"today in the bay's" tracie potts is live in washington, d.c., with more on the investigation going on. we have the indictment right here, tracie. >> and it's a long one, and it's got a lot of details about connections to wikileaks, when they released those hacked emails from hillary clinton's campaign, and democrats. roger stone said he had nothing to do with that. this indictment seems to say otherwise. stone was off the trump campaign

payroll. he was an adviser early on but according to this indictment, he through an intermediary seemed to have some knowledge of when those emails were coming out, "well done" is what one trump senior official texted him after one of the releases and former cia director john brennan says they have their eye on stone and the trump campaign, and those emails for some time. >> in the summer of 2016 we were watching what was happening in terms of what was released by wikileaks and how the russian hand was behind this so the intermediaries was something looked at very closely by the fbi and others, so again, this indictment is not surprising in any respect. >> first of all, i want to give you -- >> reporter: specifically that indictment includes seven counts, obstruction, witness tampering and five counts of making false statements regarding his statements to the house intelligence committee. stone has repeatedly deside any

collusion with wikileaks directly. he said he would never testify against president trump, but he will be in court this morning in just a few hours to answer this indictment. laura? >> we'll continue to follow that one. tracie potts, thanks so much. live now to sfo, where a flight was diverted late last night after a death on board. "today in the bay's" kris sanchez live for us at the airport, and kris, we're learning the person who actually died on that flight was a flight attendant. >> reporter: yes, that's what we've learned this morning. we just saw that hawaiian airlines flight, flight 50 pull away from the terminal over here at sfo and it is about to head off to jfk, which was its intended destination in the first place. in the last 20 minutes, we saw that flight finally leave. it was a very long night for those passengers on board. hawaiian airlines flight 50 left honolulu at 4:20 yesterday afternoon, about 6:20 our time. it was due to land this morning in new york, but sometime around 1:00 in the morning, that flight

was diverted here to sfo. one passenger tweeted that flight attendants made an announcement calling for any doctor on board to help. this passenger tweeting "it's been a long time since they asked for doctors to come to first class. i hope they're okay." once mettics boarded that plane she tweeted again "there are cops, too, and no one's moving with any urgency." here is the real time radar of that flight leaving sfo this morning. sources told our nbc station in honolulu that the person who died on board that flight was, in fact, a flight attendant, but we have not had any confirmation from hawaiian airlines. at sfo, kris sanchez, "today in the bay." >> just a tragic situation happening there. all right, kris, thank you. in just a few hours, the travis air force base doctor convicted of of sexually assaulting three of his patients was found guilty on multiple charges following a six-week trial. solano county prosecutors said he gained trust of his victims, all military veterans and got

them to perform sex acts using exposure therapy. two of those victims were looking for treatment for ptsd. happening today, the golden gate bridge district will be discussing a crash involving one of its boats, and how to move forward with plagmaking repairs. back in november, a ferry crashed into a dock at the ferry building, left a big hole in the side of the boat. two of 53 people on board were hurt. still not clear what caused that crash. new for you this morning, a bay area restaurant chain is set to pay a multimillion-dollar settlement in the state wage theft investigation. the argument includes present and former workers at burma ruby in palo alto. rangoon ruby restaurants in palo alto, san francisco and san carlos, not to forget burlingame and belmont. the belmont restaurant recently

closed. in total, 380 workers will split up to $4 million. the restaurant owners issued a statement saying "the settlement was a compromise and was reached without any admission of liability." let's head outside to contra costa county this morning. east bay looking at walnut creek, should be a pleasant day. good weekend to look forward to as well. kari hall tracking our tgif forecast. >> i think it will be a great we weekend across the bay area. you need a jacket for the start of the day. look at these numbers, right now in the upper 30s for livermore. also 38 for san martin and we head into the north bay with some widespread 30s and also patchy fog. as we head over toward walnut creek for our temperature trend, there may be some patches of fog through about 7:00, and then going into the afternoon with some sunshine, we go from the low 40s to the low 60s today, a look at all of our microclimates and the high temperatures for today, even reaching into the upper 60s in some areas, so it's

shutdown as well that may help markets today. intel will likely move lower after that company warned about sales. we'll talk more about intel in a second. let's talk about facebook first. facebook ceo mark zuckerberg wrote an op-ed in the "wall street journal" which he said sometimes people assume we do things we don't. for example, we don't sell people's data, even though it's often reported that we do. keep in mind, facebook we think is on the cusp of a massive fine from the ftc and it's been on sort of a long-term apology tour, after a whole year of scandals in 2018, including the biggest with cambridge analytica. facebook this week said it would crack down on fake news. it often announces something, diversity reports, new initiatives, that kind of thing, when it's in the middle of a bad press cycle. santa clara's intel, the world's most important chipmaker still doesn't have a permanent leader. the company reported profits yesterday, and said sales were slowing. its current or interim ceo says

he doesn't want the ceo job, though he says it's the biggest and most important job opening in the world. take a look at this, the fella in the center of your screen is joe escanazi, a long time reporter in san francisco who is experimenting with news by text message. he texts you every day telling you what's going on in city politics. we're going to talk with joe about that on "press:here" sunday morning after "meet the press" and look at a new california law making it illegal to have all male boards of directors requiring women on the board. it's been proven over and over companies perform better in the stock market, they make more money if they have women on the board, but should you legislate that? should you force somebody in a free market to do the right thing that's actually good for them anyway? >> i just went to a forum myself this last week that talked about that very thing. >> oh, good. we're going to debate it hard. >> interesting to see. all right. thanks, scott. taking over the world! hey, in south texas, strong

winds knocking down a spacex rocket, spacex ceo elon musk tweeting it will take weeks to repair the damage. 50-mile-per-hour winds broke the mooring blocks yesterday afternoon. the rocket is a test version of starship, which spacex is building to transport humans and cargo. maybe some of that ice cream. >> i'll take a scoop or two. >> there you go. hey! conversation hearts! >> yes, you know what? hearts are going to be broken this valentine's day. the candy favorite will be missing from store shelves there. you won't be able to buy the sweethearts with the original heart shaped candies with the messages on there. you can see "get my drift" "be mine." all right, the owners of that company says the new owners say they don't have time to produce the wildly popular sweetheart there is. the old company sold it last year and they closed the factory there, but the new ones said they didn't have time.

krispy kreme is stepping in to fill the solution. the chain is offering a new conversation doughnut available january 30th through valentine's day, and the doughnuts from feature more than a dozen phrases including "all the feels" "be mine" "all the feels, i didn't get that one. >> get the feel, the emotion, all the emotion. >> the young kids terms, "i've got all the feels." >> i just explained "lol" to marcus. >> it's good because i'd rather have krispy kreme than sweetened chalk. >> i never liked them. >> they don't taste like anything really, but they were always cool. >> thank goodness they still have the necco wafer. >> that's the same thing, sweetened chalk. >> kind of gross. so this morning, as you get ready to get up and get out the door, here is a live look outside at san rafael. we've seen a little bit of some patchy fog across parts of the

north bay, but we're looking good at that shot, but as we head up toward santa rosa, visibility down to a quarter of a mile, so you do need to watch out there, use those low beams as you get ready to head out the door, and then we're also seeing visibility mostly clear. i can still hear you guys. all right, temperatures in the upper 30s for parts of the north bay. fairfield is now at 38 degrees. it's 48 in oakland, as well as palo alto. so you do need a heavier jacket heading out the door. antioch we're dipping down to 39 degrees, so the heater may be on full blast for a little while, and then it's going to quickly warm up. at noon, 57 degrees continuing to go up. it's another great hair day. now our humidity is at 89%, but that's relative. our temperatures are so cool. it's really not that humid outside, so fairly crisp and the humidity drops as we go throughout the day as our high temperatures head up to 64 degrees in oakland, and in palo alto. we're up to 66 in santa rosa, and livermore we're seeing a high there of 63 degrees.

still nice and clear, no storms developing out in the pacific, although we are seeing some clouds moving through. that could increase our high cloud cover going into tomorrow, but still no rain. speaking of rain, i wanted to quickly show you the drought monitor because parts of the central sierra has been taken out of a drought and where we see yellow that's abnormally dry conditions, which is still not too bad, just slightly below where we should be in terms of our rainfall, but we do still have a moderate drought for parts of the south bay, the peninsula, as well as the north bay. so that's something we'll be watching as we continue on with a few more days of some dry conditions. and then looking at some highs warming up into the upper 60s for the weekend for our inland valleys. for the start of next week, we may have gusty winds picking up but no rain into thursday of next week and san francisco also slightly warmer than normal temperatures, watching out for the gusty winds on monday, and morning temperatures in the upper 40s but overall it's

looking pretty good throughout this seven-day forecast. and mike, you have something happening now in the south bay? >> right now we have a light flow of traffic but we're starting to see a few more cars and not really evident here in this shot on 101 northbound with the tail lights. this is just north at 680/280 interchange up here. we also look at more traffic flow over the santa cruz mountains. no problems for 17. that box just cleared from the report, from the monterey system, which is just south of san jose, headed through morgan hill. it's a smooth drive. now for your commute direction as well out of south county. a smooth flow of traffic, a little slowing, a little build out of the altamont pass for westbound 580 and watch eastbound, that construction crew still blocks at least one lane getting out of the area but no major crashes, not like yesterday. that's good stuff. a smooth drive through the rest of contra costa county, highway 4 at bailey, the crash is over on the shoulder and a smooth flow of traffic in toward the maze and toward the bay bridge toll plaza as well. i give you a look at mass transit, you can avoid the drive, just take the ride over on the rails, or here on the ferry system, no delays reported for the san francisco ferry

system. same thing for the golden gate ferry, no delays over the water. over the dublin grade, a clear view, look at this beautiful drive, this is westbound with the tail lights, again, talking about the traffic flow, a lot of traffic coming out of the altamont, and over in toward the dublin interchange and continuing west across the bay, here is the san mateo bridge, you need to drive over that high-ri high-rise, a tleer viclear view major problems. it's usually building later in the morning. back to you. coming up on "today in the bay," the reason a new documentary about the late king of pop, michael jackson, has many people upset. plus, warriors stars in washington, d.c., meeting with bay area congressional lawmakers, including nancy pelosi. up next, we'll show another political heavy hitter that the players were mingling with.

one film premiere good morning to you. taking a look in dublin, seeing a lot of people on the road getting ready for their day. mike inouye will have a look at our commute coming up in a bit. 5:2 5:21 right one. one film premiere at sundance is generating more than just buzz, it's prompting heightened security. "leaving neverland" reintroduces the idea of pop star michael jackson preyed on young boys. he claimed his innocence and

fought off molest charges in 20003537 journalists say it focuses on two men who at times have claimed to be victims. >> it is not only the story of the two alleged victims but it's also a story about the people around michael jackson, the people who either protected him, made sure that these kinds of stories weren't reported. >> devoted jackson fans are vowing to protest. the family calls the film a hit piece. as for the men featured in the film, both had recent lawsuits against jackson's estate tossed from court. one of them once testified jackson never molested him. the "today" show has an in-depth preview at 7:35, after "today in the bay." it is 5:22 right now. more details on sundance and another premiere that has a lot of people talking, a documentary on the rise and fall of the blood testing company theanos called "the inventor: out for blood in silicon valley."

it charts the founder elizabeth holmes, it will air later this year on hbo. a central indiana school superintendent is facing fraud charges for using her insurance to help a sick student. according to court documents, casey smitherman took her 15-year-old student to a clinic after the student became sick and didn't show up for school. police said smitherman used her insurance information to check the student in under her son's name at the clinic. she also used her insurance to pay for an antibiotic prescription for the teen. the community and school are standing behind her. >> the lady tried to help a young man that needed help and really it's not right, but she got caught. i was a teacher for 25 years, and you just run into those things that break your heart, and you want to help kids. >> smitherman says that prosecutor has agreed to let her enter into a program which could eventually help get those charges off her record.

5:23 right now. this morning, a north carolina toddler who had been missing since tuesday alive in home with his family. video of parents thanking searchers. 3-year-old casey lynn hathaway was found in a wooded area by professional search and rescue crew not too far from where he disappeared. casey went missing after playing in the yard of his grandmother's home with two other children. so nice, happy ending there. the accolades keep coming in from the mckleinman's high school football team in oakland. >> the team won its third straight state championship last month, just over 300 students. mcclymonds easily defeated so cal powerhouse garfield high which has 2,500 students. mcclymonds' athletic director praised the team and wants to set one thing straight. >> there's an old perception out there that mcclymonds is a hard

core get toe school. i am here to tell you mac is producing scholars and future leaders of our society. >> over the weekend, coach michael peters was named california's prep football coach of the year. >> good celebration there. if eight was great, then nine is just fine for warriors fans. >> in d.c. last night, washington could not shut down the dubs, who won their ninth straight game and they did it with some boogie in their step. demarcus cousins scored 17 in the 24 minutes he played, only his third game in uniform with golden state. the warriors won it 126-118. now they go for ten in a row tomorrow night in boston. this was the warriors only visit of the year to washington. no white house visit but the warriors did have time to visit with former president barack obama at his office. "mercury news" reporter tweeted out a photo. espn reports steph curry arranged that meeting, though curry denied it. as champions they seem to be putting the traditional white house visit in the rear view

by. >> as we take a live look outside in san francisco, it is all clear and also chilly once again this morning. we've seen a lot of upper 30s and low 40s, as you get ready to head out the door, maybe heading to the pleasant hill b.a.r.t. station. it will be 40 degrees. we'll see low 40s through about 8:00 and quickly warming up, noon we're at 59 and continuing to go up from there. we have some great weather in the weekend forecast. we'll get to that in about seven minutes and mike has a look at the friday commute. >> we're easing in right here. just gradually building the backup here at the toll plaza. this happened just before the commercial marcus showed you the lanes were pretty much cleared and fast track starts to show slowing. we'll have the metering lights n on any minute. a lighter flow of traffic continues until 7:00 and a lot of folks decide we should head into the office to take care of a couple things. a smooth drive here through the south bay. i am hearing about a possible

car fire on 280 near downtown. i'll get more detail from chp once they arrive. back to you. >> all right, we'll check back with you. it is 5:30 right now. now to breaking news, the fbi arrests roger stone. he was president trump's former campaign adviser. this follows an indictment by a federal grand jury in special counsel robert mueller's investigation. he was indicted on five counts of false statements and one of witness tampering. he is expected to make an initial appearance later this morning in federal court. scott mcgrew will join us with analysis coming up in just about ten minutes and we're going to take you live to washington, d.c. acti d.c., for a report at 6:00 a.m. more breaking news just coming in, tsa agents will soon be getting a partial paycheck. that comes amid day 35 of the government shutdown. the agency's administrator just tweeted out the news saying that tsa employees who work in an

exempted status during the pay period 26 will get a check. however, thousands of other federal workers are missing out on their second paychecks today. this morning, there are signs of compromise, fueling hope that the government shutdown could soon be over. now the senate's top republican and republican met for the first time, saying they're working on a plan that would include billions for border security, but no money for a wall. >> i've never been more optimistic than i am now if we can find a way to open up the government for three weeks. >> there's not a person in this building virtually who doesn't want this government reopened. >> now there is no deal, if there is no deal, president trump's backup plan may be declaring a national emergency to use pentagon funds to build the wall. and this morning, help is covering for tsa agents in the bay area. the alameda county food bank will deliver bags of groceries to federal employees.

later in the afternoon, alameda labor union will hold a news conference in support of the workers. happening this weekend, senator kamala harris will kick off her presidential campaign rally in oakland she's creating a lot of buzz across the country. "today in the bay's" pete suratos is live where the event will take place this weekend. probably a lot of people expected to come out for this as she begins the big fight in the race for the white house. >> reporter: yes, that's right, laura. we could expect a big crowd in oakland as senator kamala harris kicks off her campaign rally in downtown oakland in a couple of days, doing so less than a week after making this announcement. >> hey, everyone. so it's official. i'm running. i'm running for president of the united states. >> reporter: that's kamala harris, senator kamala harris announcing her intentions to run for president on her twitter account this past monday. it's been a busy week for harris, making the rounds on tv and at her alma mater, howard

university, letting people know why she's getting in this presidential race. she of course has deep ties to the bay area. she's an oakland native, got her law degree from uc hastings and wi was san francisco's district attorney in 2004. she'd become attorney general in 2011 before becoming a u.s. senator in 2017. nbc bay area's political analyst larry gerston calls her the next generation politician who he believes made a smart decision by getting in the race early >> she's wise to get out early, because right now, she won't have to fight for as much publicity as she would let's say three or four weeks from now. >> reporter: here is information on the rally for folks that are interested in coming. it's going to take place at frank ogawa plaza sunday at 12:45 p.m. and senator harris is expected to explain why she's running for president and her vision for the country, and as we've mentioned she is a bay area native so we should expect

to see a big crowd here come sunday. we're live in oakland, pete suratos for "today in the bay." >> we'll continue to follow that one of course through the weekend, too. thanks, pete. at 5:34 right now, we now know more about a deadly hit-and-run crash in san jose. it involved a driver being chased by police. the driver of a white bmw matched the description of a burglary suspect in san jose. so ferz officers went after it. the car got away, speeding down meridian avenue at the intersection of meridian and kooser, the bmw crashed, colliding with a black suv. the two male passengers in the bmw were injured, one later died. the driver of the bmw fled on foot and is still on the loose. 5:35. happening today, hundreds of people will be out this morning to count the number of homeless in sonoma county. the county's community development commission is conducting today's count. the u.s. department of housing and urban development requires

this. this is all part of what has to be done for the county to receive nearly $3.5 million to build supportive housing. san francisco is boosting efforts to clean up park restrooms including dolores park in the mission. the mayor's office announcing an expansion of the program run by the park department. restroom monitors are being added to seven park locations around the city, just to keep them safe and clean. some of the cases that include safe needle disposals. a live look at the san francisco skyline on this friday morning. soon all those high-rises will be getting an added safety inspection. it's all for earthquake safety. mayor london breed issued an executive directive yesterday to strengthen the city's high-rises. this means the city will begin working with building owners to identify any engineering issues. experts say there's a 72% chance a 6.7 magnitude earthquake or greater will hit before the year

term rentals reportedly on hold. voters last fall approved limits on short term rentals in south lake tahoe. property owners are suing to block it. the new law bans the granting of new permits and phases out existing ones in residential areas. it also includes caps on the number of guests. according to lake ta show news groups that part of the measure remains on hold until the legal challenges play out. new this morning, governor gavin newsom is saying "god no" when it comes to a possible 2020 presidential race. newsom called the idea of challenging president trump crazy. newsom had frequent twitter wars with the republican president, and recently ran political ads in several eastern swing states. earlier this month newsom hinted he's likely to endorse senator kamala harris who recently announced her bid. happening today at the san diego border, president trump's administration will start sending asylum seekers back to mexico. they will have to wait there, while their cases wind through

the u.s. court system. the plan calls for agents to bus asylum seekers back and forth to the border for court hearings in downtown san diego. big news this morning, one of president trump's longest serving political advisers has been arrested. >> we're talking about roger stone, now in the custody of the fbi this morning. >> and charged with seven counts, laura, including witness tampering, obstruction and false statements. stone is a long time but unofficial adviser to the trump administration. before that, the trump campaign. the special counsel is particularly interested in stone's connections to wikileaks, which released the democrats' hacked emails hacked we think by russia. remember how important that hack was to the trump campaign. >> russia, if you're listening, i hope you're able to find the 30,000 emails that are missing. >> the fbi's investigation into a connection between the trump campaign and russia would begin four days after that speech.

stone denies he ever passed wikileaks information to the trump campaign, though he repeatedly bragged about his connections to wikileaks in the past. he even tweeted about it. stone is the sixth trump associate to be arrested, the 34th overall indicted by the special counsel. the senate voted on two bills to reopen the government on tuesday. both measures failed, one from the democrats, one from the republicans. this creates an opportunity for compromise. if there is any movement, it's towards the democrats, though it's subtle. one democrat voted for the republican plan yesterday, and six republicans voted for the democrats' plan. the president says he's looking forward to a compromise. >> it depends what the agreement is, yeah, but if they come to a reasonable agreement, i would support it, yes. >> the president says that, but even his closest republican backers have their doubts. remember, he indicated to

temperatures starting out in the upper 30s, another cool start to the day, but after this cool start, we will see those temperatures warming up and in martinez, we go from 40 degrees at 7:00 to noontime temperature of 59 degrees, so as you look out the window, you're standing in front of the closet, getting ready for the day, add on the layers for the first part of the day but later on, you'll be comfortable with maybe some jeans and some short sleeves. look at our temperatures, headed into the mid to even some upper 60s for today, and then we are starting out with some clear skies, but there will be some clouds moving in for the weekend, but those clouds will not bring us any rain, just give us filtered sunshine. we continue to warm up with our highs in the upper 60s. we'll be up to 68, the peak of the temperatures on sunday, for the inland valleys, and then our winds will pick up, but it still looks nice and also very comfortable going into the middle of next week. mike, you are tracking a couple of slow spots. >> literally just a couple.
