7:05 am
not yet entered pleas. they could face, if convicted, an additional 20 years behind bars for their alleged role in this massive pay to play scheme. >> are you scared of going to prison? >> reporter: trailed by the paparazzi, lori loughlin was running errands just as the new indictment was handed down. the actress, her fashion designer husband, and 14 other parents are now charged with conspiracy to commit money laundering in addition to conspiracy to commit mail fraud. loughlin and her husband are accused of shelling out $500,000 to get their two daughters into usc. >> anything you want to say to the charges against you? >> reporter: investigators believe the indicted funneled money to william singer, the mastermind behind the scandal through his charity. disguising the payments as donations. some using offshore accounts to transfer large sums of cash. >> are you sorry for what you did? >> reporter: with prosecutors aggressively pursuing parents who have not entered a plea, loughlin and the others could face stiffer sentences with the additional felony. both counts combined carry a maximum of 40 years in prison. facing the threat, "people" magazine reports a source

familiar with the legal discussion says the couple resisted any agreements that would result in jail time. this morning no comment from the family. experts say if convicted there will be jail time. the new charges will not affect felicity huffman and a dozen other parents who already agreed to plead guilty earlier this week. this morning new drama in a scandal involving the rich and famous with every bit the hollywood twist. >> while many parents face similar charges, the guidelines for sentencing vary based in part on the amount of the alleged bribes. now, no one believes anyone is going to get 40 years in prison, but the chances of some parents seeing prison time is now very real. hoda, back to you. >> miguel, thank you. >> we have nbc legal analyst ari melber here. good morning. >> good morning.
7:07 am
>> all right. so lori loughlin and company get slapped with money laundering charges. does that make a plea bargain completely off the table? >> i think it puts a lot more pressure on them. people always ask why is there so much pressure? because the feds often hold the cards. they can add to the charges, add to the potential jail time. these will be serious conversations they are having with their lawyers why their deal just got worse. >> absolutely. we saw that first chunk of parents we talked about yesterday, they took a deal and there is a possibility that they may get no jail time at all. for this next set of parents, even if they come in and get right with prosecutors and make a plea deal right now, is there any chance they could avoid prison time with this many charges up against them? >> as you know, with these kind of charges it would look like jail time would be a part of the deal unless you drop some charges. the money laundering is very serious. they are in a much worse position than when it was just cheating, which is serious but not as heavy a charge. >> were you surprised to see how
7:08 am
aggressive the federal prosecutors are being? >> two things. one, we discussed on "the today show" that the reason that you would want to plea is that you didn't get further charges. they had the grand jury open. we knew that. here they got the further charges. number two, americans across the country are outraged over what this is. stealing the spots of the actual deserving, hard working other students. so the feds are clearly sending a message here beyond just these cases to try to dissuade people from doing this in the future. >> some of these defendants want to see it go all the way, think they will be acquitted. >> as always, people have the presumption of innocence. there may be cases where the evidence is less. it's hard when you have the guy behind the whole thing testifying against everyone he sold these services to. >> ari, always good to talk to you, thank you. to washington now. the showdown over the mueller

report. attorney general william barr back on capitol hill today after vowing to soon release a redacted version of the special counsel's findings. his announcement not satisfying many democrats. we will start with nbc white house correspondent peter alexander. hey, peter, good morning. >> reporter: good morning to you. the attorney general will testify today before the senate appropriations committee after yesterday's hearing before its counterpart in the house. william barr said the process of redacting the mueller report is, in his words, going very well, but he largely brushed off the criticism from democrats who are renewing their threat to subpoena the entire thing if he doesn't give it to congress. this morning day two, attorney general william barr returning to capitol hill to face more questions over his handling of the release of the mueller report. barr says he will hand it over soon. >> within a week i'll be in a position to release to the
7:10 am
public. >> reporter: he says americans won't see the entire nearly 400 page report saying congress and the public will get a version with redactions. vowing with the help of mueller's team to be transparent about what he is blacking out, including grand jury material and portions that would compromise ongoing investigations. >> i am relying on my own discretion to make as much public as i can. >> reporter: democrats are fiercely criticizing the approach, demanding to see mueller's full report. >> i think it would strike a serious blow to our system and to our democracy if that report is not fully seen. >> reporter: barr summarized the report's main conclusions in a four-page letter to lawmakers last month, but according to a u.s. official members of mueller's team have told associates that on the issue of obstruction of justice the report is more critical of the president than barr suggested. barr said tuesday he accurately reported mueller's conclusions and revealed that he offered mueller a chance to review his letter and that mueller declined. top republicans argue the special counsel's case is
7:11 am
closed. >> the conclusions were simple. no collusion. no obstruction. >> reporter: still, house democrats say barr is covering for his boss. >> it's clear to me that he acted as an appointee of the president of the united states and his allegiance was to the president and it may not necessarily be the truth. >> reporter: for their part, the president's lawyers say they have yet to see the report. the white house is declining to comment. >> the haven't seen the mueller report. as far as i'm concerned, i don't care about the mueller report. i've been totally exonerated. >> reporter: of course, mueller did not make a determination either way whether the president obstructed justice, specifically he did not exonerate the president. barr said there wasn't enough evidence to charge him. president trump has repeated calls to investigate the investigators, today saying it was an attempted coup, and barr testified that within the next
7:12 am
two months, the justice department inspector general will wrap up a review into key aspects of the russia inquiry, including how the fbi handled the counterintelligence investigation in its early days. barr also says he said he has no plans to ask a judge to make secret grand jury material public. >> peter alexander at the white house. peter, thanks. >> we have craig with the other beg headline out of washington. >> good morning. president trump trying to down play this week's major shake-up at the department of homeland security amid reports that his administration is considering tougher immigration policies. nbc white house correspondent kristen welker has more on that. kristen, good morning to you. >> reporter: hi, craig. good morning to you. it is day one for the president's new acting homeland security secretary. he takes over at a critical moment. the president enraged with border crossings spiking to their highest level in over a decade, and he's demanding dramatic changes.
7:13 am
today on the job kevin mcaleenan, the new acting department of homeland security secretary, is tasked with getting tougher at the border. it comes amid an ongoing shake-up within dhs. the deputy secretary offered her resignation. the president downplayed the changes. >> i never said i'm cleaning house. i don't know who came up with that expression. we have a lot of great people. we have bad laws. >> reporter: multiple officials tell nbc news the white house is working on plans to make it harder for migrants to receive asylum with some top officials pushing for border agents to do the screenings instead of asylum officers arguing they will be suffer and grant fewer passes. the president defiant on tuesday. >> and we're stopping them. if we don't stop them, i.c.e. is throwing them the hell out. >> reporter: and while u.s. officials also tell nbc news the president is eying the possibility of reinstating a version of the controversial family separation policy, mr. trump said he is not going to do that.
7:14 am
>> we are not looking to do that, no. >> reporter: but acknowledging he sees family separation as a deterrent. >> once you don't have it, that's why you see many more people coming. they are coming like it's a picnic. let's go to disneyland. >> reporter: the president enacted a zero tolerance policy last year that directed law enforcement to criminally prosecute all adults crossing the border illegally leading to an estimated 2,000 children separated from their parents. is it's a policy he reversed after a public backlash. some democrats taking aim at the administration for making so many leadership changes at once. >> it feels like this is a midweek massacre of the department of homeland security. >> kristen, you have been talking to senior officials about this overhaul at dhs. what are they telling you about timing? why is this happening now? what are they hoping to accomplish with these changes? >> reporter: the timing because you have that big spike in border crossings. more than 103,000 last month alone, craig, and that is a
7:15 am
monthly high for over a decade. what are they hoping to accomplish? well, they are hoping to implement significant policy changes at dhs. so, for example, they are talking about limiting work permits for those seeking asylum as yet another deterrent. the thinking is that the former leadership was really reluctant to make some of these changes, questioning the legality of all of it. critics are concerned that the president just wants to implement yes men and women. they are, by the way, bracing for even more staff changes at dhs. craig, savannah, hoda. >> kristen, thank you. breaking overnight, israel's leader benjamin netanyahu appears to have secured a record fifth term in office. unofficial election results show netanyahu running neck and neck with his main rival benny gantz. the likud party appears to be
