i'm laura garcia. >> i'm marcus washington. mike a look at the commute in a bit. first out the door with the weather. meteorologist kari hall has been tracking that monday forecast. >> it starts out cloudy. some of us had rain overnight. most of it is starting to move out. we have seen the cloudy skies over the south bay. a live look at san jose. our neighborhood temperature trend with mid-50s as you step out the door. it will slowly warm up today with peeks of sunshine. a little bit cooler than we have seen. we will talk more about that. and the rain moving out as well. mike, you're tracking the recovery. >> recovery is the key word. where the traffic is starting to build. we just saw a crash on the 98. we do see recovering approaching 23rd for southbound 880. more jamming on 7th and 980.

>> michael cohen is due to report to federal prison. he was sentenced to three years for tax evasion, lying to congress, and campaign finance crimes. a live look outside cohen's home. he is expected to report to federal prison 60 miles outside new york city. the prison is a medium security facility with 800 inmates who sleep in barrack style bunks. on capitol hill, president trump's administration is facing major deadlines around the president's tax returns. >> this comes as he said robert mueller should not testify before congress. blayne alexander joins us live with more on how democrats are responding. good morning, plain. >> reporter: good morning to you both. a pair of tweets came out from the president overnight. he is weighing in on the possibility of mueller testifying before lawmakers. as you can imagine, democrats had a lot to say back. it's only escalating this

growing battle between the two. a new week with new deadlines. house democrats demanding attorney general william prar respond to their request for a more complete version of the mueller report by this morning. >> we just want the information so we can do our work, so we can do the oversight that our committee is required to do. >> reporter: barr has made a less redacted verbal vacation to 12 top lawmakers, but democrats want all members to see it. if not, threatening to hold barr in contempt. >> my question to the chairman is why doesn't he read what's already available. if he wants more, then work with the department of justice to if eurg this out. >> reporter: and working to bring robert mueller before the house judiciary committee, president trump said mueller should not testify, tweeting no re-do for the dems. but just last week he said -- >> i don't know. that's up to your attorney general. >> reporter: democrats accusing the president of trying to silence mueller. and as the president's former attorney, michael cohen, is set to report to prison today in

part for lying to congress, president trump is still considering whether to let don mcgahn testify before lawmakers. house democrats have subpoenaed mcgahn demanding documents by tomorrow. but president trump could invoke executive privilege and block mcgahn's testimony. and there is one other major deadline we're watching and that has to do with the president's tax returns. today we could learn how the administration plans to respond to the subpoenas demanding to see the president's taxes. steve mnuchin missed the first deadline but says he will comply today. the u.s. is sending a carrier strike team and bomber task force to the middle east. the trump administration says this is in response to a, quote, number of troubling and effect la tore indications from iran. john bolton didn't give any

specifics what they were responding to go but says they are sending a clear message to iran. the u.s. is prepared to respond to any attack. this is video of the uss abraham lincoln near the strait of gibraltar last month. a somber day in court. 36 people lost their lives in the fireback in 2016. "today in the bay" bob redell is live for us this morning. bob, do we know who may take the stand this morning? >> reporter: marcus, in a few hours the prosecution will begin presenting its case at superior court in oakland. we did speak with tony serra, one of the defense attorneys. he expects the attorney will call five witnesses to the stand, including those who escaped in oakland two and a half years ago that killed 36 people. and former ten nantz who lived in that --

>> all right. it sounds like we lost his microphone there. but we expected several defendants to actually testify in the ghost ship warehouse trial. it is interesting because the defense is claiming that the fire itself was set by several different people. they are claiming it was arson. we'll see what the rest of the trial entails as we continue to follow that. 6:06 right now. a developing story still in contra costa county. a massive melee at a popular mall parking lot with an officer pepper sprayed. >> reporter: yeah. good morning to you, laura and marcus. we know so far there were 70 people taking part in this melee in the parking lot of the sun valley mall some pleasant hill. i want to show you behind me. that's the safeway parking lot. we're learning that the fight spilled into that parking lot as well. that's right along here on contra costa in pleasant hill.

police say it happened roughly 8:30 p.m. saturday night. concord police, and sheriff's deputies were called to break up the scene. 30 juveniles took part in this fight. it's unclear whether everyone was coming from. we do know one police officer and a security officer needed treatment for a pepper spray exposure but they do appear to be okay. they disbursed fairly fast. they had three police agencies on scene. they tell us no further investigation is expected by police at this time. pete suratos for "today in the bay". thanks for the latest, pete. >> a heads-up now for anyone needing a rideshare this weekend. some drivers are planning to strike. uber and lyft drivers. this is a nationwide strike impacting cities like san francisco and los angeles. all this is in hopes of getting a living wage, fixed fares and

job security. 6:07. if you're a bay area sports fan, prepare for a busy night ahead. you will have choices to make, of course. the warriors take on houston in game four of their nba playoff series. warriors lead 2-1 after losing to the rockets in overtime saturday. and about 30 minutes after the warriors tip-off, the sharks and the colorado avalanche there will drop the puck for game six of their stanley cup playoff series. and most importantly, right here. if the sharks win tonight, they move on. they are up 3-2. but they will have to win tonight on the road in denver. >> they have to keep the momentum going. a lot of hype around that, kari. >> we have come close in the past. >> a busy time of year. all right. let's talk about our weather. yesterday storms moving through the bay area. storms over the sierra, through

right now at 6:13, still light rain across parts of the bay area. and a cloudy start as we take a look live in fremont. as we see, the clouds rolling by, we'll get some peeks of sunshine later this morning. a storm system moving away from the bay area. we will talk about what that means for cooler temperatures in the forecast in less than five minutes. in the south bay, the crash at the top of the screen just

cleared north 101 approaching the merge with 87 passing by the airport there. north 87 itself, we still have this jam. it's growing as we approach curtner. a crash blocks the left lane. that is causing early backup from the capital expressway. and very good morning. happy monday to you. this is the week that uber goes public. so for now it is zeros. used to seeing this on our board. the hit the market will take in 15, 20 minutes. really it should have been a good monday. remember, we get the spectacular job number on friday. lowest unemployment rate in 50 years. but president trump surprised everyone saying he is going to raise tariffs on certain chinese goods from 10% to 25%. it pushed the futures, the bets extra traders make on the open, down enormously. the dow down 500 points on the open. now, why would the president do this? well, he's making a bet and he's

all in. mr. trump is hoping his last-minute threat to raise tariffs this friday will make it easier to deal when they arrive in washington on thursday. you have three outcomes on this. america gets better terms, the bet pays off. talks don't move forward, and the tariffs go into place. or the president backs off, doesn't do what he tweeted he would do, which is probably the worst thing that could happen. there are a particular number of electronic sort of things, devices, supplies that we need here in silicon valley. currently 10% will go to 25%. you will see tech stocks in particular hit hard today. broadly it will be pretty bad. >> okay. one to continue to watch. >> yeah. >> 6:15 right now. "avengers endgame" is dominating the box office and shattering

more records in the process. it has raked in $2.2 billion. the total makes it the second highest grossing film ever worldwide, passing "titanic". just this weekend alone it made 300 billion nationally. avatar is still the top grossing movie of all time. >> we will see if it passes it up. >> a lot of people this weekend may not have been going to movies. it was the derby, cinco de mayo. mother's day this upcoming weekend. walking out the door to more clouds after a busy night. we have storms to track. it was all because of a system moving over the sierra.

lightning strikes tkra uninto this area of low pressure still to our south. giving us clouds and rain. so i'm still watching out for that for most of us. we will see our weather calming down. still light rain moving across parts of sonoma county as we get a closer look, we can see it moving through santa rosa, healdsburg and north of petaluma, moving to bodega bay. as the run risun rises, the wil out. low 70s today. it will be cooler. with the clouds it will keep temperatures down a few more degrees compared to what we have had the past few days. 68 in palo alto. san francisco reaching 61 degrees. still breezy. in martinez, cloudy with mid-50s to start.

a slow warmup. the storm system moves away from the bay area. the rest of the week, once it gets out of here, we will get sunshine. and our warming trend gets under way. inland valley as warm as 78 degrees. more clouds. and mother's day is looking really nice. upper 70s by sunday. san francisco stays in the 60s all throughout the workweek. mike, you are seeing some of the crashes clearing. >> that's right, kari. good recover as well. if the roads are packed, it doesn't help a lot. they are showing improvements. tri-valley and peninsula look great. north 87. this crash may have cleared. you have the jam from capital expressway to curtner.

as far as the speeds go. slower drive. speeds 10 miles per hour. better than a few minutes ago. a lighter volume overall for the south bay. we just see more volume for 101, 87 affected by the earlier crash which cleared. a slower drive. west 92 across the san mateo. nothing dramatic. the earlier crash is cleared to the shoulder. there may be defree in the roadway. we are seeing a little slowdown. back to you. >> new for you, all lanes of interstate a 505 back open after a deadly crash last night south of allendale, three miles north of vacaville. at least one car was fully engulfed. sadly, one person died. two others were taken to the hospital with major injuries. and three others were treated at the scene for minor injuries. the cause of the crash is under

investigation. >> in just hours, san jose police are expected to learn more about a deadly police shooting in which an officer was dragged by the suspect's car. live at the san jose police department with what we know now, what we can expect to learn later today. good morning, ali. >> reporter: good morning, laura. we are expecting to get an update on the police sergeant after being dragged by the suspect's vehicle over the weekend. the update will come from eddie garcia at 12:30 this afternoon. here's what we know so far this morning. we know the shooting happened in broad daylight around 1:00 p.m. east san hoe. officers went after a suspect while investigating a stolen car. we're told that the suspect sped off, hitting the officer and dragging him 10 feet before pinning him against another car. three officers then fired shots. the suspect, who is believed to be a known gang member, was killed. the violence played out in a neighborhood while families were

out and businesses were open. here's what one woman had to say. >> you don't want a family member hurt or a police officer hurt. you know, they're in here trying to clean up whatever is around. >> and we did some checking. this is the second police shooting in san jose this year so far. in this case, police have still not released the name of that suspect. but we do know at last check the police sergeant had a broken collarbone. the good news here, he is expected to make a full recovery. again, waoerb expecting updates at 12:30. and we'll be there. reporting live in san jose, ali wolf for "today in the bay". >> we will follow up tonight as well. thank you, ali. developing now in the middle east, a cease-fire holding after a series of weekend air strikes destroyed homes in gaza city. some residents returned to find their homes reduced to rubble. 70 homes are destroyed. israeli forces responding to

hundreds of rockets being fired. intense fighting finally came to a halt in the early morning hours. both sides announced a truce agreement a few hours ago. cameras capture the moments flamed erupt. this is a deadly crash as a plane landed in moscow at an airport there. 41 of the 78 passengers died. sit believed at least one american was on board. the plane had just taken off yesterday when pilots reported a malfunction and turned the plane around to land. it is possible that a hard landing ignited the flames. here's an up-close look at the wreckage. aviation investigators released this video showing a burned-out shell of the plane. it serves a handful of cities in america. the plane is russian made. not commonly flown here in the u.s. in the meantime, there is growing concern about boeing's management of the 737 max design. the company is releasing a statement detailing how it knew

for months that a safety alert in the cockpit was not working as intended. yet it did not disclose the fact to airlines or federal regulators until one of the planes crashed. the feature was designed to warn pilots when a key sensor might provide information about the plane's nose. the warning light only worked when they purchased a separate add-on feature. 6:35. next generation commuter service makes its debut on the peninsula. samtrans will offer an on-demand rideshare service. it rolls out for a small area of pacifica around linda marr park. the bus line previously served the same route. maximum controversy. that's about the only way to describe this year's version of the fastest two minutes in

sports, the kentucky derby. did you see what happened in saturday's big race? it never happened before in kentucky derby history. race stewards disqualified the winner, maximum security, agreeing it drifted into the lane of other horses. they named second place country house the winner. the owner tells nbc's "today" show he plans to file an appeal with the state of kentucky today. but, yes, i saw the horse move out. every kentucky derby you could sit down, two, three, four horses if you wanted to. it's like a rodeo out there. >> betters lost an estimated $10 million because maximum security had been the odds-on favorite. country house was a 65-1 long shot. experts believe his race was not impacted by maximum security's foul. so if you bet on that one, whew, probably did okay.

we're coming up on 6:42. a cloudy start. a look over san jose. as we check out our temperature trend, it will be cool to start. low 50s. every now and then the sun will peek out. as we head closer to noon. more sunshine today. we'll talk about a storm system moving away and what's ahead for the rest of the week in less than five minutes. we see a few of those clouds up in the sky. the roadways okay. watching for any issues. still slowing in san jose. 6:42. it is expected to be a somber day in court as testimony begins in the trial of the two men accused in the ghost ship warehouse fire. you may remember 36 people lost their lives in that fireback in 2016. in a few hours, prosecutors will

begin presenting its case. it is expected that the district attorney will fall five witnesses to testify, including people who escaped the fire and former tenants who lived in the warehouse. they will give jurors insight into what it was like to be cramped in the space with only just hours to escape. the building was there. derrick almena signed the release. both face 36 counts of involuntary manslaughter. new overnight, biodiversity paints a gloomy picture of the earth's future if nothing is done to reverse climate change. they released a report. scientists find extinction is looming for one million plant and animal species. the rate of loss is accelerating thousands of times faster than it has in the past. unless they can restore half a million species they are likely

to go into extinction in just a matter of decades. in southern california, a home explosion and fire rocks a neighborhood. >> oh, my god! >> police say there was a marijuana operation in that home in san diego. neighbors took out cell phone have&started recording this video. you can see blasts from inside the home. firefighters were able to stop the flames before they spread to other homes. one home did have exterior damage. so far no arrests have been made. 6:44. the break drivers are waiting to hear in the case of a rock thrower terrorizing a stretch of a highway. someone keeps throwing rocks at drivers on 152 west of gilroy. people were injured.

a lot of cars have been damaged. police arrested 28-year-old jeremy valdez. deputies managed to track the suspect down in a nearby feel. it came as relief for one fremont man who said someone threw rocks at his car and he has been terrified to drive-through the 152 corridor ever since. >> i don't want to go back. as long as that guy is not caught, i will not go back. >> the suspect is tied to yesterday's incidents but they have not yet determined if this is the same man tied to attacks that have been going on for months. gas prices may soon stabilize. that's what experts are saying. we have been reporting prices have been on the rise since january. even jumped five cents in the past two weeks. crude oil prices are starting to drop. that could mean welcomed news at the pump. the highest price in the nation

in san francisco $4.14 a gallon for regular. robert mueller should not talk to congress, said president trump. >> but does the president that the power to stop him? >> he can certainly stop bob mcgahn by claiming executive privilege. bob mueller, private citizen, can talk to anyone he wants to, including congress. the president does not want that. bob mueller should not testify. no re-do for the dems. there is a mixed message because the president said over and over that the mueller report clears him. his attorney general says the mueller report clears him. why wouldn't he want mueller to speak to congress? because the mueller report does not entire clear the president. it says if we were confident the president did not obstruct, we would say so. but based on the facts and the applicable legal standards, we're unable to reach that

judgment. the report in fact, implies the president could be charged with a crime once he is no longer president. that, too, is a hot topic this morning. the president retweeted a tweet saying he should get an extra two years tacked onto the first term because of mueller investigation. now, you can dismiss this as constitutional nonsense. but the sitting president of the united states retweeted it. and then referred to two years in a tweet of his own. in which he said they have stolen two years. this comes hours after speaker of the house nancy pelosi said she was concerned the president wouldn't leave if he were defeat indeed 2020 unless that defeat were by a very wide margin. the peaceful transition of power is a hallmark of the american democracy and both the speaker and the president called into question this morning. live pictures from the camera outside michael cohen's home in new york city. the former lawyer due to show up

saw storms firing up over the sierra. lightning strikes across the central valley, the bay area. it was being drawn by an area of low pressure off to our south and off the coast. now as that continues to move away, we start to see our weather coming down. but there is still light rain lingering over parts of the north bay. but really exciting to see some of the storms. and a little bit of rain that came along with it. so we are still tracking the rain moving across the north bay as you get ready to head out the door. south of santa rosa, north of petaluma. and over the hills into bodega bay. look at all clouds and interesting sunrise left behind. the east behave and walnut creek. it is going to stay mostly cloudy the next several hours. then the sun starts to peek out. temperatures warm up slowly, eventually reaching into the low 70s in our inland areas. low 60s for oakland. 68 today in palo alto, as well as napa.

eddie garcia is expected to give an update on the investigation. police were trying to recover a stolen car saturday afternoon when the suspect ran into a patrol car and sped into officers. one was hit, dragged and then pinned. three opened fire. the suspect believed to be a known gang member, died. the officer was dragged under the suspect's car. he has a broken collarbone and other injuries. a massive melee at a popular mall parking lot over the weekend. an officer was pepper sprayed. this is a live look at where it happened. 70 people were part of a brawl. it happened in the parking lot of the sun valley mall, spilling into nearby safeway parking lot. it's on the side of the wall in pleasant hill. it took place 8:30 saturday night. at least 30 juveniles are said to have taken part in the fight. one officer and a security senator needed treatment for pepper spray exposure but they
