vallejo, eventually toward san francisco. the new one out of richmond is fine, operating on schedule and no problems for the roadways. there was a disabled vehicle reported around the bay bridge but i looked at the live shot and there were no lanes blocked, at least no problems with the flow. a smooth flow around the bay. we'll give you a closer look coming up. back to you. >> thank you, mike. a shooting near a san jose casino raising a lot of questions, including where the shooter was when they took aim at a person who was found shot outside bay 101. "today in the bay's" kris sanchez joins us live from the scene with what we know so far. kris? >> reporter: hi there, laura. that victim was found here in the parking lot of the bay 101 casino, the newer part, the part that is a multiple level building, and here's what our crews found as they arrived here on scene late last night here in the parking lot. there is a car with bullet holes and a shoe in the middle of the street. san jose police and the chp were both on scene here as it happened, just after 10:00, but because the shots may have come from the highway, the chp is now

leading the investigation. the person who was found shot in the parking lot here was taken to a local hospital and is expected to survive. if the chp has a vehicle or suspect description at this point, they have not released it, which means either they don't have one, or perhaps they know exactly who they're looking for. when they release the suspect description and the risks to the public, we'll let you know what we find out. >> thank you, chris. 5:01 for you right now. as we enter day 33 of the government shutdown, something we've never seen before, the senate votes tomorrow to end it, but will those votes really restore federal workers' paychecks? for more we check in with "today in the bay's" tracie potts, she is live in wash wash for us. tracie, is this the beginning of the end of the shutdown? >> well, not necessarily, marcus, because even though we're seeing some action, which we haven't seen in 33 days in

the senate, even though they're now going to allow the democrats plan to come up for a vote, senate leader mcconnell initially said he wouldn't do that, it does look like there's some momentum, but neither of these plans can go anywhere unless someone crosses the political line. two plans, two votes, and no solution. >> this is nothing for anybody to be proud of. >> reporter: tomorrow, for the first time since the shutdown, the senate votes to end it. republicans will pitch the president's plan, temporary protection for a million immigrants if he gets money to build a border wall. >> why are democrats not supporting the president's proposal? >> reporter: because they have their own, reopen government for two weeks, then negotiate border security. without support from the other side, both plans are expected to fail. >> people are saying isn't there a way out of this mess? >> reporter: right now, there's just finger pointing. >> it's nancy pelosi. >> the speaker's position seems

to be that she demands the unconditional surrender of the president on every position involving the shutdown. that's unreasonable, illogical, it's irrational. >> we cannot have the president every time he has an objection to say i'll shut down government until you come to my way of thinking. >> reporter: the fbi says the shutdown is making america less safe. >> the failure to fund the fbi is making it more difficult for to us do our jobs, to protect the people of our country from criminals and terrorists. >> we appreciate all of your help. >> reporter: food banks feeding furloughed workers now a daily symbol of washington's dysfunction. so even though we're expecting to see two senate votes tomorrow, more votes, house votes at some point, nancy pelosi says, speaker pelosi says this week. again, it looks like momentum, but nothing that seems to have enough support to actually end the shutdown.

marcus? >> tracie, one we have to follow, we know you'll be following as well. thank you, tracey. amid the shutdown, hundreds of irs employees are getting permission to skip work due to financial hardship. union leaders say they expect that number to surge as part of a coordinated protest. this could hamper the government's ability to process your tax refunds on time. president trump's administration recently ordered at least 30,000 irs workers to process refunds without pay. speaking out. the high school student at the center of the tense weekend confrontation outside of the lincoln memorial. student nick sandmann is talking exclusively this morning on the "today" show with savannah guthrie. >> do you feel, from this experience, that you owe anybody an apology? do you see your own fault in any way? >> my position is that i was not disrespectful to mr. philips. i respect him. i'd like to talk to him. i mean, in hindsight, i wish we

constant battle with water. state water officials say the snowpack is 10% above average this time of year. it comes after as much as four feet of snow dropped near tahoe this month. good to see, kari >> it was good to see. there were some spots that got over seven feet of snow, so now, as we continue on with some dry weather, we are also going to see the temperatures warm up. here is a live look outside, looking from our sutro tower cam looking at the golden gate bridge, a nice start to the day, but it will be chilly. in martinez, you're down to 39 degrees, very cold through at least 7:00, and we'll gradually warm up, by noon we're at 56 degrees, and then looking nice as we go throughout the day. as we head out the door in san jose, headed to diridon station, upper 30s and low 40s to start, and we'll be at 57 degrees as you head out for lunch. we'll talk about what else is going on in our other microclimates coming up, and mike, you're getting us out the door with a couple of updates to the commute. >> that's right, the crash and the slowing have cleared from

the areas in most of the spots for the bay area. it wasn't a big crash at the bay bridge toll plaza. in fact, if there was a crash at all, because i didn't see any interruption of the flow. 680 southbound headed toward 24, a clear drive. i saw that from our camera. we have one crash registered over there as you come down through contra costa county. i'll do another scan with our camera. a smooth drive down the east shore freeway as well, just under 15 minutes from highway 4 to the bay bridge. on the peninsula side after they cleared the crew at willow the lights are dimmed down. you're left with a smooth, easy drive, but nothing interesting there at university and willow. a nice flow of traffic coming out of the altamont pass. westbound 580, 24 minutes now. so we've added a minute, a little bit more slowing coming out of the altamont. the dublin interchange moves smoothly and so does 84 although you find slowing around vallecitos. there is the san mateo bridge, westbound 92 moves smoothly across, toward the peninsula

north bay. and good morning. happy wednesday to you. markets fell tuesday on further fears that the economy is slowing down. the white house insists it's meeting with the chinese to talk trade is still on, but there are rumors of cancellations. a first for netflix, its movie "roma" was nominated for best picture yesterday, that is pretty amazing for netflix. oracle in trouble after the u.s. government accused it of discrimination against women and minorities. the redwood shores company underpaid thousands of female, black and asian employees by more than $400 million in total. no comment from oracle. oracle's run by a woman, and a man, they're co-ceos, though if you google it, you get the man's bio. target is adding apple pay, so too are taco bell and half a dozen other stores, meaning there are now about three-quarters of all major chains that take apple pay where

you just tap your phone to check out. cvs joined recently but you'll still get that massive paper receipt at cvs. a santa clara company will start testing a mobile market in boston. it's not robotic. the little car is driven by somebody remotely. "the boston globe" points out that may not actually be legal in massachusetts. and a new industry study says 150 million americans play video games, that estimate might be a bit low, considering 200 million people play fortnite alone, though that's a worldwide number. but 150 million americans is pretty amazing, because that is half of the entire country's population. >> wow. when do people have time to do that? >> you know what? it's a great question. netflix, the other day, said that's what they're doing, that's our problem. we're not competing against nbc, we're competing against video games. >> video games. >> you only have time to do one thing, and sometimes it's playing fortnite. >> usually work or take care of my kids. i don't have time for either.

temperatures, as you head out, 580 looking good, no fog, although it is a little cool out there, you may even have a turn on the defroster, if your car's been sitting outside in the temperatures dipping down to the 30s this morning, we're at 36 in livermore, 40 in antioch and 34 in fairfield. ukiah this morning at 36 degrees. as you make your way out to the dublin b.a.r.t. station, some mid-30s to start out the day, and it's definitely teeth-chattering cold standing out there on the platform, but as we go throughout the day, it's going to feel a lot nicer. we start out with our school day forecast in martinez, also in the 30s, and then as you go out for recess around lunch time, with the kids heading out there, it's going to be in the low to mid-50s, so still cool, our gradual warmup will happen by this afternoon. let's check out our frizz factor, it is going to be a great hair day. we know that when the humidity is low, temperatures are low, we don't have much of a win, so overall, it's looking nice and

also very dry. our temperatures for the south bay heading up to 58 in los gatos. headed toward the east bay, walnut creek, we're going to see a high of 61 degrees, and 61 also in san mateo. daly city at 59 degrees. 58 on the embarcadero and the north bay reaching 62 in sonoma. looking at our overall weather pattern, nice and quiet, dry conditions. it was so busy last week. now we are seeing a break as high pressure moves in, and that also gives us some dry weather over the next few days. our temperatures will be warming up, at least for our afternoon highs, those mornings though will still be cool. make sure you prepare for a wide range in temperatures, from the morning to the afternoon, and then cooling down once again, once the sun sets. san francisco 58 degrees will be the high today. we're headed into the low 60s for the weekend, and no issues headed from now through next tuesday. mike, now you have a note for some of the commuters. >> for the transit riders

specifically over the water, wanted to clarify the buses. the buses are replacing those boats as you know they're doing maintenance changes and the different models, you don't need to know about those but some are faster than others, right now using the bus for the first round, that will delay you out of vallejo and toward the bay bridge, mare island to vallejo. the bus takes you the route and that will be delayed, about 5:30 we see the metering lights turn on and the backup builds for the east shore freeway, talking about those delays, if you normally take the ferry from vallejo. richmond they're okay toward sf and a smooth flow of traffic out of the area as well. green sensors all around, both sides of the bay, the south bay no problem, moving toward the south county, highway 17 no delays. highway 1 out of santa cruz and 101 san martin an easy drive.

5:22, a horrible story to tell you about a, three men and a teenager are waking up in an upstate new york jail this morning. the former boy scouts are suspects in a bombing plot. police say they have arrested 20-year-old brian colaneri in connection with an alleged bomb plot against a muslim community. 18-year-old andrew crystal, and 19-year-old ventin vetromile are

also charged in criminal possession of weapon and conspira conspiracy. a 16-year-old boy who police say told a classmate has also been charged. happening now, thousands of central american miglants back on the road in mexico headed north toward the u.s. borer it. they are more than 900 miles from the nearest u.s. border crossing. some say they're still undecided which route north they will take. most members of the caravan are from honduras. president trump is vowing to stop the central american caravan sending troops to reinforce the border. judging from a hearing happening this week, it's still anyone's guess if the 2020 census will contain a citizenship question. last week, a new york judge blocked the idea from the commerce department, did not do a due diligence. this week, a judge in maryland is hearing testimony in a similar case. california, meanwhile, is part of the third lawsuit playing out in san francisco. the trump administration already

we know what that means, cold outside. meteorologist kari hall is getting us up to date on what we can expect with the cool temperatures behind you. >> it is cold this morning. take a look at some of these numbers and what people will feel stepping out the door. it's coldest right now in fairfield, but we have san martin running up in second place, 35 degrees. it's 36 in ukiah and in oakland 42 degrees. after this cold start, we're going to warm it up. antioch, it's going to take a while, it won't be until noon until we reach 55 degrees but we have a lot of sunshine in that forecast today. we'll get a look at what's happening for the rest of our week and the weekend coming up, and mike, you were saying there's backups in the bay. >> two spots. the first one not a surprise, this is the bay bridge, just saw all lanes finally fill in over the last 90 seconds, and that's the bay bridge toll plaza. the rest of the bay i want you to notice, very nice green sensors for most of the bay. we'll take you to another of our major slow spots, because of a crash, which should be in the center divide, but there's no

center divide area really. it's kind of as far off to the left as they can make it. this is slowing southbound 680 coming into walnut creek. we have the camera i showed you, but it's just south of the crash. i cannot see the crash but this is a note if you're headed toward 24 and the interchange, look how clear that traffic is. you're building the volume, and there is that b.a.r.t. station, which is experiencing no delays, laura. back to you. >> thank you, very much, mike. at 5:31, in a few hours the number of people plan to protest inside the san mateo county district attorney's office. they are upset with how the d.a. is handling the case in which i man died after being tased by law enforcement. it is the third such death in the county over the past 12 months. "today in the bay's" bob redell spoke with the d.a. and new this morning, he is live outside the government center in redwood city with the response. bob? >> reporter: laura, about 10 to 20 people with a group called justice for canedu will perform a sit-in protest at the office

of the san mateo county district attorney between 10:00 and noon to demand he release the video and 911 calls related to this deadly incident. they argue it's been 100 days and the public has a right to know what happened. last october, five san mateo county sheriffs deputies tased canedu okobi during an encounter in millbrae. he had a history of mental illness, died during the struggle. the d.a. has 25 minutes of video from a surveillance camera, dash cams and witness cell phones that show some but not all of what happened. okobi's family saw the video and questioned whether deputies had a right to stop him in the first place. they say he was walking down a sidewalk, not running in and out of traffic as the sheriffs office says. d.a. wagstaff will publicly release the 25-minute video and transcripts of interviews with the deputies and witnesses once his investigation is complete mid-february. >> i understand the impatience,

but the question is, as i've said multiple times, 25 years ago johnny cochran said something that's run in my mind when we ccused the d.a. of a rush to judgment. i remember that, when i make my decisions now that we're not going to rush to judgment. >> it's not fair for chinedu's sake. he's gone. he doesn't get to speak for himself. we are here to speak on his behalf, and we want to see change in this county, and we're not going away. we are not going away. this has to change. here in san mateo, and across the united states, black men need to be treated with dignity. >> reporter: d.a. wagstaffe says he is waiting for a report from an outside use of force expert before deciding whether or not to file charges against the five deputies. protesters question the independence of that expert, given that he is former law enforcement. okobi was the first person to die after being tased in san mateo county.

another man died during an encounter with redwood city police in august, a third in january with daly city police. no charges filed in those last two incidents. reporting live in redwood city, bob redell, "today in the bay." >> thank you very much, bob. at 5:34 this morning, a developing story from the south bay. san jose police still sifting through clues, trying to track down a person who shot and killed a woman in her own home. she was murdered in front of her grandchildren. on saturday, officers swarmed the east san jose home of 58-year-old lili santiago hernandez. one neighbor says a family gathering was interrupted by a single gunshot. >> when i go to the restaurant, i listen, boom, and then, oh, my god, what happened? everybody happy. >> he says no one knew someone was hurt until two children next door started crying for help. family members of that victim who don't want to talk on camera say that two kids, ages 9 and 7, were cooking with their grandmother, when she was shot.

police have not revealed the suspect's motive. later today in the east bay, teacher, parents and students in oakland will be protesting their school district, this is the second protest in less than a week, but this one will be for a different reason. "today in the bay's" pete suratos is joining us live in oakland unified. pete, what are the details behind this new protest? >> reporter: yes, good morning to you, marcus. in this new protest is actually over a proposal to close a middle school in east oak lan, that middle school that i'm referring to is roots international academy, in east oakland, it is on the chopping block as far as proposals go from the oakland unified school district. the proposal will be discussed or presented at tonight's oakland unified school district board meeting set for 5:30 p.m., where teachers and supporters we're being told plan to shut down the meeting by protesting. this potential school closure could be the first of as many as 24 school closures as the district continues to deal with its budget issues. the protest is taking place during a busy day throughout the

district, including a community meeting taking place later this morning at about 10:00 a.m. to discuss the current budget crisis and potential cuts throughout the district. of course, all this is adding more tension between teachers and the district, where the teachers, of course, holding that one-day strike this past friday, unhappy over wages and class sizes, among other things, and i'm being told by folks organizing on friday, there's a good chance a longer strike could take place as early as next month. so teachers are going to protest at tonight's board meeting but a final vote on the school closure we're talking about will not take place until next week. we're live in oakland, pete suratos for "today in the bay." >> seeing more and more teachers across the country standing up for what they want. thanks, pete. hundreds of jobs are up for grabs today in san francisco. the mayor's office holding a career fair. this is aimed at providing young people with job opportunities. job seekers can get practice with mock job interviews and an opportunity to get help with

their resumes. this begins at 11:00 this morning, at the war memorial building along van ness avenue. it will last until 6:00 tonight. berkeley city council members taking a bold step to do something about its disposable waste problem. last night councilmembers voting unanimously to pass its litter reduction ordinance, charges people 25 cents for each disposable cup they use. some say it has to be done. >> it's two-thirds of our street litter in the bay area. and it causes significant cost and harm to our environment. >> some business owners say it comes at a bad time now that minimum wage has been increased to $15 an hour. there is one more vote and the plan is set to go into effect in january, 2020. >> 5:37 this morning. new for you this morning, bay area transportation leaders are reportedly speeding up the opening of the third westbound

lane on the richmond-san rafael bridge. you may recall last spring, a third eastbound lane opened and that's been a big hit with commuters. the ij now reporting it's possible that the new lane could open for walkers and bicyclists as soon as april. some people are hoping that that same lane could be used for vehicle traffic during the morning rush. the original plan was to keep the third lane car free for a few years. car problems out there this morning, mike? >> no car problems and i'm glad the walkers who line up every morning to get onto that bridge -- no, they don't, but they're making changes at least. we'll see how that goes. we could use more commuting across the richmond-san rafael bridge at the top. a smooth flow of traffic for most of the bay but we have a traffic alert, a crash we've been telling you about, changed to alert status, southbound 680, two left lanes are blocked. chp has traffic alert because they do feel this is going to, as it shows, have a major impact on your morning commute. no major injuries. we did check with the walnut creek area, and they don't have any major injuries, but this has

and then some upper 50s as we head throughout the day. we'll get a look at our complete microclimate forecast coming up in less than five minutes. >> most of contra costa county looks great. we have this traffic alert though for southbound 680, critical timing here toward walnut creek, two right lanes are blocked, two left lanes are blocked by a crash and we'll get you an update from chp. new details for you this morning, the city of santa clara is reportedly on the hook for more than $3 million after losing a lawsuit that led to district-based council elections. the judge last year ruled against the city, which argued to preserve its at-large election system. minority groups sued, seeking a larger voice on the city council. despite the legal defeat, santa clara city attorney is still vowing to appeal. according to "the mercury news," the judge ruled the city has to cover $3.1 million in opponents legal fees. the city is not commenting.

' new for you this morning, good news for students at california state. according to the "l.a. times," tuition will not go up in the fall. the university's chancellor made that announcement during an annual state of the csu address yesterday. governor newsom had proposed a $300 million increase in funding for cal state, as part of the state's budget. >> quarter to 6:00 right now. teachers in los angeles back in the classroom this morning. the strike that started more than a week ago is officially over. last night, teachers overwhelmingly approved a new contract between their union and the school district. union leaders say that that deal includes much of what they were asking for, a cap on class size, hiring more nurses and librarians and a pay increase of 6%. southern california human rights groups are reportedly in line to receive millions of dollars to assist migrants if governor gavin newsom's proposed state budget comes ta pass. he wants to use $to million who-to-launch what he calls an immigration rapid response

with a mean face? >> no. >> just no. >> i'm going to go shopping. >> i'm out. all right. so we are in for some cool weather, and some nice afternoons. here is a live look outside at our new camera in walnut creek, looking at 680. we have clear skies, but then as you step out the door, it is chilly. take a look at some of these numbers. it's been in the 30s and low 40s. we're down to 36 in livermore. it is 37 in santa rosa, and 36 this morning in ukiah. as you step out and head for your morning drive in antioch, it's only going to be in the upper 30s. we're going to stay there through about 7:00 and a nice warmup as we go throughout the rest of the day, looking at some mid-50s, also a nice day to go out hiking, as we are going to see temperatures go from the low 40s in the east bay to the upper 50s, with some light winds and sunshine. getting the kids up and out the door for school in san jose, it's only going to be 39 as you're walking to school, so they do need the heavier coat,

with of course their name written on the label. as you get dressed this morning, and you put on that heavier coat, you may need more layers like a scarf but later on today, a sweater will keep you comfortable. we'll continue on with some sunshine, and some dry weather. no weather systems headed our way, and we can see that in our seven-day forecast, as we start a warming trend, and it's still going to be chilly during the early hours, but the afternoons are going to be very pleasant, headed into the mid to upper 60s, and we'll see that weather continuing into the start of next week. mike, you're taking us back to that traffic break. >> yes, the traffic alert is the big news for the bay. everything else moves smoothly. the bay bridge toll plaza not an alert, that's just the backup because the metering lights are on. this is pretty good now. we're showing a smooth flow of traffic around the bay and we'll see traffic flows southbound 680, really jamming up coming out of the area off of highway 4 and the like, so just be careful out there. i'm trying to get our waze system back online but it doesn't look like i can. we'll give you the update if i can in the next few minutes.
