january 9th, 2019. >> from nbc news, this is "today" with savannah guthrie and hoda kotb, live from studio 1a in rockefeller plaza. morning, everybody. welcome to "today." thank you for joining us. it's wednesday morning, late night in washington. but no progress to report. >> yeah, it was a big night last night. our top story, two vastly different takes on the government shutdown. border security and how to end the stalemate that has millions of families caught smack in the middle. >> the president argued in his first prime time oval office address that the country faces a crisis at the border that a wall could help fix. but democrats accuse the president of stoking fear and playing up a manufactured crisis to get what he wants. well, this morning, we're going to fact check the claims on both sides and lay out what's next. we'll start with peter alexander. good morning to you. >> hey, savannah, good morning. no new concessions from either side. both sides digging in their materials here as top democrats return to the white house today. the president will take his

pitch to capitol hill. he'll meet with senate republicans, trying to prevent support among members of his own party from eroding even as this government shutdown drags on. the president's scripted remarks offered almost nothing new, and again claim ago barrier at the border is the only way to keep america safe. the president selling his hard line immigration plan in his first ever oval office address. >> this is a humanitarian crisis, a crisis of the heart and a crisis of the soul. >> now 19 days into a government shutdown, a political stalemate ensuring 800,000 workers will not get paychecks this friday. the president is not offering a single new proposal or idea, instead, delivering the same

message about violence and crime that helped propel him to the white house. >> i've held the hands of the weeping mowers and embraced the grief stricken fathers. so sad. so terrible. how much more american blood must we shed before congress does its job? >> president trump blaming his political opponents for the shutdown. >> the federal government remains shut you down for one reason and one reason only, because democrats will not fund border security. >> ignoring his own words from just last month. >> i am proud to shut down the government for border security. >> also ignoring that he torpedoed a plan senate democrats and republicans initially agreed to that would have kept the government open while green lighting more than $1 billion for border security, though none of it for a wall. president trump overnight frequently fudging the facts on that border wall.

>> at the request of democrats, it will be a steel barrier rather than a concrete wall. >> but democrats have repeatedly resisted a wall, regardless what it's made of. on his claim that a wall would stop drugs from pouring into the u.s. from mexico. >> every week, 300 of our citizens are killed by heroine alone. 9 9 90% of which floods across from our southern border. >> the vast majority of hard drugs from mexican cartels come into the u.s. through legal ports of entry, which wouldn't be affected by a wall. in his 10-minute address, president trump notably never mentioned the threat of terrorism, abandoning his argument disputed by fact checkers linking terrorism to the southern border and the president did not declare a national emergency as he threatened he might do. as for this unforgettable rallying cry -- >> who is going to pay for the wall? who? >> mexico.

>> president trump also rebranding that claim. >> the wall will also be paid for indirectly by the great new trade deal we have made with mexico. >> but that trade deal still hasn't been approved by congress and nothing in it directs any money to the wall. if it passes, it wouldn't take effect until 2020 at the earliest. >> about president trump's new strategy to speak from the oval office, the "new york times" reports hours before giving the address, president trump dismissed it as pointless. in an off the the record lunch with tv anchors, he made blunt in terms that he was not inclined to give the speech or to go to the border tomorrow, but that he was talked into it by advisers. the times citing two people briefed on the discussion said the president told the room, quote, it's not going to change a damn thing, but i'm still doing it. moments after the president finished that address, democratic leaders responded,

blaming him for the shutdown and imploring him to reopen the government. that sets up new drama when the two come face to fwas lat-to-fa today. kristen welker has that part of the sorry. good morning. >> hey, hoda, good morning to you. in just a few hours, the duo dubbed chuck and nancy will be here at the white house looking for a deal to reopen the government. and it comes after they address the nation. the president offering no new ideas, indicating they're still deeply dug in. >> in a rare joint rebuttal, house speaker nancy pelosi and senate minority leader chuck schumer responding to president trump tuesday night for refusing to reopen the government unless he gets $5 billion for his border wall. >> president trump must stop holding the american people hostage, must stop manufacturing a crisis, and must reopen the government. >> the democratic leaders accused the president of stoking fear and misrepresenting the facts. >> the symbol of america should be the statue of liberty, not a

30 foot wall. >> the fact is, some democrats including schumer has voted for border barriers in the past, including the secure fence act of 2006, which authorized a 700 mile fence between the united states and mexico. >> we don't govern by temper tantrum. >> democrats blaming the bitter back and forth on the president as the shutdown now enters its 19th day. >> he promised he'd keep the government shut down for months or years, no matter whom it hurts. that's just plain wrong. >> even though house democrats were well aware the spending bill they passed would not be taken up by the senate or signed by the president because it included no new funds for the border wall. where do negotiations go from here? with no indication a deal is in sight, president trump will meet with senate republicans today urging them not to break ranks. >> if we undercut the president, that's the end of his presidency and end of our party. >> later, the president will huddle with congressional

leaders of both parties. democratic leaders getting pressure from members in their own party not to negotiate including freshman new york congresswoman alexandria ocasio-cortez. >> cannot tell you the amount of dysfunction this president is advancing. >> reporter: to turn up the heat on the president, house democrats are planning to introduce individual bills aimed at reopening specific offices. but the white house says that's a nonstarter citing the president's demand for border wall funding before he reopens the government. >> thank you. now to the breaking news we mentioned at the top of the show, a big change at the justice department, deputy attorney general rod rosenstein planning his exit. pete williams joins us with the breaking story. what have you learned this morning? >> reporter: it will be a profound change, but it's not a huge surprise. rod rosenstein had long planned to serve about two years as the justice department's number two official.

we've been told he's not being forced out by the white house, that this is his own intention. that's despite the fact that he's been a frequent target of criticism from president trump's twitter attacks on the justice department, but these officials say he plans to remain on the job until after the new attorney general is confirmed. after pushing out jeff sessions in november, president trump nominated william barr to be attorney general, and bar will be at the capital today, beginning a round of courtesy calls with senators ahead of his confirmation hearing. rosenstein considered resigning last fall but decided to stay on the job. >> one of the big questions is what is this whole thing going to mean to robert mueller and the russia investigation? >> if it weren't for that we wouldn't be talking about the deputy attorney general. rosenstein had been in that role ever since jeff sessions of recused because of his position in the trump campaign. even with the arrival of the acting attorney general, matt whitaker, rosenstein has

continued to help supervise the mueller investigation. if barr is confirmed, and that seems likely, he will take over that role of the mueller investigation, and from all we've heard it appears that that investigation is entering its final stage anyway. barr would play a key role in deciding whether to share the report with congress and whether to make it public. but as for the exact timing for rod rosenstein, he said he wants to help make the transition to his successor a smooth one. >> pete williams in washington, pete, thanks. staying on this legal beat, a slip-up by paul manafort's lawyers has revealed new information about his contacts with the russians during the trump campaign. this came in portions of a court filing that were supposed to be secret. while paul manafort was serving as donald trump's campaign chairman the documents reveal he was in contact at least twice with a man by the name of constant teen kalimnik, an associate u.s. officials believe

is linked to russian intelligence. these details come in a document that was filed by manafort's lawyers. some lines were blacked out or redacted but it turns out they could easily be read simply by copying and pasting them into a new document, and that revealed that manafort shared polling data with the russian about the campaign and then lied about it to the federal investigators. the russian kilimnik has denied having links to russian intelligence. also this morning, al roker is tracking a big storm that could disrupt your weekend plans. we're talking about maybe snow and ice and rain for a lot of people. >> that's right. first we want to take a look at what's going on here in the northeast. we've got lake effect snow developing as the low pressure moves away. we've got that return flow of air, and that's bringing in snow. snowfall amounts from western new york and pennsylvania into northern new england. we could be looking at 6 to 12 inches of snow. here's this storm we're talking about. by friday it starts coming out of texas bringing rain, but ahead of it into colder air, we see snow developing in illinois and missouri. as we move into saturday, that

starts to spread into ohio, parts of pennsylvania, new jersey, and so we're looking at snow from kansas to new jersey saturday on into sunday. does it make its way into new york? there's this high pressure pushing down to the south. does it inspect right now, here is what we're looking at. we think between friday and saturday the more significant snow is going to be from southern missouri all the way into virginia with lighter snow as you get into the northeast. if that storm tracks further north or that high pressure doesn't build in, we could be moving that heavier snow up to the north. we're going to continue to track that a little bit later. guys. thank you. craig joins the table with an update on the story we've been paying a lot of attention to. >> good morning to you. some new charges have now been filed connected to the shooting death of 7-year-old jazmine barnes. the latest twist coming as that shattered community in houston came together for the little girl's funeral. nbc's ron mott has those details. >> reporter: good morning to

you. it was an emotional final farewell to 7-year-old jazmine barnes, and it came on the day that a second man was charged with her murder. still, there are questions about this drive-by shooting that remain unanswered. ♪ >> this morning jazmine's parents still coming to grips with the loss of their second grader. >> god blessed me and my family with an angel. he seen fit to take her back to heaven to be with him, but her job here was done. >> her father saying her tragic death helped bring the community and country together. >> as she wasn't only my daughter and my baby and my angel, she's all of our daughter. >> the open casket ceremony for the 7-year-old shot and killed while her mother says she and her four daughters were out on an early morning coffee run, laporsha washington also injured in the drive-by shooting choking up reading a letter a relative

had written as if it was from her little girl. >> i'm writing this from heaven where i'll dwell with god above. where there are no more tears, pain or sadness. just eternal love. elected officials among the hundred is who turned out for jazmine's funeral. a service reportedly paid for by basketball great shaquille o'neal and his friend a houston police officer. the sheriff who's leading the investigation also speaking at the service. >> jazmine's spirit touched all of us who have worked on this investigation. >> as jazmine was being laid to arrest, authorities charging 24-year-old larry woodruffe with capital murder. authorities say woodruff is the gunman who fired into the barnes car from another vehicle. they say that car was driven by 20-year-old eric black jr. also charged with capital murder. both men now being held without bond. the sheriff promises jazmine's short life won't be forgotten. >> and i look forward to the day that i can truly say rest in peace, sweet jazmine.

for justice has been done. >> larry woodruff, the accused gunman in this case, is expected to be in court today on a drug charge. he's expected to be arraigned tomorrow for jazmine's murder. both men if convicted could face life in prison without parole or the death penalty. craig, ladies, back to you. now to a dramatic rescue in the french alps, we've got incredible video. take a look at this. a helicopter, a police chopper was called in after a skier hurt his knee. you can see the pilot making a partial landing on the steep mountain side. only the chopper's right skid happens to be in contact with the ground. the nose and the rotors just inches from the snow. the crew managed to load that injured skier in the chopper and fly off to safety. >> never seen anything like that. >> i've never seen anything like that. >> don't you want to watch that like ten more times? >> yes, to have the rotors so close. >> yes. >> no room for error. >> that looks like disaster waiting to happen. >> it does. impressive. al, how about your forecast? >> hopefully not a disaster waiting to happen.

u.s./mexico border wall. he offered little in the way of concessions to break the standoff that has left parts of the government closed for 19 days. in a joint rebuttal democratic leaders urged the president to reopen the government. >> this is a humanitarian crisis, a crisis of the heart and a crisis of the soul. >> we can secure or border without an ineffective expensive wall. and we can welcome legal immigrants and refugees without compromising safety and security. >> the president is expected to meet today with congressional leaders of both parties at the white house in the situation room. officials in australia are investigating a suspicious package sent to the u.s. consulate in melbourne overnight. packages were also received at several other diplomatic nations. the u.s. consulate was not evacuated. there are no reports of any injuries. the scare came two days after a

come forward. >> it was shocking even for those who had known about these allegations against r. kelly for years. alleged victims came forward sharing their stories with the show's producers. now prosecutors are saying they too want to hear from them. >> it shouldn't have happened. >> this morning just days after the explosive series surviving r. kelly detailed disturbing allegations of abuse, the cook county state's attorney in illinois is urging any accusers to share their stories with prosecutors. >> we cannot do anything related to these allegations without the cooperation of victims and witnesses and that is why i'm here today to encourage anyone who has information to please come forward. >> the prosecutor says at least two families have shared information about kelly, but for now they don't have enough evidence to file criminal charges against the multiple grammy winning singer. >> no matter how demeaning it

denied any wrong doing and has never been convicted of any related crimes. his accusers now say his time is up. >> it's about black women being taken seriously and be heard about the abuse that he's doing to women. >> so miguel, is there anything that prosecutors can do right now with what they do have from those two families that have come forward in illinois? >> for right now there isn't much they can do. for criminal charges to be filed allegations need to hold up in court. that's why the state attorney is encouraging alleged victims to come forward. >> all right. thank you. we turn now to mr. roker. you mentioned the shutdown affecting the weather. what do you mean? >> well, we depend on data and we need the people and the resources to do that. so the national -- the noaa, the national weather service, nasa all gather this data. well, nonessential operations have ceased and forecast model research and development is done

and there was just the beginning of this year a new set of data points that models use all around the world. we can't input that into our american model because there's nobody to do it. hurricane season preparedness training is on hold and climate reports and data unavailable. so right now we have the resources to do the work, but we're not at our optimum right now. we do know that we've got 16 million people affected by wind warnings and wind advisories. look at these winds that will be popping up today. new york city gusts up to 28. and much colder air coming in now and we're going to see temperatures feeling a lot more winter like. look at what we'll see for today. pittsburgh 31. chicago 10 degrees below normal. and that cold air tomorrow spreads to the east from tampa, nashville, milwaukee, philadelphia, all below normal and as we head into the weekend, new york city, friday, 28 degrees. 40s in raleigh.

even dallas into the low good morning. i'm meteorologist kari hall. we also have some strong winds and some rain moving through the bay area, as we track it on storm ranger, a lot of scattered activity, especially for the north bay, with some pockets of some heavier rain. right now, really coming down in napa, moving toward vacaville and also some scattered showers for the south bay, just south of san jose, down to the south county. we will see off and on rain throughout the day, especially the first part of the day, but a little bit clearer headed into this afternoon into the evening. >> and that's your latest weather. >> all right. thank you. now to a story that's got a lot of people talking. a meteorologist fired in new york fired after being accused of using a racial slur on air. he's now speaking out with what happened. >> good morning. a lot of controversy this morning because jeremy kappell says this was his worst nightmare. it was an honest flub that he

says he mixed words during his forecast by simply talking too fast. now he's fighting back against those who say otherwise. >> we know it's a nice day -- >> a typical day at the office gone terribly terribly wrong. >> it's the way it looked out at mather luther king park. >> reporter: jeremy kappell in rochester new york was trying to pronounce the name of dr. martin luther king jr. when he seemed to utter a racial slur that has been historically used against black people. kappell said he stumbled while speaking quickly and combined king and junior. >> two words mashed together incorrectly. what i said was not even a word. it was a sound. >> nobody addressed the slipup on air when it happened friday but after outrage grew online over the weekend late sunday, the station fired kappell.

>> meteorologist jeremy kappell is no longer with news 10 nbc. >> rochester mayor warren saying station manage mts only took action after the station was shamed into doing so by a lack bash on social media. kappell and his wife lisa released an apology on facebook. >> but there was no malice. >> for him to be called a racist, it's just, you know, it's just -- it makes me very sad. i was sickened. we teach our children the message of loving others. >> and while critics online are calling kappell's mistake both racist and willful he's also receiving a wave of support including a change.org petition to get him back on the air. >> this is ridiculous wrote one twitter user. i can see this was just a flub. hope you get an even better job. kappell says he was never given a chance to publicly apologize. >> of course i don't harbor any racist thoughts. they're not thinking through.

we have to have less. >> yes, so we're all about eating more, 2019 is the year of more. so more vegetables, more fruit, more plant-based protein, more seafo seafood. these are all things we're under consuming. so focusing on eating more of these things can help us make better healthier changes for the long haul. >> that goes right to it, eat real. >> exactly. look for a whole real food as the first ingredient. that's the number one way to make sure you're eating a wholesome nutritious diet. choosing oranges instead of orange juice or let's say the real soup instead of the kind of dried veggie chips. we're looking at the closest to nature as possible. >> you say think versatility? >> we want things you can use in multiple ways. canned tomatoes you can use in sauce, you can also use them in soup. things you can use multiple different ways are the best ways to make the most out of your grocery shopping experience. >> i'm moving you on to myth number two. i need a post holiday detox? >> no, no detox here.

we want to chew. we don't want to drink. >> a lot of those detoxes are shakes. >> teas, all of these drinks you're not going to get the sen sensory benefits of how you're going to feel when you sit down to eat a veggie filled meal. definitely chew, that's number one. next is be wary of the word proven. all of us in the scientific community is looking at links. there's really nothing that we can say definitively is proourch. it's a r -- proven. >> it's a red flag. >> start with breakfast, do we fast, do we not eat breakfast? >> often we try to restrict earlier in the day to kind of cut back. it's a little bit of this propagating of a myth that we have to eat less and keep eating less, if we start with a bigger breakfast we're more likely to burn energy throughout the day and make better choices. >> myth three, people say i

can't do it. i don't have will power, how do you conquer that? >> i call this the seconds decision tree, drink, snack, sleep. first rule out biology. a lot of times we're eating when we're actually thirsty. it's a little bit of a sub clinical dehydration. start with 16 ounces of an unsweetened beverage and then make a decision about whether to snack. >> every three to four hours, eat a combo of protein and fiber, an apple with a piece of cheese or some nut butter when you're on the go and maybe a latte. that can also count. definitely none of us are getting enough sleep. you can also caffeinate if you need to or if it's late at night, go to bed. >> actually do the sleep. caffeine can help with your appetite, too, right? >> exactly. >> myth four, i'm addicted to sugar. >> we're not addicted to sugar, it's just that sugar is ubiquitous in our diet. we're drinking it. we're eating in it places we didn't know it previously one. number one, skip all sugary

i feel like if my core was stronger that would help support my back and maybe i'd be in less pain. when's the last time you've done a plank? >> i don't plank as often. >> i can't even tell you the last time i planked. >> we're expecting to feel like winners. you ready to get fit today? >> let's do it. >> core strength and flexibility. these are two things that go hand in hand. >> they are, and being strong isn't just about big biceps or carrying people in on your back. your body needs strength all day every day to protect yourself from injury, but also to push you to do the things you want to do in your everyday life. you don't just get that by lifting weights. you get it by combining weights with body weight exercises and things you may have never tried before like pill ates or yoga. we're going to be timing your planks over the course of the program to see how your core strength is developing, and we're also going to be testing your flexibility throughout the program.
