act. nbc's tracie potts joins us from d.c. with the latest tracie, what happens next? >> reporter: well, what happens next is they are going to vote whether or not to issue a subpoena for kellyanne conway. take a look. the white house responding to the request from the oversight committee saying that in the accordance with long-standing precedent, we respectfully decline the invitation to make miss conway available for testimony before the committee they want to ask her about statements that she's made publicly about her tweets, about democrats. the hatch act says that federal employees cannot be involved in political activities by disparaging people who are running for president against president trump. the office of special counsel says that's exactly what she did. by the way, this is a different office from robert mueller who was involved in the russia investigation. kellyanne conway has gone public to say that she's done nothing wrong here she believes the democrats in charge of this committee are trying to retaliate for her

being involved in president trump's win back in 2016 so bottom line, she's not going to show up by invitation to testify. tomorrow that oversight committee may decide whether or not to issue a subpoena. frances? >> all right, we'll see if that happens. tracie potts for us. thank you, tracie. >> the battle over border security is raging on capitol hill this morning. the trump administration is facing fierce new criticism for the conditions at some federal detention facilities on monday, officials relocated hundreds of migrant children at the texas border patrol center that lawyers described as appalling and potentially dangerous. nbc's hallie jackson has more. >> reporter: a new move for nearly 300 migrant children detained in filthy crowded conditions they have now been transferred to a tent camp after a national outcry set off when lawyers like laura visited. >> there is no access to soap. there is no access to toothbrushes

>> a sentencing hearing will continue today for a new jersey woman turned isis supporter who became a u.s. informant only to flip back to being an isis supporter. the fbi said she tried to recruit isis followers online and betrayed the government by trying to delete evidence when she was supposed to be helping federal investigators with leads on isis. she was arrested in 2016 and pleaded guilty in 2017 adds part of her plea agreement, she gave up her leads with the terror organization, but was later caught trying to correspond with them online. >> senate majority leader mitch mcconnell is expected to meet with 9/11 first responders this afternoon. this comes after blistering criticism from comedian john stewart who accused the gop leader of using the victim compensation fund as a political pawn first responder john field said in an interview that the meeting with mcconnell was long planned, but jon stewart's advocacy has helped he said mitch mcconnell should feel jon's passion as well
