6:00 am
we'll get to the commute in a moment with mike. first we want to start off with the weather with kari, who is seeing some rain in the area. >> there's some light rain that will stick around for the next couple of hours for your morning commute and then we'll see things improving as we go throughout the rest of the day. here is a look at the radar as you get ready to step out the door. we are seeing some showers moving through the area from san francisco on southward, and we've seen it kind of filling in for some of the south bay, as this system moves in. it's going to bring us a couple of rounds of rain, but there will be a break in between, and then as we get a live look outside over san jose, you can see the low clouds but so far, only some light showers and our rain chances will be for the next hour or so and the rest of the day is pretty much all dry, as the sun breaks out, our temperatures warm up too. we'll talk about more of what's ahead in a few minutes. mike, you're tracking another crash. >> just as laura was welcoming everybody to the 6:00 hour i saw the lanes reopen. there was a quick traffic break to remove that crash. we've been tracking it off of the berkeley curve. now that was not the main commute, withcy westbound 80
6:01 am
getting over toward the bay bridge. this is off of the east shore freeway. i want to show you the maps, sorry, we can take that system and looking at the lower drive coming off of the east shore freeway and the maze getting up counter commute. the backup though is on the approach right here, coming over there off of highway 24. the crash is on the east shore freeway not bearing as much of an issue. the damp roadways are the word of caution for the rest of the bay. back to you. breaking news to tell you about. we knew it was coming and this morning, it is official. pg&e filing for bankruptcy overnight. the utility faces billions of dollars in potential damages from wildfires in california. >> "today in the bay's" pete suratos joins us live from san francisco with some of the new details. pete? >> reporter: good morning to you, marcus and laura. yes, as you guys mentioned, we knew this was coming but still, a huge development for the nation's largest utility. of course we're talking about pg&e, which has been at the center of a number of investigations when it comes to those wildfires that ripped
6:02 am
through northern california over the past few years. but here is what we know at least at this hour, when it comes to this bankruptcy. we know that the utility company has filed for chapter 11 reorganization. they've cited hundreds of lawsuits from victims of the tubbs fire and other fires between 2017 and 2018. now this comes as they were recently cleared of wrongdoing, when it comes to the tubbs fire that took place in 2017. now, the bankruptcy filing does put a halt on lawsuits and consolidates it into bankruptcy court, making it harder for victims with claims. so that's something that we're going to be following closely. now, of course all of this happening as the california public utilities commissions approved a plan for pg&e to take out, get this, roughly $6 billion in loans, a plan thatition that commissioners say will keep the power on for customers without raising rates. local officials aren't too happy about that decision. >> the people of the state of california, particularly
6:03 am
northern california, have had it with pg&e, so do not be surprised if a constitutional amendment ends up on the 2020 ballot. >> reporter: if our viewers recall, pg&e did file for bankruptcy in 2001, after a botched state deregulation of the electricity industry so this makes it two bankruptcies in less than 20 years. we're live here in san francisco, pete suratos for "today in the bay." >> thanks for the latest there, pete. 6:03. happening today, president trump's long time adviser roger stone will appear in a washington courtroom. stone faces charges in the fbi's investigation of russia's interference in our presidential election. tracie potts joins us live with more on today's proceedings. tracie? >> hey there, laura. good morning, everyone. it happens two hours from now. stone is facing seven counts from this federal indictment. he'll go before a federal district judge. he's also saying even though he still supports president trump, he might be willing to talk to
6:04 am
the russia special counsel in this case. >> it's been most unfair -- >> reporter: long time trump adviser roger stone appears in federal court this morning. he faces seven counts of obstruction, making false statements, and witness tampering in the russia investigation. >> did you in any way work with the russians to help president trump? >> categorically not, no, absolutely not. >> reporter: prosecutors say stone was the connection between the trump campaign and wikileaks, the group that released democratic emails stolen by russia. >> if anything, the indictment shows, tends to show that the trump campaign was not involved in the conspiracy. >> reporter: stone, who said he would never testify against trump, now says he will answer questions from special counsel robert mueller, but knows of nothing illegal. >> the investigation is i think close to being completed, and i hope that we can get the report
6:05 am
from director mueller as soon as possible. >> reporter: meantime, convicted former trump lawyer michael cohen will testify privately before the house intelligence committee on february 8th. >> there is an effort to, i think, launder money and i would like to hear more about that from him. >> reporter: he's headed to prison march 6th. now, keep in mind, cohen canceled his big public appearance on capitol hill to testify before a different committee because he said he and his family were getting death threats. back to you. >> tracie potts live from washington, thank you. with the government shutdown now over, the in allout for many people using calfresh benefits is going on. that's the electric version of food stamps, which is only funded through february. today, santa clara county supervisors are expected to vote to allocate $1 million to issue benefits early. alameda county and several other counties in the state are also looking to take similar actions. according to one non-partisan
6:06 am
policy group, 42 million americans counted on s.n.a.p. benefits in 2017. 65% are families with children. police on the peninsula are looking for two young men tied to a string of car break-ins. they say this surveillance video from the night of january 19th shows the pair. this is on shasta drive in san mateo. police say the two are behind at least 20 car break-ins, all in the neighborhood around hillsdale high school. in most cases it's said to be taking small items like phone chargers and loose change. we spoke with one victim who had to repair his broken window. >> i just pulled the car in here, cleaned up broken glass, which is a pain, because regardless of how you clean it, it's still never be that clean. >> police say both young men are between 5'6" and 5'8" and want you to look at this backpack here because it has unique features on it. if you can help, contact police.
6:07 am
volunteers in santa clara county are taking a survey of the number of homeless. the group started just about an hour ago. the survey is to collect data for the county supervisors. m mayor liccardo is expected to attend. here is a live look in minnesota, a nice skyline there, but it is cold. 17 states already under cold weather advisories and alerts. in chicago, temperatures expected to plunge with windchills well below zero. several universities have already canceled classes. more than a thousand flights are expected to be grounded to and from chicago alone. the city's mayor is warning major frostbite is a big concern. >> as i think everybody knows, while the snow may be ending, the cold is just starting. >> reporter: what are your plans? >> i'm going to stay at home, i think. >> i would. in atlanta, the super bowl less than a week away. game officials and coordinators
6:08 am
are hoping the weather will cooperate. city leaders are also hoping to avoid a repeat. remember this, snow jam five years ago, just over two inches of snow paralyzed the city. >> we may see that happening all over again. we'll be watching. here is a look at the current much wi windchills across the country. imagine this, 37 degrees below zero, that's in bismarck and minneapolis 28 degrees below zero, and some of the advice they were giving people, cover all exposed skin. no heavy breathing and minimize talking outside. that's just crazy. we bring it back home to the bay area, we're tracking some rain, some light showers for your morning commute but it will skip around, pleasant hill area so if you're on your way to the b.a.r.t. station, it will stay mostly dry and then as this system moves out, we'll get some sunshine and warmer temperatures again for today. we'll talk more about that rain coming in, and mike, you're starting with what's happening in the south bay. >> that's right, and no warning, right, for folks in the south
6:09 am
bay. you can go outside and talk. other parts of the country so cold. we are watching the weather but it's the damp roadways, not a major concern but still a concern, lighter traffic keeps the speeds a little bit higher on the roadways. you see they're just starting to dip through san jose, so that will mean the issue is traction, your traction getting off the freeway speeds, 680, 880 slows a bit for the typical east bay and tri-valley commute and the bay bridge toll plaza we have the backup because of the inle inle but the crash cleared coming off of west 580. >> thanks, mike. all of us, you probably have already been there, stuck in the middle seat on a flight. okay, but did you ever act like this? >> this is just impossible because you're squishing me. like friggin', just unbelievable. >> i don't know if you could make it out, she was like pushing me and she says it's unbelievable. next and all new this hour, we'll show it to you, a middle seat meltdown that's going viral this morning. plus a super important day
6:10 am

right now a live look in san jose, starting to see a few raindrops on the camera lens there of 101. you may have the raindrops on your windshield wipers as well. willow glen our rain chances continue until 8:00. the rest of the day is dry as temperatures head into the low 60s. it's going to be a nice day. we have to get through this. we'll take a closer look at the radar, coming up in less than five minutes. the drops dried on this lens over on the richmond side of the san rafael bridge but the flashing lights, the crews did not clear by 6:00. now we have additional delay, fewer lanes, we'll track this as well coming up. good morning. happy tuesday to you. china and the united states start new negotiations other trade today, restart them. nvidia got stomped on yesterday as it warned it would make half a billion less than predicted. our pete suratos is covering the pg&e bankruptcy filing.
6:14 am
the shares still have value. this is a reorganization, remember, not a liquidation. you heard there's a bug on iphones facetime that allows people to listen in on you without you knowing it. apple shut down the group facetime as it works on a fix. stick around, kris sanchez will tell you how to make extra sure this is turned off. but the big, big apple news today is whatever it is going to say this afternoon, as it reports quarterly earnings. this is huge. the company will not meet profit expectations. it already warned us about that. from a financial point of view what apple says today is far more important than one of those product announcements where we breathlessly report on a new iphone. apple is the most important company in silicon valley and investors are biting their nails other big news, that's the acting attorney general and the director of the fbi and cabinet members announcing major charges against the chinese firm huawei, accusing it to stealing american secrets, dealing with iran and
6:15 am
destroying evidence. this is the same company whose chief financial officer was arrested in canada and may be extradited to america, accused of skirting american sanctions against iran. china has since arrested two canadians and canada is warning its citizens about travel to china. now that america has leveled charges, this may be something to think about if business takes you to china. huawei has offices in san jose with american employees. the company is charged. the employees have not been charged, but they're probably refreshing their resumes, though. on a lighter note, we've all come to know elon musk as the super cool executive who is sending rockets into space, but a blogger has found an old video dating back to a 1999 cnn report where we first meet elon musk and his first billion. >> back in '95, there weren't many people on the internet, and certainly nobody was making any money at all. most people thought the internet was going to be a fad.
6:16 am
>> turns out it was not a fad. >> yeah. >> he made his first billions in paypal and zip2it and poured that money back into tesla and spacex. he's the guy at the roulette table who gets the big pile of chips and puts it all back on the table. so he's fun to watch. >> a gmbleer there, all right. we were talking about this, when you've been on a plane flight. this is new video from on board a flight certainly going viral, showing a passenger getting upset about being stuck in the middle seat. united airlines flight was headed from las vegas to new work earlier this month. video posted to facebook by a new jersey nurse who was sitting next to the upset woman. >> oh my goodness, i don't know how i'm going to do this the next four hours. this is just impossible, because they're squishing me. i'm like friggin', it's just unbelievable. >> after asking the flight attendant to move, several other passengers also became upset saying she had no right to cause an issue. >> that doesn't look like that
6:17 am
airline where you just pick any seat. it's an assigned seat so maybe she booked it later and that's how she got the middle seat. >> you got to just deal with it? >> you know that going on the plane. >> that's a long flight, too. >> to hear her. >> right. >> i can't move. uncomfortable. >> let's sing a song. let me sing a lullaby to you. >> shhh, take a nap. >> we'll have a lot of people traveling within the next few days and hopefully if you're staying at home you'll enjoy the breaks in between the rain. we are starting out with some of the showers moving through this morning. this won't last all day. we are going to see it move through, and then the rest of the afternoon will be nice and sunny, but we are seeing quite a bit of the showers moving through parts of the peninsula, right there over san mateo to redwood city and we are catching a break for palo alto for now. we are also seeing the rain extending over toward milpitas and up toward the tri-valley and moving into the south bay as we start to see some showers moving
6:18 am
in to san jose, down to saratoga, and we are once again going to see this move through fairly quickly, and then a break in between and another round of rain will be here by tomorrow afternoon. so as you're getting ready this morning, it is a muggy one to start, but the humidity will improve later today. maybe a little extra hair spray will help you out a bit, as you get ready, and our temperatures will be nice for the afternoon, reaching up to 65 in santa rosa. also see a high in the mid-60s for the south bay. 63 degrees in antioch, and in livermore. so for the afternoon, a few breaks in the clouds, it's going to be pleasant, just partly cloudy sky. for tomorrow, we start out dry, but then the showers start to move into the bay area, starting in the north bay, and then spreading inland as we go closer to the evening commute, getting heavier by tomorrow night for all of our microclimates, and then we could see it linger into early thursday morning. we're looking at the potential of getting quite a bit of rain for parts of our microclimates and our bay area. we are seeing computer models still going back and forth.
6:19 am
this one showing about an inch of rain area wide, and then a break on thursday, before more rain moves in for the weekend, and it's going to be soggy, even going into next week, and it's going to cool off with our high temperatures in the upper 50s. heading over to mike, you were seeing what is happening on the roads and how the rain may affect the commute. >> that's right. we had rain on this richmond-san rafael bridge camera earlier on the lens, that cleared up. this has not cleared yet, the last crew approaching the bridge and the toll plaza, slated to be here until possibly 6:30. they're starting to light up the flashing lights, i think they're getting ready to move in the next ten minutes. the damp roads there, again. and kari talked about the north bay pushing across from the peninsula in toward the east bay. contra costa county moves nicely but has been hit with the rain along 24. same thing alame da county and the tri-valley. no major problems as far as speeds, typical build through the east bay and tri-valley.
6:20 am
the peninsula just fine right now. watch the speeds, even though the roads are clearer right now, you could have a slicker roadway and could have trouble stopping. be careful there. san jose shows a push northbound and starts back here in san martin, coming up 101 toward morgan hill, your typical south county commute. a nice ride on cal train from the south county as well as the other systems, no delays reported for the rails. that's a nice ride for you as well. back to you. >> thank you, mike. still ahead this hour on "today in the bay," arming schools with police officers in one contra costa school district is becoming a major issue. so coming up for us at 6:30, what leaders are demanding. she says her credit card was hacked but her bank says sorry, we don't believe you. i'm consumer investigator chris chmura, "nbc bay area responds," next. and here we go, 'tis the season, get ready for girl scouts selling those cookies, but before you get frustrated from having to buy from everyone, or pass them in front of your local store, make sure to check out my facebook post

a sad story to tell about this morning. an arizona lyft passenger is behind bars, accused of brutally attacking his pregnant driver and killing her and her unborn baby, happened early sunday morning. police say the passenger, fabian durazo attacked kristina howato with a knife, while she was inside her suv. she was taken to the hospital, where she and her unborn baby were pronounced dead. according to police durazo eventually left the scene in the victim's car. he was later arrested. >> that is such a frightening story. 6:24 right now. nbc bay area responds to a san jose woman who says her credit card was compromised by crooks. >> she got a new card but not all of her money back. she turned to consumer investigator chris chmura's team for help. >> good morning. when hermenia f. spotted fraud on her credit card, she reported it right away. the bank closed her account and sent her a new card with her new number, but declined to remove
6:25 am
$674 in fraudulent charges. hermenia asked if we could help. we asked the bank to take another look, and it did. it removed every single penny. we didn't get an explanation of what happened. hermenia told us a bank rep. said her card number was used at a chip-enabled reader. that's somewhat surprising because those chip cards we all got a few years ago were supposed to be safer, but crooks are catching up with technology. so even if you have a wallet full of those new cards, you still need to keep an eye on your accounts, just like hermenia does. set up those alerts. they are free and great. one side note, by the way, gas stations are still exempt from requirements to install chip card readers. that means lots of gas pumps still have old magnetic stripe readers which the hackers absolutely love. until the chip readers make it to the gas pumps, you might want to consider paying for your gas inside with the clerk, just to be safe.
