moorepark avenue. it's being moderated by lester holt and his team. in a matter of hours the supreme court is expected to make landmark ruling on whether or not the 2020 census should include a question about citizenship. the decision could potentially tip the balance of political power for the next decade. "today in the bay"'s pete suratos joins us live. >> reporter: california and san francisco separately filed lawsuit when it comes to the 2020 census citizenship question. it's going to talk about the arguments for and against this question on the 2020 census. the trump administration is in favor of this. they want the citizenship question on the 2020 census

claiming it needs the data to enforce the voting rights act to help identify majority and minority districts, and it could serve as possibly discourage immigrants from participating in the census, and it could trickle down to handing information over to the immigration, and that would violate federal law. it's the first time a citizenship question has been asked since 1950s, so it has been sometime. a san mateo walgreen's is still closed at this hour, more than 24 hours after a bold smash and grab atm theft.

it happened about 4:00 yesterday morning when thieves drove through the front doors, and there's that plywood covering the stores. these thieves used a stolen vehicle, and both the car and the pride open atm were found about a block away. at this point we don't know how much money was stolen. a new law signed by governor newsom allows regulators to shutdown racetracks for safety reasons. under the previous law the board needed to complete a 10-day public notice period to suspend or move any event. the company that owns santa anita declined to comment on yesterday's bill. and then as we have been reporting for months now on "today in the bay," a university is proposing a 20-year-long development project, and it

calls for adding academic space, and a third public hearing is being held at 1:30 this afternoon at the santa clara government center here in san jose. the weather looking good for this weekend and you need to be careful as we head to the water. i want you to check out this video from the coast guard. that's a paddle border being rescued on tuesday. that battle border needed help after the strong winds pushed them into the rocks. they are doing fine this morning but certainly a reminder for people out there, as you are enjoying it, be careful because dangers could be lying around. >> the national weather service every day issues whether or not the water conditions are good for you to go out in a small boat like that. there was a small craft advisory in effect yesterday and that means don't go out there in a paddle boat, it's not safe. we have had strong winds and

5:23 right now. new details on the search for a missing university of utah student originally from southern california. >> overnight police in salt lake city searched a home in the investigation of her disappearance. officers were seen digging in the backyard with shovels and searching a garage. she vanished after taking a light from l.a.x. to soft laalt city. at this point police are not

saying if any arrests are made. authorities say that suspect is now in custody. oakland police yesterday confirming u.s. marshals tracks down the man you see here and arrested him. the 27-year-old allen in virginia is accused of striking a 30-year-old and her son, angel, as they were walking across the street in april. this was on 26th avenue and foothill boulevard. police later discovered the car abandoned a few blocks away. compelling testimony in the deadly ghost ship warehouse fires. on the stand yesterday a firefighter spoke about being inside the doomed building several years earlier. one firefighter testified his daughter once lived in the ghost ship warehouse, and he said he helped her move out and he believed the space seemed fine without any obvious safety

days. >> they sure have. bob, this fire should really be a warning as to why we need to be so careful during the hot, dry weather. >> reporter: correct. it's because the contra costa county fire protection district thinks the fire was mostly caused by a cigarette butt. highway 4 is above us, and you see the embankment, and we are standing here in martinez. you can see it was growing pretty good. the fire started around 1:00 this morning. they had it contained in about 40 minutes. firefighters also responded to a two-acre fire that broke out last night. this is in unincorporated san leandro. another brushfire reported yesterday afternoon in livermore on mines road.

you can see how close the fire got to your structure on your tv screen, and it ended up charring ten acres before it was fully contained. and cal fire tweeted out these pictures of the firefight, and the rock fire is now just over 2400 acres, and that fire started tuesday night along the canyon road just west of patterson, and it's burning through canyons and open space, and ranch land, and no structures are threatened. pg & e is preparing for potential wildfires, and the utility giant is hosting a wildfire safety open house to discuss emergency preparedness at the finley community center in santa rosa at 6:00 tonight. the meeting comes as pg & e is warning about the pre-emptive power outages.
