"today in the bay" continues right now. thanks for joining us on this wednesday. i'm kris sanchez. laura garcia is off this morning. >> and i'm marcus washington. mike will have a look at our commute in a bit. first we want to start off with the weather. meteorologist kari hall has been tracking that storm headed our way. is it going to hit any time soon? >> it will be later on tonight. we have one more day of dry conditions and also some mild temperatures throughout the day, but we start out with some fog, and we can see from atop the low clouds looking at our sutro tower camera over san francisco it's a gorgeous shot starting out this day, waiting for sunrise. you can see the visibility in the tri-valley is down to about a quarter of a mile. we're also seeing some patchy fog in the south bay as well as the south county, so just watch out for that, as you head out the door in pleasant hill, headed to the b.a.r.t. station, it's going to be 50, a cool start, but we will have some milder weather today with highs in the low 60s, and mostly sunny skies. we'll talk about when that rain

arrives in just a few minutes. mike, you're talking just fog and cars. >> both of us, so that's great, because that's our gig, right? we look over here, speed sensors are just fine. we are showing this orange, where the road weather index takes the weather data and says you know what? you'll have lower visibility there. watch brentwood, discovery bay and livermore and dublin. we've seen it over 580 for much of the morning. highway 17 low visibility from time to time and more fog and causing slowing out of san martin. toward the bay bridge we have the metering lights on but we don't have much of a problem, just a little more cars down the upper east shore, slowing 24 minutes from highway 4 to the backup at the bay bridge. back to you, marcus. >> thanks, mike. today, border security will dominate the conversation in washington. a panel of 17 lawmakers selected to come up with a compromise will meet for the first time this morning. tracie potts has a look at this crucial meeting as another possible government shutdown looms.

>> reporter: today, the dealmakers get to work. >> we're going to work out some sensible solutions, and there are many of them that i think we can all support. >> reporter: their job to come up with a border wall compromise that both parties will support and president trump will sign, avoiding another government shutdown on february 15th. >> we can bridge our differences based on facts, based on evidence, based on experts. >> reporter: the conference committee includes nine democrats and eight republicans. their first public meeting happens today. >> we'll have to see if they're willing to break from the president. >> reporter: the senate's top republicans already giving them some leeway. >> i'm for whatever works, which means avoiding a shutdown and avoiding the president feeling he should declare a national emergency. >> reporter: whatever they come up witwillave ithing that look sounds like a wall. >> physical barriers have to be part of the solution. >> it could be barrier. it doesn't have to be a wall. >> we are willing to support

fencing where it makes sense. >> reporter: america's counting on this new team of negotiators to keep the government running and keep paychecks flowing. tracie potts, nbc news, washington. 6:03 right now. this morning, a mother and her daughter are waking up together for the first time after weeks apart. >> sidney flores and her partner kevin and flores' 18-month-old daughter, gretchen, are from honduras. they were separated after arriving at the california border late last month. kevin was caring for the baby but detained because he was deported before. there the baby responding to seeing mom again. gretchen was placed in i.c.e. custody. flores is in the u.s. while her asylum request is processed. there are times when flores didn't know where her little girl was. >> translator: devastated. not knowing what to do, feeling

impotent to know that my daughter is somewhere else and she's not with me. i've felt very bad. >> flores has two other children who are 7 years old and 9 years old. they came across with her and are staying with flores' uncle in san francisco. she is hoping for asylum. her partner, kevin, is fighting deportation. new this morning, police records released to the "east bay times" are shedding light on the firing of two police officers in the delta town of rio vista. the officers were accused of violating use of force rules and filing false reports in separate incidents a year and a half ago. in one case, a woman who called police about her car alarm ended up with a k-9 dog bite and handcuffed in the back of a squad car. the other case involved a dangerous chokehold. happening today, the community is coming together to help the family of a fallen newman police officer ronil singh.

california pizza kitchen locations across the state are participating in an all-day fund-raiser. 20% of the profits earned today will be given to the non-profit organization police and fire for fallen heroes. the organization will be given that money raised through events to the singh family. singh was shot and killed last month during a traffic stop. according to prosecutors, gustavo perez arah ga shraga sh after a traffic stop. the county tried to buy the series from verity health which is going bankrupt. it includes o'connor hospital in san jose, de paul health center in morgan hill and st. louis regional hospital in gilroy. the state justice department tried to block the sale over concerns the county might try to phase out low income health services but "the mercury news reports" this morning that the

judge is now determined that the state has no authority to regulate the deal. the judge's final ruling will be issued today, and that sale is expected to close in march. in a few hours, san francisco mayor london breed will deliver the state of the city address. she will make her speech at 11:30 this morning at the national lgbtq center for the arts. it's not clear what topics breed will cover. however, homelessness and street sanitation have been ongoing problems throughout the city. our investigative unit was the first news team to survey the city's filth block by block. our reports went viral and even grabbed international headlines. you can watch them on our website nbcbayarea.com. happening today, volunteers in contra costa county will take a survey of the number of homeless people. that group will start at 8:00 this morning, and the data will be used by federal, state and local government determine funding for homeless services. last year, the number of homeless in the county went up by 627 people.

>> 6:06 now. happening today, leaders across the east bay meet to confront the housing crunch. the mtc is organizing this meeting, and councilmembers from fremont, hayward, newark and san leandro are among those going to attend, and they are hoping to devise new housing strategies. that meeting focuses on numbers taken from a recent report, it finds over the next 20 years, the bay area may add 2.5 million people and more than 1 million jobs. right now at 6:07, as you get ready to head out the door, we are going to be tracking a storm, but the rain really doesn't get here until later on this evening. so we are starting out with some patchy fog. as we get a closer look, though, storm ranger showing that you do have dry conditions around the bay area. we'll be watching out for those rain chances, but expect clearing skies throughout the day. here we are at 3:00, and we are seeing some sunshine, all clear conditions out there. rain starts to move in after sunset, and gets heavier by 9:00

tonight. we could see where the reds and the yellows are, indicating some heavy rain that will be with us through the overnight hours, and into the start of the day tomorrow before this system quickly moves through. we'll be tracking several more systems behind that. i'll have the time line in just a few minutes. mike, you're telling me now you have a crash in sunol. >> it's a moonor crash as far as severity but involves a big rig so we're always concerned it will be a big issue. over on the shoulder as the commute buildings south 680 out of pleasanton and sunol. also there's fog in the area north of there for 84, livermore, for dublin and brentwood and discovery bay. south county seeing fog build up coming toward san jose proper. watch for that as well but so far the speed sensors are at the slowing into traffic starts to build anyway concord and also wesoul sts whe and we're building through oakland, no problems. we have north with the tail lights and south with the

through the east bay just 25 minutes from highway 4 to the backup at the bay bridge. the maze is starting to get ars. and a very happy wednesday to you. the fed has a two-day meeting today and will make an interest rate announcement noontime. facebook and tesla, we're interested in how much cash flow tesla has. apple opened its book to investors tuesday, said it sold fewer iphones than it hoped. the company says people are holding onto their old phones longer and it's struggling to sell phones in china. other business segments are growing so that stock may actually do okay this morning. apple also says it's working on that facetime bug that kris told you about yesterday. it turns out apple knew about the problem for much longer than it the flaw allows you to listen to people through facetime, even if they don't answeur it was discovered by a 14-year-old boy several days

ago. his mom tells the "new york times" she frantically tried to get apple's attention. here is the young man. >> i'm only 14 and stumbled upon this bug trying to play video games with my friends, so it really shows how crazy these devices are, like anything could happen, any bug could give away all your personal information. >> meanwhile, apple's tim cook says he's talked to president trump about the trade war with china. he says he expects tensions to ease. chinese and american officials are meeting today to try to work something out. up in wisconsin, the chinese company foxconn says the big factory that was going to employ more than 10,000 people probably won't be a factory. so far, only employs 1,000 people. you may recall president trump, foxconn president terry gau made a big splash about bringing factory jobs back to wisconsin. foxconn got a sweetheart tax deal.

foxconn tells reuters the factory will probably end up being a research facility and will hire skilled engineers and not factory workers. a new study says americans got 26 billion robo calls last year, up from 18 billion the year before. a spam monitoring service called hiya found we answer about half the calls placed to our cell phones. i have an app called nomorobo. it works about half the time. i will get that and it will say "this is a robo call" but they change the numbers. >> so fast, if you don't think about it, you answer it thinking it looks familiar. >> it's worth a shot. what we should all do is answer the calls and press one to get an operator and waste their time in some fashion. >> i've done it. >> at least a little revenge. >> i ask for the credit card number, one, two, three, four, five. they're like, click. problem solved. >> that's one strategy. >> thanks, scott. 6:15 right now.

happening now, a polar vortex bringing record cold to much of the country. in fact, 85% of the u.s. will be at or below freezing today. take chicago for instance. it's expected to be colder than antarctica today. current temperature there is 20 below, but it feels like 49 below. 49 debelow zero is cold. it's the coldest day in the city in 34 years. as "today in the bay's" susan carlsson reports, banks, schools, even restaurants are shutting down. >> reporter: notice i'm sitting inside one of our station vehicles instead of venturing outside on this brutally cold morning. we've already set a record in chicago and with windchills nearing 50 below zero, frostbite can set in, in just minutes. the railroad gates are stuck down at this suburban commuter train station.

police are directing cars around the downed gates in brookfield. this is one of many transit problems today. for those who do have to go outside, it hurts. >> i have on my uggs, i have on leggings, pants, two jackets. >> it's freezing but i'm bundled up. >> reporter: commuter trains coming from indiana to downtown are not running at all because of this arctic weather. trains from the suburbs are running on a reduced schedule, and at much slower speeds. chicago's loop is expected to be relatively empty today. many offices are closed, and some other employers are allowing people to work from home. in chicago, all bundled up, susan carlson for nbc news. >> you don't think about the traffic impacts, you know, like the rails freezing, the arms not coming. >> stuff we don't deal with here. >> yes. >> it's reality. >> i guess we're lucky. >> yes, i posted it on facebook yesterday, the coldest temperature i've been in, so you might want to check that out. >> my goodness. >> everyone shared their experiences, too. >> you're from the south, the coldest is what, like 34?

>> it gets colder like that, in the teens. the south gets cold. >> sorry. >> low 20s. >> it's all relative. so this morning, we are starting out with some relatively cool temperatures across the bay area. our main concern will be the fog, and that's what we are seeing right now as we get a look at dublin, our live camera, looking at the tri-valley, 580, everything is still flowing well, but you do have to deal with slow down speeds and the visibility down to about a half of a mile. elsewhere, visibility is down to about a mile and a half, or two and a half miles in san jose. so it's not too bad. we've seen some fog just lifting above the roadways. be mindful in campbell with kids walking around the school zones t will be in the low 50s and once we see this clear out, we'll have a beautiful day, despite the fact that we're talking about rain moving in.

it will hold off until later on this evening, giving the kids a chance to get outside and play before that rain rolls in later on tonight. if you're on your way out to the warm springs b.a.r.t. station, low 50s to start and up to about 64 degrees at 1:00 today. here is the storm system we're tracking. we're starting to see some clouds moving in but we will catch a break from the clouds and have storm ranger powered up and ready to track this next system moving in, but showing that we're all dry from now and there's quite a few storms out there lining up in the pacific, so as we time it out, all clear conditions once again for today at 3:00, and then shortly after sunset, we start to see the rain moving in, and there may be some waves of heavy rain, as we go into tonight, where you see the yellows and the reds, indicating some really heavy rain that will be with us, but really winding down by tomorrow morning, as you get ready to wake up and head out the door. i'll have more dls and mike, you're tracking changes at the been aboay bridg. >> there were great changes for 20 minutes.

we saw the left lanes really clear up. they're starting to build once again, coming out of the maze, the traffic flow will stop for the f t if you're green cash, you can get over toward the left lanes, great. if you can carpool, greater, hov lanes here and at the top of your screen, rarely any backup there at this time of morning. we're showing a smooth flow of traffic. upper east shore freeway, only 25 minutes to the backup i showed you at the bay bridge. slowing for highway 4 and the build for walnut creek over there near the interchange with 24. smooth flow of traffic for much of the rest of the bay. the crash 680 south in sunol is on the shoulder, a distraction but no problem and also fog, watch that brentwood, discovery bay, livermore and the south bay, san jose, santa cruz mountains as well as highwayowo martin the building traffic on schedule toward morgan hill but lingers for that portion as well. we show you the san mateo bridge, we're starting to see a little glow. there are low clouds hovering around the deck and more cars

>> thanks, chris. new for you this morning, in the north bay, a new restaurant with somewhat a unique spin is opening today. you won't be required to leave a tip at roadhouse 29 in st. helena, because all of the staff are paid above minimum wage and will receive profit sharing bonuses. the no tipping policy isn't new to the bay area. camino and oakland in san francisco both already have similar operations. the business owners say it really makes it easier to their workers. new for you this morning, this is a story that will make you go, what? so opioid prescriptions for pets on the rise, and that's raising some questions about is really behind using them. >> so researchers from the university of pennsylvania say prescriptions a 41% in ten years, but the number of visits only rose by 13%. experts say it is likely that some of the drugs that were

door not too cold, in the low 50s but that's about normal as we go throughout the day, warming up into the upper 50s as we do today but we'll see patches of fog moving by especially in the tri-vle ao seen it in the north b b but right now, no rain as of i'll tell you more about the timing of the rain coming up in just a few minutes, and mike, you are tracking something happening out there on the roads. >> we say something because obviously there's flashing lights off of the off-ramp at high street. that's not the incident. we're talking about over here as you get northbound and get to the on-ramp with folks coming off of 66, something going on there. we had actually another vehicle on the shoulder, there may have been a fender bender or just some assistance, but lanes are clear. still tracking that, nothing from chp, andoe issue is over h east bay, that's down the east shore freeway, westbou there is a crash there, and maybe blocking your slow lane

for a short period of time. that's the slower dri odeo and bridge. but once you get past san pablo and appian way, things move smoothly, a little slowing through richmond and berkeley, a slowdown through hayward for the build toward the san mateo bridge and a crash around tennison. we'll check on that coming up. back to you. >> thanks, mike. all new this morning, facebook is ending a controversial marketing program on iphones that collected users data. that's just the latest scandal to hit the social network. "today in the bay's" bob redell is outside facebook headquarters in menlo park with what forced this move. >> reporter: two reasons for this, a tech report accused facebook of spying on teenagers which the social media giant says is no true and two, this marketing research program enabled by facebook might be in violation of apple privacy policies. since 2016 facebook has been paying users between the ages of

13 and 35 $20 per month plus referral fees to install the "facebook research app" on their apple and android phones. in return, facebook would be allowed to monitor phone and web activity, collect data on things like social media messages including photos and videos and track location information provided by other apps installed on the phone, and that right there could be in violation of apple's policy that prohibits one app from collecting information from other apps installed on the phone. facebook has been the target of much criticism over the way it handles user data, especially after it was revealed that the data of 87 million users had been improperly shared with political consultancy cambridge analytica. now facebook has responded to this latest controversy. they put out a written statement. i'll read part of it. "there is nothing secret about this marketing program. there was no spying. all users gave their permission. less than 5% of whom were teens whose parents had signed consent

forms. forms." here in menlo park, bob redell, "today in the bay." >> thank you very much, bob. 6:34 now. happening today, pg&e is expected to argue that its recent bankruptcy will impact court-ordered fire prevention efforts. that order stems from a criminal case tied to pipeline safety violations. the judge recently ordered pg&e to remove or trim all trees at risk of being blown into power lines. pg&e attorneys already argued the proposals are too costly in light of yesterday's bankruptcy filing. the utility says the effort could cost $150 billion. new details now in california's effort to boost fire prevention. state wildland managers announced plans to streamline the process for logging and prescribed burns. supporters say the steps can be cumbersome, heightening the dangers until the permits are sortut the changes would create one review process and it could potentially double california's forest management coverage each year.

a live look now at san francisco, and san francisco seeing some of the clouds we just saw in the city of san jose as well, some of the big e even biggest event in the city may have a different cloud overhead, they may be able to sell cannabis legally. "today in the bay's" pete suratos joins us live with details. we know people already do it. this is a matter of changing the law so folks can't be prosecuted, right? >> reporter: yes, that's right. good morning to you, kris. really at this point according to "the san francisco examiner" this is a proposal by the san francisco board of supervisors, they have to go through that process, but it could be here in time just in time for the annual 420 event that happens over there at golden gate park. let's talk about how this permit process will work. basically it will implement assembly bill 2020 which went into effect at the start of the year allowing cities in the state to issue cannabis permits for temporary events with a state license and a local license. now initially permits would go

to events held on a regular basis that received city permits and have significant amounts of unregulated cannabis. an example of that would be the 420 event that takes place at golden gate park. it will be issued these permits by the office of cannabis and require city agency approval for the area where it's taking place, so in the example of 420, that would be the parks and recreation department that would give the approval. permits could range from $500 for smaller gatherings to as much as $3,000 for bigger gatherings. with that said, smoke something still notmpon ofoking is prohib. we're live here in san francisco, pete suratos for "today in the bay."much, pete. the search is still going m allegedly beat up a bay area actor, singer and lgbtq activists.

new reaction this morning from nancy pelosi. jesse smollett was born in santa rosa and stars on the tv show "empire." chicago police say smollett say two men approached him outside of a fast food restaurant around 2:00 a.m. they held in racial and hoe foe phobic slurs. they then beat him and wrapped a rope around his neck. so far no arrests have been made. house speaker nancy pelosi tweeted her reaction to the attack calling it "an affront to our humanity." right now in the south bay, the search is on for a serial groper. sunnyvale police released this sketch of the suspect. police say a man who looked like this grabbed and groped with imin sunnyvale and santa clara last year. he wasn't caught and now they think he might be back. all of at tacks happened near raynor park. the first was in april of last year in santa clara followed by an attack in may in sunnyvale, and then just a few weeks ago on january 10th it happened again in sunnyvale. police are now urging women not to walk alone.

notorious member of an australian graffiti crew is due in court today, accused of vandalizing b.a.r.t. trains. matthew white is charged for tagging at the millbrae yard. he was arrested earlier this month at sfo while he was waiting for a flight to sydney. he's held at san mateo county jail on a $400,000 bond. it is unclear whether he is linked to other b.a.r.t. yard vandalism. >> $400,000 bail, all right, that's a lot of money, folks. no delays since we're on the topic of b.a.r.t. this is the walnut creek b.a.r.t. station. our camera aside 680 southbound and 24, the split right there at the walnut creek interchange, everything's fine right here. ransit and the roadway al drifting around parts of contra costa county, as we have 580, and brentwood and discovery bay with the road weather index showing that. we don't see a lot of slowing. the crash west 80 over at appian has cleared to the shoulder, so that's good news.

good morning. it is a mostly cloudy start and patchy fog around the bay area. let's head over toward cupertino, after the cloudy start, sunshine for the rest of the day and our high temperatures headed into the mid-60s. later on this evening clouds roll in and the rain won't be far behind. we'll talk about the timing of the rain in less than five minutes. >> metering lights, headlights and the sunlight, actually a break in the lights on the left approach to the bay bridge. we're looking the opposite direction toward the san mateo bridge where the build is on. you see slowing across the span here. we'll show you what else might be tougher to see. now we are following breaking news to tell you about, just in to our newsroom, there's a fire to tell you about in san jose at a strip mall on saratoga near stevens creek. here is a map of the area. initial reports there are no injuries but we have bob redell headed to that scene right now. we'll keep monitoring that.

this is a fire there in san jose near saratoga avenue there. we're going to have more on this as soon as we get that information. one of our top stories right now is a chance to help make san francisco safer for pedestrians and bicyclists and that chance comes tonight. muni invites you to comment on designs for the folsom howard street scrape project, it would upgrade pedestrian crosswalks with new signals and mid block crossings, so people don't have to jaywalk. it would add transit only lanes and new bus service. bicyclists would see concrete barriers and move the bike lane so it sits between the curb and separation between the cars and fer,ou have the the bikes, put the parked cars between them and it makes for a much safer ride. >> reporter: your thly. right up until about here, it's pretty chill, but from here to the water, it's just a mess. you got people blocking the lane

brady attended san mateo's sarah high school. the mayor who loses that bet will have to deliver the winning team's mayor a basket of goods. they will donate to the city's largest nonprofits, novato's north marin community services or san mateo's police activities league. a good bet going on right there. >> novato and san mateo are taken a long stretch of 101 they could have signs lit up with their faces and who won and who lost. >> showdown on 101. we might see some with another hazard this rounds of rain but we start out morning, fog in parts of dri th north bay, in san rafael, we are tracking some low visibility, and some of those areas, but it looks like everyone's making it okay, heading into san francisco, and then you head over toward the tri-valley, where visibility is much lower, down to a quarter of a mile. just watch out for that, low clouds over the south bay as well, a live look outside and as you get dressed this morning, you do want to wear something that will keep you comfortable.

it's still going to warm up today, so some long sleeves and even some sunglasses and yes, we've been talking a lot about rain, but there will be still some sun breaking out today for the afternoon, before that system arrives. we could see the swirl of the clouds and it's kind of cut off from anything that will help steer it, so it's been kind of wobbling, the computer models going back and forth and as it moves in later on this evening, will bring in the potential of some heavier rain across parts of the bay area, not the whole bay area, but we have storm ranger powered up, parked on san bruno mountain and it's ready to track this storm as it moves in. but our hour-by-hour outlook shows that during the middle of the day, we could get some clearing and by 4:00, the clouds start to move in. we start to see some green, yellows, reds. the reds indicating some really heavy rain but that's not until about 10:00 tonight. it's going to pour as we go into tonight into early tomorrow morning, but it does show tfos rain from san francisco over toward the east bay on southward. this is where we could get some

of our higher rainfall totals, some of the north bay microclimates may get also some scattered showers, but then it's all pretty much clearing by thursday, and then friday we'll be watching another round of rain late in the evening. this is what the computer model shows now. it has shifted down for the north bay, because of that southward jog from that area of low pressure, and it may still wobble, even as we go into early tomorrow morning but shows some rainfall totals for parts of the peninsula and the south bay anywhere from a half to close to an inch of rain. we will see a break in the rain on thursday, then some more widespread rain on friday, as another system moves in with some gusty winds and off and on showers through monday. keep checking in for more updates on that and mike, now you have an update on the crash. >> a crash in fremont i forgot to tell you.. we checked on the crash 880 at mowery, out of lanes and not causing much slowing. we have the typical build san leandro 238 past the san mateo and the dumbarton bridges. west of course is your commute direction. this morning.

the real issue is the fog as kari has been talking about, 580, livermore, brentwood, discovery bay, all suspect for the foggy conditions and lower visibility, and it creeps up as the fog moves in toward san jose. highway 87, 101 and 85 show the build and possibly showing lower visibility. 17 hasn't been a problem but now more cars hit the northbound direction. we see some slowing there and creeping across 101 into san martin and morgan hill, so those commuters hitting the roadway and may be a concern for them. there say live look from our dublin camera. i turned toward the dublin grade, which would be seen here, but you can't. it's still locate there had. no problem for the grade and the b.a.r.t. stationnearby as well shows no delay. no delays for b.a.r.t., san trans, and we have a slight delay for the aceintohe area. back to you. >> thank you very much, mike. happening now, you might want to check your freezer before you pack the kids' lunches. tyson is recalling more than 36,000 pounds of chicken nuggets. you might have bought some, it
