspect rode the same bus to the pittsburg b.a.r.t.
6:05 am
station and had an interaction on board before that shooting. right now the search continues for a suspect accused of shooting and killing a high school student on the peninsula. constitutional a lot of questions to be answered in the story. >> "today in the bay's" pete suratos is live in belmont, where the student attended high school. pete, the school community definitely in shock this morning. >> reporter: that's right, good morning to you, scott and laura. the shooter we're talking about is mow had amun, who attended carlmont high in belmont, set to graduate not too long from now and also a student athlete at the school. as you can see in the video of him playing football this past season at the belmont school. there's a lot of questions as to what led to the shooting death but according to belmont police, they received a call monday night from the parents who were requesting a welfare check on their son, who they believe was at central elementary school, which i looked up, is about five minutes north of where we're standing. now, when officers went to the school, they say they found him
6:06 am
dead in the front parking lot of the school from an apparent gunshot wound. still a lot of questions as far as what led to his death, but here is what his football coach and other students at the school are saying about this shocking news. >> we had a lot of them here at school today just, you know, in my classroom, kind of just supporting each other and trying to talk each other through it as much as possible, but we're all having a really hard time with it. >> well my reaction to the death of mow had, i was kind of in shock. i don't expect people getting shot in this community because it's such a good and quiet community. you know what i'm saying? >> reporter: so there's no suspect description at this time, but take a look at this void yes. these are investigators in pleasanton last night at this home. there's no word from police as far as why they were there, but neighbors tell our crews that the family living there moved from belmont about a year ago, and also police do not believe this is a random shooting. othman and the suspect may have known each other. of course, if you have any information to help with this case, contact belmont police. we're live in belmont, pete suratos for "today in the bay."
6:07 am
>> thanks for the latest there, pete. >> it's 6:06. new this morning, authorities in the north bay looking for a supermarket bank robber. police say the person you see here walked up to a u.s. bank teller about 5:30 last night. this bank is inside the satisfy way on navei drive. the robber handed the teller a note demanding money, got the cash and fled. anyone with information should contact novato police. happening today, a new homeless center is hoping in san francisco. the shelter is located near fifth and bryant streets south of market. the center will have 84 beds for those in need. it is on land owned by the california department of transportation. the city is leasing the land for $1 a month. four other so-called navigation centers are already open throughout san francisco. ceo tim cook reveals what
6:08 am
the tech giant is working on this year. he talks about the successes and downfalls from the past year and shares some of the new services apple plans to announce this year. >> if you zoom out into the future, and you look back, and you ask the question, what was apple's greatest contribution to mankind? it will be about health. >> cook also discussed the impacts of the ongoing trade dispute between the u.s. and china. he said it was in both countries' interest to reach an agreement. and we are still seeing some of the scattered showers moving through parts of the bay area. right now at 6:08, with some of the heavier rain now moving through the north bay, lighter showers elsewhere, and as we go into the rest of the morning into the afternoon, still a chance of some of those showers passing by. here we are at 11:30. we see another wave of rain approaching the south bay and also moving through the north bay, but then the general trend for the afternoon will be for rain chances to go down, even some peeks of sunshine, and our
6:09 am
winds will be calming down as well. we'll see a break in the rain for tomorrow, as well, and looking across the bay area for martinez, we are going to see those temperatures go from the mid-50s this morning to about 61 this afternoon. i'll talk about what else is going on for the rest of the week, and man, it's been such a rough morning, mike. >> it has, kari. the roadways are wet, but that's not why there's all the drama. anything north of the south bay itself shows a nice, pleasant drive. the bay bridge toll plaza metering lights are on. radar activity down over here, we've had wet roadways overnight and through the morning and we've been following this jam over here in this section but north 87 now feeling the build as folks try to shift over and avoid the backup. we continue to follow this, the crash north 680 at berryessa leaving only your right lane open in that direction. north 280 there is a crash coming off the same area. we have slowing because of a crash on the right shoulder and activity with tow truck there is and the continuing big issue, the traffic alert northbound 101
6:10 am
approaching mckee road, where we had a deadly crash that leaves your left lane open. bob redell is on scene, gathering facts and the progress and right now, you see the overturned box truck there, right in the middle of the screen. the coroner is on scene doing the investigation, finishing that up. they have to then right the truck, clear the lanes. this will be a while. wet roadways as well in the area. we continue to follow this, guys, back to you. >> thanks for the latest, mike. coming up next on "today in the bay," one day more, a gasp for sears, still alive and intact. today's new deadline. plus moose on the loose. the video from inside a hospital that has people talking this morning. yes, inside a hospital. you're watching "today in the bay."

6:17 am
here is a live look in san jose. you could tell it's wet and the roads are still going to be slippery in spots, still maybe some puddles, as we track it on storm ranger, that is our mobile doppler radar. some of the rain is continuing to move away from parts of the south bay, and we haven't seen much of that activity in spots like hayward, over toward dublin, but then you see the rain that's been picking up, and at least the evidence of it around livermore, and going into the north bay, where it's just been pretty much off and on, as the system rolls through. here is the last little bit of it, the last push of it, moving through for at least the late morning/early afternoon hours and you could tell there's a break in between before this system arrives on friday. so it's still going to be busy out there. because we've had such active weather, there will be some gusty winds picking up through about 10:00, when the wind advisory expires. we've seen those gusts close to 60 miles per hour in some of our hills, and mt. diablo a gust of
6:18 am
54 miles per hour. los gatos had a 46-mile-per-hour gust, and san francisco 44 miles per hour. mt. tam at about 38, and even in san jose, 22, so as you step out the door in san jose this morning, headed to school, you will still have the wet roads, and the sidewalks, and it's going to be in the mid-50s. chance of rain into early afternoon, so make sure the kids have the rain gear, even if it's not raining at the time. our hour by hour outlook shows that by 11:30, there will still be some rain chances here and there. very scattered activity, and as we go into the evening commute, most of us will be drying out, maybe even some clearing skies, and we'll get some peeks of sunshine throughout the day tomorrow, before that next storm system moves in on friday. looks like by friday afternoon, we start to see the rain approaching the coast. as we go through the seven-day forecast, the good thing is that there will be some breaks in between, so tomorrow is our break, and then a break on saturday afternoon, but this is still going to be very wet with
6:19 am
waves of rain moving through, even through next tuesday. as we head over to mike, you've been tracking a lot of major issues, especially for the south bay. >> that's right, as the rain came in early morning, we had a crash. i'm not tying the two together. i'm saying that was the timing. chp is going to do the investigation, and in fact, they continue with this investigation on the screen behind me, this is an overturned box truck, in this truck someone died as a result of the crash. the driver said it was related to the fact he fell asleep and there was a crash involving a number of other vehicles, and a lot of the roadway, north 101, at mckee, only your far left lane is open right over here on the side of the screen. an investigation continues and until it's completed by the coroner, who is on scene, and we can't have the lanes open. bob redell continues to follow this scene. nearby, we have 680 northbound, with only the right lane open. this is over at berryessa. they're clearing up the second of the two vehicles that we saw remaining in lanes. the tow truck's positioning and they're hopefully going to clear the remaining vehicle, which is obviously facing the wrong

direction. wet roadways here. no major injuries here. back out to the maps, talking about both of these freeways which take you away from north 101, a major congestion point for the south bay. north 280 a crash, quite a spectacle until a tow truck arrive. calmer, slow toward 87, your alternate to get out of the backup. the whole section of the south bay, san jose, really a problem, and people hearing about it, knowing the roadways, they're taking 85 over toward 87 so that one small problem, and then another, i should say big problem and bigger area and ripples out toward this area coming in from alamdin county and combined with rain in the area as well, plan on a tough drive for that section. southbound 17 in that area, we had a tree down, one lane is now open south past the summit. anywhere north of silicon valley, everything moves smoothly. the bay bridge metering lights are on. back to you. >> thank you, mike. >> maybe you should stay home for a little bit longer. 6:20 right now. they say you shouldn't judge a book by its cover.

trouble with a moving company. let )s turn to consumer welcome pack. be welcome back. nbc bay area responds to a sonoma county man who had trouble with a moving company. >> let's turn to consumer investigator chris chmura. he gets a lot of complaints in his inbox. >> oh, yes. our team has logged 58 moving complaints about various moving companies over the past two and a half years. in this case, greg lynch needed help after his mom passed away, and we to move her furniture from lake tahoe to sebastopol. greg hired o'brien's moving. on moving day, they broke a beloved bevelled mirror and couldn't get o'briens to pay in full to replace it, so he turned to us for help. we contacted o'briens. the company said it offered greg $150, and noted he had agreed to basic protection of just 60 cents per pound, so 150 bucks for a mirror was pretty generous. nonetheless, the company made an exception and paid greg $484, the cost of replacement that he had sought.
6:25 am
superstition says shattered mirrors are bad luck, but greg had yet pretty good luck here. after all, o'brien's went out of its way to give him 100% replacement cost, which he wasn't entitled to. moving companies contracts are strict, and fall into two categories you really need to know. we have released value and full value. at released value, your stuff is worth just 60 cents per pound. at full value, it's worth $6 per pound. the choice is yours, but full value will cost you more to move. you will see those options in your estimate, and again, on your receipt, what movers call the bill of lading. federal law requires it. if you have a consumer complaint, box up your documents and send them to us, electronically, that is, nbcbayarea.com/responds or call us, 888-996-tips. >> thank you, chris.

a person's body shape may influence your first impression of them. >> that is according to new research from the university of texas. researchers asked more than 70 people to judge different 3-d models of body shapes and the results, thinner models were considered easy-going and self-confident. people perceived larger models as careless and simple-minded. >> these stereotypes develop so young. i think we spoon-feed children from cartoons and from characters that cinderella looks a certain way and acts a certain way and cruella deville looks and acts a certain way. i don't think you're born with the stereotypes. i think society training them in, with the images we get presented, and the associated characteristics. >> the researchers say they hope the study will make people more mindful when judging others. >> 6:26. while you were sleeping, rain pounded parts of the bay area. the overnight damage and the wet roads you'll have to deal with, as you head out the door.

good wednesday morning. we have some wet roads right now at 6:h43, a live look at palo alto 101. people are up and out the door. it's time to get moving. we'll see cloudy skies and a chance of rain early afternoon. rain across the north bay, a closer look coming up in less than five minutes. meanwhile, this look at 101, can't get moving until they clear the lanes of the deadly crash investigation, north 101 at mckee road. we're following this. bob redell is on scene as well and will give you the latest, as well as how the alternates are shaping up. >> thank you very much. trump just tweeted a minute ago, "billions of dollars are sent to the state of california
6:44 am
for forest fires" he will misspell forest twice. the bottom line of this tweet "i have ordered fema to send no more money. it is a disgraceful situation in lives and money." this comes directly after new governor gavin newsom talked about forest fire protection and gavin newsom and donald trump are shaping up to be strong enemies in this. there's a lot to unpack in president trump's tweet, much of it is that the national forests are controlled by the federal government, even here in california. we will do some of that unpacking for you and have more detail coming up in our midday newscast. >> 6:44. palo alto police swarmed a home on reports of a deadly domestic violence shooting that turned out to be an entirely different kind of crime. "today in the bay's" kris sanchez joins us with what police are calling an incident of swatting. >> reporter: you may have heard of swatting, that's when
6:45 am
somebody calls police to report a crime that turns out to be untrue. we talked with the spokesperson for palo alto police and she confirms this was a prank that went down last night. this is a scene from a photo of palo alto daily post, outside that two-bedroom home on emerson street, where this all happened last night. in this case, the caller claimed to be a facebook cyber executive who claimed to have shot and killed his wife. now, palo alto police got the call about 9:15 last night from that man, claiming he shot his wife, tied up his children and planted bombs all over their home. the caller identified himself by name as a facebook executive. the caller also threatened to kill anyone who tried to help. it took about an hour for palo alto police to get to the bottom of all of this and to clear that scene. and according to "the daily post" at that time, the man at that address and another person
6:46 am
was detained. it turned out to be untrue, someone was impersonating him, there was no shooting. the prank tied up police for about an hour, both police and fire. there have been other incidents of swatting like this. in one case, about a year ago in wichita, a man showed up at his front door to open the door, where police thought they were responding to a shooting, and a hostage situation. that man was shot and killed, so clearly swatting incidents like this can go bad very quickly. this case did not go poorly and palo alto police will try to talk, track down that person who impersonated that man, claiming to have shot and killed his wife. everyone is safe, no one was hurt. in palo alto, kris sanchez, "today in the bay." >> kris, thank you. to a developing story out of phoenix, arizona. an investigation is unfolding after a woman in a vegetative state for more than a decade in
6:47 am
that facility. she gave birth last month. health care workers and families said they had no idea the woman was pregnant. the health care company is working with law enforcement to investigate. arizona's attorney general called the incident disgusting. >> i think it's absolutely abhorrent you have someone in a vegetative state that got pregnant. >> and taken advantage of. right now the ag's office leaving the case in the hands of local law enforcement. >> 6:47. peanut allergies can be dangerous. you may have a family member dealing with that issue. there's a new device that could save a life by detecting peanuts in food within minutes, but does it work? here is the "today" show's jeff rossen. >> reporter: good morning, i'm jeff rossen. coming up this morning on "today" an all new "rossen reports" talking about the kids and adults, too, with dangerous and potentially deadly peanut allergies. they have no idea when they pick up a plate of granola bars, for example, are there peanuts in
6:48 am
here? you can't always tell. now there is this new little device that fits in your pocket, right like that. this device right here that claims that it can detect peanuts in food. all you do is take a tiny, little sample of the food, literally, like this big, they say to make it pea size, you do that. you put it into the little tester right in here and within minutes it supposedly tells you whether there are peanuts in there or not. we're going to try this out, from cakes to granola bars, even trail mix. will it sense even trace amount of peanuts on a raisin that was adjacent to a peanut? we're trying it all out this morning right here on "today." >> jeff's full reporting coming up in the 8:00 hour of the "today" show. internet kind of freaking out after photos of beyonce in the diaper aisle at target surfaced, even chrissy teigen, who has a cookware line at target is weighing in on the queen bey's sighting.
6:49 am
she tweets "you are so silly, i can send you my new knives." maybe she like a lot of moms wants to spend time at target, a nice break. >> i think all the parents know it's decompression time. >> although you walk out of there with too big a fill. >> you told me the story, law camera, people stop you. you go to target? of course i go. i need paper towels. >> like regular people? i said yes, because there are some things in the paper goods aisle that we use all over the house. >> fair enough. >> don't get that in the trees because it will stay up there forever. it's raining forever. >> it's so soggy and we only have a little bit of time to clean up that before the next round of rain comes in. we are going to see some showers, even some gusty winds continuing across the bay area. here is a look at storm ranger. we've been tracking it with our mobile doppler radar, and it gives us an up to the second view of where the rain is falling, and in very high detail as well. so we've seen some of the showers moving through parts of
6:50 am
sonoma, napa, and also lake counties this morning. we are also picking up on some heavy downpours that just move through san rafael, and moving aless kro t across the bay approaching richmond in the next few minutes. the south bay the rain has been more spotty and light, but still making things very slippery, as you get ready to head out. so this storm system rolling on through. we still have a few more hours to deal with it, and then there will be a break, but there has been another system right behind that, that will bring us our next round of rain on friday. as all of the storm systems are rolling through, our winds are gusty and the wind advisory continues until 10:00 this morning mostly for the coast and the hills, where we do have the possibility of winds reaching 60 miles per hour, but so far, wind gusts at mt. diablo, 54 miles per hour, los gatos 46 miles per hour and in san francisco 44. in san jose, we've had a pretty high wind gust at 22, that was enough to bring down a tree.
6:51 am
we are looking at some cloudy skies in walnut creek, and a chance of rain as well. as we take a live look outside in san jose, the roads are still wet. it's still a day where the umbrellas may still get flipped inside out because of the gusty winds so a rain jacket and some boots or at least shoes you don't mind getting wet. there are a lot of puddles. as we go throughout the day, still some scattered showers, especially in the north bay, but we could see that rain anywhere across the bay area. for tomorrow, we take a break, maybe get a little bit of sunshine, but as we go into friday, we'll see that next storm system approaching, but it looks like it does arrive, moving into the afternoon to evening hours, as we see that rain moving in, that will linger into early saturday morning. saturday afternoon, another break, before the next storm system moves in on sunday. i'm tracking all of that for you, and mike, do we have any progress of the crashes in san jose? >> we do. 680 northbound cleared at berryessa, making some progress
6:52 am
over there, and behind me looking at the overturned box truck. i want to point out this tow truck, they've dispatched these arms there to steady the truck, basically putting it out, making it a wider base so it won't tip over as it starts to try to right this overturned box truck, the one that contained a person who has died as a result of this crash. now, i also want to point this out, it's a bit of a morbid fact, but some might have noticed the yellow tarp over here which is often used in deadly crashes, but this is over here, it is simply a piece of tarp in the roadway. bob, i asked him about that, he said do not worry, it's just draped over there on the metal side railing there, but it is not an issue there. we are looking over here toward the rest of the investigation and only at times we see traffic stopped from time to time as they picked that up, northbound 101 again at mckee. now, this is progress, but look at the other traffic camera we have, this is the backup, still jammed up solid because traffic right now not getting past that scene. we're going to stick with just our maps in the area and show
6:53 am
you how traffic shapes up. you're jammed northbound 101 coming into the area and even though lanes have cleared, 680 folks are using that as an alternate to get out of the backup and 280 as well. the ripple effect we see, the south bay experiencing more of a ripple effect, rain continues to fall in the area. capital expressway flooded, folks headed toward 87 or trying to get around 680 farther north, that's the worst of your commute around the bay. the rest of your bay moves smoothly, north 680 at sunol a crash, blocks one lane temporarily and we hope that counter commute crash clears but more rain coming into the area. the bay bridge metering lights are on but the worst issue is the rain coming in now. guys, back to you. >> thank you very much, mike. 6:53. breaking news, nbc news reporting this morning that deputy attorney general rod rosenstein plans to leave the justice department. sources say it will happen shortly after william barr, the president's pom know for tern g attorney general is confirmed. if you're just joining us, a

shut down, only one lane open. chp tells us they hope to have this fully reopened within the next 30 minutes. the record crew is trying to reright side up this box truck that overturned around 3:45 this morning, killing a passenger inside the vehicle. the driver of the vehicle told chp he had fallen asleep while traveling northbound. the driver was taken to the hospital with major injuries but he is expected to survive. as a result, all lanes at one point were shut down, so you do have the residual backup, not only because of the shutdown, but because you also only have one lane open right now. again, they're hoping by 7:30, they can have all lanes of northbound 101 north of mckee reopened. reporting live here in san jose, bob redell, "today in the bay." >> tough to stay out there. thanks, bob. follow-up to more breaking news overnight 680 near berryessa. all lanes open after a two-car crash closed several lanes, this happened in the northbound direction as well. chp says the drivers of both cars were not injured.
