moves in, and mike, you're still tracking our crash in palo alto. >> i am, which sounds like a big deal but you can't see it from this big shot of the bay area. brentwood no problem, down through toward the south bay and over toward the peninsula side, where we show you the one area with unusual slowing, is northbound 101 coming just up toward the embarcadero exit. there was a crash there, a car blocks your two left lanes and a fire crew arrived to lend assistance. it sounds dramatic but sounds like this happened because, look at that, it went to green, a car hit a tire in the roadway. very dark in that area of the peninsula. they remain there until they can clear the tire and the vehicles involved. we'll track that. back to you. first to:can cloud cover county, a shooter is on the run this morning, after shots were fired in downtown walnut creek. our cameras were there as that crime tape went up late last night in the area outside the

union bank and century movie theater. we can tell you that one person was taken to the hospital with non-life-threatening injuries. that victim was shot in his back. again, no one is in custody this morning. walnut creek police are expected to tell us more later this morning. of course we'll bring you a live report coming up in 25 minutes. it is 5:02. vindicated, that's the message from president trump from the white house this morning after the justice department released a summary of robert mueller's russia report. we're waiting for word from u.s. california senior senator, former san francisco mayor dianne feinstein, on her reaction to the summary after calling for it to be released when the u.s. attorney general was confirmed in january. both sides of the aisle want to see his original findings, evidence, interviews, really everything. "today in the bay's" tracie potts joins us live on capitol hill this morning to explain what is next. this is a big day moving forward, tracie. >> it is.

we're seeing reaction from the white house, the president's legal team, from the president himself. he's been tweeting messages of victory this morning, excerpts from the mueller report, although we have not seen the report yet. we saw the attorney general's summary and while it was very clear that there was no collusion, it was less clear on obstruction of justice. what happened, mueller couldn't decide one way or the other there was evidence for and against. he said that the president was not, had not committed a crime, that they couldn't prove he committed a crime but they also couldn't clear him, so the attorney general decided not to prosecute. democrats not much faith in this attorney general, who had criticized the investigation. now, here's president trump's reaction to the investigation being over. >> this was an illegal takedown that failed, and hopefully somebody's going to be looking at the other side, so it's

complete exoneration, no collusion, no obstruction. >> it is imperative that the attorney general release the full report and the underlying evidence. >> that is because democrats are still investigating, and they want to see not only the report, but the evidence behind it, the interviews, the other evidence that was collected. they think they might be able to use it in their own investigations. back to you. >> thank you, tlaracie. 5:04 to operation varsity blues, the admissions cheating scandal. the first wave of defendants involved is set to be arraigned in court in boston today. actresses lori loughlin and flesifles i felecity huffman will not be arraigned until later. 12 colleges and coaches involved in proctoring as well as providing financial situation to

provide false tests will appear in court. some of california's schools allegedly involved as part of the investigation include stanford u, c berkeley, usc and ucla. actresses felecity huffman and lori mcloughlin are scheduled to appear in federal court friday. "fuller house" co-star accepted an award at the kids choice awards over the weekend, candace cameron beret who plays d.j. in the series says "family sticks together no matter what." possibility of a teacher strike in san ramon, dublin and surrounding communities are about to be officially off of the table. earlier this month, the san ramon valley education association ratified the tentative agreement reached with the district. tomorrow, they'll bring the agreement to the board of education for final ratification. the union represents nearly 1700 educators who say they were prepared to walk off the job for a raise as well as smaller class sizes, and more resources.

a follow-up to a story we first brought you last weekend, an east bay principal who police say was shot by his wife has died. paul schachtwell was on life support and slipped into a coma after being shot at his home last saturday in pittsburg. investigators believe his wife shot him with a handgun after an argument. prosecutors will seek murder charges against her. he had eight children. an open case an open-ended heartache for a grandfather of a san jose teenager gunned down without explanation. it's been two years and still no arrests. "today in the bay's" bob redell is live for us at san jose police headquarters with the latest on the search for the killer. bob? >> reporter: marcus, san jose police tell us that after all this time, they still have not been able to identify or make any arrests of suspects in the murder of 19-year-old joseph

veramontes. the last two years have been agonizing for his 74-year-old grandfather, cor close pardeza. he says he can't eat or sleep without hearing his grandson asking him to do something to find his killer. viramontes was a beloved teammate in the san jose 49ers youth football league for a number of years. his grandpa told us somebody has to know something and he wants them to come forward so he can feel just a little relief from his crushing pain. >> i can't replace him. i can't bring him back. the only thing i can do is find this jerk that did this, okay. it's two years now. and he's running the streets free. somebody knows something. >> reporter: take a look at your tv screen. here are the details of joseph

viramontes 'murder, shot sometime between friday march 24th and saturday march 25th, this was back in 2017. he was found on bart street near toyon elementary here in san jose. his grandfather did put up a reward and so did crimestoppers. if you know anything, you can report it anonymously, we have the phone number up there for crimestoppers, you can see it there, 408-947-7867. reporting live outside san jose police headquarters, bob redell, "today in the bay." >> no doubt that family needs closure. thank you. it is 5:08. if you live or work in oakland the city has a warning for you this morning. on wednesday usgs teaming up with oakland and alameda county to test its earthquake alert system. the state office of emergency services will send a shake alert to all cell phones in that downtown area at 11:00 a.m. the government already uses the system to send out amber alerts and severe weather alerts. the idea is to give people a few seconds' warning in the event of

a real earthquake. 5:08 right now. the legal battle over the iconic flint stone house in hillsborough is heating up and you can see from the home, you can see it from interstate 280. it is now owned by the fang family which owns "the examiner." hillsborough leaders recently sued calling the home's most recent decorations a nuisance but they're battling a solid legal team, including former san francisco supervisorage leeal a alito. people feel priced out living in the bay area but a new silicon valley poll a whopping 44% of residents are considering moving away. 77% of those who said they plan to move in the next few years say it's because of housing costs. 51% cited traffic as a major factor as well. poor quality of life came in at 45%, and taxes came in at 41%.

a silicon valley leadership group conducted that poll every year. happening today, if your commute takes you through santa clara, you might want to budget a little extra time this week. crews are closing part of lafayette this week to work on repairing a sink hole. the work is 7:00 this morning through 5:00 this afternoon between caya de luna and highway 37. got to get them patched up before more rain comes in. >> more rain and more potholes and the need for the umbrella throughout the week. here is a look at mild temperatures you'll feel as you head out the door right now at 5:10, and our morning commute in antioch looking good to start, but there will start to be rain moving in, also for the rest of the bay area as we go into late afternoon. we're seeing the rain already in the north bay but it's slow moving and i'll be tracking that for you with the time line. mike you're tracking two crashes. >> one crash in palo alto and

we've seen the backup of the bay bridge toll plaza form for all lanes, ready to take your money for all these folks as you travel over toward earning your money in san francisco. good morning. i'm frank holland at cnbc global headquarters. here are today's top business 1qu headlines. week out in the positive. as investors continue to worry about a slowdown in the economy and whether that could lead to a recession. overnight in asia, japan's market posting its worst day of the year. europe is also lower. on friday the dow falling more than 450 points, its worst performance since early january. on the watch list reports on the housing sector, consumer confidence and fourth quarter gdp. american airlines is canceling about 90 flights per day through april 24th due to the grounding of boeing 737 max jets following two deadly crashes in ethiopia and indonesia.

american has two dozen 737 max planes in its fleet. not every flight on the 737 max is cancels as americans make arrangements to use other aircraft. and prices at the pump they're jumping. the average price of regular unleaded rising 16 cents in the unleaded rising 16 cents in the past two weeks. in it's now $2.66 a gallon nationwide. there in the bay area, gas is averaging $3.64 a gallon. analysts say the increase comes as supplies get tight while refiners undergo maintenance in higher demand demand of the summer driving season which unofficially kicks off memorial day. gas prices are exactly the same level they were at this time last year. last time i said i guess we can't complain at $3.64, maybe you can. back over to you. >> exactly. >> thanks, frank. >> start riding my bike places. 5:16 right now. tesla adding a new update to its autopilot system that may boost safety. the feature will alert drivers to traffic lights, it uses cameras and sensors to keep the

car in its lane, and navigate tight turns. if the car is about to run a light, the new system will alert the driver. but the palo alto company warns the new feature does not mean drivers should avoid paying close attention. this morning as you put avocado on your toast, bagel however you eat it, one retailer is recalling its fruits including in california over listeria concerns. no illnesses have been reported, but california-based henry avocado says it took the action out of abundance of precaution or caution, during positive results during a routine government inspection. 5:17 and talk about a double set of double trouble for two virginia couples. >> you might recall this story, we told but two sets of identical twins, they fell in love at a fair for twins and ended up getting married.

now all four plan to live in the same home, so they can raise their families together. they're hoping to even get pregnant at the same time. that's a lot of planning and i guess they all get along. >> a reality show? >> of course it is. >> what could possibly go wrong with that? >> and then they have multiples. >> put them in a tiny home or something. >> what would be fascinating to see what their kids will look like. >> i would think they'd like similar. >> totally different. that's the twist we watch for. >> then it's like -- never mind. >> all right, so this morning, as we get ready to head out the door, it is dry in the tri-valley. that's a live look outside at dublin. later on today, though, we'll start to see some scattered showers moving in, and for most of us, we won't see too much out of this. if you're on your way out to the dublin b.a.r.t. station, grab your umbrella in case. later on today we start to see rain moving through. our temperatures are cool, starting out with upper 40s.

we'll be at 59 degrees at 11:00 and 61 degrees at noon. our highs today reaching into the mid-60s, which is still about normal, as we go into the day, even though we have rain and a cold front approaching. this is such a slow-moving cold front it's going to spend most of the time this morning in the north bay, and then gradually make its way into san francisco by the afternoon. but the rain that we're seeing right now in areas like clover dale and ukiah, and extending over toward clear lake have been in the same spot for the past several hours, and once again, this system is moving very slowly, but will gradually make its progress into the rest of the bay area. so this is storm number one moving in that will bring us some rain. the second storm right behind that will be here as we go into wednesday, and it looks a little bit stronger. so this starts out with some rain that once again mostly hits the north bay. by 1:00, we're just starting to see it make its way in to san

francisco. for the east bay, it may not be until about 5:00, and maybe even a little bit later for the tri-valley and for the south bay, mostly after sunset we'll see that rain moving in, and then our rainfall totals with this initial line of rain will be about a quarter inch of rain for areas south and east of the golden gate bridge, maybe a little bit higher for santa rosa. we do also have a winter weather advisory in effect for the sierra after a nice stretch of some quiet weather. we'll see some more snow moving in and the snow this week may total up to about two feet, and elevations above 5,000 feet. so we're going to have a lot to watch here in terms of rain for the bay area, and snow for the sierra, also going to be windy headed into wednesday, high temperatures reaching into the mid-60s. mike, do you have some good news for palo alto? >> i do. this shot looks similar to what we've been showing you but there was yet another traffic break over the last 20 minutes and now everything should be moving smoothly as you come up toward university for northbound 101,

all lanes have been cleared of that earlier crash, and the big tire that caused the problem in the first place up toward embarcadero and oregon expressway. no more slowing there. peninsula is great, south bay, tri-valley, look at that, contra costa county. just a little slowing out of theality month pass and althe altamont pass and more traffic at the bay bridge. brentwood toward concord and richmond, a smooth flow of traffic. the bay bridge toll plaza though does have an early backup that formed over here for all lanes. that means the cash takers are open as well. that's a lot of traffic here and across the span. we see how packed it is up the incline, so it looks like there's a big rush to get into the city this morning, maybe a lot of folks have to catch up on some work. this jam up on the incline though is going to cause the metering lights to be turned on at least at the regular time, and should be turned on now so this may result in a little more jamming in toward san francisco until they do get the metering lights to sort of ease up the traffic on the span. here is the rest of the north bay drive, no delays, 101 all the way down to san francisco.

5:24 for you right now. authorities are investigating a fire at a southern california mosque as a hate crime, this happened early yesterday in escondido. several people were inside when the fire started. luckily no one was hurt. firefighters later found a note in the parking lot referencing the recent mass shooting in new zealand. in new zealand dozens gathered over the week toend to remember lives lost with 50 people killed in the mosque shooting there. >> today we are you and you are us. we will stand for peace and we will stand together as one. >> most of the victims were migrant or refugees, and their deaths sent shock waves through the muslim world. new zealand's prime minister has announced a top-level inquiry into what happened and what could have been done to prevent the attack. a bay area woman along with hundreds of others are safe this morning. over the weekend, their ship put out a mayday call. video from on board shows some

of the chaos. take a look at it, it was amazing to watch, as the boat ebbed in both directions. more than two dozen passengers were injured, one critically. one rio vista woman tweeted she's finally back on dry land in norway. "the viking sky" loss engine power in rough waters. it made for dangerous conditions. people got hurt from the things flying across the room back and forth. hundreds of passengers had to actually be air lifted off that ship. >> big rogue wave crashed through, smashed through a window in the bulkhead support, and it felt like "the titanic." >> i think the roughest was part was getting in to the helicopter once we got up. >> nearly 600 americans were said to be on board. 5:26 right now. it could soon be a historical first for the red planet, picture, a helicopter touching down on mars. the chopper would be part of

a slow-moving storm going to start in the north bay, eventually move south. when will we get a little dry spell this week? we'll find out with kari in just moments. thanks for joining us. i'm laura garcia. >> and i'm marcus washington. right now we want to go to meteorologist kari hall, who has been tracking that storm for us. >> we are seeing the rain mostly in the far north bay. that's where it will stay for most of our early hours, and then later on today, it starts to make its way into san francisco, the east bay, as well as the south bay later on tonight. a closer look shows mostly a light, steady rain from clover dale over toward clear lake and extending past ukiah, and we're going to see this slow-moving system once again bring us our first round of rain for the week. we are going to see several rounds of rain going into the rest of the forecast, by 1:00 it's just now starting to edge its way in to san francisco, and once again, around the evening commute into the east bay and the peninsula. i'll have another look at the time line and the weekend forecast coming up.

mike, folks are getting an early start. >> that's right, at the bay bridge toll plaza, all the toll takers reporting for work before 5:00 so all the lanes were open and filled but folks headed into the city earlier this morning as well. the metering lights were turned on at the normal time, when we saw the traffic jamming up on the incline. it's smoothing now. i was concerned about the immediate approach to san francisco but that's okay so far. some debris or road hazard near the east shore freeway. the rest of the approach through contra costa county, same for the peninsula, south bay and the tri-valley. good stuff for most of your commute. back to you. >> thank you, mike. breaking overnight in the east bay, an hour's long crime scene investigation in contra costa county. >> gunfire broke out late last night in downtown walnut creek near a popular movie theater. we've been working this story for hours. >> pete suratos is live in walnut creek with what we know as police search for the shooter this morning.

pete? >> reporter: good morning to you, marcus and laura. the scene has wrapped up in downtown walnut creek. it happened in front of the union bank on locust street and mt. diablo boulevard in walnut creek. that was the active scene last night. according to walnut creek police, it happened roughly before 2:00 p.m. in this parking lot that we're standing in. the motive of the shooting is unknown but the victim took himself to the nearby kaiser in walnut creek with gunshot wounds to the back that appear to be non-life-threatening at this time. as far as crime goes in walnut creek i was able to pull up some statistics for the month of january. looks like there have been eight reported assaults with a deadly weapon in walnut creek, and two strong-armed robberies. not many crime stats to show in the city, making the shooting fairly rare in walnut creek. no suspects are in custody at this time. we expect more details from walnut creek police later this morning. we're live here in walnut creek, pete suratos for "today in the bay." >> we'll check back with you. thanks so much, pete.

5:33. now to the bombshell report released over the weekend in washington. president trump saying he is vindicated after the justice department revealed a summary of robert mueller's russia report. democrats and some republicans want to see his original findings as well as evidence, interviews and much more. tracie potts has more on why there are still so many questions this morning. >> that america is the greatest place on earth. >> reporter: president trump declaring victory as he arrived at the white house from florida. >> this was an illegal take-down that failed, and hopefully somebody's going to be looking at the other side, so it's complete exoneration, no collusion, no obstruction. >> reporter: not exactly. according to the attorney general's summary, "the investigation did not establish that members of the trump campaign conspired or coordinated with the russian government," but special counsel

in the bay." >> 5:35 right now. santa clara county may be ready to start contacting federal authorities when violent undocumented felons are released. supervisors tomorrow will debate a measure to end the current ban preventing deputies from contacting i.c.e. it involves inmates being released, despite detainer requests. undocumented inmates would be instead held until federal authorities assume control. that move is being sparked in large part by the deadly stabbing last month of a woman in her south san jose home. investigators say 24-year-old carlos eduardo arguelo carranza killed 59-year-old bambi larson. authorities say he was a repeat offender, released twice from jail without i.c.e. ever being notified. critics are blaming sanctuary city policies. having bump stocks in your possession will be considered a felony this week under federal law. the new rules go into effect starting tomorrow. people must turn them over to law enforcement or destroy them.

are completely melting or crushing the device to prevent further use. bump stocks allow a semiautomatic gun to fire repeatedly. the push to ban the device is set in motion after the las vegas massacre. this morning, high alert in the city. the search continues for whomever shot six people in san francisco's filmore district. one of the victims died. one man says he was in the area selling flowers during the shooting. he says what he did next may have saved his life. >> one youngster reached in and took, snatched a rose from my vase. pow, pow, pow. pow, pow, pow. if he didn't snatch the rose, i might have been one of the casualties. >> the president of the san francisco naacp is asking for more foot patrol officers in that area. he's also asking for more opportunities for young people, to prevent future shootings. six weeks from now, one leading economist will reportedly lay out his economic impact from the devastating camp fire in butte county. of course, that fire was the

state's deadliest and most destructive ever. at least 86 people died. pacheco enterprise record reports that on may 6th, sonoma state economist robert eihler will headline a breakfast in chico. he examined the impact from other recent devastating wildfires and is now looking into the camp fire and the car fire near redding. other local leaders will also be on hand. new details on a possible new delays for san francisco's long-awaited central subway. muni is hoping to launch its light rail line through chinatown by the end of the year, but "the examiner" reports this morning that contract disputes may get in the way. that's ard coulding to an independent monitor, who suggests that the opening may get pushed to get worked out in time. muni says that the project is still on track. and heads up, if you're a morning commuter there and you take your way through hayward. you could actually expect a lot

of construction on i-880 this week, so crews will be working on southbound lanes, this is between wynton avenue and highway 92. work is expected to last from midnight until 4:00 a.m. each night until thursday morning. crews are installing new signs for 880, express lane project. work picks back up again next week. something to be mindful of, mike. >> that's true and not a surprise, folks traveling through the area have seen the closures over the last week and a half, and have been at various times a full closure or partial. watch for bright lights through that area. right now, we're seeing a little slowing because the commute is just starting to build through hayward and headed south. the south bay itself shows a standard drive. we are looking at one crash i pointed out, westbound 580, getting away from that east shore freeway headed past regatta. it's over on the shoulder, there say good amount of traffic headed toward that richmond to san rafael bridge and look at the bay bridge span itself.

you can't make it out too closely but i put my face close to the screen and i could see the incline is moving well. >> is that how you check? >> i do. sometimes i go through the screen. >> we'll have to send kari out to really feel that rain. >> hey, we're doing that already in the north bay. the rain is coming down as you get ready to head out the door, mostly santa rosa on northward, and then this system will bring us some soggy weather to the rest of the bay area later on today, and this is the first in a series of two storm systems that will make it for a soggy week. by the time we get to the weekend, you'll really appreciate this, looking at highs inland in the low 70s, and mostly sunny skies. san francisco will also have some beautiful weather, looking at some mid to upper 60s. so as we make plans, if you're going to the tri-valley, it's going to be 64 degrees on friday, and near 70 degrees for

something the world certainly will be watching. >> "today in the bay's" kris sanchez is live in cupertino with the next steps the company is taking as well as the company's fight against amazon. >> reporter: hi there, march russ and laura. apple doesn't tip its hands before the company is ready to launch what it is that is going to be the next big thing. tech insiders seem to think this is going to be a streaming service that will be announced a little bit later today by tim cook. apple streaming service is expected to include some original programming, but also packages from traditional sources like hbo and stars. while it might seem like a move to take on amazon and netflix, nbc news reports that the strategy seems more about making iphones more lucrative for apple by creating more content and more service opportunities. iphone sales have lagged because a lot of us are not upgrading as often as they like. apple reportedly does already

dry, and i just wanted to give you that reminder that you need the rain gear, the umbrella and the jacket, and then we'll see this rain that's been over the north bay for the past few hours, starting to fill in on the radar, with a very slow-moving system, and we haven't seen it move very much all morning long, it stayed north of santa rosa, guerneville, cloverdale, ukiah now getting in on some rain that's been light to moderate and fairly widespread in those areas, extending up toward northern california. then as this moves in, we'll be tracking another system right behind that. by wednesday, we'll have another storm arriving. but this first one looks pretty weak and will bring us some scattered showers, going into early afternoon. it's just now starting to make its way into san francisco. the east bay, the peninsula seeing it around 5:00 to 6:00 and then it kind of falls apart as it moves into the south bay later on tonight and we'll be tracking another storm system moving in by the middle of the week. this one looks to bring us about a quarter inch of rain for areas

near the golden gate bridge to the east and to the south, and then for the north bay, about a half to maybe even three-quarters of an inch but the next storm system moving in will be stronger, bringing us more rain and some gusty winds. so this is the way it looks on our seven-day forecast, showing temperatures staying in the mid-60s. morning temperatures in the 40s, but off and on rain from now through thursday, and the weekend is looking amazing. as we head over to mike, you start out with what's happening in the south bay. >> i wouldn't call it amazing but it's all right. the live camera north 101, we had the volume build over the last few minutes and then it cleared, right on schedule, just before 6:00 a.m. another halfeur things will pack in for the south bay san jose northbound push. you see the slowing that happened a few minutes ago. that's 101. 680 northbound off ramp at berryessa is closed because of the crash. use alum rock exit, the one just
