"today in the bay" continues now. a very good friday morning to you. thanks so much for joining us. 5:00 right now. i'm laura garcia. >> and i'm marcus washington. mike is going to get a look at that commute for you in a bit. first we want to talk to meteorologist kari hall about the weather. it seems like it's not as bad as yesterday. >> not as bad as yesterday but it's still raining and we are going to still have the waves of showers coming through and may be heavy at times. here is a look at storm ranger as you get ready to head out this morning, overall very light. that's the good news. we have some rain coming down in

san francisco, and then extending over toward oakland and berkeley, so it is still raining there and the roads are very wet. now, as we get a look at the wider view, if you're planning to travel, it is still going to be unsettled, and some heavy sierra snow coming down, if you're planning to travel there, heads up, it may be closed in some spots, some of those roads. headed toward concord, upper 40s this morning. a cool day with still the need for an umbrella. mike, you still have one highway that's flooded. >> that's right, kari, and we also have mud that caused a closure for highway 9 into and out of lahonda. the roadway most recently closed because of flooding in the north bay, westbound highway 37 is your commute direction for a north bay commute, hot spot here as you travel from vallejo, you'll be forced off the freeway at atherton avenue. it takes you directly to highway

101, today being a pre-holiday weekend, this friday might see a lighter flow of traffic but you'll see slowing. we'll track that and i'll give you another alternate coming up. back to you. there is breaking weather coverage we're tracking, rivers across the bay area, the russian river in guerneville has crested. the water is about flood stage. >> "today in the bay's"s. sps alive along the water. have you seen the water recede at all? >> reporter: good morning to you, marcus and laura. actually, the water has gone down just a little bit since we've been out here but still you're getting a good amount of flooding because of the russian river cresting, as kari just mentioned, all morning long, just a few feet above flood stage. here a couple years ago if our viewers recall the golf and arcade. the area is prone to flooding. there is flooding here as a result of the russian river cresting. it is a little bit lower than it was earlier, not too long ago but still you could see the area flooded, so it will be a

headache for folks trying to get around here this morning. i wanted to show you video, this is what we showed you at the top of the river road, where you have homes, seeing some of that floodwater from the russian river making it onto the first floor of those homes. now i want to point out sonoma county sheriff's department issued an advisory for folks to evacuate if they are in low-lying areas along the russian river, which is where those homes are. now, i want to point out, too, many of the homes in this area have been raised or put on stilts because they are customed to the flooding in this area and how they're preparing but still, you're seeing the flooding, you're seeing these roads turn into rivers and you're going to see folks later on today using canoes just to get around. now here is what one home own her to say about the conditions here, back in 2017. >> almost three feet, right about up it-to-here. >> trying to secure as many thing as we can. all our rv tenants have left and gone to higher ground. there's not a lot you can do.

>> reporter: take you guys back out here live to guerneville on drake road, where you're seeing flooding from that russian river and also want to remind folks, the sheriff's department says to use caution driving around the flooded roads. clearly this is a problem for folks throughout the day. we're live in guerneville, pete suratos for "today in the bay." >> a lot going on there. thanks for the update. 5:04 right now. in gilroy, another dangerous mess. water spilling over from uvas creek, at silva's crossing by christmas hill park, where they always have the annual garlic gilroy festival. silva's crossing looks more like a river than a place to cross right now. happening now, a man is in the hospital, following an overnight crash in san jose. this is video new to us from that scene just into our newsroom, and that crash happened on southbound highway 85 near deanza boulevard. emergency crews working to help that injured man. it was raining at the time and not yet clear what caused the crash, but the chp is

investigating it as a possible dui crash. the highway is back open this morning. and we have much more online, including this video, an ac transit passenger took while riding the bus in oakland. a very wet ride for them, where water is getting inside the bus, while the driver is trying to cross a flooded street. head to nbcbayarea.com to see more. this morning, a u.p.s. driver is safe after being being held hostage. the scene is cleared, this is exclusive video. the driver shaken up but certainly unharmed. the standoff lasted for nearly two hours last night. the gunman, mark moraski was in the front passenger seat of the u.p.s. truck with a shotgun. tactical officers moved in to eventually end that standoff where he ran and was shot. moraski died on the scene. deputies chased him as he drove a stolen black suv. during that chase he shot at

him. 5:05 right now. the government shutdown will not shut down today. president trump plans to sign a budget deal congress approved last night. he also plans to declare a national emergency at the border. "today in the bay's" tracie potts breaks down how the president plans to pay for this wall. >> reporter: the federal government will not shut down today. president trump announces this morning he is signing off on the budget compromise congress approved last night. and as promised e he's adding to it, declaring a national emergency to build a border wall. >> i think he has all the legal authority in the world to do this, and i'll stand behind him. >> reporter: so will the senate's top republican. he had opposed it. >> i'm going to support the national emergency declaration. >> reporter: democrats call it a gross abuse of power, they may sue. they argue there's no emergency, because illegal border crossings have been going down for years. >> we will not have an enron

around the congress of the united states. >> reporter: some republicans are concerned the emergency declaration sets a bad precedent. >> i think it will be aer itish idea. >> reporter: in addition to the budget deal, president trump plans to build the wall with $600 million from a treasury department drug fund, $2.5 billion from a pentagon drug program, and $3.5 billion in pentagon construction funds, some of that money was earmarked to rebuild puerto rico, after hurricane maria. the island's governor tweets "is it now puerto rico and california, american citizens that, will pay for the wall? if this is the case, we'll see you in court." tracie potts, nbc news, washington. >> as scott mcgrew grows even more in-depth on the deal, he'll have more on his checks and balances segment coming up in 40 minutes. happening today, oroville dam officials head to court in sacramento, the fight over the spillway which you can see in the time lapse video is still under construction, work expected to last until spring.

it comes two years after 188,000 people living nearby were all ordered to evacuate due to the fear that the damaged dam would fail. it really created a lot of chaos with everyone trying to move out of that area. now in just a few hours, a judge will decide whether or not to dismiss portions of a lawsuit over the spillway crisis. it was filed by the city of oroville, several farms, businesses, and other plaintiffs involved. the city alleges petty theft by department employees and conspiracy to cover up or destroy documents. i want to check in with kari hall because the rain we're getting now is what led to all the problems back at this dam in 2017. >> yeah, we had rain after rain, and waves of it coming through and we are seeing the same conditions now. luckily, we are still not seeing any problems like that as of yet. as we get a look at storm ranger and our radar showing still some rain, as you head out this

morning, and also the water that may be covering the roads, we've also seen our reservoirs across the bay area running at or above capacity at times. so we are still going to have some rain throughout the day. here is a live look outside in palo alto, before you head out the door, you still need the umbrella. we are going to see the potential of some showers, not only this morning, but continuing into the afternoon, and temperatures will not warm up much from where we are now. we'll talk about what else is going on today, and the forecast for the weekend coming up. mike has a look at the morning commute. >> and overall, kari, being friday morning we expect this lighter flow, which we see. we have a couple trouble spots, mud blocking part of highway 9, multiple parts, typical as we continue to follow those closures in the south bay. but this has been happening since last night. westbound highway 37 is closed at atherton avenue because of flooding. novato pd are hoping to have westbound lanes open by 8:00 a.m. that could be good for the

right now at 5:13, it's time to get you ready to head to the sierra for the weekend and it has been a great season for squaw valley and alpine meadows. we are seeing a season total of 408 inches, and there's more snow in the forecast throughout the weekend. today you've got 33 lifts and 29 runs. we will see some more snow. here is a look at the current radar. it's snowing right now. so bring the tire chains and also keep up-to-date on the road information. we'll get a look at our rain as

it continues to move through the bay area, coming up in less than five minutes. and we're looking at the nimitz in oakland. everything is moving smoothly, southbound with the headlights, we did have a crash at davis, but it cleared pretty quickly through san leandro. we're tracking the closure in the north bay. and a very happy friday to you. we expected better numbers on the markets, but then we got the latest retail numbers. they were fairly grim. u.s./china talks ended in beijing but will apparently restart in washington next week. you heard that amazon is pulling out of its plan to build a headquarters in new york city, and "the washington post" reports the ftc is this close to slapping a massive fine on facebook. facebook also under fire for allowing anti-vaccination posts and ads on its service, youtube as well. california congressman adam schiff wrote a letter to facebook and google-owned youtube asking why they allow

false information about vaccines on their site. schiff says there's strong evidence medically inaccurate information about vaccines surface on your websites. now they've taken some steps to stop the spread of false information. youtube has stopped recommending anti-vaccination video. facebook says it will "explore minimizing harm caused by misinformation about vaccines." here is a straightforward reminder for you. vaccines do not cause autism, and the person who made that original claim lost his medical license. in other news, the california dmv released the latest numbers about autonomous cars. lots of numbers. bottom line is, there are a lot more cars out there driving four times as many miles compared to last year, and weimo cars drove 1.3 million miles total, compared to 353,000 last year so

you see how the number is accelerating. the average waymo car was able to drive 11,000 miles before the driver had to intervene, what they call disengagement. waymo cars able to go about 11,000 miles before the human safety driver had to take over. you see how far ahead they were from gm cruise, which, to be fair, tests its cars in san francisco and not mountain view and the city is harder for robots and zoox startup trails behind that. apples to oranges, but in zoox's case they had to take over about every 2,000 miles. if you think of these as potential accidents, human beings can go roughly 300,000 to 400,000 miles before having an accident, so a little bit apples and oranges, but clearly they are nowhere near as good as people. they're not even in the same universe as people. >> right. literally. >> yet. >> and figuratively. >> yet. >> thanks a lot. 5:16 right now. this weekend is all about the king of rock 'n' roll.

radar and you see those rain drops sticking around for a bit. kari, this is something that we're going to see off and on throughout the day. >> off and on throughout the day. we had several inches of rain, downed trees yesterday, and also the possibility of mudslides and that still continues today. we know the hillsides will remain a little bit unstable, and then we were also tracking the ga wuadalupe river levels t ten feet. yesterday we were watching for the potential of flooding. it still has gone down quite a bit, but may still be running pretty fast, and may be dangerous to approach those areas. once again, the ground is very unstable, and we do still have some rain moving through. so as we go into the day, the rainfall totals may be adding up. we are seeing on our radar now that the rain is back in san francisco, and extending over toward oakland and also moving toward concord and san ramon, expect the rain to get going mostly some light rain within the next few minutes, but some of the heavier rain right now

around san mateo in the south city area. we're going to see it once again continuing, it's like doing this over and over again, day after day. it's like we're in groundhog day or something, seeing more waves of rain coming in. i want to talk to you about the reservoirs, and the capacity and the update that i have this morning. the uvas reservoir is now close to 104% of normal, so it's still very high, and then also the almaden reservoir at 104%. these other reservoirs are very close and at times going up to 100%, and it was a quick rise. yesterday the guadalupe river crested at about 5:00 in the morning but once again, running high and fast and we'll continue to monitor that, as more waves of heavy rain come in. here we are at 7:00, and still seeing some pockets of some showers moving through palo alto and continuing into parts of the north bay. off and on rain throughout the day, but you'll notice it will be a lot cooler, and the snow levels will be dropping across parts of our hills in the east

bay as well as the north bay. but additional rainfall totals may add up to be another half inch to an inch, and cool temperatures this morning, but don't forget the umbrella, as you head out for that morning commute, and you may have to turn the heater on along with the windshield wipers. watching out for low elevation snow for the weekend, spotty showers on sunday, but much of the activity will be winding down and looking dry at this time for presidents day. definitely great news there. headed over to mike, you've been tracking the roads. any issues out there? >> wet roadways clearly, kari. as you've been talking about, i continue to talk about the same slippery situation for the off-ramps. things are pretty calm right now on the roadways. we have green sensors for most of all of the bay, except for up here, this is a concern for your commute direction westbound 37, we continue to talk about the closure, as you are coming over from vallejo, forced off the highway over here toward atherton avenue, that will take to you 101, one of your alternates for the morning commute. novato police tweeted out saying

they hope to have the lanes open for highway 37 about 8:00. we'll track that and see the situation as it continues to evolve. that richmond to san rafael bridge right be another option for you traveling over out of the east bay. you can travel across that carquinez bridge down to this point and cross over in toward the north bay as an alternate to highway 37 as well. you see the little puddles here and that is a continued issue, slick roadways around the bay. be careful, watch for other debris that might have fallen overnight. b.a.r.t. has about 21 trains running on time and no delays for ferries or train systems either. back to you. >> thanks so much, mike. a federal budge is questioning pg&e's wildfire prevention plan. the new details coming up. plus rose actor jussie smollett back in the headlines this morning. what chicago police are saying about allegations the actor staged his own attack, which he called a hate crime. that's all coming up next. you're watching "today in the bay." a federal judge in san frao

is now questioni 5:24, and new for you this morning, a federal judge in san francisco is now questioning pg&e's plans to prevent wildfires. he says their intentions to clear vegetation and electrical power lines would take more than a decade to complete and now asking for the utility to respond to that question. pg&e submitted the plan to the puc last week. new detail this is morning, chicago police department is dismissing reports that actor and singer jussie smollett

morning, making for yet another wet, tough morning for us in that commute. >> you are so right, marcus. new video, rain overnight, this was from los gatos. ponding water out there. our poor little umbrellas are getting a workout these days but it is friday. good morning to you and thanks for joining us. i'm laura garcia. >> and i'm marcus washington. nbc bay area issuing the microclimate weather alert for you this morning through the storm system. we've been dealing with this for several days now, the heavy rain. >> we're feeling soggy, kari. >> we do, and we are watching out for flooding, and we could see still rising the russian river in guerneville. the overall trend is going down. we have rain in and around the area and seeing it mostly moving through parts of northern sonoma county and northern marin county in the next few minutes. san francisco toward contra

costa county picking up on rain and more showers moving through oakland, extending toward san ramon and concord pushing off to the east for hayward. we'll see waves of it coming through throughout the day. but there will also be breaks in between, so we're looking forward to that, as it may give that rain a chance to soak into the ground and keep it from standing on some of the roadways and rising creeks as well. so i'm watching all of this for you and talking about the weekend, more in a few minutes but the commute, mike, is light right now. >> it is because it's friday. we look at the bay bridge now starting to see some of the cash payers waiting in line a couple of minutes here. you see the wet roadway and kari showed you the radar activity across the san mateo bridge as well but no problems and no major slowing. green all over the bay, talking about slick roads. we have a closure for flooding west 37 over there. the alternate to 101 atherton so

that's good news. bob will talk about that in a couple of minutes. you've got a wider area we're focused on in the area as well. >> that is the breaking news we're covering this morning. the russian river is above flood stage, creating dangerous conditions for people near the water. >> "today in the bay's" pete suratos live out there now in guerneville. we've seen it behind you that water extremely high. >> reporter: that's right. good morning to you, marcus and laura. the water is high here as the flooding is taking place from the nearby russian river as the river crested a few feet into that flood stage. we're also getting a combination of that downpour. we had a good downpour not too long ago. the rain is coming down here in gue guerneville. this is arcade and golf, to give you an idea when this flooding how bad it is. it is right under the window area. we've seen it before, it was in that window sill area. right now it's under it but still it's flooding nonetheless so it's an issue throughout the

day. i want to take our viewers to some video we got from this morning on river road, this is near homes so you see that the flooding is impacting homes in that area, the low-lying areas. i want to point out the sonoma county sheriff's department issued an advisory for folks to evacuate if they're near the russian river. many of the homeowners made the decision to raise the homes, put them on stilts to avoid the flooding problems they've seen a number of years because of the area we're in. what you'll see later today is you're going to see folks using canoes to get around, because those roads are turning into rivers, because the russian river is flooding, you're seeing the stream of water on those roads. let's take you back out here live to see the situation out here in guerneville. we'll still be in the flood stage at least until about 10:00 a.m. so it's going to be a problem throughout the day, coming up at 6:00 a.m. we'll tell you guys what locals are saying about the conditions.

we're live here in guerneville, pete suratos for "today in the bay." >> the cleanup will be a long process. >> all that water. flooding forced the shutdown of a major commute route in the north bay. "today in the bay's" bob redell is live in novato along highway 37. i know that entire road closed or looks like part of it is open now? >> reporter: eastbound 37 has always been open. westbound 37 is shut down right now, and as you can see behind me it's diverted off of atherton avenue, by the park n ride, and this is in novato, because of flooding, and now the estimated time of the reopening of the westbound direction is at 8:00 this morning. initially chp was saying 7:30, they're now saying 8:00 so right now, that would take place in the middle of the morning commute. here is the reason why, from nbc bay area sky ranger yesterday's heavy rains flooded the fields north of highway 37 and caused a levee that contained the novato creek to break. the water eroded the foundation underneath a set of railroad

tracks. chp and cal trans initially shut down one lane of highway 37 westbound. drivers are upset because they thought recent work was going to prevent this from happening. >> they retrofitted it last year and fixed it, so it's going to be pretty hard. it's going to be pretty hard on us. so i think my reaction to it is, i'm a little disappointed. >> they raised the roadway, improved the drainage and that is holding and that is not the same thing we had happen out here today. >> reporter: to reiterate what chp is saying, the work they did on the road last year is not related to what's happening here. again, westbound 37 shut down here at atherton avenue behind me. there's a steady flow of commuters diverted to get back on to 101. the estimated time of reopening, 8:00 this morning. reporting live here in novato, bob redell, "today in the bay." >> thanks, bob. >> with all of that rain, ac transit answering some tough questions about driver and passenger safety this morning.

>> he's pointing the shotgun, he's getting down. oh no. get down! get down! get down! he's pointing the shotgun. okay, you're fine. he's opened the door. oh my god, he's running! he's running! he's running! >> janelle ear hen photographer who she was telling to get down took over. they are okay. police, however, shot and killed that suspect. nbc bay area's kris sanchez is live at first and trimble in san jose this morning. kris, i know you got the chance overnight to listen to some of the new recordings from police dispatchers. what did you hear? >> reporter: they seemed to confirm what friends of the suspect told nbc bay area out here last night, that that suspect did not think he was going to live through that standoff. >> copy, per the victim, the shotgun is loaded, unknown how many rounds the vehicle is running, but there are no keys. >> the suspect also said that he stated that he wanted to die

tonight. >> copy, suspect stated that he wanted to die tonight. >> reporter: now that suspect mark moraski was shot when he ran from the u.p.s. truck with the shotgun. moments before that, tactical officers moved in on the truck. i want to show you where this all started around 5:00 last night. on the map on your screen you'll see pearl and chynoweth. north first street and trimble is where it ended. the suspects led deputies on a chase first in a stolen suv, then in this that hijacked u.p.s. truck. the chase ended on north first street when the u.p.s. truck hit spike strips. a female accomplice was released and she was taken into custody, but it was hours before mark moraski released the u.p.s. driver. in that time, some of his friends gathered nearby and they say he was telling them good-bye. >> he was scared, he said "i love you, i'm in a standoff" and

now through company a7:00 and w rain coming through. we're not done with the rain yet. we'll talk about what's ahead for the weekend coming up in less than five minutes. >> we saw that rain hit the san mateo bridge and seeing it here on our oakland camera. we see the glow for the lights, the mist, the drizzle and the water kicking up. we were' talking about a slick drive here and farther north. and it's going to be a huge day in washington, as the president says he will declare a national emergency. but will it do what he wants it do? president trump says he'll sign a bipartisan deal to keep the government open but the white house says at the same time he will declare a national emergency, giving him the legal power to take money away from the defense department or other sources to build part of his wall, the wall congress won't give him. the house and senate yesterday passed a compromise funding bill, gives trump $1.3 billion for border fencing, far less

than the $5 billion he has demanded. mr. trump has the power to declare a national emergency, and in fact, presidents have declared them before. usually something to do with terrorism or sanctions, but congress also has the power to end them. congress can vote to revoke that declaration, and it sounds as if nancy pelosi will call for that vote. >> i know the republicans have some unease about it no matter what they say, because if the president can declare an emergency on something that he has created as an emergency, an illusion he wants to convey, just think of what a president with different values can present to the american people. >> if pelosi calls for a vote, it will put republicans in a very awkward position. they're going to have to go on record as to whether they support the president's move, and the senate will have to vote as well, in this case, a vote in the house forces a vote in the

>> you saw firefighters rescuing susan gordon live here on "today in the bay," if you joined us yesterday morning, pretty dramatic to see. it's a story we brought to you as breaking news. crews dug her out of the mud after her duplex slid down the hill onto an empty home. "today in the bay's" kira klapper joins us with more on how the community is coming together to help gordon. kira? >> laura and marcus, good morning. the 75-year-old gordon was buried for 20 minutes, her son says miraculously, she is going to be okay. this is video from our nbc bay area sky ranger yesterday morning. you can see the slide caused widespread damage, as gordon's duplex on sausalito boulevard came sliding down a hill onto a vacant home on crescent avenue. five cars were swept up in this one mudslide. no one else was hurt, but gordon's cat named peaches is still missing. right now, four buildings are still red tagged, with rain

still falling, as laura and marcus said, people who were able to return home are feeling anxious. >> and the hills are clearly saturated. i hope this is the end of the rain, because they really can't tolerate much more. >> you can see here that water continues to pour out of the mudslide grooves, creating new paths down the hillside. some homeowners are hoping sandbags will prevent more damage. meantime, a go fund me page has been set up for susan gordon, at last check this morning $20,000 had been raised. later today, fire crews will be back on scene to continue damage assessments. back to you guys. >> so concerning what happened to her. thanks a lot, kira. let's look at the why. this is the rain that continues to inundate the bay area. we've had such super soakers around here. so slick on those hillsides as well, and so now it's on and off throughout the weekend? >> yes, we're still going to see the waves of rain coming through and that will be the concern, as we go throughout the next 48 hours, and this rain is just not

letting up, and we are also dealing with some chilly temperatures, and that's also lowering some of the snow levels, and some of our north bay peaks as well as some of the east bay foothills as we are going to continue to see rain moving through. we're seeing some of the snow on mt. hamilton right now and also south san jose, as you get ready to head out. most of what we are seeing now is light. we will still have a chance of getting heavy pockets of rain through 7:00 to 8:00. we're seeing rain in the north bay, as well as the peninsula, and then rolling on through off and on today, some breaks in the sunshine, getting some sunshine at times, but then we're still not done with the rain, so even tonight into the day tomorrow, you do have to plan accordingly, as we could still see this rain coming through, and looking at additional rainfall totals, it could measure anywhere from half an inch to an inch on top of the several inches we've already gotten, and there will be some low elevation snow once again on our peaks and highs in the low 50s. cool temperatures next week, but
