all of this is headed your way, this entire storm coming up the east coast, leashing this cold wet snowy mess behind it. this morning a powerful winter storm system roaring across the country. more than 200 million people nationwide facing heavy snow, torrential rain, an crippling ice through thursday. beginning its journey in california several days ago, the winter weather wallop aiming its fury at the southern rocky mountains dumping as much as a foot of snow in new mexico and colorado, then giving las vegas its worst snowfall in a decade. the desert city now bracing for even more snow. in the midwest, strong winds and snow spreading across kansas. rain causing potentially catastrophic flooding. many airlines preemptively canceling flights in the washington, d.c., area, where this closed in

a.m. and p.m. rush that we're concerned with. >> reporter: in the northeast, ea n a commute so we've got wednesday preps are under way in philadelphia and new york city. new jersey already declaring a state of emergency. authorities warning residents to stay off the roads. >> as of noon, it's going to start coming down. it's going to affect the afternoon rush hour without a doubt, so, again, we're stressing use mass transit as much as possible. >> reporter: and here in the greater d.c. area, this storm is causing the kind of government shutdown that folks around here actually like. the federal workers have all been told to stay home today. that will help keep the roads clear and let those plows do their job as we get into the messy morning commute. >> and the kids are home from school too. >> it's really the timing of this massive storm system. it's affecting the mid-atlantic this morning, also back through chicago for this morning's commuties. northeast be more impacted later on for this evening's commute. we're going to see the here is the snow, heaviest back through minneapolis, st. paul,

and washington, d.c., area, and also across the northeastern virginia airy. as we go through this morning, that's where the snow will be falling. by the time we get to about 2:00, 3:00 this afternoon we'll transition to a quick period of ice and over to rain basically everywhere. in new york the snow will start early this afternoon. it could remain heavy through the evening's commute, just enough to accumulate a few inches before it changes over to ice and eventually to rain by the time we get to 7:00, 8:00 tonight. in boston we're only looking for a couple of inches before the changeover. we're going to see significant delays in new york city, delft ya, chico will likely see some delays as well. same goes for minneapolis/st. paul. most of those delays this morning. in the northeast it will be later on this evening. we could see about four to six inches of additional snow on top of what already is on the ground across the upper midwest. in the mid-atlantic an additional three to four inches and then in the northeast, again, a quick twoo three

inches before that changeover. turning now to the growing fallout over that bombshell new mueller investigation after sitting down with savannah yesterday. we're going to start with peter alexander. hey, peter. good morning. >> reporter: good morning. the president and his top aides here have tried to discredit andrew mccabe as a liar and a leaker but the fired acting fbi director is not backing away from his account and the concerns he says that led the fbi to launch an investigation to determine if president trump was secretly working to after thein overnight fired acting fbi director andrew mccabe detailing while he raised red flags about president trump and russia. >> do you believe the president could be a russian asset? >> i think that's possible. i'm really anxious to see where director mueller concludes that investigation. >> it follows his appearance with savannah here on "today."

he briefed lawmakers after the fbi opened an investigation into president trump in 2017. adding no one pushed back. >> did you tell congress? >> i told congress what we had done. >> did anyone object? >> that's the important part here. no one objected. >> reporter: that and apparent rebuttal republican criticism that top justice officials were plotting an administrative coup against the president. mccabe recused accused of lying under oath. the president repeatedly attacking him on twitter. >> i don't think anybody really takes those tweets by the president very seriously. i certainly don't at this point. >> reporter: and this mor the pde facing new scrutiny. an exclusive "new york times" report says his own appointee during e of the investigation the 2016 campaign which is president denies. >> i don't know who gave you that. that's more fake news. there's a lot of fake news out

there. no, i didn't. >> reporter: the times reports president trump called his hand picked acting attorney general matthew whitaker to ask whether u.s. attorney berman could be put in charge of the widening investigation into his personal lawyer michael cohen. according to several unnamed officials. berman had already been recused from the the case. the president soon soured on mr. whitaker and complained about his inability to pull levers at the justice department that could make the president's many legal problems go away. testifying before congress earlier this month, whitaker addressed the idea of presidential interference. >> at no time has the white house asked for nor have i provided any promises or commitmentscounsel's investigat or any other investigation. >> reporter: that testimony adding fuel to house democrats claims that whitaker may are perjured himself and their efforts to bring him back before congress to explain what they've characterized as inconsistencies

miacin yet another lawsuit overnight. overnight, the opposition mounting to president trump's emergency declaration to get his border wall built. the american civil liberties union becoming the latest group to sue the administration over its move joined by several other groups. writing in documents the president's declaration was made solely out of disagreement with congress's decision about the proper timetable for constructing a border wall. president trump defiant tuesday in the face of another lawsuit filed by 16 states. >> i thi e we're going to be very successful with the lawsuit. it's an open andd case. >> reporter: mr. trump predicting victory over the legal battle to stop him from redirecting $3.6 billion in military construction funds to pay for his wall. the president doubling down saying he's got an absolute right to declare a national emergency. >> we need strong borders. we have to stop drugs and crime

and criminals and human trafficking and we have to stop all of those things that a strong wall will stop. >> reporter: the lawsuit filed in the ninth u.s. circuit court of appeals argues that the president has used the pretext of a manufacturered crisis of unlawful immigration to declare a national emergency. all of the attorneys general in the 16 states are democrats, but they deny politics is at play. new mexico's attorney general speaking out overnight. >> actually he has to follow the rule of law. we don't have kings in this country and this is not about the king's funding. >> reporter: and a new twist this morning, a day after california filed a lawsuit against the emergency declaration, the trump administration announcing it plans to pull some $900 million in federal funding from a high speed rail project for the state. it's also poised to try to take back billions of dollars more that have already bee cali that political retribution,

allegations the white house denies. craig, hoda? t >> the high school student at the center of the viral confrontation at the lincoln memorial last month is suing the "washington post" for defz molestation claiming the newspaper accused him of racist acts. he seeks $215 million in damage. the suit claims the "washington post" waged malicious attacks on him by falsely accusing him of instigating the tense standoff with the native american activist nathan phillips. in a statement the "washington post" said we are reviewing a copy we plan to mount a vigorous defense. ph also this morning, additional chaw a judge has rull hearing that revealed some trbl details in that case. nbc's steve patterson joins us with more on this story. steve, good morning. >> good morning to you, craig. for hours frazee remained mostly stoic in court as the gruesome

details about his fiancee's aled murder were rattled off shedding some light on what prosecutors say happened. just a warning, some of the details you're about to hear are disturbing. >> reporter: this morning real life details that sound more like grim fiction. >> patrick kills kelcey in a horrific manner with a bat in the back of the head as she is sniffing candles with a blindfold. >> prosecutors laid out their case against patrick frazee revealing graphic testimony fro preliminary hearing centering on the day kelsey berreth was allegedly killed. the story spinning from a key witness, crystal as part of a deal for evidence. >>kenny's story an investigator who interviewed her said kenny was asked by frazee to kill berreth three separate

times. in september frazee told kenny to poison a coffee drink and deliver it to berreth. kenny says she didn't follow through. a month later frazee gave kenny a metal pipe and told her she had another chance to get rid of berreth, and after kenny didn't go through with a third plot involving a baseball bat, prosecutors say frazee decided to take matters into his own hands allegedly blindfolding berreth with a sweater in her own home before beating her with a baseball bat on thanksgiving day. their 1-year-old daughter believed to be in the next room. after the alleged murder, kenny says frazee called her saying get out here now. you have a mess to clean up adding it was hard to have thanksgivingas binod but leaves telltale evidence for our investigators to find. prosecutors say burned the body along with bags of evidence. frazee's defense team countered

by painting kenny as love sick, unstable, and unwilling to let go and that frazee never specifically asked kenny to kill the mother of his child. >> again, after hearing the evidence, the judge ruled there is enough for frazee to stand trial. he's scheduled to be arraigned in april. the district attorney stressing this is an ongoing criminal case. meanwhile, the couple's 1-year-old daughter remains in the custody of parents. guys, back to you. >> that's a gruesome case. >> horrifying. now to some heart stopping video out of utah when a sn avae tense moments all caught on camera. a group of friends were skiing together in the back country south of park city last weekend. one skier goes off on a jump trigge 200 feet down the mountain through trees and rocks until finally burying him completely. when it stopped he screamed for help. >> i'm here, here! >> moments later, his friend spotted the tip of a ski

have canceled flights in washington, d.c. in anticipation snow. federal workers have been told to stay home. a lot of schools closed. dylan will be back in a bit with her forecast. southwest airlines is apologizing to travelers for a spike in cancellations not because of the weather, but because of mechanical issues with its planes. the airline is investigating why the number of aircraft unable to fly has doubled in recent days. on tuesday southwest canceled nearly 200 flights and delayed more than 800 others. a company executive blames the mechanic's union saying it has a history of work disruptions. the union dismissed those claims saying quote, safety is and always will be our number one priority. a dash camera captured a frightening close call for a nevada highway patrol trooper during a routine traffic stop. as the t starts walking back to his vehicle he sees an suv coming straight for himspee. some sw, though, t trooper avoids getting hit. the driver of that suv is facing

a list of charges including dui and reckless driving. >> happy that trooper is okay. now to the latest developments in the jussie smollett case, the "empire" star who claimed he was attacked on a street in chicago facing intense scrutiny from police over his story, but when will he talk to investigators again. nbc's national correspondent miguel almaguer joins us. >> law enforcement ssman who sa. jussie smollett hasn't spoken to investigators in several days, but while he may not be ready to talk, the two brothers who police say are involved in the case are speaking to authorities. >> the two men in this surveillance photo who jussie smollett identified as his attackers met with prosecutors late tuesday. ola and abel osundario who say the actor hired them could be

asked to testify in front of a grand jury. new developments come as law enforcement officials tell nbc news smollett is no victim and could face criminal charges. >> i'm an advocate. you do such a disservice when you lie about things like this. >> the brothers who know smollett from the set of his hit show "empire" were arrested last week, then released without any criminal charges. at their home investigators seized a magazine and stamps. smollett said he received this death threat with magazine clippings in the mail days before he reported the attack. the local cbs station in chicago says smollett paid the brothers to help orchestrate the assault after the alleged hate mail failed to grab headlines. >> they called me a [ bleep ], they called me [ bleep ]. there's no which way you cut it. >> in his onlyel he was targeted because he's black and gay, and perhaps an

outspoken critic of president trump. >> who says [ bleep ] empire [ bleep ], this maga country [ bleep ] ties a noose around your neck, and pours bleach on you, and this is just a friendly fight? >> after repeated requests to question smollett again, police are still waiting. his attorneys she investigators. this morning the actor continues to stand by his story while police and the public wait to hear from the outspoken activist who's gone silent. >> and in another twist in this story, the top local prosecutor in this case has recused herself. her office saying the decision was made, quote, to address potential questions of impartia familiarity with potential witnesses in this case. it's still unclear who she may now and how. >> let's bring in nbc legal

analyst ari melber. this started off everyone calling it a hate crime, and now police are wondering if jussie smollett orchestrated this entire thing. we say people rushed to judgment in the beginning. we're not sure what's happening right now, but police are gathering evidence, right? what are they trying to find? >> they're ultimately looking at whether the original allegation which they were investigating is now itself potentially the infraction. in other words, was there a crime and a victim of that crime y doing he person who said they something that itself may be leg illegal which is faking a crime. >> he hasn't spoken to investigators since these developments. can these investigators compel smollett to talk to them? >> they certainly can. i spoke with chicago police officials yesterday in preparation for this segment. they are still trying to put on the pressure privately and publicly to say if you really are the victim of course you should be willing to come back anduptimo asethis, what kind of charges could he face? >> the kind of charges you're looking at here is basically obstruction or lying to

authorities. in illinois that would typically be a misdemeanor, but there's nothing typical about this case, so while in a lot of situations you could have a false call, people have heard of false bomb threats that are called in, and there's no real actual crime, those aren't usually charged. i think there's a tremendous national interest now in how you resolve this. >> also in the piece we showed that there was supposedly a threatening letter that came to jussie smollett through the mail, and there's some question now as to whether or not that was true. if that winds up being a hoax, what kind of charges could he c long-term, sophisticated premeditated attempt to fake evidence that there was a something and that's what they're investigating, they haven't announced that yet, the worse it looks for whoever's involved in that fakery because it's not a one-off, it's not one false statement, which anyone might make accidentally to the police. it starts to potentially look much bigger. >> i want to go back to the fact that smollett hasn't talked to investigators again. from a legal standpoint, if you are accusing others of a crime,

why would you not talk to investigators again? would there be a legal reason for him not to sit down with investigators to have a subsequent conversation? >> look, craig, the short answer is no, that doesn't look good and i think you're putting a finger on why the suspicions are rising, but technically, yes, there are lawyers who might say if we think the direction of the authorities has shifted whether they're right or not, we are now trying to protect our client from a new theory in the case, which is turned on the client ask that may not ultimately mean the client did anything wrong. you have the right not to talk to the police in most circumstances. certainly you have the right to your lawyer present and your counsel, so again, those are the kind of arguments that would help some blic, i'm not sure they help this individual that much at this point. >> this thing stiunfoing. >> tha >> should we plug his show? >> we love ari. >> 6:00 the beat on msnbc. >> thank you, ari. n ba>> to dylan dreyer. let's focus on the rain now with this big storm system.

the nobel prize in medicine was given 18 months ago for work on circadian ritdhythm. it's not just about jet lag or how you sleep, those are obvious, if you eat when the sun's up it makes a difference because your metabolism is different when your body is awake as opposed to your intestines are asleep. >> how do you do all that and get in sync with your own body clock? >> the number one problem we're facing is electronics. i'm talking about the actual light itself. you want to turn off the blue light on your phone. if you can hear my voice, take your phone out, go to settings and set it right now so at 9:00 tonight or 10:00 tonight you turn off the blue light part. >> what's wrong with the blue light? >> think about when you're a little kid going the sunsets, everyone's tired. the sun has orange rays it tells the brain to release melatonin. melatonin is a hormone for circadian rhythm. it tells your body it's late at

night. by showing light blue light, you're telling your brain wake up. an hour before your bedtime, distance yourself from the phone, which is hard to do. >> change the settings. >> does the tv give off the same blue light? >> all lights that actually are -- even in your computer now you can put screens up to block it or give yourself half an hour doesn't take a long time for your brain to realize it's nighttime. >> you don't realize your brain is picking up those little things. we have around here a lot spl what's wrong with coffee? >> you don't drink coffee, do you? >> you look so relaxed. >> not much though. >> we actually have collected a sleep score 4 million nights of data, and 4 million night ofs data told us if you have four cups of coffee or less early in the day you can sleep just fine. when you sleep later at night, we think it disrupts your rem sleep. even if you think you're sleeping it's not the same quale lofe me, one in seven of us don't metabolize coffee well. if i have caffeine in the evening i don't sleep well. >> when should we be done with

coffee for the day? >> i would say six hours before you go to bed. >> you drink coffee all day? >> i'll have a cup at night. >> decaf? >> no, regular. >> and you still sleep good. >> maybe it's not good. who knows. >> it's good enough for some, not others. why take a risk. >> then there's the whole issue of food. hingwh i to do, eat with the sun. the average american eats 15, 16, sometimes 17 hours a day, you are intestines go to sleep, and when we keep eating the food sits there. there's shocking day about how you might want to change what you're eating. it turns out when you eat dramatically affects how much weight you gain, not just how much calories but when. >> this is a breakfast. this is what we should be having for breakfast? >> what'd you have for breakfast today? >> chicken wings. >> come on, i had greek yogurt with raspberries. >> that's a show offbreakfast i'm proud of you. >> if you're going to have carbs have them in the morning. you can get away with it. i recommend things like noodles.

breakfast? >> here's why. if you have pasta, especially if it's cold pasta, it gets resistance starch in it. in other words, it behaves more like a fiber than a starch. >> if it's cold. >> the temperature actually makes a difference. more importantly, you want to sttch is probably going to be your biggest meal of the day. >> i love that meal right there. >> you know what, i think salmo i' sorry. have a nice little cut of salmon. where am i going to get that. >> i always cart my food with me. >> the big message here is not the salmon. you want 3/4 of your calories before 3:00 p.m. that's your cutoff time. this study has been done in spain. >> so your big meal is what -- >> we're americans. we put emphasis on dinner. we're talking about happy hour, getting with our friends and family. we want to celebrate with a big dinn dinner. >> a big dinner is metabolic suicide. >> so be it.
