[sfx: victory song plays] yes! this is the good stuff™ we are preparing for storms as parts of th welcome to tuesday morning. already february 12th. a live look at our radar right now. we're preparing for some storms to hit later tonight. parts of the bay area will be under that flash flood watch as well. storm could bring a lot of rainfall. preparing for that. good morning to you and thanks for joining us. i'm laura garcia. >> and i'm marcus washington. mike will have a look at the commute in a bit. first we want to talk about the rain coming our way. we have to be prepared for that. >> today is the day to clean out the storm drains and also get ready for the rain that will become more widespread for tonight. here is a look at storm ranger, we can see that there's some light, spotty sprinkles off the coast, and that may move into

the north bay while the rest of the bay area sees an increase in cloud cover, and this is a fairly large storm, and tapping into some subtropical moisture, meaning that we will see a lot of extra rainfall, as a result. so here's what we're expecting, anywhere from one to five inches of rain, and that five inches will be in our hills along the coast as well. watches likely will start tonight and wind speeds up to 50 miles per hour or more and there will also be some scattered thunder and maybe thunderstorms at snow levels near 7,000 feet. more details on that and what to expect and mike, you're getting us out there on the roads. seems quiet. >> pretty quiet. the crash in oakland hasn't yielded any slowing. tracking for details 808 south on 23rd. peninsula airport boulevard in this area, reports of a possible crash there as well for 101 south. we don't see any slowing there. chp is not even on scene. we'll track that. getting over toward that richmond-san rafael bridge, the speed sensors show green and behind me, you show why. there's no problem and not a lot

of traffic. we'll track your commute as it builds. back to you. >> thank you very much, mike. back to the storm threat we've been talking about, closely watching our bay area's reservoirs, as more heavy rain is about to move in. many are either full or nearly full and that could mean the possibility of overflows. "today in the bay's" kris sanchez joins us live in los gatos this morning. kris? >> reporter: hi there, laura. this morning the cold is the story for us out here at lexington reservoir. we know by tonight we could be talking about reservoirs that are spilling over their banks. this is lexington reservoir, this is not one of the ones that's under risk of overflowing but uvas reservoir down in morgan hill is. let's show you video of the last time we were there. it was at capacity, even before the rains are starting to roll in tonight. the thousand trails campground was evacuated as a precaution in the last week or so, though the flooding, the water districts said there's no imminent flooding. there was concern there would be a bridge impassable.

almaden reservoir is nearing capacity, and as is vasona. by daylight, people have been seeing that sight water over the spillway, which the santa clara valley water district says is normal ahead of the storm. that may happen at almaden, one of the smaller reservoirs in the ten-reservoir system. here is where some of the valley water's reservoirs stand right now. vasona at 95% plus. uvas is over 100%. lexington is 74% at capacity. stevens creek one of the smaller ones is at nearly 80% capacity. almaden is at 89% capacity. notice we say capacity and not full, because some of the reservoirs in the district cannot be filled to 100%, because they are not seismically sound for that capacity. we are going to continue to watch the reservoir levels for you. we know they are likely to change drastically by tomorrow morning. in los gatos, kris sanchez, "today in the bay." >> should get a lot of rain there. thanks so much, kris. breaking news for you,

before we get to that? >> we want to tell you, download our free weather app and the radar we use here in our studio, you can have it there in the palm of your hand as this big storm is approaching. a fire in contra costa county burned down two buildings overnight, and sent one man scrambling for his life. >> "today in the bay's" bob redell joins us live in antioch this morning. do we know how that man is doing, bob? >> reporter: we believe he's going to be okay, laura and marcus. the fire took place behind me. you can see the firefighters actually just wrapping up the arson investigators trying to determine a cause. right now they don't think there's anything suspicious. it took place on the back of this property here on walnut avenue, this is a small neighborhood not far from highway 4 in hillcrest here in antioch. the fire started 4:12 this morning in a modified workshop, a building out in the back. it burned through that, and then it spread through a modified two-story structure, also back there, described as a clubhouse or an outbuilding, and there was

a man who was asleep in there. he was able to get out, but looks like he did hurt his knee. first responders took care of him on the scene. he's expected to be okay. one of the challenges for the fire department, no water hydrants here on scene, so the fire crews had to call in water tenders, basically big trucks with water to bring water into the neighborhood to put the fire out. you have this house in the front, that house is fine but there are some structures in the back and it's those two structures that were destroyed. reporting live here in antioch, ready read bob redell, "today in the bay." >> 5:05 for you. on capitol hill lawmakers reach a potential deal to avert a government shutdown. president trump will possibly sign off on a deal as we await the news of its approval. miles of steel slats and other fencing, not a concrete wall at the border, restricted mostly to the rio grande valley, plus $1.7 billion to homeland security for other measures like technology and more agents. >> we believe this will open the government. >> there's not a single one of us that's going to get every single thing we want, but nobody does. >> reporter: president trump apparently not yet briefed at a rally last night. he told the crowd -- >> i will never sign a bill that forces the mass release of violent criminals into our country. >> reporter: the issue, space to detain immigrants arrested at the border. democrats reportedly backed off their demand for less space, agreeing to just over 40,000 beds, a gradual decrease from what was planned for this year but significantly less than the president wanted. >> reducing bed spaces for violent offenders in return for

more border wall funding is a bad deal. it's a dangerous deal. >> we want sufficient beds that criminals could be taken off the street. >> reporter: now the big question, will the president sign off? he had said he would, if democrats and republicans agreed. tracie potts, nbc news, washington. lawmakers may have a deal, but the city of san jose isn't taking any chances. today, city council will finalize another loan assistance program for federal workers in case the government shuts down again. during the first shutdown, the council voted to create the loan program to keep about 500 federal workers on the job, mostly tsa workers at san jose international airport. mayor sam liccardo called it a moral obligation. the credit union will make a half million dollars available for low-interest, short-term loans. happening today, governor gavin newsom will deliver his first state of the state address. he is expected to talk about several topics including border

security. as we reported yesterday, he will withdraw national guard troops from the border. he's expected to address pg&e's future and wildfire prevention as well. you could also expect the governor to go after president trump. the speech will take place in the capitol before a joint session of the state legislature at 11:00 a.m. you can watch his speech on our midday newscast and we'll stream it live on our website, nbcbayarea.com. happening today at stanford, a symposium on sexual violence that includes a woman at the center of a scandal in virginia, involving virginia's lieutenant governor justin fairfax. dr. vanessa tyson accuses him of sexual assault in 2004 which he denies. she is currently attending stanford on a fellowship. tonight she'll speak at a symposium called "betrayal and courage in the age of me too." new details on a story we first brought you last week, 150,000 californians yet to get

their renewed drivers licenses. this morning the dmv says the licenses should be arriving soon as we've been reporting. the dmv made an error while processing online or mail renewal requests which led to people not getting their licenses at all. dmv workers say it was powered through the weekend and they tried to power up the system through the weekend to process all those requests. there's also an online portal for people to check the status of their licenses. 5:09. a follow-up now on an ongoing fight to save three struggling hospitals in santa clara county. the county wants to buy them but now we're learning nurses are taking a stand about this, and talking about striking. the gilroy dispatch reports nurses from o'connor and saint louise hospitals will ask county supervisors to recognize their union, california nurses association, or cna, as their rightful representation. another union already represents county nurses. cna says if its demands aren't met, nurses will strike after

the sale, which has been tied up in court. the state is trying to block the sale, to get guarantees for certain services. a case surrounding a secret recording there, a planned parenthood workers, those names of those allegedly targeted will remain sealed. maybe you remember that story, in 2017, two pro-life activists were accused of shooting undercover videos as they tried to buy fetal material. the trial is scheduled for april. the judge yesterday agreed to keep all planned parenthood names sealed because some of them have since received threats. two vallejo dogs may have to be euthanized after they got into a farm, mauling animals. three alpacas were killed. sheep and goats were injured. the husky mix dogs dug their way under a fence at loma vista farm last friday. >> it's equivalent to losing a beloved family pet but in this

case it's at school, where we know it's supposed to be a safe place. >> the dogs had caused trouble at the farm before, but they say nothing like this. animal control identified the owners through the dog's microchips. they may be liable for veterinary bills and other expenses. to learn more about how you can help the farm, head to our website, nbcbayarea.com. >> 5:11. a follow-up now, palo alto is scrapping a downtown office camp according to "the palo alto weekly" city council voted to do away with the law setting a limit of 350,000 square feet on new nonresidential space. several councilmembers have long complained about the impacts of downtown's new office developments. dozens submitted emails and attended the meeting, urging the council to keep the cap. right now, winter weather causing crashes and knocking out power on the west coast, and washington, state cameras were rolling as an suv hit a patch of ice and it went sliding along. heavy snow proved too much for the awnings at an olympia dock

collapsing on the boats as well. look at this, slipping and sliding all over the road. that's frightening. pg&e actually expects power to be restored to most customers very soon. in honolulu, crews are cleaning up this morning, following a powerful winter storm there. several trees were down, a result of the high winds that they had. the storm also dumped snow actually in the higher elevations in the usually balmy normally tropical island of maui. pretty amazing to see there. >> they were seeing that as a record for the possibly lowest elevation of snow they've had in that area. as we get a look at what's happening here, we are starting out with some quiet weather, already a lot of people up and out on the roads, and we no he th know are preparing for the storm that was affecting hawaii to move into the bay area. we are going to see temperatures starting out in the upper 30s and as we go throughout the day our temperatures stay cool, only some low 50s. more on the storm coming up, and

it sounds as if congress has made a deal to keep the government from closing, but we have to hear from the president, see if he likes it. i think wall street may pause to wait for that. latest data from an industry group shows that sales of iphones in china have fallen 20%. apple hasn't confirmed that number. keep an eye on apple stock. amazon is back in the news, it's going to buy eero which makes the little devices to spread wifi around your house. hats off to nick weaver there, the founder, we're guessing that deal is well north of $100 million. meanwhile, shoppers at whole foods reporting prices are going back up. you remember amazon cut prices when it bought the grocery chain. the "wall street journal" got a look at internal memos at whole foods confirm the chain raised prices on 550 different items. remember john mcafee, the eccentric in millionaire who

deep, they always slip. >> interesting. >> interesting. >> all right. so getting ready to head out on your workout this morning, as we start out, here is a live look outside in san francisco, starting out nice and quiet, good day to get outside, but it will still be cool, and as you head out the door, headed to work, your morning drive from pittsburg will be in the upper 30s. it is going to once again starting out in the 30s, another cold start, with well below normal temperatures, and we will see more clouds moving in, so it will be slow to warm up, and all those clouds ahead of our next storm system and even some light rain picked up on storm ranger, wouldn't be surprised to see some of that moving into the north bay but that's not the main storm. the bigger storm is starting to roll in, moving closer. we can see the swirl of the clouds and an area of low pressure moving from the north connecting with some subtropical moisture connecting all the way back to hawaii. so as that moves in, it will enhance the rainfall that we'll see and also give us some gusty

winds. looking at the rain that will start out once again in the north bay, later on this afternoon, into the evening hours, but getting heavier later on tonight, by 10:00 to 11:00 that rain moving across parts of the bay area, and then continuing through the overnight hours into the morning commute tomorrow that looks very treacherous for parts of the bay area. now, we are going to see that rain continue through thursday, and then gradually tapering off, but want to show you what one computer model is putting down in terms of our rainfall. the possibility of getting anywhere from two to over five inches of rain in parts of the north bay, so north bay will get quite a bit, and this will be also a higher elevation storm for the sierra, but still looks to bring some significant totals on top of what we've already seen there recently. looking at some gusty winds, and also some heavy rain tomorrow, continuing through thursday, tapering off on friday. saturday is dry. sunday more rain, and then dry again on monday. so still a lot going on. and mike, are you saying the roads are moving pretty well? >> moving pretty well for the

roadway sensors at least. we're seeing green, a little bit of slowing out of the altamont and a tad bit for 84 and that's really the only change over the last few minutes aside from the bay bridge toll plaza. we've seen slowing out of the berkeley curve and up the incline. at the toll plaza itself, we have seen a good number of cars building up over the last ten minutes, and they probably have the metering lights turned on right now. over the last few minutes we saw a burst of traffic coming through the area. remember, b.a.r.t. trains started to run at 5:00 a.m. yesterday. instead of their 4:00 usual starting, yesterday we saw a lot more cars early at the bay bridge toll plaza, and we might have seen that again today as folks continue to adjust. early bird bus service taking over, and that should end at about 5:30, when typical b.a.r.t. service will be online in full over there. there is the peninsula, a smooth, easy drive, light on this side of the bay. back to you. >> thanks, mike. coming up, a story about a man in prison for nearly two decades for a murder he did not commit.

actor and singer "jussie smollett" is handing over welcome back to "today in the bay." it's 5:26. actor and singer jussie smollett is handing over redacted phone records to chicago police, coming nearly two weeks after he said he was a victim of a hate crime in that city. smollett, who grew up in santa rosa, says two men attacked him. police plan to use the phone records to corroborate the time line of the alleged attack. it was not immediately clear why

the call log was redacted. this morning, after 19 years behind bars, a new york man convicted for his mother's murder is being cleared of all charges. huey burden was charged when he was just 16 years old. last month a judge vacate the conviction due to findings detectives coerced burden into falsely up lly confessing. today he sits down with craig melvin to speak about the experience. >> at 16, i had never before that never been in the back of a police car, let alone a precinct, being questioned about a murder. and also i was always taught by my parents, my mother in particular, to trust law enforcement. and whatever they, you know, whatever they say. >> you can watch that full interview ahead on the "today" show, that starts at 7:00, right after our broadcast. coming up, we're following

look at our radar storm ranger is tracking the coming rain. later today, a flash flood warning for parts of the bay area. we're timing out that storm that could bring a lot of rain and powerful winds. good morning to you. thanks so much for starting your day with "today in the bay." i'm marcus washington. >> and i'm laura garcia. let's head straight on over to kari right now, watching the storm that's going to hit later tonight. >> later tonight, so we do have some time to get out there, get things done today, and try to wrap up any loose ends with clearing up around the house, and clearing the storm drains before this storm arrives. as we take a live look outside in san jose this morning, heading over to sunnyvale, now normally we're up to 62 degrees but we're going to stay well below that today. more clouds moving in, and a very chilly start. here's what to expect as that storm moves in, the potential of one to five inches of rain. also a high flood risk, some high winds and also some thunderstorms. we'll talk about all of these factors that we'll have to deal with, headed into the weekend, coming up, and mike, you're starting to see the build at the bay bridge. >> i am. the lanes are full and the metering lights turned on during

the last report just as we talked about. all the folks are filling in, all those cash and fast track lanes, all the way back from the 880 overcrossing. the berkeley curve slows a little bit but this is not bad for a tuesday, combined with the fact that we talked about the early trains, the early b.a.r.t. changes cause more folks to hit the roadway but today we're seeing kind of a regular tuesday. around the rest of the bay, a smooth flow of traffic. we'll zoom in more next report. back to you. >> thanks, mike. breaking news to tell you about, a fire in contra costa county burns down two structures overnight. "today in the bay's" bob redell live for us in antioch, and bob, some unique challenges for firefighters this morning. >> reporter: a big problem. they don't have fire hydrants in the neighborhood, a small neighborhood off hill crest and highway 4 in antioch, the fire taking place in the back of this property here, so what the contra costa county fire protection district had to do is bring in water tenders to extinguish this fire that started around 12:30 this morning. take a look at the video, you

could see it started, it's hard to see but there is a bunch of outbuildings in the back and it started in a modified workshop and then it spread from there to a modified two-story structure that the fire department describes as a clubhouse. now, inside that clubhouse, there was a man who was living in there. he was able to get out on his own, and from some of the video we took a look at, it looked like he hurt his knee or something so the first responders were able to take care of him on the scene but we understand that he is okay, but the fire destroyed that workshop and two-story clubhouse but it did not spread to other structures or the actual house in the front part of this property. as far as the cause, i did speak with the arson investigator out here. he does not believe there was anything suspicious, that this was an accident. reporting live in antioch, bob redell, "today in the bay." >> tough morning, thank you for the update. authorities in the central valley are hoping the mother of a newborn found in the middle of the street will come forward.

newspaper deliveryman found that little girl early in the morning. >> i heard the baby crying and screaming. i was like, okay, you know, this is a baby. i got to get out there. >> that's arielio fuentes who found the baby in madeira. it was 30 degrees out. he stayed with the baby until paramedics arrived. the little girl is said to be healthy and at a local hospital. the search for that mother continues. >> 5:34 right now. a north bay school district will decide if it's time to change its name, it comes after months of debate whether the name is offensive. "today in the bay's"s. s. i pete suratos joins us live at miller creek in san rafael where the vote will take place. >> reporter: good morning to you, laura and we're talking about dixie school district in north san rafael and it could have a new name soon and of course when you hear that name, the heart of this controversy is the word "dixie," which some folks in the community believe

is racist and that's why they want a name change. so let's explain what's going to happen today when it comes to this vote. you're going to have the board of trustees voting on this issue. they'll hold a special meeting here at miller creek middle school in san rafael, where we're standing. they'll vote on whether or not to change the name based on the name submit bid a group of petitioners just last month. those names have been reviewed by the lorraine county elections department and meet all the legal requirements to move forward on this vote tonight. the 13 names all together will be considered and some of the proposed names include big rock, john muir, and skywalker, just a few of the names being considered. the group calling for a name change say the dixie name is named after the confederacy during the civil war and that's enough reason to change the name. however, those who want to keep the name claim it was named after a mewak indian woman named dixie. there is high profile support for the name change including

the naacp, congressman jared huffman and marin county superintendent of schools. only one board member publicly supported the name change. the meeting is tonight at 5:30 p.m. pete surat. pete suratos for "today in the bay." >> thank you. continuing coverage of the case surrounding the ghostship warehouse fire. a judge shoots down a legal bid to charge more people. attorneys for derek almena and max harris tried to force a citizens arrest for the fire that killed 36 people. among the list, the the building's landlord and her children who acted as building managers. while the judge denied yesterday's bid, pointing out she lacked power to charge anyone, she admitted to being intrigued by the motion. >> 5:36. protesters in redwood city last night tried to send a message to san mateo county supervisors ahead of their study

session on the use of tasers, this comes on the heels of four deaths last year tied in part to law enforcement's use of tasers. chinduokobi died after being tased last october. investigators say okobi assaulted a deputy who responded to reports he was running in and out of traffic. his sister believes deputies went too far. >> we want to see police officers there's accountability when they don't follow procedures. we want to see transparency. >> the tasers are definitely a tool that we appreciate and value here at the san mateo county sheriff's office. the majority of the time they are safe. >> an outside investigator is now looking into the case. okobi's family hired noted civil rights attorney john burris. we're still seven weeks away from the nhl playoffs, but the san jose sharks right now are on a big-time roll. >> last night they won their sixth straight game, including the last four on the road against vancouver. evander kane scored two goals as

it comes to passenger traffic. more than 14 million people traveled through the airport last year, a record nearly 15% increase in fact from 2017. san jose's now the number two most traveled airport in the bay area. sfo of course the leader serving more than 50 million passengers yearly. a major development going up in downtown l.a. construction officially under way on the grand avenue project across from walt disney concert hall. this is a look at the finished development, what it will look like at least. the project is heavily focused on art. a new art museum and departments, restaurants and shops, expected to create 10,000 jobs as well. the opening date is 2021. l.a. mayor eric garcetti is ditching plans to rebuild three natural gas power plants which would have cost billions. the mayor says instead the city will focus on renewable energy sources. this is a big win for environmental groups, but the city's department of water and power was backing the building

and the plants saying they were critical. all the rain we've been getting has helped to keep more trees in california alive and healthy. centr a new survey found 18 million trees died in 2018 compared to the 27 million the year before. but officials worn there are plenty of dead trees out there which increases the risk of wildfires in the central and southern sierra nevada regions. the survey found 147 million trees died during the drought which lasted from 2010 to 2017. 5:45 right now. there is a deal on the table that would keep the government open. >> but will the president say okay on this one, scott? >> we're watching twitter. the president got back to the white house, laura, very late last night, past 2:00 a.m., after a big rally in el paso, texas, last night. there the president once again pushed for his wall and repeated the claim that a border fence erected at the border in el paso led to lower crime there. he insists that's true.

today and warm. we are going to see some cool temperatures as the rain starts to move in, already some spotty, light showers farther to the north, and that's where we can also see some showers moving in initially, but the brunt of the storm gets here tonight, all of the bay area picking up on some rain, as this area of low pressure dips down to the south. it draws in some sub tropical moisture connecting all the way back toward hawaii, and that will enhance the rainfall, also increase those winds as we go into tonight, so we will have a high wind watch in effect for the coast and the hills. the darker shades indicates where we could have gusts potentially reaching 70 miles per hour, and then for the valleys, our gusts may reach up to 45 miles per hour, so you should be prepared for power outages and also some downed trees. we also will have a flash flood watch in effect that starts at 10:00 p.m., and goes until 10:00 a.m. on thursday. a lot to watch here, as we start to see the rain increasing. by 3:30, we could start to see light showers moving in, but heavy rain by 10:00 to 11:00,

continuing off and on throughout tonight, as well as pretty much all day tomorrow, and then starting to taper off on thursday. our winds will be gusty, and then starting to calm as we go into thursday morning, but still some lingering showers. by saturday, we get a brief break to dry out from all of that heavy rain, before we get some more scattered showers on sunday. i'll be watching all of this for you with more updates and headed over to mike, you're tracking the morning commutes. >> that's right, kari. we have a new crash reported on the bay bridge, here but it's eastbound, the lower deck approaching treasure island. sounds like everything is out of the lanes. we don't see slowing eastbound counter commute. the backup at the bay bridge toll plaza formed early but this being a tuesday this is great as mild slowing up the incline, this is 5:50 so not bad. contra costa moves slowly through the area and the rest of the bay a smooth flow of traffic in the south bay.

doctors will expand care to five days a week in august. 5:56. new this morning, tesla responding to allegations that a car while on autopilot veered into a ditch, that's what the driver says happened this weekend in new jersey. he told police his model x was in autopilot road but crashed. the driver tried to regain control of the vehicle but it wouldn't let him. police say they have no reason not to believe him. here is reaction from other tesla drivers. >> i've experienced it once. it's kind of freaky when it takes over, and you can let it autonomously function, but i think that it may also lead to distraction to the driver who is not going to pay attention. >> tesla says the autopilot mode does not make a car autonomous, calling it an advanced driver assistance system that requires the driver to pay attention. there's also says a driver can easily override too pilot by lightly touching the steering wheel or brakes. driver deception, it appears a scheme to sell fake ride share

accounts is widening. >> last fall our investigative unit first exposed a black market ploy allowing people to bypass background checks required by ride hailing companies. they still got behind the wheel. now investigative reporter liz wagner uncovered more people being taken for a ride and why most police departments she says aren't doing anything about it. >> we recently rented two ride share accounts being sold in online chat rooms after we first uncovered the scheme last year. we never drove, but the app history shows in just a few weeks, one of the accounts wracked up more than 200 rides across the bay area. account sharing or driver using someone else's ride share app can be difficult for passengers to detect. airport police are cracking down. take a look at this body cam video from los angeles international, where an officer confronts a driver. >> i'm only going on what i see right here, right now. you're not authorized to drive under this account. >> turns out not all police agencies are focused on ride
