pleasa pleasanton, livermore, 680 is the slowest drive, unexpectedly slow drive. south bay very clear. so is most of the east bay. tri-valley is showing a slowdown toward little valley road, where the paint ball signs are, but it looks like speeds are improving. we'll follow up. guys, back to you. >> thanks, mike. new overnight a developing story in contra costa county. police need your help to find a person who shot and killed a young man. >> "today in the bay's" bob redell is live outside san pablo police department with the details and whether the public at large should be worried. bob? >> reporter: no, not according to san pablo police, kris and marcus. i spoke with a family member of the victim, they didn't want to talk. off camera, they do not know who shot and killed their loved one. san pablo police do not believe this was a random crime. they believe the victim, a 22-year-old man was the intended target. the shooting and around 9:20 last night on the 900 block of stanton avenue, not far from the intersection with giant road

here in san pablo. the officers who responded found a man in a vehicle with a single gunshot wound. police did what they could to try to save his life, until paramedics arrived but sadly, the man died there on the scene. police have not released his identity. they want to notify his family first but as i mentioned, it appears the family are quite aware of what happened and again, police believe the shooter targeted this man. if you have any information, detectives in san pablo would like to hear from you. reporting live here in san pablo, bob redell, "today in the bay." >> thank you very much, bob. we know that investigation will continue. new overnight, one person is dead, another critically injured after a late night shooting in san francisco's bay view district. it happened about 11:00 last night on jennings street two blocks east of third street. right now, police are not saying whether they know what led to that shooting but officers say one man died at the scene and another man is said to have life-threatening injuries. we are working to find out more

if there is a suspect. president donald trump is speaking out about labor secretary alex acosta who is under fire for cutting a deal with a sex offender in 2008. jeffrey epstein is facing federal sex trafficking charges in a new case this one out of new york. "today in the bay's" sarah dallof is live in washington with more. sarah? >> marcus, good morning. the president sending some mixed signals about the labor secretary, praising him for his work, but also saying he plans to take a close look at that plea deal. this morning, labor secretary alex acosta under mounting political pressure. the president saying he'll be looking very closely at acosta's handling of a controversial case involving billionaire and politically connected financier

jeffrey epstein. >> i can only say this from what i know and what i do know is that he's been a great, really great secretary of labor. the rest of it, we'll have to look at. we'll have to look at it very carefully. >> reporter: epstein is now sitting in a manhattan jail cell after pleading not guilty to sex trafficking charges in new york, but in 2008, he cut a widely criticized plea deal with then florida u.s. attorney alex acosta, allowing him to plead guilty to state charges of soliciting and procuring a minor for prostitution in order to avoid more serious federal charges. now democrats demanding acosta quit or be removed. >> we should hold this prosecutor accountable. he should resign from his position. >> reporter: republicans not going as far but wanting to know more. >> if this plea deal doesn't withstand scrutiny, then it would be a job for the judiciary committee to find out how it got off the rails. >> reporter: acosta commenting on the new case saying the crimes committed by epstein are horrific and now new evidence and additional testimony is available, the new prosecution

offers an important opportunity to more fully bring him to justice. sarah dallof, nbc news, washington. >> and new this morning, the woman who says she was sexually assaulted by jeffrey epstein speaks out. jennifer araus says she was raped by ensteep when she was in high school. she is not part of the federal criminal case against epstein. he pleaded not guilty this week to sex trafficking charges in new york. araus offers a chilling account of how she was recruited, groomed and then raped by epstein. >> did you ever tell him your age? >> i told the recruiter, i mentioned it in front of him, yes. >> you're 14 years old. >> yes, he knew very well my age. he knew exactly, you know who he was hanging out with, you know? >> she never contacted authorities to tell her story,

but she says that she did tell at least four people. nbc news reached out to all four, and all of them confirmed that she told them years ago that she had been sexually assaulted by epstein. in a few hours, prosecutors will cross-examine the defendant in the ghost ship warehouse fire. derick almena wiped away tears and pointed the finger at the city and building's landlord. he and his associate max harris face a lifetime in prison if they are convicted on all counts of involuntary manslaughter for the fire that killed 36 people in 2016. almena defended the layout of the warehouse saying that it was not a maze. he claims as many as 50 city employees visited the oakland warehouse before the fire and no one ever cited him, but the victim's families just aren't buying it. >> he is such a poor actor. he doesn't know how to fake it very well. children fake tears better than he does. >> almena also says that he was instructed by one of the

co-owners of the warehouse to lie to authorities and say that no one was living in the warehouse. san francisco voter also decide this fall on a plan for more affordable housing. supervisors have approved a $600 million housing bond. it would allow for the construction of nearly 3,000 new low income housing units. some of those units could be available within a matter of a few years, provided the bond measure is approved. new details san mateo, santa clara county officials are inspecting areas after native fruit flies were found and the bugs are considered a threat to wildlife. crews are placing insect traps near the discovery site in palo alto and also checking east palo alto and menlo park. according to county officials, exotic pets like to hitchhike on fruits and produce transported illegally from other countries. new for you this morning, some researchers believe going forward, rainy season may be on again/off again

phenomena in california, meaning they alternate between dry and extremely wet years. according to "the chronicle" the ucsd study looked at future models. they see atmospheric rivers happening every other year. overall, rain rates would most likely stay the same. we want to check in with meteorologist kari hall. we're not talking about any rain at this point. we know it's coming. right now we're talking about low clouds and cooler temperatures. >> it's nice not to have extreme drought and deal with the unusual weather at this point in the year but we are also seeing our usual sights of some foginess in san francisco, even some mist and drizzle. let's go throughout the day as we are going to see temperatures at 10:00 in the 60s and 70s across the bay area. as we go into the afternoon, the temperatures start to spread apart because we will see the fog near the coast. san francisco stays in the mid-60s and the inland valleys clear out with sunshine and reach into the low to mid 80s for the afternoon.

here we are at 4:00, in ant knock it will be 85, and soeps san jose in the lower 80s. we'll cool down tonight dropping back into the upper 50s and low 60s. we'll talk about some hotter weather in the forecast and mike, you're seeing a little change for the speed sensors? >> a few changing from green to orange, a little slowing over here through hayward. nothing major for the nimitz. highway 84 going toward the green, out of the red, looks like that crash has cleared from the roadway where you have your typical slowing, valecitos headed out of livermore toward 680 and sunol. highway 4 a build into concord, pittsburg. upper east sheer freeway the crash started slowing highway 4 to solano avenue. the lanes are open. the bay bridge toll plaza shows that build, so now we have all lanes backed up, and a slow move for the fastrak lanes but all lanes are visibly moving. the chp warned you about the fog that kari told you about as

happy wednesday. right now at 6:13, this is our last day of near normal temperatures before we start to heat things up. we do have some clouds over palo alto right now that will linger through about 10:00, and then all clear skies, and still some comfortable weather. we'll talk about how hot it gets, and where, that's coming up in less than five minutes. and over the last five minutes, we've seen the crowd build over at the richmond to san rafael bridge, that's your westbound commute in richmond. we'll show you how the approach is off the upper east shore and how does that build for the south bay. a very good morning. we've made it until wednesday. mixed markets as investors continue to worry about interest rates. we'll talk more about that in a minute.

tesla management sent out an email to employees saying get ready for increased production. watching shares of intel as well today. they may be allowed to sell to huawei again. the trump administration is issuing new rules loosening previous restrictions. twitter on tuesday issued new rules prohibiting users from attacking people based on their religion. these are rules that were already in place. at first glance it seems like a big move. it's honestly what twitter originally planned to do. twitter's head of safety told the "new york times" "we get one shot to write a policy that has to work for 350 million people who speak 43-plus languages while respecting cultural norms and local laws." probably the most important thing to watch today is jerome powell, head of the fed. he'll start two days of congressional hearings. regular scheduled appearances. president trump pressuring him to lower rates. it's not normal for presidents

to directly pressure the fed. and yet more hearings. google, facebook, apple, twitter, all going to face tough questioning next week not over censorship or privacy, but something that has the potential to be far more serious, anti-trust. are these companies too big for their own good? in the past, tech companies have gotten a good pass at congress, but the mood really has shifted, to be honest and they won't get protection from the democrats necessarily either, because remember, next week's hearings are in the house, and the democrats called for the hearing. kris and marcus, "friends" will not be there for you on netflix. it will be on a new service hbo max. "the office" is moving off as well. apple's working on a service, disney. cbs already has one i didn't know. i do hulu and netflix as well.

>> a dad had three sons, all three shared the same birthday, it was not planned. father, son and the second son, all share the same. >> that is sweet. >> what have you got, kari? >> nothing. i haven't even met anyone with my birthday, march 10th, so if your birthday is on march 10th, let me know. we're starting out with cloudy skies this morning and it's going to be a nice day, once all the clouds get out of here. let's get a live look outside in walnut creek, as we start out today, some upper 50s and low 60s as you head out the door. we'll be at 60 degrees. 63 degrees there at 7:00, and then once the skies clear later this morning, our temperatures start to go up, and it will be slightly warmer today, compared to yesterday, and so as you get ready to head out in san jose, we're also going to see the low 60s to start. mostly cloudy skies, up until about 9:00, and then it's clearing out, fairly quickly and temperatures reaching into the

mid-70s. it will be a little bit warmer for the south county with morgan hill reaching 82 degrees. we'll also see some mid 80s for parts of the east bay, with pittsburg today up to 85, and oakland topping out at 71 degrees. cool in half moon bay. the fog looks like it's safe for most of the day. palo alto 79 degrees. low to mid-60s in san francisco, and the north bay in the upper 70s and lower 80s. we have this unusual storm system moving across the pacific northwest but that will lift off toward the north and east over the next few days. our weather will change as a result, we go from an onshore wind flow and cooler ocean air to high pressure building across the desert southwest, and our temperatures going up as well. so it's going to spark the trend a little bit hotter in the valleys, going from the mid 80s today to the low 90s for saturday and sunday, and then it will come down again early next week, so our spike in temperatures, it doesn't look to last that long, while san

francisco stays cool, and gets a little bit more sunshine. and mike, the drive is slowing across the bay. >> that's right, specifically crossing the bay, on the san mateo bridge, you see the volume build over the last 20 minutes, expected for that pattern and expected for this volume as well. so no surprise this flat section and you see the sensors going to orange right there, not a problem. headed down hayward 880 down toward union city and fremont, the dumbarton bridge, expecting to show slowing. it's a lighter build. the south bay not a problem, we check on that. looking at 84 out of pleasanton and livermore, slowing past the earlier crash. lanes are flowing smoothly past the paint ball area and power plant. slowing westbound 80 toward solano the shoulder. it's a distraction toward 580 and the bay bridge toll plaza, which has the backup of course. you can avoid that toll plaza with b.a.r.t., no delay there is.

6:24 for you this morning. nbc bay area responds to an east bay woman and her noisy appliance >> nobody like that. she had a hard time getting anybody to listen, she turned to consumer investigator chris chmura and his team. >> good morning. seema seghel's brand new condo in newark came with a brand new whirlpool washer and dryer. she says the washer would bounce and shake and the dryer made similar noises. it was so bad, seema said she was afraid to do her laundry. she asked whirlpool to send a technician. it did, but seema said the tech found nothing wrong. so she asked us to step in. we asked whirlpool to take a second look. it did. whirlpool later agreed to replace both appliances worth about $1,200. we wanted to know what happened behind the scenes but whirlpool didn't get back to us.

>> and i'm marcus washington. right now we want to get a look at the forecast for you. meteorologist kari hall has been studying everything happening across the bay area. how is it looking? >> it's looking cloudy to start but sunny this afternoon, and this is our usual setup and we have our average temperatures for this time of year, as we take a live look in san jose, we are starting out with some clouds in santa clara. we'll start to see the skies clearing by late this morning and our temperatures going into the low 70s this afternoon. downtown san jose reaching up to 78 degrees, while gilroy tops out at 84. we'll talk about some hotter weather in the forecast coming up. mike, you spotted some new slowing. >> i did but it was starting to move better over the last couple of minutes. we see some folks tapping their brakes north 101 at the 680/280 interchange headed up toward 880 and oakland. i gave you a lot of numbers. right here on the map, you see orange and slowing north 101 into the area at capitol expressway. typical pattern. 87 starts to build at 85 and 280

also right about now. just before 7:00, we'll see more slowing out of san jose in toward silicon, the rest of silicon valley. everything else moves nicely in the east bay and approach toward the bay bridge, just about a half hour, slowing mostly through san pablo and hercules. back to you. >> thanks, mike. 6:32. a car break-in turns violent for a tourist in san francisco and now san francisco police are doing their part to make sure that that tourist is still safe as he recovers from his injuries. >> even as the natives are feeling less than safe as well. "today in the bay's" pete suratos joins us live from sfpd headquarters with the details and pete, nobody likes to see this sort of crime. >> reporter: that's right. good morning to you, kris and marcus. we know that sfpd has an officer with the tourist at the hospital. they're going to help that tourist who is with his son reunite with family, who is flying in from south carolina at the airport a little wit labit this morning. the scene from yesterday after that break-in took place. it did take place outside the

legion of honor in san francisco. as i mentioned, the tourist is from south carolina, who was hurt in all of this, and he was hurt when the suspects drove their getaway car at him, after they spotted that tour iist takg pictures of them breaking into his car. emergency crews were able to take the victim to the hospital reportedly with head and collarbone injuries. all together the suspects broke into two cars in that museum parking lot and residents who live nearby call the situation unsettling. >> that's scary that i think shows how little value people have about other people's lives. >> reporter: now the tourist is in stable condition, and police describe the suspects as two men in gray hoodies driving a silver car, possibly a bmw. so if you have any information to help with this case, contact sfpd. we're live here in san francisco, pete suratos for "today in the bay." >> all right, thank you very much, pete. we know a lot of folks will be watching for that investigation

to see what happens. marcus? >> 6:33 for you right now. for the first time, a death is linked to the recent violent shaking in the mojave desert. this is video of an area one hour west of las vegas. still far from the epicenter. deputies in nye county, nevada, discovered the body of the man pinned under his truck after it fell off of its jacks. investigators say that man was last seen july 3rd, the day before the first big quake, that 6.4 in ridgecrest. as for the shaking in ridgecrest, seismologists warn it will not stop any time soon. inspectors are combing through the primary impact zone, about 130 miles east of bakersfield to evaluate building safety. scientists are predicting more than 30,000 aftershocks during the next six months. that hardly makes things easier for many of the people who have been dealing with the aftershocks. >> there's more damage here than

upset about low staffing levels, crowded group therapy sessions and what they claim are extended wait times at the clippic on gary boulevard, that's where today's one-day strike will take place. kaiser recently told "the examiner" that its therapists are some of the best compensated anywhere in california and mental health services is a challenge facing all health care providers. an update now and possibly what could be the last update really to that long name change saga for one north bay school district. for years, people wanted to change the name of san rafael dixie school district due to its confederacy ties associated with the name. dixie will now give way for the new miller creek elementary school district. board members last night voted on the name change. the name change becomes official next month. the heart of rock 'n' roll at this moment happens to be the heart of the baseball world. >> last night they played the annual mid summer classic, the all-star game.

two a's took to the field, leon hendricks and matt chapman. the only giant closer, will smith. smith happened to serve up the seventh inning solo home run hit by rangers outfielder joey gallo. the american league beat the national league 4-3 for the american league's seventh straight win. 6:37 now, and the parade is starting to get under way. you see the logo there for team usa, the women's soccer winner champions are having a ticker tape parade in new york city. this is the sky view shot from overhead. the parade was starting, supposed to start right at 6:30, so we know folks are gathering there on the ground and that the parade will start to wind its way through the city. lots of folks cheering on team usa because not only was it their win this year, but it's their second consecutive win, and just a lot of pride there. >> fourth in recent years so they're not strangers to this. a lot of people slen grate icel.

we are celebrating in southern california but not dealing with the congestion they have from the parade. >> they are the national team, that's right, usa, usa. and the men playing their tournament as well, playing right now these days as well. westbound across the san mateo bridge, where we're not playing. this is a slower drive because of the commute. it's moving smoothly but you see the congestion building off of the east bay, that's 880. we've seen a gradual build across the dumbarton bridge. same thing for the south bay. san jose now pushing up in towards santa clara. nothing major there, also through saratoga, a build for 85. walnut creek interchange holding steady with a slight slowdown for 680 out of concord and toward the bay bridge a nice drive down the east shore freeway, for the toll plaza. the berkeley curve shows a nice clear drive. the toll plaza is the only backup you have there, low clouds. i'm guessing. i'm traffic, not weather. you might be familiar with this taco bell in pacifica, it

inland areas reaching up to 90 degrees. the bay at 86. for sunday slightly hotter maybe in the valleys. headed to the los altos arts and wine festival it will reach into the upper 70s there and briefly hit 80 degrees on sunday. we'll have milder temperatures for the arts and wine festival this weekend. in the tri-valley, look at how hot it's going to be. sunshine reaching the low 90s. you'll want to find some air conditioning wherever you go. if you're going out to the sierra and squaw valley, we can still see a little bit of snow left there and look at how warm it's going to be, reaching into the upper 70s by friday. 80 degrees will be the high on saturday. russian river valley also will have some hot weather, so maybe you want to find a pool to cool off in. it's going to be in the low 90s on friday as well as saturday. sunday we're still pretty hot, up to 89 degrees and for carmel valley, it's going to be much more comfortable on friday but

right now at 6:44, it's all cloudy as you step out the door but we will have more sunshine today in fremont, as you get ready to head out for the day. you can probably still leave the air conditioning off but we will have hotter weather in the forecast. more on that coming up in less than five minutes. and looking at a little bit of slowing here, as you head toward the bay bridge, where the metering lights are on but also we have more folks headed toward the richmond-san rafael bridge, where things are loosening up for the fastrak lanes. in our top stories, a 22-year-old man is dead, after a shooting in san pablo. >> this happened on stanton avenue around 9:20 last night. police say the man was found shot in his car. investigators believe that victim was targeted specifically. so far, no arrests have been made but "today in the bay's" bob redell is headed to the scene, and will have a live report for us coming later this

morning. friends and family are mourning the death of a 16-year-old student shot and killed outside of a fast food restaurant. the bay area wide manhunt is under way for this man, 21-year-old who are shea luis tejes, shot and killed 16-year-old emmanuel mosby pictured here. monday night mourners held a vigil near the taco bell in livermore where moseby died. he was a star athlete at livermore high school and people say extremely talented. >> he's a child and he didn't deserve that for a 21-year-old to shoot him like that. he didn't. it's terrible. >> he had a lot of plans and i knew for a fact, as soon as i met him, he was a great person. he had a good heart. >> police say the suspect and the victim had prior history and that suspect fired in the middle of a heated altercation.

we're learning new details about the california woman killed in a shark attack while snorkeling in the bahamas. jordan lindsay's family says the tour company did nothing to help rescue her and the staff didn't have a basic first aid kit. a tiger shark attacked the 21-year-old college student. in a statement relatives called on all tour companies to change their safety protocols. so far the company sandy tows can't commenting on the deadly shark attack. now to a follow-up, a bill that would require california priests to report their co-workers' confessions of child abuse, is being put on hold, this comes amid opposition from the catholic church. california law already requires clergy to report knowledge of child abuse and neglect, but they can keep it a secret if they learn about it during a confession. in oakland, the damage is being assessed after two separate crashes at grace baptist church, a couple miles south of the oakland coliseum. the first crash happened when a car drove off 98th avenue, ran into the church wall last night. no one was hurt, but then a few minutes later, another car

crashed into a patrol car there. we're told that the officer suffered minor injuries. new details on a state plan to give college students better access to food. lawmakers in sacramento passed the college student food insecurity bill and it will provide subsidies to tens of thousands of california students through the cal fresh program and streamline the application process. the bill heads to the governor's desk for approval. >> 6:4 rig7 right now. now to decision 2020 and the presidential race. this morning former joe biden earned millions after leaving the white house. >> the democratic candidate is releasing his tax returns. biden and his wife, jill biden, earned more than $15 million during that two-year time frame. he earned income through the sale of his book "promise me, dad," public speaking events and a teaching role. a prominent critic of

president trump resigned this morning. >> scott mcgrew, the british ambassador to the united states stepping down. >> that's right, kim derek said a number of critical things about president trump and the white house. it was never supposed to be public. he was communicating his impressions to his own government, the british government, and that's what ambassadors are supposed to do but his communications were leaked. derek told "the crown" the trump administration was "inept and clumsy." he's stepping down saying it's impossible to do his job effectively but still has full support of his home office, his boss saying publicly "the prime minister, foreign secretary and whole of the public service have stood with you. you were the target of a malicious leak. you were simply doing your job." we're also keeping our eye on alex acosta, labor secretary. back when he was u.s. attorney, he was the one in charge of prosecuting accused child molester jeffrey epstein.

there's pressure on acosta to resign but he has the backing of the president. >> he's been a great, really great secretary of labor. the rest of it we'll have to look at. we'll have to look at it very carefully. home depot has gotten itself involved in presidential controversy, as one of the founders said he would support president trump's re-election. he supported the first election, too. it's really nothing new. some people though calling for a boycott of home depot, to which president trump said "more and more of the radical left is using commerce to hurt their "enemy." they put out the name of a store, brand or company, and ask their so-called followers not to do business there. they don't care who gets hurt, but also don't understand that two can play that game!" two can play that game, because trump plays it all the time. he has called for boycotts of at&t, cnn, nfl, apple. he said never buy apple products.

degrees. for the east bay, pleasanton will reach 82 degrees with oakland reaching 71. for the peninsula a temperature range from 61 in half moon bay to 79 in palo alto. san francisco mostly in the 60s again today, with the north bay in the upper 80s for ukiah, mid 80s there with upper 70s today in sonoma. so we do still have the storm system we're watching well to our north, as it continues to bring some rain across parts of the pacific northwest, and then as it moves off toward the north and east, we'll start to see things shift here. our cooler weather will turn hotter, as we get closer to the weekend, as high pressure builds across the desert southwest. our winds will turn offshore, and so we won't get our natural air conditioning, and so our temperatures going way up. so low 80s in the forecast, in some of our warmer spots today, reaching into the 90s for saturday and sunday, but we will cool down by early next week, while san francisco kind of holding steady with some upper

60s throughout the forecast. mike, you're following up on that south bay commute. >> that's right, kari. we had a crash reported north 101 at alum rock, north of our camera right here. we saw slowing, build and then clear, build and then clear, and now we're looking like another recovery pattern here. what typically happens after a crash clears from lanes, folks hit their brakes and it ripples back and forth in this one section. true to form, 87 showing slowing north of capitol expressway. there's 280 and 85. also showing the build just before 70 right like we talked about. slowing tri-valley and east bay and building for 808 and the dumbarton bridge sees more traffic flowing through palo alto, menlo park getting toward 101. a nice easy drive that build for concord out of bay point and pittsburg for highway 4. walnut creek interchange toward the caldecott slower, morning traffic, no problem. the bay bridge toll plaza. a new crash north 880 around 980 may be an issue. chp is headed out there to check

state closer to a health care for all policy. a key portion provides financial help for middle income families to join the state's insurance pool. newsom says this is what the health care market needs. the state's new budget invests more than $1 billion over three years to help pay for the premiums of low and middle income californians. it expands medical coverage to all income eligible undocumented young adults through the age of 25. san francisco voter also decide on a plan for more affordable housing. supervisors have approved a $600 million housing bond. it would allow for the construction of nearly 3,000 new low income housing units. some of those units could be available within a matter of a few years if the bond measure is approved. now to a different update in emeryville. in emeryville, the city council
