it is - - - - - here is a live look outside -- good sunday morning to you. here is a live look outside at 7:00 a.m. at san pedro square in downtown san jose. wet roads right now. looks like a little break in the rain? good time to run out for a coffee, but not for the next 59 minutes. we hope you'll stick with us and watch the show. thanks so much for joining us. i'm kira klapper. vianey arana has a look at our microclimate forecast. you say similar to yesterday. >> yes, where we had that little bit of a break in the rain, and then the sun came out, and it seemed like everything was okay, and then the rain moved in again. that's what we're going to be seeing once again. 34 degrees in santa rosa, that's one of our coldest spots up through the north bay. napa 37 degrees. oakland 46 right now, as you

head out the door. san jose 42, morgan hill 40 degrees, and it's going to be another day with cool daytime highs, only topping out in those upper 40s, and low 50s. look at the radar, satellite radar, you could see we've still got plenty of shower activity moving through the area. our storm ranger has been up and scanning, but you can see a lot of it now kind of out but we still have a lot of instability, so if i zoom this in earlier, we had showers pushing in through walnut creek. it seems like everything is okay from san leandro, the hayward area as well, down through the south bay, things are starting to dry out quite nicely but look at how the santa cruz mountains are doing. we have a couple of cells moving in through there, light to moderate rain is actively falling at this time, and the winds are expected to also pick up, so i'll have a closer look at your long range outlook, how we're doing for the work week, coming up in 15 minutes. >> see you in 15, vianey, thanks. from the weather to an earthquake waking up parts of the bay area overnight. the usgs reports a magnitude 3.8

trembler struck near yountville just before 2:00 this morning. people as far away as san francisco and berkeley commented on our tweets that they felt the quake. as of this hour, no damage nor injuries have been reported. another fire ignited outside the tesla plant, the second in six months, it ignited around 8:30 last night. you could see the smoke from our fremont traffic camera. firefighters say the flames came from outside the plant, not inside, at a storage area containing hazardous waste. fire crews were able to move other materials in that area and isolate the fire. a hazmat team stayed on site, keeping an eye on things. you may recall back in august, another fire sparked outside tesla, this was the view from our nbc bay area sky ranger. some cardboard that was going to be recycled caught on fire. it threatened some nearby outbuildings at the time. fortunately, no one was hurt. as vianey was saying, as we anticipate more rain today, many people are still cleaning up, after this latest storm.

the sausalito city council will declare a state of emergency and hold a special meeting tomorrow morning, this after this massive mudslide sent homes sliding down a hill. the city hopes the declaration will get them financial help. meanwhile, residents remain evacuated from their red tagged homes. >> we have nothing. everything is still in our house. >> the slide destroyed two homes and temporarily buried a 75-year-old grandmother, miraculously leaving her with only minor injuries. marin county already is under a local state of emergency because of heavy storm damage. flooding forced the westbound lanes of highway 37 to be closed and heavy rains damaged this section of a freight railroad nearby. yesterday analysts analyzed for damage. to the south bay we go, where a huge chunk of this hillside came crashing down off

highway 9, blocking the entrance to savannah channel vineyards and forcing the tasting room to close. the road leads to at least two homes up above. here's another impact of this week's storms, downed trees all over the bay area. this redwood, for one, fell into a home in wood acre in west marin. the home has been red tagged. another redwood came crashing down yesterday morning in nicasio on lucas valley road. neighbors got their power turned back on just before the tree came down. >> we woke up probably really early around 5:00, 6:00, we heard a big crash, and we didn't know what that was about, and so the power was out completely, and it had just returned yesterday, and it had been out previously for about two days. >> thankfully, no one was hurt. to get weather updates while you're on the go, be sure to download our nbc bay area app. it is free. you can find out the impact on

your neighborhood, ahead of time. well, the clock is ticking. oakland teachers announced they officially have plans to go on strike this week. "today in the bay"ed bay's" ser quintana explains the details. >> reporter: surrounded by teachers a few parents and students the president of the oakland educators association announced the date when teacher also walk out. >> they have set the date of thursday, february 21st as a strike date. >> reporter: the teachers union has been pushing for three main issues. they want a 12% pay hike rolled out over three years, hoping the district can shrink class sizes and want oakland unified to hire nurses and counselors. parents at the conference support the strike and railed against outside influences who they say are pushing for charter schools and mandates that are costing the district >> my family stands on the side of teachers, and are asking

families to join and not cross the picket lines. >> it is unconscionable that being nairs from outside of the state can not only buy school board seats, influence state and county policy. >> reporter: almost immediately after the union announced plans for a thursday strike, oakland unified asked negotiators to return to the bargaining table. spokesman john sasaki says they still have several days to come to an agreement. >> we're hopeful that we can still sit down at the table and present to them what we have right now, which is a comprehensive proposal to avert a strike. >> this vote to go on strike comes as teach he weres and other districts across the country have also voted to walk out of classrooms. the most recent in denver and los angeles. sergio quintana, "nbc bay area news." a bizarre chain of events in the south bay, as santa clara university student has been arrested after stealing a tree trimming truck. police say the suspect was involved in a disturbance with a roommate when police arrived on scene, around 6:00 last night.

the student stole the truck and took off. he crashed into two parked cars just a few blocks away from the university. he was taken to the hospital with minor injuries. new details about that chase that forced one westbound lane of the caldecott tunnel to close yesterday afternoon. it turns out the man driving the car reported stolen, injured two officers. police say the suspect dragged one of the officers with the car in antioch, and rammed into the other officer's patrol car. both officers, we're told, are going to be okay. antioch police and the chp chased the car to the tunnel where the suspect stopped, got out and ran. police say he tried to carjack several cars before he was arrested. officers found a loaded gun, thankfully no one else was hurt. it is 7:07, we have much more ahead on "today in the bay." coming up, panic at the play. we told but this yesterday morning, people sent rushing out of a performance of "hamilton" the musical.

medical emergency that coincided with the sound of gunshots coming from the play. "today in the bay's" christie smith went back to the theater and spoke with people who were inside during all that chaos. >> the world we live in right now -- >> reporter: heidi freeman came back to try to get her coat today. she wasn't sure what the emergency was about last night at a performance of "hamilton," but she got out of the theet of >> there was no direction. but at the same time the audience reacted so fast. >> it was one of the scariest experiences of my life. >> reporter: dr. amy avazaze said she heard yelling and running to the side of the th t theater. it was her husband's birthday and she says they ended up taking cover by their seats. >> you know, everyone's like, get down, get down, get down, and then from there, we just started saying, go, and everyone

just started running. >> reporter: she says some patrons tried to help each other but there was a sense of chaos and panic. police seand firefighters arriv. no gun was found. >> there was a medical emergency in the theater, and people in the crowd got scared. >> reporter: firefighters say someone went in to cardiac arrest, a medical alarm may have been triggered, prompting confusion. there was also a report of a seizure. three people were injured trying to leave. in a statement the producers and shn said in part they are reviewing the events that brought an abrupt end to the performance. as for friedman, she hopes she'll have another chance to see it. >> i hope so, because i waited two years, and you know, we paid a lot of money. >> reporter: in san francisco, christie smith, "nbc bay area news." >> hope so for her sake. we have much more ahead on "today in the bay." it is 7:12. coming up, a ride share driver accepts a ride to pick up a woman, but ends up picking up a man instead and a strange request. we'll tell you about this mixup, next.

good sunday morning. here is a gorgeous look, as the sun shines over the golden gate bridge on this february 17th. it will be chilly again today. temperatures in the 50s, with off and on rain, but boy, what a gorgeous way to start the morning. hopefully you're able to get out and enjoy it, before the rain comes back. good news, though, sunshine is on the way for the work week. dramatic, new video of a massive pile-up on an icy road in missouri. >> there's nothing we can do! >> wow! one after another, cars and trucks slamming into one another, unable to stop. in all, 47 cars were run off the

road or damaged. this happened friday morning around 11:30 on interstate 70, this is southeast of kansas city. sadly, one person was killed. in addition to those icy conditions, police blame speed as the main cause for the pile-up. back here in the bay area, a ride share driver in marin county unknowingly became a drug smuggler. he says he accepted a ride to pick up a female passenger and take her from san francisco to tiburon, but when he went to pick her up, a man was there instead. he wanted the driver to deliver this shoe box to tiburon. the driver agreed, but a few minutes into the drive, the ride share was canceled. deputies pulled the man over, and looked into the box, fentanyl was hidden inside one of the shoes. wow. the chp and cal trans continue to tell people who are thinking of making a trip to the sierra to just stay home. drivers say the trip to south lake tahoe took more than ten hours this weekend, and some drivers couldn't get there at

all. now some towns are becoming inundated with traffic and visitors who are stuck, raising concerns for residents. max resnik from our sister station in sacramento reports. >> reporter: pine tree limbs and pines sank from a week's worth of thick snowfall, the kind of snowfall that knocks out power and brings down small buildings like thisout door kitchen in kathy staller's backbackyard. >> i haven't seen it since 2011 and back bafr thefore that, 199. trying to get out of their homes in order to get to the grocery store and get propane. we can't get services out. we called for a plumber days ago and we got contacted that they can't come out. they don't have all-wheel-drive vehicles to get to us. >> reporter: these issue, kathy says, made worse by stranded drivers who haven't come prepared for hour long delays on highway 5. >> people were going to the bathroom on the side of the

road, having snowball fights in the middle of the street, started fighting, people getting angry, using gps to try to get to roads that they thought were there that aren't there, getting stuck at people's homes. >> reporter: many got stuck near 50 grand, a restaurant owned by jim mccarthy. >> every table in our restaurant was full and we had about 150 people come through and in a two-hour's time span. >> reporter: maybe good for business, but jim says he witnessed the fighting, too. >> it's not the behavior that i would like to see. >> reporter: behavior kathy says could have been avoided with better planning. >> i think all of our systems up here just kind of were so overwhelmed by the people, the whole thing was a total failure. they should have been stopped down the road, after that first storm we had, when people still don't have power and stuff up here. >> reporter: these concerns during a holiday weekend expected to bring even more snow. >> that was max resnik for us. you would have been prepared if you had listened to this lady, vianey arana, with a look at our

sunday forecast. you said don't even bother going. >> don't even bother. we've got the winter storm warnings still in effect, there's avalanche warnings. you saw, it's pretty chaotic up there, very beautiful. if you are going to stay home, let me bless you with this beautiful shot of what it looks like. squaw creek, lake tahoe but it enjoy it from home. >> just transport us there. >> just imagine yourself there, warmed by a fireplace, and you're good to go. don't worry, the sun is making it to return back to the bay area. i want to show you that gorgeous shot there. right now the current temperatures in the 30s in santa rosa. 34 degrees. napa 37. down through san jose into those low 40s, so we're waking up to some chilly temps yet again and satellite radar we have shower activity. again, it's similar to yesterday, where we had those pauses in the rain. we had some breaks and sunshine and the rain made its return into the evening hours but it looks like it might be making its exit sooner than we thought. storm ranger is up and scanning. we have a couple pockets of rain here and there. we have some rain that just pushed through santa cruz, a lot

of it now is kind of seeming to die down a little bit. we have rain moving in but further down south and a lot of it moved east through the modesto area, really if you're traveling down to southern california, it would be a good time to check out the road conditions before you do. you might catch icy roads. there's cold out there as well. hour-by-hour outlook to plan out your sunday afternoon, we have rain moving through, about the 9:00 hour, showers start to pop up but notice how light and scattered it is. could see a wintry mix in the mountains, low elevation snow in the mountaintops, should make for a beautiful sight, right around 6:00, we might get more pockets of rain and look at this, right around 7:00, it really just clears out completely, beautifully, even the cloud cover, which will make for a very dry, hopefully dry enough monday morning start to our work week commute. long range outlook we're going to keep the possibility of that snow for the 2,500 to 3,000 feet

elevations, at least through monday morning, and then, if i fast forward that time line, all the way through wednesday and thursday, this looks like it might once again be bringing back the return of some possible showers, and more snow near the low snow level elevations once again, with highs only in the 40s and 50s. so it's going to be a below average week when it comes to our temperatures. now, by saturday and sunday, it looks like we have a drier fo , forecast leading into next weekend, giving us time to thaw out. lake tahoe golf course 16 degrees right there and so far our sierra snowpack versus average is phenomenal. northern area 125%, central 147%, statewide, at about 141% of snowpack versus average. over the next seven days, here is a look at what you can expect. again, we have a dry, sunny start to our work week into tuesday, and then come wednesday and thursday, we get the return

to raise its profile in recent years ... welcome back. the athletic department at san jose state university has been working to raise its profile in recent years and now they're going global. here's "today in the bay's" colin resch to detail a new partnership with the golf channel. >> there is a lot of buzz going on at san jose state. i'm pretty excited to sort of be a part of it. >> the buzz that san jose state director of athletic marie tuitt refers to are the improvements in facilities. in the last two years, the

school has opened new softball, soccer, tennis and golf complexes for its student athletes. >> the spartan golf complex is one of the nicest complexes in the nation, and then we host the silicon valley tennis classic, a professional tournament last year, it comes back again this august. there's a lot going on in the south bay and in particular at san jose state. >> the buzz this past week at pebble beach had nothing to do with facilities but rather a partnership between the school, top golf, and the golf channel, to broadcast 18 hours of coverage of this april's western intercollegiate, which will take place at historic pasatina golf club in santa cruz. >> it's a huge deal for san jose state and the golf channel. i feel like i'm representing all parties involved here which is cool in a way. >> reporter: aaron oberholser

won the western the last time it was televised, in 1996. >> because of tiger most likely. >> reporter: woods part of a long list of storied past competitors and champions of the event. oberholser views it as a way to garner more exposure >> and to put san jose state on the map. in the bay area you have stanford, cal, uss, st. mary's, santa clara, you got all these other schools that are vying for attention and to have this on a network that can broadcast globally, we could not be more thrilled about it. >> reporter: the tournament takes place april 15th through 17th. in san jose, colin resch, nbc bay area. >> local professional soccer team the san jose earthquakes is stepping up to do good for a youth soccer team down on their luck. last week, a truck full of equipment belonging to a youth team in salinas called ac milan was stolen, the loss valued at

that's a good preview of what we'll be experiencing today. thanks so much for joining us. i'm kira klapper. vianey arana has a look at our microclimate forecast, and that's what we saw yesterday, we saw rain, sun, rain, sun. >> you know what, kira, i have a little bit of good news. looks like the models are trending a little bit drier toward the afternoon. >> good. >> which means we won't be as we had as yesterday evening, drying out sooner, 44 degrees. look how beautiful san francisco looks. the good thing when we get storms we get beautiful clearing skies. current temperatures very, very cold, especially in the north bay, 34 degrees in santa rosa, 37 in napa. 40s for the rest of the bay area, and satellite radar you could really see we've got some moisture, but let me zoom in so you could see where we are in per specificive to the bay area and everywhere else. the rain is trickling east and we are still seeing just some rain activity near the monterey area. some rain is pushing through santa cruz. further off to the east it is

>> we're hopeful that we can still sit down at the table and present to them what we have right now, which is a comprehensive proposal to avert a strike. >> this vote to go on strike comes as teachers and other districts across the country have also voted to walk out of classrooms. the most recent in denver and los angeles. sergio quintana, "nbc bay area news." now to an unusual story out of tahoe, where as we've been reporting, people are stuck because of the snow. two men were shot last evening in tahoe city and one of the victims was killed. this happened around 5:00 at the boatworks mall, a popular place for people to shop and eat. investigators say the two men were sitting in a car outside in the parking lot, when someone shot them. the man killed was 33 years old, from sparks, nevada. no arrests have been made. five people killed and several others injured at a warehouse in aurora, illinois. we are now learning more about the victims and the accused

shooter, who, according to police, never should have been able to own a gun. nbc's chris pallone has the latest. >> reporter: many questions remain after the country's latest workplace massacre, this one happened in aurora, illinois. >> attention all police, aurora does have an active shooter. >> reporter: five people shot to death friday at a manufacturing plant that makes plumbing valves. police said saturday the shooter, gary martin, never should have had a fgun to begin with. >> he was not supposed to be in possession of a firearm. >> reporter: main started shooting in a meeting in which he was being fired after 15 years on the job. five years ago, state police ordered him to turn in his gun when they discovered martin was a convicted felon, the same .40 caliber smith&wesson he used friday. >> after a revocation, the subject is provided a letter stating that they need to relinquish their firearms and we're looking into why that did not happen. >> reporter: outside the henry

pratt company plant, friends and co-workers are remembering the dead. police identified them as human resources manager clayton parks, intern trevor weiner, mold operator russell byar, plant manager josh pinkert and stock manager vicente juarez. >> words can't describe how good of a dad he was. he was a great dad. >> reporter: five police officers shot during a gunfight with martin are all expected to survive. >> i also want to point out that we're thinking about the victims of these families, the families of the victims, that is also foremost in our thoughts, and as you know, we're trying to take care of each other. >> reporter: police shot and killed martin after the ram paipai pain, some answers to why he did this might never be known. the pope is expected to make comments at sunday mass today following an historic action

taken by the catholic church. the former archbishop of washington, d.c., in newark, new jersey, has been expelled from the church. pope francis officially defrocked ex-cardinal theodore mccarrick. vatican leaders found him guilty of soliciting sex in the confessional and committing sex crimes against adults and children. in just a few days, pope francis is set to lead a gathering of bishops from around the world to help the church grapple with its sex abuse crisis. >> both abuse and its coverup can no longer be tolerated and a different treatment for bishops who have committed or covered up abuse, in fact, represents a form of clericalism that is no longer acceptable. >> the 88-year-old mccarrick lost his title of cardinal last year. he's been living in a monastery in kansas since then. former vice president joe biden says he hasn't yet decided whether to run for president in 2020, but apparently he soon

will know. mr. biden is in germany attending the munich security conference. he says he believes the election process starts too early nowadays and we should be more focused on president trump's policies. if he does decide to run, the 76-year-old would find himself at the center of a debate the democratic party is currently having -- should the nominee be a political newcomer or a seasoned veteran? and we're learning more about the alleged attack of "empire" actor jussie smollett, santa rosa native. sources say investigators are looking into the possibility that smollett paid two brothers to fake an attack against him. last night, the actor's attorney released a statement denying those allegations. the brothers were questioned and later released. chicago police have not released their names, but nbc news obtained search warrants for the home belonging to the two brothers who are from nigeria. at least one of them reportedly worked on the "empire" set.

it is 7:47 on a lovely sunday morning. it seems like we're finally going to start to thaw out and dry out, maybe not thaw out. it's still a little chilly, 44 degrees in san francisco right now. we've got some beautiful clear skies. of course we had some rain move in overnight and we're still seeing a couple of showers, but the majority of it seems like it's finally going to come to its end. santa rosa right now 34 degrees. some of our chillier spots through napa, 37 degrees as well down through san jose, 42 degrees and this is what satellite radar is showcasing right now. you could see we have a lot of moisture but a lot of it is further down south moving east and kind of out of the area, so let's zoom in and get a closer look using our own storm ranger. it has been working extremely

hard with the past couple of storms. now we're going to start catching a bit of a break as that rain moves out. i'm going to zoom in cloers, we have closer, a couple of showers in merced and fresno. traveling to southern california you'll catch some rain. i have some good news, by 9:30, we have a lot of moisture but a lot of it stays offshore and we get a couple of pockets here and there, begin to pop up again between 4:00 and 5:00 so don't be surprised by that especially near the east bay, oakland, fairfield, tri-valley and through san jose, wintry mix that pops up along our mountaintops. 2,500 to 3,000 feet we could see low elevation snow. i fast forward the time line to 8:00, look how things clear out. beautiful, clear skies, which will make for a very dry start to our monday morning, but a very cold start, our temperatures are going to drop down, we'll be waking up to 30s

wasn )t so simple. nbc bay area responds to a woman whose oil change cost her a simple oil change that wasn't so simple. nbc bay area responds to a woman whose oil change cost her more than $10,000 for a whole new engine. turns out the state already was investigating the auto shop for fraud but there was no easy way for her to know that and go somewhere else instead. consumer investigator chris chmura looks into it. >> when kayne doumani pulled into this napa midas center all she needed was an oil change but a tech improperly replaced the oil filter and the engine burned out. >> the car lost all power. >> reporter: when she took the car a dealer for repairs, she got a shock. >> he told me you need a new engine and it's going to be about $16,000. >> reporter: kayne knew the midas shop was to blame.

what she did not know was that the state had been investigating this shop since 2015, after receiving previous complaints. >> they committed fraud. they made false and misleading statements, and with nun case committed gross negligence. >> reporter: the bureau of automotive repair says inspectors took undercover cars to this company seven different times. >> of those seven undercover vehicles, 26 serious violations of law occurred. >> reporter: but the only way for kayne or anyone else to know the stop had already been accused of failing seven inspections would be to look up the license online, search the docket and decode the legalese. >> i wish i had done it before i got my oil changed. >> reporter: in the meantime the state let the repair shop stay open throughout the investigation and disciplinary process. the last stop on that journey is the state attorney general's office, where we found a backlog of auto repair cases involving serious allegations. the backlog has tripled in the past three years. at the end of 2018, there were

1,314 auto shops in california under investigation, yet free to continue doing business as usual, including the midas in napa. there's no requirement to tell consumers, and that's very different from another place you commonly spend money, restaurants. an official health score helps you quickly gauge whether a restaurant is above board. they go off immediately after inspections and restaurants are required to post them. so couldn't the state grade mechanics the same way? we took that question to sacramento. >> i think we could do a better job at publicizing whether or not a particular repair shop might be above approach. >> reporter: evan lowe chairs the state assembly committee that oversees the bureau of auto repair. we told him of kayne's story. >> one is too much. >> reporter: low showed an appetite for grading auto shops
