do next. tracie potts, nbc news, washington. 5:04. a california woman is suing tess louisiana she claims her model x suv suddenly accelerated and pinned her against the wall while she was pregnant. bob redell is live with the company's response. >> reporter: marcus, the tesla company blames the mother's 2-year-old son, wofrs behind the we'll at the time. the mother said her model x is unsafe. it's faulty and that the company knows that. here's the lawsuit that was filed earlier this week in alameda superior court. the mother, mallory harcourt. she claims the incident happened last december after she and her two-year-old son came home from getting groceries. she says she put it into park. he ran out and dropped into the driver's seat.

harcourt 8 months pregnant says she crossed in front of the suv, the modem x with the door still opened accelerated lifting her off her feet and pinned her against the garage wall. the impact broke her leg and forced her into premature labor. the model says tesla should have proper driver's seat sensors and a system that should prevent it from accelerating with the wing doors opened and better software to prevent better acceleration. business insiders said tesla sent harcourt's attorney a letter defending herself writing data shows her suv quote responded to the operator's input as designed and her 2-year-old son provided some input. the data shows the brakes were pressed. the driver door closed and that the gearshift was put in drive and that over the next six seconds, both the brake and
