but he is now in custody. in a side note, the attacker actually tried to live stream his rampage and when authorities realized it, the video was quickly pulled from many social media sites. just released a few minutes ago, the white house is condemning the attack. >> we will continue to follow that. also president trump is dealing with dissension in the ranks. his signature issue, that border wall with mexico, got a definitive no from a dozen republicans. nbc's tracie potts is live in washington with what happened and what happens next. tracie? >> what happens next is they try to override a presidential veto, because president trump has made it clear that's what he's going to do. this morning, the white house confirmed they got that rejection. he has ten days to veto it. >> are there any senators wishing to change their vote? >> reporter: a republican revolt. >> yeas are 59. >> reporter: 12 joined democrats what they considered a power

grab. president trump declaring a national emergency to pay for a border wall after congress said no. >> this is not about the president or about border security. this is a constitutional issue. >> reporter: the constitution says congress, not the president, decides how to spend tax dollars. >> so now he's violating the constitution to steal money that has been appropriated by this branch. >> reporter: some republicans are concerned it sets a bad precedent and could back-fire on them. >> already democrat presidential candidates are saying they would declare emergencies to tear down the existing border wall, to take away guns. >> reporter: the block from congress will force mr. trump's first presidential veto. >> i'll do a veto. it's not going to be overturned. >> president trump will prevail. his veto will be sustained. >> reporter: still democrats are hopeful. >> my hope is republicans now see how this president is trampling on the constitution and understand that it is possible, in fact courageous, to stand up to him. >> reporter: unlikely allies

across party lines, but for how long? so now, house democrats will try to override that veto. they don't really have the votes to do so and it's tougher in the senate, where they have to pick up eight more republicans who would vote against the president. back to you. >> certainly a lot of folks watching that one. thank you, tracie. meantime, u.s. immigration and border authorities so far are not commenting on this new video posted to twitter last night. it shows a group of people breaching a section of the border wall in tee with a has where it meets the southwest corner of san diego. about 30 people including children break through, seemingly overwhelming a border patrol agent. we are not sure if it happened this week or years ago but the video has a lot of people talking this morning. >> look at them run for their lives there. turn to sports news here. where will the raiders play next season in will they stay in oakland for one more year? joins us live outside the coliseum where a decision is expected later this morning. bob? >> reporter: laura, in a few hours the commissioners with the oakland alameda county coliseum authority are going to decide whether or not to extend the lease agreement for the raiders to play at the coliseum here this upcoming football season, with the option of extending to 2020, if their new stadium in las vegas isn't complete by then. the problem is, their lease with the coliseum ended last season. both sides had a deal to extend, but that fell apart when the city sued the raiders and nfl in federal court for breach of contract over their planned move to sin city. you might recall the raiders did look temporarily at playing temporarily at levi's stadium in santa clara and oracle park in sf, but neither location materialized, so here they are back to square one. oakland city councilman ignacio de la fuente also commissioner with the coliseum authority says the lease amount would be more than $3.5 million that was paid

under the previous arrangement, that's the annual fee. if the authority approves the lease today, the oakland city council and alameda county board of supervisors would also have to give their own thumbs up. reporting live in oakland, bob redell, "today in the bay." >> a lot of people waiting for that one. thanks, bob. out with the old and in with the new. a live look at the raider's future taj mahal, stadium built near the las vegas strip. if you're wondering, vegas leaders insist there's no need to worry about the 2020 option year. the stadium is on track to be ready they say with time to spare. the man accused of the brutal killing of a woman at an oakland b.a.r.t. station could make a plea today. john lee cowell faces murder and attempted murder charges for last year's deadly standing at the macarthur b.a.r.t. station. this is the suspect, 18-year-old nia wilson died during that attack. her sister was also stabbed but survived. new this morning, a santa rosa junior college student under arrest accused of raping

another student. petaluma police say the suspect sexually assaulted the woman in the school library monday. officers located him yesterday and arrested him without incident. he is facing multiple felony charges. also new this morning, busted, police say for selling to minors, in this case not alcohol, it was cannabis and hash products. napa police sent out photos of a bust at napa smoke and vape shop. police got tips about workers selling to young people. officers closed the store yesterday and say the store owner and other workers will also be charged. if you think your commute is bad, believe it or not, probably could be worse. more than 120,000 of us spend at least three hours every day getting to work and back. that's according to a new study by apartment list. if you live in the immediate bay area, san jose, oakland or san francisco, there's about 5% chance you spend at least 90 minutes getting to work, then another 90 minutes going home. not just talking about drivers here. the study includes some

commuters who use b.a.r.t. speaking of b.a.r.t., you could soon have one more way to pay, ad fare machines, finally able to take credit cards and your debit card as well. right now if you're out of cash, you have to ask a station agent's permission to exit the station to reload your card on a machine beyond the gates. two of the new machines were installed at the embarcadero station over the last few weeks. stations between 24th street and monday comery will see them by mid-april. at the same meeting where that was announced, b.a.r.t. revealed it is on track to replace dozens of escalators along the san francisco market street corridor. the project's contract also allows the option of replacing four elevators at the embarcadero station. the total cost is nearly $97 million. happening tomorrow, san francisco celebrates holi, the annual hindu festival celebrating spring. people douse each other with color. the festival gets under way at

tesla unveiled its model y suv last night. tesla is hoping people will put down a deposit on the car, giving tesla more cash to work with. tesla hasn't built this car en masse yet and hasn't said where it will build it, much less the assembly line. elizabeth holmes would build a machine that would analyze a drop of blood. feds say it was a fraud. the story is told several times including a book called "bad blood" a podcast and tv show called "the dropout" and now hbo documentary called "the inventor" directed by alex gibney. they'll be talking about it on the third hour of the "today" show. >> just a few hours theranos was worth $9 billion and we're talking about the fact today it's all gone. obviously her machine didn't work. she was lying to investors. her rise and fall which is why we're talking about it today, is part of a new documentary. it is fascinating. >> again, they'll talk about it

yes, we're still seeing some 40s out there, including in san jose. for the most part, these 40s are going to warm up, setting us up for a lovely day ahead. seasonable temperatures, climbing into those mid and upper 60s throughout. 48 degrees right now in san francisco. we will start to notice a couple of high clouds rolling through and that's going to kind of linger into the afternoon, which may actually have some of our temperatures running just a little bit warmer, thanks to kind of a little blanket of high clouds. doppler radar right now, very quiet, and let's talk about the changes ahead, but first, let's go over your microclimate highs for today. i know you're planning out your afternoon, what do you wear to work, what do you expect after you get out of work, maybe grabbing dinner. we have 60s on the map for you, even san francisco and the coastline, low to mid-60s and yes, those are 70s on the map, up through the north bay and the tri-valley. 66 degrees for concord and down through the south bay, 69 degrees for san jose. we're going to start creeping into those 70s into the next couple of days so let's look at

the long range outlook. the high pressure will continue to dominate. that's what's been keeping the beautiful temperatures throughout, and then just looking ahead, jumping into monday, the nice weather will remain but into tuesday and wednesday, we're monitoring a bit of a system that right now it's looking like the best chance of rain will be tuesday night into wednesday. so far it's not looking like a big storm for us, but take a look down through southern california, it looks like they might get a little bit more out of that storm than we will. let's look at what we can expect over the next seven days. so again, we're going to keep the beautiful weather, all the way through st. patrick's day into monday, and then tuesday those rain chances will move in late at night, into wednesday, which also happens to be the very first day of spring, but that's okay. we've got some spring showers. you saw how well that did for our california drought free, that was revealed yesterday. >> roll that down there. all right, over here looking at great green roadways. you'll see the green hills, where you sometimes use the brown hills to orient us to the east side of the bay. no, they're all green so you'll be messed up now.

use your gps. westbound highway 4 is jammed up. this is the only jam for the bay area. i told you one lane was blocked westbound, but it happens to be i'm told your middle lane. lane number two, second from the left, and that's what's causing all of this backup. the vehicle that was shouted out in the chp report reported as 100 miles per hour, so the roadways are clear, folks, but you cannot go faster than it is safe for conditions. the crash resulted in four cars being involved there. that is a slow drive there into bay point. the rest of the bay an easy drive. the bay bridge has a few cars waiting for those cash lanes. nothing dramatic. over here, walnut creek moves smoothly. there's the folks splitting off toward 24 and 680. you saw the green over at the walnut creek interchange, and again, we mentioned the bay bridge. those cash lanes about half way past the parking lot. fast track is starting to show a few folks waiting as well. we have a lighter build as we approach the time when we normally see the metering lights on. we'll see if they delay that by a couple. back to you. >> 5:20. coming up next, it was a shooting that made headlines in

welcome back, everyone. 5:23. you're looking at cell phone video showing a controversial takedown of a woman in south florida. in the video, an officer you can clearly see grabbing the woman by the neck, wrestling her to the ground. miami-dade police say they were called to the area after two women were arguing with a man who they claim threatened them with a gun. the police chief is calling the video deeply troubling. at least one officer is on paid administrative leave, as the

department investigates. the father of a man acuse a in a deadly shooting in tennessee facing charges of his own because authorities say he he illegally supplied the man. 11 months ago a man opened fire at a waffle house. four people died. authorities say three years ago the gunman was treated at a mental health facility, and had his firearm license revoked. but his father, who lives in illinois, is accused of ignoring orders to not give his son any weapons following his son's treatment. >> 5:24 now. today marks the one-year anniversary of when six people died when a miami pedestrian bridge collapsed. you might remember this. it was at the campus of florida international university. a vigil and mass will be held to remember the lives lost in the tragedy. one year ago, the 950-ton bridge just crumbled to the ground, killing five people who were in cars below.

up, this crash still blocks your second lane, one of your middle lanes jamming up traffic all through the area. i'll give you some alternates coming up. the rest of bthe bay an easy drive. developing this morning as we've been following in new zealand, a tale of horror as worshippers were slaughtered in a terrorist attack. >> the number of people who died in that attack, 49, shootings at two separate mosques and the gunman live streamed the whole thing on facebook. the terror unfolded around 1:30 friday afternoon local time in the city of christchurch, that is the largest city on new zealand's southern island. right now, it is believed that one man armed to the hilt attacked both of those mosques, but authorities are not yet confirming that it is, in fact, the same person. in both cases, the gunman walked through the front door during friday prayers and started firing at will. dozens of other people are injured. authorities say four people are in custody, three men and one woman. one of them is believed to be

is having a huge impact on cities in the bay area, and around the u.s. >> "today in the bay's" pete suratos is live outside the islamic center of san francisco with deail s details on what' going on there. >> reporter: good morning to you, laura and kris. the san francisco police plan to increase what they call passing calls around this area or patrols in essence around mosques in san francisco. so far this morning, we haven't seen any of that, but that could also change throughout the day. we'll show you the tweet with that information sent out by san francisco police. sfpd says they're following the event in christchurch, new zealand. officers will be making extra passing calls at san francisco mosques. "we work stronger as a team. please, if you see something, say something." they're not the only domestic department doing this. new jersey and lapd announced last night they're adding patrols around mosques in los angeles. there's no apparent threat to los angeles when it comes to

this situation but extra patrols were added nonetheless. i want to read off a portion from a state from the council on american islamic relations, the statement says "we mourn the heartbreaking killings of men, women and children gathered for prayer in their houses of worship and urge leaders in our nation and worldwide to speak out forcefully against the growing anti-muslim relations." also tweeting this, their executive director says that he has family in new zealand and says there's a lot of refugees there who left war-torn countries to find a safe haven, only to be murdered. absolutely heartbreaking." of course we'll keep an eye on local reaction here locally as we're live here in san francisco, pete suratos for "today in the bay." >> thank you, pete. >> we'll continue to follow the situation in new zealand

throughout the newscast as well. thank you, pete. in the bay area, a once raging inferno in contra costa county is out this morning. three homes destroyed after flames erupted on bethel island. thick, black smoke could be seen for miles. the fire started just before 6:00 last night. complicating the battle to put it out, the fact that the island doesn't have a fire station and the only fire hydrant is downtown. >> we have a fire pump hooked up to the water itself, in the delta, but yeah, we had to turn it on and use it but there's no one here to operate it that knew how to use it. nothing we can do. >> the cause is under investigation this morning. no one was hurt. hundreds of employees with oakland unified school district are expected to get layoff notices either today or tomorrow. among them, secretaries, librarians, job coaches and reading tutors. this is part of a nearly $22 million cut approved by the school board last week. this, of course, as you might remember, does not mean that everyone will be fired. it's just that district

officials have to give them notification by law by a certain date. they are still working to secure grant funding to secure many of those positions, and some positions will be reassigned. school board members have said that the cuts would help pay for teacher raises following last month's strike. young people across the nation, including here in the bay area are organizing a plan to walk out of class today. it's part of a global call for action on climate change called the youth climate strike. in the bay area alone, some 20 events are planned, that includes the march in san francisco, starting at 10:00 a.m. from nancy pelosi's office to union square, that's where students will rally. on our website we put together the complete list. 5:36 now. a critical highway connecting marin to solano county is being shut down next weekend. highway 37 just east of 121 will close next saturday beginning at 7:00 in the evening, to make emergency repairs to a railroad crossing east of sears point. the road is set to reopen sunday morning at 10:00.

crash which remains in the roadway. we see traffic slowing and then folks are bailing off at bailey road. we'll give you another alternate coming out of antioch. housing advocates be are are applauding a new statewide push for rent control. democratic assembly members introduced a series of bills meant to add a rental cap and statewide limit on rent hikes year over year. they rejected a rent control ballot measure last year that would have been applied statewide. reverend al sharpton plans to join the family of stephon clark for a news conference at the state capitol on monday, which marks exactly one year since his death. earlier this month, prosecutors announced they would not charge the officers who shot and killed clark. the officers claimed they thought clark was pointing a gun at them, but he was holding a cell phone. he will then join the city's mayor as part of a speaker

series, the reverend will. now to developments in decision 2020, presidential hopeful and california senator kamala harris said she supports stopping the death penalty at the federal level. harris made that declaration during an interview on npr yesterday. she says if she was elected, no one in the u.s. would be executed. harris also applauded governor gavin newsom's decision to use executive action to stop capital punishment in florida. president trump tweeted earlier this week he disagreed with the governor's decision, saying "friends and families of the always forgotten victims are not thrilled, and neither am i." >> here is a look at the 31 u.s. states that have the death penalty right now. five states ended capital punishment in just the last ten years. conservationists are raising concerns about a white house announcement expected later today. it would ease protections for the sage grouse bird species. it would open current restrictions for oil and natural

gas drilling in parts of 11 states. it is not considered endangered but four years ago the obama administration adopted new land management plans to better protect the birds. the white house calls those policies too restrictive. a string of defeats for president trump in the last 24 hours. >> scott mcgrew joins us now. he says he's getting ready to fight back. >> president trump says he's going to veto a resolution that passed both the house and then the senate, trying to stop him from taking money to build the, take money from the military to build the wall. here is his reaction "veto!" in a simple tweet. we knew there would be republicans voting against the president's plan but it turned out to be far more republicans than we expected. we figured about four and ended up with 12. now it's not that those republicans don't agree with the need for a wall or don't support the president broadly. it's that they feel the president was taking too much power. they were defending their branch of government legislative against the executive. the president has ten days to

veto the bill. meanwhile, the house unanimously republicans and democrats together voted to demand the mueller reporting released to the public. that move has been blocked in the senate by the president's closest allies, senator lindsey graham. he doesn't want the public to see it. to be clear, there are two mueller reports. the report mueller makes to the attorney general, bill barr, and then barr gives a report about the report to congress. it's unlikely you'll see the raw details that barr sees. that's by design. the rules changed after the special investigation and eventual impeachment of bill clinton that were very intimate details in that report that made their way to the public, and the intention was to not let that happen again. president trump has not reacted to north korea's new statement it may resume missile testing after the failed summit in vietnam. trump and north korea dictator kim have had two meetings, you recall they used to call each other names, then president trump said they were in love.

yesterday we were shouting it from the rooftops, california is officially drought free and that's the first time since december of 2011, and this was released yesterday which is why it has yesterday's date and the day before that on thursday as well. look at that, we've got march 1239, which 13th of 2018 last year and look at what it looks like this year, beautiful conditions throughout california. enjoy that sunshine. it's going to last all the way through st. patrick's day, with our next chance of rain moving into tuesday night and wednesday. mike, how are the roads? >> we're going to start with the big problem. one major problem here coming out of antioch, pittsburg. pittsburg jamming up into bay point at bailey road, two left lanes are open, three right lanes are blocked. the off-ramp is an option for folks trying to get out of the back yum. it's five miles backup to summersville. everything else is looking clear through contra costa county. i can give you the alternate waze timed things out. we talked about the surface
