fighting to get its three children back. they were removed from the home by police in the middle of night and it started because one of the children had a high fever. you can see police officers there forcing their way into the family's home. it started last month when the family took their 2-year-old son to the doctor with a fever. the clinic told the parents told the parents to take the boy to the er. after they left the clinic the parents said the boy's fever broke. dcs has not commented on this case because of privacy laws. now to this morning's breaking news in the jussie smollett case. federal officials now looking into the decision by prosecutors to drop those charges despite fact that prosecutors and police still insist that jussie smollett faked that racist attack and lied to investigators. we're going to talk to one of jussie smollett's attorneys in a

moment. first miguel almaguer has the very latest. >> reporter: good morning. the president just tweeted his reaction to this story writing the fbi and doj to review the outrageous jussie smollett case in chicago. it's an embarrassment to our nation. after the actor was indicted on 16 felonies he could have faced up to 48 years in prison. legal experts don't expect him to get any serious jail time, if any but what they did believe he would being convicted of lying to investigators. now the county's top prosecutor is in the hot seat. with jussie smollett facing no criminal charges today the county's top prosecutor is under new scrutiny. kim foxx said she reaccused herself from the case after speaking to jussie smollett early in the investigation. >> these conversations while permissionable and allowable have entered another realm when my victim has become a suspect. >> she first came under fire two weeks ago the "chicago tribune"

linking the "empire" actor in detail to the brothers who investigators say he paid to orchestrate the bogus hate crime. >> never in my mind did i think they would just drop the charges. >> reporter: their former attorney says both men were ready to testify against jussie smollett. police prepared to unload even more evidence. but say they were barred from doing so by a court order. the prosecutor now says -- >> the entire file was not supposed to be sealed so they are trying to unseal the court file. >> reporter: jussie smollett's legal victory could be sweeter. nbc news learned the feds may not pursue charges of mail fraud against the actor after police say he mailed himself this fake death threat. his legal troubles may all be behind him. that federal case may be falling apart because there isn't enough hard evidence. in the meantime jussie smollett's future on television and as a singer remains unclear.

prosecutors discussed dismissing the case. >> you don't know about any contact by friend in high places. >> no. >> kim foxx recused herself. do you know of any contact you the lawyers or anyone on jussie smollett's behalf had with kim foxx since she recused. there was no involvement with kim fog and the decision to dismiss these charges. >> the discussions were with the prosecutors who were handling the case. >> the prosecutor's office said the charges were dropped in exchange for your client's agreement to forfeit $10,000 that he had paid in a bond and to do commune service. is that correct? were those conditions on his dismissal of charges? >> there were no conditions and obviously no plea. there was no agreement in place. they did want him to for at the time the bond and that's something we discussed with him and he initially struggled with he didn't want the perception to be he did anything wrong. at the end of the day forfeiting $10,000 versus putting your life

on hold for a year was a small cost to pay. >> prosecutors are trying to say there were conditions there wasn't a get out of jail free card. you're saying he chose to forfeit that bond essentially voluntarily? >> they had asked if he would do that and we advised him he should do that because it was going to cost him almost multiples of that number to go to trial. >> what about the community service? >> we initially raised ourselves saying this is somebody who volunteered hundreds of hours, thousands of hours since he was a teenager to all sorts of organizations. something he's always done. in our discussions with the prosecution we told them about his volunteer surface. we did show them a few letters of his ongoing community service. >> was it a condition of the charges being released. >> there was no obligation. no conditions. these are things he chose to do because that's his character and again you can find out from multiple sources this is what he's done for years and years with multiple organizes. >> let's talk about some of the facts here. first of all is it your position

he is, in fact, factually innocent >> absolutely. no question. >> he didn't stage his own hate crime? >> no. absolutely not. >> he didn't send a letter fake death threat letter to himself. >> no. >> it's undisputed is it not that whatever the motive, the brothers they are the attackers here. >> when you say it's undisputed, there's more information leaks than we've received from the prosecution in discovery in this case which is a little absurd but that the situation. we've never received any of the videos that have been referenced. >> i'm talking about jussie smollett on tv. he looked at that surveillance picture, was shown the picture, asked are those your attackers. he said yes. >> when you say we know we believe that at this point with the information we've been told. a lot of information the police has put out there and said is evidence has turned out not to be evidence. we have to question he had a hard time believing because he was friendly with one of the

brothers he didn't know the older one very well. he was friendly with abel. he had a hard time believing his friend would be behind this. >> what's the motive for the brothers? >> he would be speculating at this time and i don't want to go on record right now and give my own theory of the case but i do have a theory but, you know, it is speck lakulation. >> they didn't take money, phone, car. >> no theft. nothing short of pretty much the brief interaction that you heard of. >> was it just coincidence or luck that they happened to run across him in his neighborhood at 2:00 a.m.? >> neither. so, they knew he was going to be in his neighborhood at 2:00 a.m. he had hired amp bel. jesse was in communication with abel via text and phone call.

>> he spoke to them about an hour and 15 minutes before this attack. >> correct. >> he walks out of his apartment at 2:00 a.m. and lo and behold there are these brothers waiting to attack him. did he tell them i'll be leaving the house at 2:00 a.m. >> what happened is he spoke to abel. he was delayed for four hours. he said we'll still train. when it turned out to be a four hour delay he told them we're not going train any longer and they were supposed to train in the morning and scheduling that and abel said make sure you eat. he had to eat eggs or something. >> what does that have to do with coming out of the house. >> he was being picked up by somebody. he made it clear he was on his way. on that note too, their story says that, you know, they thought or that he allegedly planned the attack for 2:00 a.m. sharp and according to the police they arrive at 1:22:00 p.m..

it's freezing cold. it's a 15 minute car ride. why would you get there 40 minutes early to wait in that cold weather which jesse got so much grief for. brothers waited in the cold for 40 minutes. >> if they were going to attack him. they were looking for their opportune. >> it makes much more sense if you look at it through that lens they were trying to catch him as soon as he got home as opposed to 2:00 a.m. >> jussie smollett was clear with police on the night of the attack his attackers were white. had masks on and gloves he saw their eyes and saw the skin surrounding their eyes. was that a false statement >> to be clear he only saw one of the attackers. he saw one through a ski mask. again he could not see their body. everything was covered. he had on a full ski mask on. he did tell police he, from what he saw he thought it was pale skin or white or pale skin. i think is what he said.

i )m ... we )re following breaking news n sonoma county: very good morning to you. it is 8:26. i'm laura garcia. there is an active homicide investigation underway in the community of hillsburg. police aren't saying very much about it except that it happened last night at the canyon run apartments. the last homicide there was back in 2016 when a father was charged with drowning his 4-year-old daughter. we'll continue to monitor that. and mike is monitoring an accident. >> yeah, the update here, 4th and king, avoid the intersection. it was a motorcycle crash involving a pedestrian as well, but no major injuries.

this is a problem off the end of 280 getting on to king. folks know the area. tends to get congested, but a small incident there in san francisco. south bay shows the biggest build and holding steady for northbound through san jose. good news matilda off-ramp has cleared. good recovery there. we're still tracking a crash santa cruz mountains southbound 17. it looks like it should be just about cleared. the northbound side had big distraction, but that has cleared. but much more traffic traveling up north toward highway 9. back to you. and i'll be back with another update in half an hour.

exclusively to nbc news. >> it is not just hollywood. it's in football. always happen in sports, and now it is at cal. >> reporter: paige cornelius explained her social media post, detailing a toxic culture in the u.c. berkeley football program. beginning with this attention-grabbing line. i will get you fired if you do not have sex with me. cornelius says that's what a volunteer assistant coach threatened during a practice. u.c. berkeley responded the same day with a statement saying, in part, quote, these allegations go against the very core of our values. cornelius, who is now on leave from cal, says she wrote the post two days after e-mails and phone calls she says she made to the school went unanswered. writing, what i did not expect was the ruthless, endless, and persistent sex harassment from the coaches. cornelius says the harassment happened on and off the field, beginning in 2017.

detailing two incidents last fall after hours with that same volunteer assistant coach. one night, she says, he offered to help her with her schoolwork. she says she'd been drinking, writing in her facebook post, he snuck me into his office. i put my backpack and binder down, and he immediately grabbed for my waist. i was terrified. my mind was fuzzy, and i do not remember much from that night. he kept kissing me, pushing me against the wall. >> this is so creepy. so creepy. i don't want to get fired. i'm leaving. i remember him grabbing at me, kissing me, putting his hands around me. >> reporter: a few days later, cornelius quit her internship but said the coach continued to contact her. while staying at the same hotel this past october, she says he invited her to his room, and she went. saying she hoped to smooth things over. i get a text from the coach. meet me in my room. when i got to his room, i was scared, so i just laid on the bed and tried to make small talk. he started talking his clothes

off. i started crying uncontrollably. cornelius didn't report the incident at the time, and says another assistant coach made inappropriate sexual advances. both coaches declined to comment. they were both unpaid volunteers who are no longer at the university. the reason for their departures is unclear. cornelius' post unleashed support and vitriol. more than a dozen women reached out to her with similar stories at berkeley. nbc news spoke to several current female athletic department employees who do not want to be identified but who say, while they love parts of their job, it is a culture of daily harassment. another intern under a previous head coach, also asking not to be identified, tells nbc news she also quit her job with the team because of constant sexual harassment by two former assistant coaches. nbc news has been unable to reach the coaches for response. head coach justin wilcox says an investigation was started as

soon as they received cornelius' allegations. >> we take pride in creating an environment where everybody is respected and feels safe. this cuts to the core and hurts really bad. we want to do everything we can as a program to support the investigation, where people can be held accountable for their actions. >> molly, these accused coaches are gone but, again, the university is saying it is taking the allegations seriously. they're still investigating. is there a sign that this may be a bigger problem on campus? >> savannah, we don't know the details of the investigation. we don't know who they're talking to. as of this morning, paige says no one from the university has contacted her. it may be bigger than just football. i've spoken to multiple women now who currently are still at cal, involved in cal athletics, who says what paige described is accurate and continues today. >> molly hunter, thank you so much. just ahead this morning, we'll shift gears and step up the skin care game. guys, listen up. the winners of "harper's
