redwood city and the south city area. light rain is starting to creep into the south bay so we're going to be watching that over the next few minutes. i'll have more updates on that. mike, you're starting out in oakland. >> that's right. as you talk about the rain, we'll watch for that effect, we see that green highlighting, the damper roadways definitely along the peninsula and south oakland earlier traffic alert which got cleared a few minutes ago, eastbound 980 getting away from the nimitz and headed up toward 580. there was a big rig involved across all lanes. it has been cleared but we saw a little slowing and there may be a tree down in the area, that's the rumor. you see how light the traffic is through oakland. we're okay. >> some commuters, mike, are dealing with big changes in b.a.r.t. startingat is morning. >> "today in the bay's" pete suratos is live in san francisco at the old transit center. pete, with the change that is happening today. >> reporter: good morning to you guys. that service is going to start at 5:00 a.m. on weekdays, if you're riding b.a.r.t., where

they have this early bird bus service. we want to show our viewers a map to explain how it all works. i want to point out, the buses are not going to stop at every b.a.r.t. station, only at 21 of the 48 b.a.r.t. stops. so it's important to plan ahead and look at that map that i'm showing you, to see which stop is closest to you. the express line that we're talking about, this early bird express is going to include about 15 new bus lines, running between 3:50 a.m. and 5:30 a.m. between the selected b.a.r.t. stops from the trans bay to san francisco to contra costa county. the late start times are being done to accommodate the seismic retrofit of the trans bay tube and the changes in times will affect nearly 3,000 passengers. a lot of people riding b.a.r.t. early, so here's what some of those commuters that we spoke to are saying about the big chs.ld get home earlier and spend more time with my family, take my daughter to >> i'm going to stay taking

baerp b.a.r.t. going to go from here at 5:003. t'or the early morning starters, those who have a job and have to earn a living. >> it should be about the same. yeah, just catch it, maybe five or ten minutes later, but i'll still get to work on time. >> reporter: changes will last for roughly three and a half years, that's the length of time it will take to finish up that retrofit project. in fact, we'll talk to b.a.r.t. shortly and hear more from them in the next hour. we're live here in san francisco, pete suratos for "today in the bay." >> all right, pete, thank you. new for you this morning, a huge scare for one man late last night in antioch. he says that he was asleep on his couch happened. as you can see, a truck barrelling into his home, this ened west of hillcrest avenue. the driver suffered major injuries. the homeowner thought he and his wife wer uboom, like thought somebody is shooting and i run up to the stair, and then the cop knocked on the door, tell me to open the

door, but i tried to open, the door is stuck. >> right now, we're trying to get confirmation from police on what led up to that crash. we did hear from witnesses that this may have been a stolen vehicle chase, but so far, police are not confirming anything. bob redell is at the scene and will have a live report during the 5:00 hour. developing new, one person hurt following a rollingover crash in the south bay, happened about 2:00 in the morning in the morgan hill area. no video in the newsroom, a sedan hit a retaining wall as it overturned. chp says the driver was hurt, but is expected to be okay. the cause is under investigation. look at that car, boy, it's not clear if drugs or alcohol played a role. a follow-up now an east bay family is mourning, they say their 49-year-old son is the pilot who died when that plane crashed on mt. diablo friday night.

marianne favro talked to the pilot's father about his son's passion for adventure. >> reporter: chris debarr was an adventurer at heart. >> he went flying every day he could. >> reporter: his father said he loved sky diving, motocross and scuba diving, putting in the time to master each skill. >> and he had a zest for life and he wanted to do everything. >> reporter: chris was even in a heavy metal band with his brothers, called the slackers. flying was his newest passion. >> here son jeff, and him over at the plane in hayward. >> reporter: his father says chris got his pilot's license about five months ago. >> he bought it, this plane that he was flying about two months ago. loved flying. >> reporter: he says chris worked as an elevator serviceman in san jose during the week. on fridays, he'd fly his plane to an airport in lincoln, and then drive to his home in granite bay. christopher debarr says he believes that's where his son was headed when he left hayward

executive airport with his two dogs friday night. >> plane crash mt. diablo state park. >> reporter: the faa says a small plane crashed on mt. diablo killing the pilot. the wreckage wasn't discovered until saturday afternoon. >> he wasn't so m afraid of dying as not living. >> reporter: as chris debarr's family mourns they take comfort in knowing he did a lot of living in his 49 years. marianne favro, "nbc bay area news." >> chris was born in san jose and grew up in the south bay. plane crashes are extremely rare on mt. diablo, but there have been two in the past year, but before that, it hadn't happened since the 1990s. happening today, a new push to protect sex workers from arrest when they report violent crimes in california. state senator scott weiner will announce a proposal this morning in san francisco, seeks to protect sex workers with being charged with prostitution after reporting sexual assault, trafficking or robbery. coming up here on "today in the bay," you still have more

good morning. i'm frank holland at cnbc global headquarters. here are today's top business headlines. wall street is set to open up higher this morning, dow futures up about 68 points right now, as investors focus on high-level trade talks between the u.s. and china and beijing later this week. the markets are coming off another positive week, the seventh straight for the dow and the nasdaq. the longest stretch for the dow since november of 2017. on the watch list for investors this week, reports on inflation, retail sales, and consumer sentiment. tax season is under way, but americans are a bit more sluggish in filing their returns this year. the irs says the number of individual tax returns the first week in the season fell more than 12% from last year. the toal number of returns process eed dropping by 25%. the average refund is smaller, $1,865, versus more than $2,000 last year, down 8%.

the irs expects to issue fewer refund checks due to changes from the new tax law. and tesla is ramping up production of the model 3, but it may be running into a few other problems. reuters reports when the company announced a round of layoffs last month, they cut the team that delivers cars to customers in north america by more than half. that may be a sign that tesla expects the pace of orders to slow down by a lot. there are worries command for the madle three tailed off after a large t the electric vehicles expired last year. marcus and laura, back over to you. >> a lot of people wanted that >> woo. >> don't we all, though. thanks, frank. diablo. the good thing, it really seems like the good times brought the snowball fights, you saw the snowmen as well as know ayn yells, always a good time there. people we spoke with say it was worth that trek to get up there. >> i haven't had this experience before, especially on the mt. diablo like so close to home. it's like in our backyard, and i think it's really cool. like i could get used to the snow, being up here. i could get used to the snow being up here. t juner it campground. the weekend brought five inches of new snow at the top of diablo adding to what was already on the ground from the previous weather system. just really cold storms that have been coming through. >> i think the next storms that will be coming in will be warmer, so we're not going to see the snow. in fact, some of that may be meltino melting. that's going to add on toook at some mostly clear skies this morning. the seven-day forecast is coming up at the bottom of the screen, but look at how cold it is, and

it will be chilly as you get ready to step out the door. some spots are just a couple of degrees above freezing and now below freezing with fairfield. we're just above freezing in livermore and san jose, now at 37 degrees, so as you start out, you see the clear skies for most of us. we are going to have another cold one, so you need the layers, a coat, a scarf, hat, gloves, if you have to be outside for quite a while, just make sure you're prepared for a day that will only warm up into the mid-50s. we're seeing some spotty, light rain moving through, so some areas along the peninsula and even into the south bay may need the umbrella, as you get ready to step out, but the rain has been very spotty and light, so really not going to change many of your plans for today. even seeing some light rain moving through milpitas and just near fremont, farther to the north. as i widen out the view, i'm showing you what's ahead, as we go into the next couple of days. we're mostly dry today but there will be another storm system moving in for the middle of the week. that gets here tuesday night

into wednesday, but we'll also have some subtropical moisture in the region, and that's going to enhance our rainfall, as we go into wednesday, especially. so starting out this morning in santa teresa, upper 30s as you head out the door and going to see some low to mid-50s already by noon, and then as we time out our rain, what to expect our hour by hour outlook spotty rain developing for today but most of us won't see it and dry for tomorrow, but as we get ready for the next storm moving in on tuesday night into early wednesday, it becomes more widespread on wednesday and continues throughout much of the day. that's the next storm system i'll be watching that could bring us a couple of inches of rain in parts of the bay area, especially for tan to the north. our seven-day forecast also shows the gusty winds that will be here on wednesday, moving out by thursday, and more rain on the way again this weekend. heading over to mike, you were seeing what's happening at the

bay bridge? >> that's right, kari. we had this backup that formed and we typically see a few cars waiting because of the cash lanes, they're not all open. we may be seeing more cars as well because some folks might avoid taking b.a.r.t. and decided to drive on the first day when b.a.r.t. isn't starting trains until 5:00 a.m.. pete suratos continues to follow this story. remember we have early bird bus service. the bridges are going on right now through 5:30. b.a.r.t. trains start at 5:00 because of that trans bay tunnel work going on for the next three and a half years so that will disrupt some of people's patterns in the morning. sf mta and muni and ac transit are working extra for buses and no problem for the capital corridor train any issues aroun the bay. there was an earlier crash on 680 at stone valley that's on the shoulder. people thought it was a power pole down on the shoulder at kirker pass road. it's at&t, so no live wires, that's good news and an easy drive throughout the north bay,

so there are no major problems. there is the san mateo bridge, and this is the lightest we're going to see it for the morning commute. back to you. >> thanks, mike. right now, richmond-san rafael bridge traffic is flowing thanks to a temporary repair completed friday night, but a temporary fix will have to wait. last thursday, you may remember chunks of fallen concrete closed the bridge. this is video of crews working to repair bridge expansion joint. cal transwa wanted the repairs done this week but there's rain in the forecast so they decided to wait until next monday. it will take place mostly overnight to minimize traffic impact and may take ten nights to finish. governor gavin newsom will deliver his first state of the state address tomorrow, the peach have take place in the capitol before a joint session of the california state legislature. the newly-elected governor also expected to withdraw several hundred national guard troops from the state's southern border with mexico. newsom is calling for increased spending on education and homelessness.

the governor wants more than $300 million to clear dry brush in heavily-wooded areas as part of a plan to combat california's wildfire problem. this story not so much of a catfight as a fight over a beloved cat. a group of san francisco firefighters say that the city wants to take her away today. edna showed up at their bay shore firehouse four years ago kitten. they say someone recently issued an anonymous complaint with the city, and they were told that edna has to go. so firefighters are using social media to help keep her where she is. so far, the city has not shown a willingness to budge. happening today, if you are looking for something to do and you love golf, may have the answer for you. check out two of the world's best golfers for free, over at more weather issues caused lengthy delays during yesterday's final round of pebble beach pro-am. imagine trying to play on that. a lot of hail out there. most everyone, though, managed to finish, but the final two
