is a violent offender, who is also undocumented, that person is to be released and will not be -- the county many not be notifying i.c.e. that will be going forward, the same policy we have had up until this point. that's despite the fact that law enforcement has been asking the county board of supervisors to change that policy. all law enforcement agencies in the bay area signed a letter stating they wanted to change the policy except for public service. the pressure has been growing. it hit a critical point with a san jose woman who was killed by a violent convict who was not held for deportation despite several requests. santa clara county released him. l.a. county released him as well. they said they want to stay out of the courts. it's a decision that also is frustrating the san jose police chief. >> it keeps of trying to figure out who is documented, who is not documented, whether or not we

should be even keeping that kind of information here. it's not our business. >> this is not just a local issue. it's a national issue. i know i speak for most chiefs around the country when they say decisions like this are disappointing and frustrating at the same time. >> reporter: now the san jose police officers association released this statement that reads in part, immigrants have every right, along with every other resident, to be protected from violent criminals. notifying our federal law enforcement partners of the upcoming release of those individuals with a proven record of violent criminal behavior is the right thing to do and we will keep pushing until this is done. they have been putting pressure on the county. clearly that pressure did not matter in the end. so at noon today, the san jose police officers association is going to meet to talk about what's next and where we go from here at this point. clearly law enforcement, at least in the south bay, wants to see some sort of policy where if that offender is violent that

they be notified that their release be released -- that law enforcement be notified of their release. very difficult convoluted story. but we will keep covering it for you all morning long. kris sanchez, "today in the bay". thank you very much, kris. 4:34. oakland is decriminalizing national mushrooms and other psychedelics. it makes oakland the second city in the nation to do so after denver voters approved similar resolution. an amendment was added to the measure that bans commercial sales and manufacturing and bans possessing or districting magic mushrooms in schools and driving under the influence. 4:34. prosecutors are expected to rest their case in the ghost ship warehouse fire trial. and once that happens, the defense will begin presenting its case.

derrick almena and max harris each face 36 counts of involuntary manslaughter, one for each person who died in the fire. closing arguments will get under way by the end of next month. the owner of a boxing gym is under arrest facing sexual assault charges. he also works as a personal trainer at the boxing theory gym located near facebook's corporate offices. investigators say a teenage girl who works out at the gym was assaulted there. police are still looking into the possibility there may be other victims. well, a lot of people who live in el cebrante want to know if this is a symbol of hate. >> he calls it a symbol fore >> it's a tibetan sign that was invented way before swastikas

were made. it represents me not having to pull weeds in that part of my yard. what does it represent to you? >> it is not this sign as johnson claims. it is a swastika. it's offensive. renee schultz has been a neighbor for 27 years and said he has never done anything like this before. he's jewish. >> i was very clear in my feelings about it with him. so i don't agree with it. i think it's wrong. i don't like it. but it is his yard. >> a yard that also has a peace sign in it. not far from more swastika looking symbols around the doorbell. sometimes he expresses ignorance. >> what is a swastika. >> a symbol of the third reich. >> i consider the guy harmless. you know, he's a little too lazy to be a full-blown neo-nazi.

over. but we are not seeing that right now from our sutro tower camera looking down at the golden gate bridge. our temperature there starting out in the upper 50s. we're in the mid-60s in palo alto. it's 57 in napa and santa rosa 56 degrees. we're normally starting out with temperatures in the low to mid-50s. so we're already a little bit warmer than where we usually begin. and your morning commute in antioch will be in the upper 60s. feels nice. you can roll the windows down on your way to work. later on today, rolling windows up and the air-conditioning on. we'll be at 84 at 1:00 today. and continuing to go up. here's a look at our clear view over san jose. already starting to see the sun trying to make its arrival. as we go through the day, it wille day for short sleeves, tee shirts and maybe even a swim day if you'll be off work and able to get to the pool. look how hot it will be again today. these temperatures pretty much matching yesterday's.

maybe just down a couple degrees in a few spots like san jose and cupertino. east bay, mid-90s for the inland valleys. staying nice and cool at half moon bay. low 60s yesterday. we'll be up to 64 today. and the mission district back to where we were yesterday. reaching 75. and some upper 80s and low 90s for much of the north bay. still a very dry weather pattern. an area of low pressure to our north by thursday and friday that cools it off. high pressure returns once again for the weekend. that means more heat from sunday into monday. we can see the temperatures dipping and going right back up. it will also be windy as the temperatures cool off. much more of app ocean breeze. we will be watching out for gusty windows late friday and starting to relax a bit going into saturday. early next week, we're in the mid-90s. so the heat is not going

anywhere. it is slow and go through palo alto. >> yeah. kari, there's a lot of 90s on there. you might want to fix that. over here, slow and go. right here, just as you approach university for the northbound side of 101, just saw a series of trucks clear, a series of lanes and a bunch of codes. that's why we are seeing a little bit of slowing. that blip approaching university. nothing unusual. crews are on the move. chp and caltrans getting notified of various locations around the bay where they are moving crews and cones and there's a little bit of directi overnight road work. treasure island, just got word of a disabled vehicle. it may be off on the very shoulder. use caution heading toward the island tunnel, the exit toward treasure island. the bay bridge toll plaza shows a slower drive. gradually building toward the
