thanks so much for joining us. i'm kira klapper. rob mayeda is in and he has a look at this microclimate forecast. >> just what everybody wanted. >> yeah. i just found out my son's soccer was cancelled again for like the eighth time. >> there's hope in the 7-day forecast. right now, this is the sun that we can find in san jose. you're hopeful for a pretty nice day. a chilly start to the morning but the reality check is the radar offshore you're beginning to see the rain approaching the coast, now reaching san francisco into the north bay and that is a sign of things to come today and the reason i have a microclimate weather alert. a few places getting close to a half inch of rain. it's cold enough for some snow showers around mount hamilton or the higher peaks later today. highs in the low 50s today. rain at times.

we'll look at that hour by hour and finally better news for soccer practice and little league maybe towards the end of the 7-day forecast. a closer look at that coming up. >> we look forward to that. see you then. thanks. frustration and anger boiling over in san francisco after a cyclist is killed. tess rothstein was killed just a block away from a protected bike lane where bikes and moving cars are separated. demanding safer streets dozens of cyclists stood in the street using their bodies to separate cars and bikes. >> it's unfair, it's wrong that our lives should be threatened because we're choosing to travel this way. >> witnesses say rothstein was in the bike lane and she swerved to avoid an opening car door and ended up in a collision with the truck. video shows the truck driving

past the point of impact. the video ends before the collision is seen. she was pronounced dead at the scene and under pressure from city leaders the transportation agency plans to speed up the implementation of planned bike and pedestrian safety projects. protected bike lines on howard were scheduled to be installed at the end of this year but now work may begin in a matter of months. new this morning a massive early morning fire is under investigation in the south bay. it happened at 3:00 this morning at north matilda. crews say they could see flames from blocks away as they were responding. they say the commercial building was engulfed in flames and you can see it there. because it was empty they were able to aggressively fight the fire. it took about an hour to get flames under control. six months after his death

there still are no answers nor arrests. the father of two was stabbed to death outside of his san jose home and last night his family was supported by a heart broken community. >> we are -- >> reporter: a peaceful march with a powerful message. guided by the anguish of a mother who's lost her child. >> i am fran ki's voice. >> her son a father of two, was stabbed to death outside of his home in san jose back on september 2nd. no arrests have been made. deputies are still looking for a truck seen in the area the night he died. 2004 to 2005 nissan titan. joined by other mothers of murder victims calling for justice. >> he was raised with integrity, respect, morals and values and

for something like this to happen to him, it's devastating. >> the award for information in his death is now $30,000 thanks to a $10,000 donation from a foundation and from frankie's employer. >> we can't allow a human being to just be stabbed to death while his children and wife are inside the home. his friends are outside and six months go by and nothing. >> reporter: his family recently started a foundation in his name to help the families and children of murder victims. for those holding on to hope for justice. >> and the protests continue in sacramento last night a crowd of 200 people marched new the neighborhood where stephon clark was shot and killed by police last year. they waved signs and demanded justice. this of course comes after the district attorney released her

decision last week not to charge the officers involved. the officers say they thought clark was holding a gun. it ended up being his cell phone. there have been demonstrations all week long during monday's protests. 84 people were arrested. the d.a. announced friday she wouldn't file any charges against any of those protesters. the attorney for actor jussie smollett is calling the 16 count grand jury indictment against the former "empire" star vindictive. police allege he staged his own attack and filed a false police report. he claims he was the victim. two brothers ultimately told police that smollett paid them to carry out the attack. his attorney says he was not surprised by the indictment but says quote, what is unexpected is the prosecutorial overkill in charging 16 separate counts

against jussie. this is redundant and indicative indictment is nothing more than a desperate attempt to make headlines. the fate of high profile giant ceo larry bear is now in the hands of the san francisco district attorney. a camera caught part of the fight at a plaza in hays valley in san francisco last friday. the tape was then sold to tmz sports and quickly went viral. it shows him grabbing a cell phone from his wife before she falls to the ground. we have confirmed that both larry and pam met with investigators and are cooperating. the d.a.'s office says it's reviewing the case but doesn't have a time line for deciding whether to file charges. legal experts say it's nearly impossible to predict the d.a.'s decision. >> the domestic violence cases are probably the most difficult cases that prosecutors face for the simple reason that your

primary witness, the alleged victim is always by definition in a love relationship with the suspect. >> we also spoke with larry bear's attorney who says if it wasn't larry baer it wouldn't have been referred to the dchl a.'s office. if it wasn't on tmz it wouldn't have been referred. much more today, she is the driving force behind getting steph curry to make shoes geared toward girls. why the warriors had her on the court at half-time. also, costly barriers keeping kids from going to college. the move one south bay school district made to erase one key excuse for all of its students.

surrounded by impressive women. literally. >> so we are one closet. >> still, the person laura is most impressed with might very well be herself or at least her 14-year-old self. >> you're like, how did i do that. right? how did i make that happen? >> what she dade back then was found her very own nonprofit call one closet. she had heard there was a great need for good used clothing for teenage foster children so she set out to collect some. which she did. by the thousands. but when it came time to head to college in arizona, laura found someone else to run the program and thought she was done with it. >> i had no idea what i was doing after college. i didn't think i was going to be going back to one closet at all. >> reporter: so why is she on the convention floor pitching one closet once more?

surveillance video last month. she also learned he was arrested for prauling while just wearing women's underwear. but we found out he was convicted only for loitering and put on probation. >> he got away with a slap on the wrist and that's not okay. he has more victims and no matter how much more he has that no one knows about. >> the d.a. will be tougher this time, says clark. >> it is a violation of special space and personal property rights and the neighborhood has a right to be concerned. >> what is the connection. why do you keep coming back? >> a follow up to a series of stories we've been covering in the east bay. police say the public has helded reduce the number of car break-ins. more than 300 break-ins were

reported during just the first six weeks of this year. now the pd says the vigilance of the public has paid off and those numbers are trending downward. the latest message, don't leave your pus or belongings in your car. nine current and former lawmakers reportedly faced allegations of harassment and misconduct last year costing the state nearly $2 million in legal fees alone. task payers say shouldn't have to pay for lawmakers' pill conduct. >> we think that the perpetrators ought to pay for those investigation. and they ought to be held liable. i mean, this is -- this is a -- a -- an understandable use of taxpayer dollars but the fact that taxpayers have to even fund

storm ranger shows you the rain started to cross over the santa cruz mountains. we've had light to moderate rain here. closer to san francisco, oakland and richmond and there you see some stronger returns. you see the doppler crossing the coast there approaching santa rosa. when you see the radar, you see this band and it looks narrow. once this clears, the rain should stop but that's really not the case. there is a little bit of a break behind that band but you'll notice this area of low pressure offshore today through at least the first half of tomorrow, that's going to track in along the coast and it will keep the shower ka chances ongoing. totals will be around the hill tops of the north bay. you see some yellow and orange here through 11:00 tonight. might see a half inch to an inch around some of those areas toward sonoma county and the other thing is interesting, you

saw how cool today's high temperatures would be. the positive spin if we're dealing with rain for the weekend is you might start to see some snow again. maybe along the higher peaks of the santa cruz mountains and north bay. so not only is it colder than average and yes, more rain, but maybe a chance of snow at times above 3,500 feet later on this evening. midday that primary rain band pushes through. we may begin to see the showers decreasing briefly but you can't pack away the umbrella all the way through tomorrow. the morning begins similar to what we have right now. showers lurking offshore. what could be a little different is a chance of some isolated thunder showers and small hail, something we'll watch closely. mid afternoon there on sunday and then by sunday night notice how some drier air comes out of the north. not a lot of help for your weekend plans but long range forecast does look better.

rail from san francisco to l-a -- was designed to welcome back. critics and some supporters say the high speed rail from san francisco to l.a. was designed to fail. last month governor appeared to derail that idea saying there's not enough money to finish the job. even before his announcement, senior investigative reporter uncovered millions of dollars in questionable spending. >> reporter: cost overruns, duplicate charges and bill for work that was never completely performed. that's just some of what we found. we reviewed hundreds of invoices submitted to the high speed rail authority by private contractors and we found $142 million in

disputed charges. >> more than a decade after california voters approved the $9.95 billion bond to start construction on high speed rail from san francisco to l.a., this is what exists. concrete pillars, fragments of a via duct and an unfinished trench dug through downtown fresno. >> too much overnight and not enough transparency. >> reporter: our team was already digging into contracts, costs, management and potential wasteful spending. we obtained a list of all contractors paid by the high speed rail authority as well as a list of all charges flagged by contract managers known as disputed invoices. we found more than 600 questionable invoices. one example, has part of this $9 million bill from a company hired to design, demolish, construct and lay tracks that don't exist yet. a disputed $275,000 in markups

and unapproved lodging expenses and this, $17,000 bill from a consultant who tried to charge the state for a new office that had not yet been authorized. even this $1,200 charge for uc davis for two different classes even though one of those classes had been cancelled. >> i lay the fault right at the doorstep of the authorities. >> reporter: assemblyman has been a critic of high speed rail since the beginning. he called for an audit that reconfirmed the misspending that we first found. >> they've been making it up as it goes along and that's the danger point. >> they started things before they should have. >> reporter: high speed rail supporter agrees. >> they made mistakes. they overspent. >> reporter: our analysis discovered a third of what high speed rail classified as questionable spend involved a single consultant.

the company provides administration services as the project manager in charge of construction. a company that billed the state more than $50 million in disputed invoices. >> we're not paying a penny unless we can validate that the service was delivered. >> the chief financial officer for california high speed rail. >> i would look at this more as a contract manager is doing a fairly good job protecting the state of california. >> reporter: his office oversees contracts issued in the state. we wanted to know how many overcharges they missed. >> are they charging for work they're not doing? >> in my experience it's many so lack of documentation. very, very seldom, i can't think of anything off the top of my head where i would consider it a fraudulent act. >> are they trying to rip taxpayers off? >> no, i think it's more learning curve, because they do a lot of services and it's hard

to validate a service so we need certain items. if it was to pay a bridge we'd look at the bridge and if it passed safety inspections check the box. >> officials declined go on come ra, but they said it's tempting to be shocked by a $50 million figure but that number paints an inaccurate picture. in reality only a small fraction of that was ever in question over a period of years. >> it's a wake yaup call. >> reporter: he says our findings and the audit makes clear to him that the way the project was set up in the beginning was flawed. >> this audit clearly demonstrates that the project does not have sufficient money to finish. >> reporter: high speed rail supporter bell remains troubled by the finding that the high speed rail authority relies too heavily on outside private consultants that may not have the best interest of the state

for their motivation. senator bell says he will push lawmakers to take a more active oversight role moving forward. he wants to see a full-time inspector general to keep watch over the books. >> if money was spent inappropriately, get the money back. demand the money. >> after negotiations with the contractors the state did end up paying some of those disputed invoices or parts of those invoices. others they never paid. high speed rail officials will appear before the state legislature this spring to discuss recommendations. meanwhile patterson believes the federal rail authority may decide to conduct an audit on their own. they could order california to pay $3.5 billion back to the feds. we have breaking news to tell you about. bart is down across the bay area

this morning. bart tells us their computer system that controls the power to the trains in oakland is having problems and it's impacting the entire system. bart tells us that crews working overnight ran into problems that impacted both their power supply and their train control routing system and that without both of those, bart isn't able to safely dispatch trains for service. for now riders are encouraged to check bart.gov and the app to find allternate transportation. coming up, it is our clear the shelters segment featuring our friends from pets in need. we'll have a little tour for you of their brand new shelter right after the break.

musical treasures. it seems this musical time machine stopped in the golden age. >> this is not a place where you come for two minutes. >> reporter: it may be occasional traffic jams but make your way through the stereos and you'll land in a vinyl paradise. >> this is where people come down and start digging for the records. >> reporter: you can dig pretty deep in a pile of 50,000 records. >> it's a little overwhelming for a lot of people. over here, these are the tasty rock jams. our famous barbara streisand record. >> and he has his own philosophy of where to begin. >> reporter: and we have peter paul mary records. the store is about to become a memory itself. the owners are taking the needle off the record and shutting down. >> young people are now buying
