you. highway 13 take 35 over there past that scene. the rest of the bay looking light. i have one more alert for the north bay, actually two. back to you. >> thanks, mike. we continue to follow the breaking news for you this morning, vermont senator bernie sanders announcing a second presidential bid. sanders releasing this campaign ad on twitter. >> real change never takes place from the top on down but always from the bottom on up. >> so far president trump has not commented on sanders' run. nine democrats have formally declared they are running including california senator kamala harris while nearly 20 others said they are continuing running from former joe biden to more. the fbi's former acting director andrew mccabe is speaking out in an exclusive interview with the "today" show, he discusses his explosive new memoir about his time in the trump administration and talking about the investigations into

president trump which were started on his watch. "today in the bay's" tracie potts joins us live in washington with a look at what mccabe is saying this morning. good morning, tracie. >> laura, good morning. one of the most explosive and interesting allegations out there is about whether or not the deputy attorney general rod rosenstein offered to wear a wire into the white house to secretly record the president. now, this never happened, but in his interview on the "today" show this morning, with something something, mccabe who was in the acting talked about it, it was a point of discussion and he also defends the fact saying this was a serious consideration. it wasn't just as some have suggested. >> these are things that happen and conversations we can and of course i'm answering those questions truthly it. >> you're saying that rosenstein did this, suggested wearing a wire? >> yes.

>> the president said this is treason. he an twitter called it an illegal coup attempt. congress was briefed about the fbi investigations of president trump obstruction and possible collusion all along that they were aware as mccabe put it on the "today" show, no one objected. >> so interesting to what's coming out. 5:04 right now. rod rosenstein expected to step down next month, he's become one of the highest profile figures in the trump administration, given his oversight of the russia investigation and appointment of special counsel robert mueller. the white house expected to name a replacement this week. new for you this morning, central agents are investigating the death of a mexican man detained by customs at the u.s. border. border patrol teams initially detained him more than two weeks ago at a rio grande station near

mcallen, texas. a spokesman says that's when he first asked for medical attention. doctors initially diagnosed him with creosis of the liver and congestive heart failure. he died monday at the hospital where he was being treated. tonight the diocese of san jose plans to participate in a panel discussion about sexual abuse in the catholic church. it comes just a day after the diocese in another bay area city in oakland releasing a list of 4r5 pooes priests accused of sexual abuse with minors. the archdiocese says they released the list because they have nothing to hide. for some of the victims the move still isn't enough. >> if they were truly transparent, they would list the name of all the names of all the accused molesters in the diocese in just instead of just a handful. >> this is part of our process going forward, so when someone

is credibly accused and we get to the end of our process, they'll be added to the list. >> tonight's discussion is under way at 6:45 at the jesuit school of theology on the campus of santa clara university. our investigative unit uncovered stories of abuse by catholic priests across the bay area, including revelations about priests in the san jose diocese late last year. to view our reporting, just go over to our website, nbcbayarea.c nbcbayarea.com. skyrocketing rent prices, a growing problem in the bay area. hayward will talk about ways to stabilize living costs. city council members will discuss a staff recommendation to amend an ordinance that gives tenants the rights to mediation when landlord as tempt to raise rents by more than 5% a year. the proposed amendment would apply to all rental units constructed before 1979. the counsel is expected to discuss potential changes to eviction regulations. several other bay area cities, including fremont and oakland,

are also considering taking similar steps. tonight city leaders in berkecally plan to talk at what it's calling a resevere housing shortage. the city is looking at pairing up with 3,000 landlords of vacant properties the goal to get them on the market as soon as possible. tonight's meeting gets under way at 6:00. this morning, sin city is turning into snow city. >> las vegas waking up to blankets of snow covering the desert city. rare snowfall came yesterday to the city streets covering lawns and roads, making for some traffic nightmares out there. this is the first accumulation of measurable snow in the valley in a decade and there's more snow in the forecast, in addition to the inch or two already on the ground. usually sight there, but boy it can get cold in the desert. >> it has been very cold here as well, we're not used to seeing

freezing temperature this is late in the sea sson, usually b now we warm up and it's cold in the bay area as well. here is a live look in san francisco low to mid-40s there but elsewhere we've dropped down into the 30s and below freezing in the north bay as well so tri-valley and the south county. so as you get ready to step out the door in dublin, check this out. we are at 29 degrees at 6:00. it is cold and going throughout the day you'll still need a nice warm jacket on even though we make it to the low to mid fifth. we'll talk about what's ahead in a few minutes and mike, back to the news that traffic problem >> it's in recovery mode. as we look around the bay we see light traffic flowing and likely see lighter traffic flow around much of the bay especially the south bay peninsula. we have scattered classes, schools, it's ski week this week. my kids don't have it, that's

mike traffic tease right now at 5:12, it is a start and cold again this morning. we are seeing widespread freezing temperatures and over toward campbell some upper 30s still at 9:00 this morning. normally we're reaching 63 degrees but you can see only 54 at 3:00 today.

we're still much colder than normal and tomorrow the rain is back, coming up in less than five minutes. a clear view of the golden gate bridge. traffic moves smoothly into and out of the north bay but through the north bay we have a couple problems we're tracking. and a very good tuesday to you. now the markets were closed yesterday for presidents day, though a little trivia because it was never made into a federal holiday. the markets called that washington's birthday even though it's not. southwest dealing with the challenge from the faa, our kris sanchez will fill you in on that coming up at 5:30. facebook facing potentially very serious penalties not just from the american government, biggest ever maybe but the british government as well. trader also keep their eye on trade talks between the united states and china. there is a march 1st deadline. president trump will slap bigger

foggy. we will still have a high amount of humidity that makes the bridges and overpasses icy, drive a little slowly over some of the spots. we're down to 30 degrees in livermore and at 34 in napa. 31 in santa rosa and ukiah and oakland starting out at 39 degrees. as you get ready to head out in walnut creek we'll continue on with mid-30s through 7:00, the sunshine makes it feel a little bit nicer but it will be a cool day and very much like yesterday, if you were out there during the middle of the afternoon, that breeze made it feel even cooler, as we reach into the mid to upper 50s today, and that's going to be a nice little break from the clouds, because they'll return tomorrow. we're going to start to see this system moving into from the north and this is a cold front that will reinforce the cool air we're feeling and keep temperatures down going toward the end of the week. we are going to see spotty light showers moving into the north

bay late tomorrow morning and into the afternoon, that kind of pushes to the south, not all of us will see the rain and we are going to see this moving through and it will be out of here by thursday morning. the computer models are not showing all of us getting rain. it will be very light trace amounts and also going into thursday, it will be drying out. if you are planning to go to the sierra, it will be a little bit more of an issue there as we'll see light snow koflg down frcomy wednesday morning into the afternoon bringing a few more inches and put the chain controls paback up for the main roadways headed to the sierra. s with' lo the bay area a sligh chance of low elevation snow above 3,000 feet and for thursday and friday, some mid-50s, we're back into the same weather pattern we've seen recently, but it will be dry. another slight chance of rain in the forecast sunday and drying

out again on monday. mike, you've been tracking the roads and a couple of issues out there. >> the good news is a full recovery for 580 through oakland around high street may be a little slowing around the 13 interchange because traffic activity but the car fire and all lanes have been cleared. a smooth drive for the south bay and coming in from the south county over the santa cruz mountains. peninsula and the tri-valley no delays reported. we take you to the north bay a couple of issues, this is ongoing major injury crash for highway 12 around beck, that's to the east of interstate 80 and so that portion of highway 12 will be closed, west texas and cor delia are your alternates to get around that scene, both directions to and from i-80. that's over on the eastern side, west of air field is fine. i-80 moves smoothly there. westbound is the commute direction from vallejo into novato. continuing today we have the closure of highway 37 over there

children in michigan who 5:24 for you right now. we are getting our first look this morning of three young children in michigan who officers say were murdered by their own mother. family members say the victims in this case are 8-year-old kyrie graham, 6-year-old cassidy graham and 2-year-old alana graham. investigators say that their mother, aubrianne moore took her own life. she struggled with mental health in the past weans ainstitutionalized last year. >> i don't understand it. she had beautiful children, wonderful children that i don't see the reason was to take them, too. >> police near grand rapids,

michigan, don't believe the children were killed inside the home, where their bodies were found. they believe the three were shot at a separate location. >> such a tragic story. it's 5:24 right now. one youtuber is raising questions about its website, calling it a potential gateway to the spread of child pornography, all a few clicks from what are legally posted videos. we're not showing you youtuber matt watson's video, it's filled with suggestive images but shows how quickly users can connect with potentially questionable videos of young girls simply from the algorithms pushing users from one video to the next. the website tech crunch got wind of what watson's video, did its own test and found possible red flags especially in light of recent scandal uncovered questionable youtube video showing children. watson believes adult viewers are connecting in the common sections and may even be trading child pornography. youtube sent tech crunch a

response saying it's reviewing watson's claims. the company believes most of the videos in question are innocent recordings of children doing everyday things adding it aggressively enforces its policies meant to protect minors. a woman stranded in icy waters in lake michigan is safe this morning. she has her dog to thank. authorities say she became stuck near holland, michigan, on an ice shelf about 1,000 feet from shore while she was trying to find the canine. the dog's howling alerted rescue crews. a drone managed to locate her. she's going to be okay. good news, lake michigan water temperatures right now are in the 30s. before taking some time to stop by oakland today, john legend stop by "ellen" to perform his new song "preach" inspired by his upbringing in the church. ♪ whoa, i do believe i can just

once my car finally warmed up, i didn't want to get out of the car because i was finally warm. 30 degrees in livermore this morning, 31 in san martin and also in santa rosa and ukiah, below freezing temperatures means that some of the roads may be icy. here is a live look in palo alto as we start out with clear conditions this morning. we go from the upper 30s to slowly into the upper 40s by noon today. we'll talk about the sunshine still in today's forecast and the rain in tomorrow's forecast in a few minutes and mike, you're now talking about what's happening in oakland. >> we're looking at the bay bridge toll plaza and unlike yesterday, where it was crystal clear, the view is clear here, it was complete ly cleared for the lanes, the metering lights on schedule. the rest of the bay shows a lighter volume building, this is just starting to get out of

former president barack obama is in the bay area and he along with warriors superstar steph curry plan to host a town hall for obama's foundation. my brother's keeper works to support boys and young men of color. "today in the bay's" pete suratos is in oakland with the report. good morning, pete. >> reporter: good morning to you, marcus. as you mentioned, former president barack obama will be speaking at his my brother's keeper conference which will take place here in oakland, right behind me, you see the setup there at the scottish right center. it's part of a three-day conference. some of the events kicked off yesterday, started with a community service event out there in west oakland and later in the day appearances by san francisco 49ers player richard sherman and san francisco mayor london breed, speaking at the conference later in the day. expect to see more than 250 of the my brothers keeper chapters, here in oakland for the three-day conference. as far as topics at this conference, they're going to

cover efforts to reduce youth violence, talk about impactful mentoring, the issue of masculinity as well as perspectives from community-based leaders. my brother's keeper was launched by former president barack obama in response to the shooting death of trayvon martin. the ultimate goal to build safer and supportive communities for boys and young men of color. our crews did peek with 11year-old demetrus scoggins of the youth development center and he said he hopes to meet the 44th president. >> a lot of people like love him as the first black president and how he gave us a lot of options in life. >> not only do we believe they can succeed but we need them to succeed and we're going to help them to succeed. >> he's speaking at the town

"today in the bay." >> thanks, pete. 5:35 for you right now. stanford police are investigating three recent sexual assault reports. police say two of the allegations involve women who were unable to give their consent and in all three cases the victims informed school officials who then contacted police. in each case police say the women never chose to file a report and each woman prefers to are he main anonymous.

police believe surveillance video from an antioch gas station may show two killers in it. it was august 19th after 3:00 a.m. watch the dodge charger, you see a man get out and then crouch next to it. police believe he was hiding, so the victim wouldn't see him. he and another man followed the victim to an apartment complex and killed him. here is another look at that dodge charger. it is a late model silver charger with black racing stripes. police also hope that maybe these sketches will look familiar. if you know who they are, call police. work to permanently fix the damage, though the richmond-san rafael bridge officially begins tonight. repairs were supposed to begin last night but pushed back due to presidents day. comes more than a week after chunks of the concrete fell from the upper deck. crews will replace expansion joints where the concrete crumbled. traffic will be reduced to one lane in each direction. southwest airlines known for his generous check bag policy. new the airline may be in trouble for how it weighs those bags. once they get to cargo.

it could pose a danger to your safety. kris sanchez joins us live from mineta, san jose. should travelers be worried? >> reporter: at this point, what we know is that the faa is trying to figure out whether the way ground crews calculate the total weight of all that baggage going into cargo is accurate enough for pilots to know how much weight they work with particularly in the event of an emergency, in just the last 20 minutes i did get a statement back from southwest airlines confimco confirming the faa has an open letter of investigation. the faa confirmed its year-long investigation to the "wall street journal" as well. southwest depends on a manual count by ground crews and you've probably seen that if you ever sat in a window seat on a southwest flight. the ground crews use a calculation using the average bag weight before they load the bags. the faa estimates in about a third of all flights that could lead to uneven weight distribution between the front and rear cargo bays which could

impact pilot response in an emergency with an engine. in the statement i got from southwest, the airline disputes that faa estimate saying there is no current information to support it. at this point, the faa has not issued any disciplinary action nor fines and at this point, there is no accident linked to this problem. southwest airlines told the faa that the "wall street journal" rather the airline is rolling out computerized scanning of all bags on the tarmac, that should happen by the end of the year, what the impact is of that on this investigation we're not sure at this point but i'll post that statement from southwest for you in my twitter feed so you can take a look for yourself. kris sanchez, "today in the bay" >> thanks for the latest, kris. now let's check the morning commute with mike, if you're not in the air, maybe you're on the roads. >> some people say they're flying down the roadway, reminder, chp is always doing their work enforcing that speed limit. we're looking where things are moving at speed for the green we

tomorrow and sunday. overall we will still have a mostly dry weekend but just some slight rain chances we have to watch out for on sunday. if you are going to the sierra, friday sis a really good travel day and scattered snow showers in the forecast for saturday and sunday. highs stay in the 20s that means icy conditions and a little bit harder getting back to the bay area sunday so maybe you can wait until monday. looking at russian river valley, some of the showers move in late saturday night into sunday morning. we have mostly dry conditions friday and early on saturday. for santa cruz we look good but a few more clouds in the mix and highs into the mid-50s. we will have a chilly weekend let me know where you're headed and check out my page

right now at 5:43, it's a clear and cold start. you need extra layers again this morning. here is a live look at the clear skies over the south bay. let's head to santa teresa. you have 34 degrees through 7:00, and then we make it into the low 50s today but that's about ten degrees cooler than where we should be for this time in february. we'll talk about if there is any warmer air in the forecast and when that rain returns, coming up in less than five minutes. a live look at the san mateo bridge, west 92, that's where the tail lights, move smoothly, picking up the volume. there may be an issue getting there. the earlier crash caused a hangup out of san leandro and a couple problems for the north bay commute as well. kari and mike, thank you very much. it's 5:44. new video just in to our newsroom showing smashed up security gates at reed hill view airport in san jose. police say a suspected drunk driver crashed the gate and drove his pickup onto the field around 10:30 last night.

officers arrested that man. a tow truck removed the damaged pickup truck. the county and airport this morning will work to repair that gate. more than a dozen people trapped for hours on a gondola at sea world in san diego are back on the ground this morning. this is brand new cell phone video of that rescue. they were stranded for hours on board that ride, dangling above water. one of them an infant. crews could be seen climbing onto the gondola and rappel willing down to the water saving one person at a time. the temperature in the 40s. investigators say a huge gust of wind tripped a circuit breaker, shutting down the ride. later today, former starbucks ceo howard schultz returns to the bay area, speaking at a sold out commonwealth club event at the herbst theater in san francisco. he'll be discussing his latest book. the last few weeks schultz hinted about running for president as an independent. the president has yet another challenger this morning. >> scott mcgrew, while howard

schultz is still brewing, bernie sanders ready to serve. >> well put. we first announced it as it happened. sanders said he will run once again for the democratic nomination for president in 2020. sanders, of course, a liberal democrat from vermont, who caught the imagination of many in the last go-round, before ultimately losing the primary to hillary clinton. so we're going to add sanders to our long list of candidates, at this point all just jockeying for position in money. this is going to get more serious as we get closer to the iowa caucuses. california and more than a dozen other states have filed a lawsuit to block president trump's declaration of emergency. the suit says the president is wrong when he says it's an emergency. during his rose garden speech, the president himself indicated he didn't have an emergency. that's listed on page 30 of the suit. it says diverting money away from current projects would hurt the states listed in the suits. in an early morning tweet the president said "as i predicted

16 cities," he means states there of course "led mostly by open border democrats and the radical left, have foiled a lawsuit in, of course, the ninth kiir s circuit. california, the state that has wasted billions on their out of control fast train." he is almost certainly right, the suit was intentionally filed in the northern district of california because if his order is blocked there, it appeals to the ninth circuit, he's right, he's had a string of tough luck in the ninth circuit and then on to the supreme court. meanwhile, expect movement in congress today as well. the house will likely call for a vote to try to overturn the order. the president can still veto it. the president will also order the creation of space force, it's not the one he wanted show. it's not a separate branch of

get a live look at the san rafael camera. we're watching out as you head out for your drive this morning, santa rosa we're down to 31 degrees, also 31 in ukiah. a lot of 30s on the map here for the parts of the bay and the inland areas. in livermore we're below freezing and san martin also below freezing. getting ready to head out to the pleasant hill b.a.r.t. station 34 degrees at 6:00. we keep the clear skies for today which is of course is some great news. it was nice to get the sunshine yesterday. we're still going to have sunshine today, and our high temperatures in many spots almost ten degrees cooler than where we should be, but i think we'll take it at this point, after all of that rain and we will see the rain returning the system dropping down from the north and as that slides closer to the bay area we'll see the clouds moving in. the system is not that strong and actually really starved for moisture. so we are going to see some

spotty showers moving through, starting out late tomorrow morning in parts of the north bay and continuing elsewhere as we go into the afternoonafterno. this is what the rpm model is showing more how much rain we may measure. a lot of us will not see much of anything, maybe some trace amounts of rain at the most, close to a tenth of an inch, not that much. as we go into the rest of the forecast, some highs in the mid-50s, clouds roll back in saturday, and this by no means looks like a wash-out. it is still good to have that rain chance in the forecast, make it a little bit more busy after this into next week so that's something i'll keep you up to date on. headed back to mike, you've been tracking a few issues especially coming out of the east bay. >> that's right, both of the issues, well, should be standard at this point. we did have an additional slowing san leandro and of

course the bay bridge. let's just lay it out for you here. the south bay shows a tiny bit of build for san jose and that's typical about this time of day. the peninsula no problems. we have this area lahonda highway 84 had the closure, mud, rocks and a tree down but that reopened. a portion of highway 35 will remain closed. south 880 past high street no problem. past the san mateo bridge and continuing with that build in toward union city out of san leandro and hayward and that will be the issue for the morning commute. we have more commuters than yesterday. this is a problem, into and out of the area by i-80, between beck and i-80, highway 12 is closed because of a major injury crash that happened overnight. cordelia at west texas taking you to or two the area to bridge that gap. that will be a problem for folks on the streets, not for i-80. i-80 is open, the transition on to highway 12 is closed. we're looking over here as well, westbound 37 is your commute direction, the richmond-san rafael bridge is one alternate

as people work across the country to file taxes there are accusations of discrimination in the midwest. a gay cup until indiana say they were denied tax services after they told their tax preparer they got married this year. one of the women says she used the company for the past four years and was shocked. >> we went in there and sat down just like we always would and then she said how are you filing this year, and i said married joint, and that's kind of just when it went downhill. >> we were pretty shocked, and upset. >> i don't need anyone to agree with my lifestyle or things that i do but if you're going to run a business, you should be able to work with all types of people. >> the owner of the company put out a statement citing her religious beliefs, as the reason she denied them service. she she was respectful and referred them to other tax services. sfo is sinking, our investigative unit discovered that's creating problems with cracking in the runways reed

leading to flight delays and investigations. stephen stock has more. >> reporter: you're seeing firsthand from the pilot's point of view what it looks like on final approach to land on the runway at san francisco international, especially after a recent rainstorm. notice the puddles of water along the runway and as the photos taken that same day show repair patches everywhere. also notice the ponding of water on the taxiways and on the apron around them. there's an extensionive linear cracking called alligator cracking, clear skinz signs, structural engineers the ground underneath is settling and creating problems >> that means the sub base is starting to fall a little bit, and that is a little more extensive repair. you have to dig it up, pack it in and do more extensive repairs with it. >> reporter: in total some was closed down for a total of 90 days, one out of every four days of the year in 2018. during those days we calculated with the help of flight aware 1,100 canceled flights.
