with kari. >> it starts out nice, cool, also foggy in san francisco once again, so we're going to see this continuing for i'd say another few hours around the city. let's head inland for your morning commute. antioch at 62 degrees in the next hour. low 60s through about 8:00, and then rising quickly into the low 80s at lunch time today, so we'll get a look at all of our microclimates coming up. mike, you were saying there's something happening in concord. >> a minor crash reported, i shouldn't say little because if it's your car, that's a pain. smooth speed sensors as you get the big look at the bay. we'll zoom in to 242, the southbound side. we have a crash, as you head down off of highway 4. i see a little slowing past here, so there may have been some sort of traffic break or at least distracted drivers because of the activity. we'll let you know, as chp arrives and gives us specifics on any lanes blocked. no problems getting toward the bay bridge, where it's still very light. look at that. back to you, laura. >> thank you very much. at 5:01 this morning, racist

getting back to work now means working on articles of impeachment filed by texas congressman, right after that contentious debate. laura? >> it's interesting to hear, but it's so hard to hear at the same time. thanks so much, tracie. 5:04 right now. bay area congresswoman jackie speier and mahershala ali spoke out about religious tolerance. it happened during yesterday's event in washington. she said it is important to draw attention to the issue. >> it's an opportunity for us to recommit to it in the united states and around the world as well. >> the discussion also included testimonials from survivors of religious persecution. back here at home, protests at fremont city hall at a meeting where the council is considering creating a navigation center to serve the homeless population. some folks there are saying not near my home. "today in the bay's" kris sanchez near one of those

proposed sites, right behind city hall. good morning, kris. >> reporter: hi there, scott. that is fremont city hall right there. this is the lot that they're talking about, one two of proposed sites, neither of which is sitting very well with some community members here in fremont. hundreds of people showed up at the city council meeting last night to speak out. so many they didn't fit in the council chambers. the homeless population grew 27% in two years here in fremont, according to the city, and the idea is to put a navigation center to provide on site services and someplace stable for folks to stay for six months while they transition into more permanent housing. in addition to this site here behind city hall, there's another site that's under consideration, it's a city-owned lot on decoto avenue near reagan nursery. there are strong positions on all sides. >> i don't want homeless people running around here tipping my towards when i'm not home. >> everybody says it's a great idea, but not in my

neighborhood, so that is the challenge is finding a place that's going to be most acceptable. >> you have to ask yourself is, if you were down and out, and in trouble, wouldn't you want the services to be offered to you? >> reporter: the city council didn't take any action last night because in fact the navigation item was not even on the council agenda. so this is a conversation that is going to continue and we'll continue covering it for you. in fremont, kris sanchez, "today in the bay." >> thank you. a man accused of killing two men in san mateo county expected in court for a motion hearing today. malik dasuki pleaded not guilty. he is asking to represent himself in trial. prosecutors say he killed a taxi driver and a towing company employee, both on skyline boulevard. this happened last month. dasuki allegedly killed the taxi driver after a ride to skyline boulevard. the next day he called a specialty towing for help and then stabbed that employee, say

police. >> 5:06 right now. the oakland city council passes a ban on facial recognition within city limits. the council president says multiple studies show the technology is flawed and biased. a few months ago supervisors banned the use of that technology by all city agencies. critics say the ban makes it harder for police to track down criminals. san francisco will help more students go to college for free. the board of supervisors voted to add $15 million to the free city college fund. the funding is expected to last ten years. mayor london breed introduced the resolution working to save that pilot program. it was set to expire this month. >> don't be mad at me, kids, but it's hard to believe, back-to-school season is right around the corner. one marin county school district is at odds on when students should show up for class. according to "the marin independent journal" the t tamulpias union high school mandated later school start

a few more degrees. i'll talk more about that, and mike, you're seeing some slowing again through concord. >> the crash shows more slowing through that portion of concord, which would be 242. everything else is pretty much green. a little gathering at the bay bridge toll plaza as we expect. south 242 the crash is updated over the willow pass overcrossing and that's why the slowing makes sense, slowing back more mileage but a quicker drive west highway 4 and down 680, so do not cut the corner right now, because that will be your slower route. the rest of the contra costa county shows a nice easy drive. same thing for the rest of the bay, a little slowing out of the altamont as you expect, no problems from the south county coming into the south bay. >> hope it continues, thanks. coming up, expanding the plastic ban in san francisco. what a new proposed law is calling for. plus how much it costs you, if you forget to bring your own bag. plus avocados getting more and more expensive. what is fueling the higher prices? we'll take a look into it.

and we're still looking at that crash and the slowing, jammed up south 242 from highway 4 down toward the crash, blocking half your freeway at willow pass road. hoping to get more detail from chp. we're hoping it's clearing but we'll show you what comes up next. good morning. i'm frank holland at cnbc headquarters. here are today's top business headlines. wall street is set for a slightly higher open this morning. stocks ending a touch lower yesterday. the dow hit a fresh all-time high during the session but closed in the red, snapping a four-day win streak. today's watch list a report on housing and earnings from bank of america and netflix. sprint is informing customers of a serious data breach. hackers may have gained access to information such as billing address, phone numbers, device type and i.d. by exploiting a flaw in a samsung website. the site advertised an add a new line feature for active sprint customers. sprint was told about the breach in late june. it reset p.i.n. codes on affected accounts. but it is still unknown how many

customers are affected. google maps can show you where bike sharing stations are in several major cities. the feature is available on android and ios devices. it displays how many bikes are available and whether there's an empty space to dock your bike when you reach your destination. the new feature has been tested in new york for the last year and expanded to two dozen more cities worldwide, including the bay area, chicago, l.a., toronto, montreal, madrid and berlin. you know, nothing worse than going somewhere on your bike and there's nowhere to put it, so great feature. back over to you. >> when i was a kid, you rode around and looked for a place and put it there. >> left it on a lawn somewhere. frank, thank you much. >> on your friend's lawn. more than a decade ago san francisco became the first city in the country to ban plastic bags. city leaders want to raise the stakes, extending the ban to include bags used for produce, bulky items. a bill sailed through the first reading at the board of supervisors yesterday. the proposal impacts every grocer from farmers markets to

larger chains. vendors would have to swap out bags with compostable versions. shopper also have to pay 25 cents instead of ten cents if they want a paper bag at checkout. >> whether you put them in bags or not, avocados are getting more expensive. the average avocado costs more than $2. prices jumped 129% since last year, still rising. both the u.s. and mexico faced unusually small crops, and demand especially in the u.s. continues to rise. all right everybody, take a little close look at this next picture. it's from the barcelona airport. notice anything odd at the top of that man's head? it's a wig, but what's under it is what has some people troubled. the man was trying to smuggle over a pound of cocaine under that toupe. of course he was busted rather quickly. police say the bad hairpiece is what gave him away. hmm. the man just arrived in

barcelona from bogota, colombia. nobody noticed him at the airport there. a little lift. i do a little lift to make myself appear taller but nothing like that. >> we are completely clean under our toupees. a little glue, a little sticky. >> a little. >> so they don't need a high wind today, kari. >> absolutely not. it may blow your cover there. we're going to have some breezy winds today, but not that windy. and here's a live look outside in san jose. it's a clear start, and a really nice sunrise under way. let's head out the door to the warm springs b.a.r.t. station, with temperatures in the upper 50s. just a few clouds here and there, but overall a really nice start, and it will be another warm afternoon, as we head into the upper 70s already. if you're going out to the park today in san mateo, expect some mostly cloudy skies at about 6:00. at 9:00, we're also still feeling some cool temperatures but as it becomes mostly sunny,

there will be a comfortable day there. so we are going to have a really nice one for getting outside, but some spots are still going to be very warm. gilroy today we're going to see a high of 85, while milpitas is a little more comfortable with a high of 83 degrees. there will still be low 90s like antioch and pittsburg today. vallejo a high of 82 degrees and we're at 63 today in half moon bay. san mateo reaching 76, and san francisco again in the 60s, while the north bay in the upper 80s, a few low 90s farther north. as we check out our weather pattern, still the same. very typical with a cool coast and warm inland valleys. later on this weekend, there will be some slight cooling going into tomorrow as well as friday but then for the weekend, we'll warm things up a couple more degrees. we're looking at some 80s throughout this forecast. at least we don't see widespread 90s so that's good news for at least now. san francisco staying in the 60s, at times some clouds and

fog. mike, you're tracking some slowing through cocoa county. >> that's really the only slowing. contra costa county shows that and nothing else shows up on our map mostly green. we'll take you through the stretch of red. speeds crawling southbound 242 as you approach willow pass road. the crash there is blocking two lanes, as you get through the cut-through highway 4 west to 680 is a little more mileage but quicker right now and the crash still being addressed by chp, with no further information other than the fact that they needed two tow trucks, two vehicles involved, one spun out after they hit each other. no major injuries reported, and we have that alternate highway 4 down to 680. a smooth drive coming down the east shore freeway toward the bay bridge. at the toll plaza the fastrak lanes with the first build and the cash lanes very light. what this usually means is lighter flow of traffic coming into and through the maze approaching this area. judging by the fastrak lanes backing up we typically see the folks who make that week way

welcome back, everyone. it is 5:23. people living in walnut creek are reigniting the debate over an officer-involved shooting. 23-year-old miles hall was killed last month. body cam video shows him acting erratically before he was shot, carrying a metal pole. some wonder whether or not the shooting was racially motivated. walnut creek's police chief is asking for open minds from the community going forward. >> did i make the wrong decision into moving to walnut creek? i want to believe otherwise.

>> speaking as a police chief, a community member but more importantly as a father, i'm devastated and heartbroken for your loss. >> the city's police chief is promising the public will have access to more information in the investigation within the next few months. >> 5:24. this morning people remembering the life and impact of retired supreme court justice john paul stevens. justice stevens was the third longest serving justice in supreme court history. president gerald ford nominated stevens to the supreme court, where he served for 35 years before retiring in 2010. he was also known for wearing his trademark bow tie. justice stevens was 99 years old. the former president of peru is back in a bay area jail. you may recall alejandro toledo was arrested in march in menlo park on charges of being drunk in public. this time he's in custody for an extradition request from peru. this is a former mug shot. he's considered a fugitive of peru, wanted for taking bribes while in office.

he denies the charges. toledo has been working as a visiting professor at stanford. a san francisco neighborhood pushing back against a taco truck's plans to serve late. the business called street meet has applied for a permit to operate from 10:00 at night to 2:00 in the morning several days of the week on union and buchanan. people worry about trash and noise. they signed a petition trying to prevent it. others are on board with the plans. >> it's terrible. garbage, bottles everywhere. >> there's a lot of people out and about, always hungry and i think having a food truck here will be a lot more sanitary. >> the business owner says he simply wants to grow his business in an area filled with bars but no late night food vendors. a public hearing for the approval of the permit set to happen over the next few months. a party keeps popping up in an eastern contra costa county town, but this one is one neighbors don't want. police seem to be powerless

stopping it. here's why. hundreds of teenagers partying outside a house on the street, this was two saturdays ago outside of a home on cole crest drive in oakley. police spoke to the owner of the house the next morning but a week later it happened again. here are some concerned neighbors. >> i mean, in the hundreds, just wandering around the streets. >> makes me feel unsafe to live in this beautiful neighborhood. >> we wonder why they keep coming back, because there's no consequences. >> maybe the parents aren't home. the police chief says the ownler eventually actually be held responsible for the cost of police coming to her home, but the home is actually in foreclosure, and the owner says she's in the process of moving out, so it could be weeks or months before she's actually called in to court. >> it's 5:26. coming up, the next top stories we're following on this wednesday morning, including the earthquake in contra costa county, felt around the bay area. up next, a look back at the history of this lesser-known

a cool start, just by my standards, not kari hall's. we'll check officially but i thought it felt cooler this morning. a live look at san jose, but it looks like a really nice start now that the sun is arriving. good morning and thanks for joining us. i'm laura garcia. >> and i'm ask t a'm scott mcgr. marcus washington has the day off. >> laura, you're very sensitive. it is two degrees cooler. >> see, i was right. >> you are right and we are starting out with clear skies. this is a live look over the south bay. headed over to evergreen we'll see a few clouds here and there but overall a nice and cool start to the day. headed into the upper 70s by noon, eventually we're going to reach 83 degrees, which is about normal, but there will be some spots heating up into the low 90s. i'll talk more about that in the weekend forecast. mike, you're seeing the ripple effect. >> you don't have to have such sensitive vision to tell it filled in the toll plaza. the metering lights turned on as we were doing the last report. we saw the fastrak lanes build and cash lanes backed up all the

way as well. this is not unusual. this is what happens and it keeps the bridge moving smoothly. the other issue, the other jam is southbound 242. rippling back from this backup more traffic for highway 4. i talked about that as being the alternate. speeds are improving or not as bad south 242 but that's because there's less traffic. still two lanes blocked. back to you. >> thanks, mike. we're continuing to monitor aftershocks and anticipating maybe some larger earthquakes after a magnitude 4.3 quake shook parts of the contra costa county on tuesday. >> that's right. you could see how widespread people felt it. "today in the bay's" thom jensen is live in blackhawk, close to the epicenter of yesterday afternoon's earthquake. it's a little known fault line. thom? >> reporter: it really is, laura and scott. good morning, and the fact that this happened on this fault line hasn't experienced a measurable quake since 1980 has some people really raising their eyebrows of what could be down the road. this was centered about six

miles east of where we are right now, we're in blackhawk, on the greenville fault which runs about 44 miles stretching from the livermore valley to the diablo range. the usgs says three smaller aftershocks followed and after that 7.1 earthquake in ridgecrest in kearn county over the fourth of july holiday weekend has some people worried this could signal a larger event. experts say in geophysical terms this is normal. >> it's a one in 20 chance an earthquake will be followed by that as big or bigger. a larger shaffer shock is certainly possible, but unlikely. >> reporter: the usgs recorded six quakes across the state yesterday, 3.5 or greater, and more than 500 aftershocks following the ridgecrest sequence of events over the july 4th holiday. this morning a group of west

coast u.s. senators is fighting to maintain the nation's high speed earthquake alert system due to what seems like a constant seismic activity recently here in california and in washington state. in fact, 20 senators have signed on to a letter to the fcc urging the fcc to make sure that it maintains those high speed alert systems as it upgrades the country's network of cell towers. we're live in blackhawk, tom ho jenson, "today in the bay." a grass fire in eastern contra costa destroyed a home. the fire started last night in oakley not far from highway 4. flames also reached a big rig, destroying its cab. fire crews were able to contain the fire before flames could spread further. sheriff deputies detained a man suspected of starting the fire but no word if he has been arrested. another grass fire in contra costa county breaking out at the

intersection of highway 4 and 680 in pacheco. new this morning, alarming new information from california's auditor, according to a new report, some personal information collected by the state may not be protected. the auditor finds certain departments have weaknesses in data security and lack external oversight. the report is not saying exactly which departments are vulnerable, but it did say the judicial branch of government and the executive all included. also new this morning, a new legal fight under way over home marijuana deliveries in california. a cannabis company is suing santa cruz county claiming the county is violating state law by banning delivery by out of state retailers. back in january, regulators it allows home marijuana delivery statewide even into communities that banned pot

sales. the town of beverly hills, santa cruz county and about two dozen other local governments have sued the state to overturn that rule. the u.s. census bureau is sending out nearly a quarter million questionnaires to households across the u.s. that does include a questabout citizenship. you'll remember the supreme court ruled earlier this month it cannot be included in 2020. this test was designed and printed before the decision, and while it's not clear if or how the government will use the data, it is not the official census. another quarter million households will receive surveys that don't include the question to see what impact the question might have on response rates. later is this morning in contra costa county, a commemoration will take place to remember the lives lost in a deadly explosion 75 years ago in the mutiny trial that followed it. >> "today in the bay's" pete suratos joins us live from concord with all the details on that. good morning, pete. >> reporter: yeah, good morning, guys. today marks the 75th anniversary of the port chicago disaster

that took place in concord, and the majority of those who died in this disaster were young black sailors. as far as the history of when this took place, that explosion took place on july 17th of 1944, killing 320 people. 202 of whom were young black sailors. they were ordered to load and unload explosives on to ships with no training and also had inadequate equipment. a week after the explosion, surviving sailors were ordered to report to nearby mayor island in vallejo to resume the dangerous workloading the explosives. when 50 sailors, all african-american refused to do the work because of concerns they were convicted and sent to prison on mutiny charges. they led to the desegregation of the u.s. armed forces and early step for thurgood marshall, chief kacounsel for the naacp. barry ross was among the black navy sailors stationed at the base when that port chicago disaster took place.

>> it was a terrible thing. i mean, you wondered, is this it? is this it? is it going to explode? >> reporter: one of the 50 men were pardoned by then president bill clinton but a campaign it being led to have the remaining 49 pardoned as well. after today's commemoration event, that will take place at 10:00 a.m. live in concord, pete suratos for "today in the bay." >> my grandmother lived through the disaster and said it was an awful time. 75 drivers were caught breaking the law yesterday, this one probably takes the cake, chp contra costa county tweeting this out, a mannequin riding shotgun so the driver can use the carpool lane. they didn't get away with it. chp lovingly called this

mannequin angel. >> she looks so life-like. in her day. >> because she was wearing that california angels jersey or shirt. >> had she had a giants jersey on maybe. >> the chp agencies around the state were doing wise cracks back and forth through twitter, so goes from there. nice. >> don't try it. >> 75 of them, too. holy cow. >> my gosh, and that was a movie mannequin, too, andrew mccarthy. we have a minor crash northbound 101 around oakland road, typically where we'd see the slowing as well. chp will give us more details. we'll let you know if that's causing additional slowing. we'll track that of course. the backup at the bay bridge is there, but the big backup on that side of the bay is southbound 242. still registering with two lanes blocked at willow pass road. highway 4 picking up the volume as folks use that as the alternate to get over toward 680. we continue to track that. hopefully getting an update as tow trucks, they're waiting for

this happened at 18th and chancellor. new video in to our newsroom, several police officers on the scene, shell casings on the ground. talking to richmond police to find out more information. we'll bring you more details when we get them. a tragedy in citrus heightser in sacramento a 9-year-old died in the family swimming pool. >> mackenzie kinley was swimming in a pool when she was electrocuted. the accident was caused by a wire attached to one of the underwater pool lights under repair. friends and family describe mackenzie as an outgoing student who liked cheerleading and soccer. they say they're devastated. >> i just fell to my knees. i mean, it was just as bad if it would have been my own granddaughter. >> so sad. mackenzie was getting ready for the fifth grade at loomis grammar school. we're learning new details about the life of late rap star and activist nipsey hussle.

the "new york times" reports he was under investigation at the time of his death. the l.a. police department and the city attorney were looking into whether his clothing store was the center for gang activity. hussle was killed outside the store in march. "the times" says the investigation continued after his death. the lapd would not go into specifics but said they were negotiating with hussle's associates to try to mitigate crime issues at the store. >> quarter to 6:00 right now. l.a. county is paying $53 million to settle a lawsuit alleging invasive strip searches of women inmates at a jail. the class action suit was filed nearly ten years ago. the inmates claimed deputies shouted degrading comments while they stripped. the settlement applies to more than 93,000 female inmates. since the lawsuit was filed the county implemented body scanners and added privacy curtains. to decision 2020 and the latest candidate to join the

field of democrats vying to be the next president visits today. tom steyer's first campaign stop since announcing his bid for the white house. expected to meet voters at manny's in the mission district that event starts at 6:30 tonight. an event aimed at making sure truck drivers are ready for a new state law aimed at curbing emissions getting under way in oakland. the truck and bus regulation law aims at reducing airborne toxins from diesel exhaust. starting in january next year the dmv will only register vehicles that meet the new standards. the california board will hold inspections to go over the regulations and offer information on financial assistance. escooters are sticking around san francisco. supervisors voted to make a temporary pilot program permanent. it was set to end in october, a year after it was put into place. when that happens, supervisors tell "the examiner" they're going to invite more scooter companies into the program. sfmta says one of the

requirements will be to indicator to low income communities outside of downtown. the agency will also draw a map of where escooter companies can and cannot operate in. if you haven't gotten a chance to check out the popular daffodil hill in the sierra nevada you are out of luck. the owners announced they're going to close the attraction indefinitely. they say they can't handle the overwhelming number of visitors. that created liability and safety issues. daffodil hill has been open to the public for nearly 80 years. one heavy but beloved pet back home with its owners this morning. the chp reunited this 250 pound tortoise after officers found it on the side of a road. it was spotted sunday on the shoulder of a road near santa barbara. no word how far it got before it was captured. we do know it was not arrested for speeding though. >> how do you pick up that? that's heavy. >> true, or did they know it was missing or just they just saw the tortoise? i have so many questions. we've been talking about the

giants lately. they're not slow. they are red hot. >> no kidding. what looked like a lost season just a couple of weeks ago has become a season of hope for giants fans. the team is playing its best baseball in more than two years. giants in denver taking on the rockies last night. the game would go into extra innings. in the tenth, the giants bats broke loose scoring four runs, including the game winner from alex dickerson. they beat the rockies 8-4. giants have won 9 of their last 11 games, just three games behind securing the second wildcard playoff spot. let's hope the trend continues. >> giants are hot, a's too. they were in a dancing mood in the stands there as they hosted the seattle mariners at the oakland coliseum last night. all-star matt chapman had a big night, his 22nd home run of the season. a's crushed the mariners 9-2. 13 wins in 16 games. the a's and mariners go at it again this afternoon in oakland. first pitch 12:30.

we have to get an a's forecast this morning. >> it will be a great one. dollar day if you're headed out there, it will help the charities as well. so nice weather. we are starting out with a few clouds near the coast. we're seeing also some clearing around the city of san francisco, with fog near the bay, and then as we head inland, we are all clear this morning, and check out that seven-day forecast, up at the bottom of the screen. just minor changes over the next several days, so as you are stepping out the door in the south bay, maybe helded to diridon station, it's going to be at 57 degrees at 6:00 and low 60s at 8:00. nice cool start to the day, and then warming up for the afternoon. so let's go hour by hour for all of our microclimates. we take you to 10:00, and we're at 71 degrees in fairfield, with some low 60s in san francisco. not a big spread in our temperatures until the afternoon, where we start to see it heating up in some of our valleys. santa rosa will be at 83 degrees at noon.

81 in concord, and in san jose 77 degrees. we make it into the low 90s in a few spots like antioch and also in the north bay, but we will keep those 60s for the coast and san francisco, and then going into the evening, cools off quickly, as the winds start to pick up just a little bit more, but it won't be as windy today, so if you're about to head out the door, grab the sunglasses and you'll be comfortable with some short sleeves on all throughout the day as high pressure continues to build across the desert southwest. we are seeing our typical summertime pattern continuing, even into the weekend. only a little bit of a cooldown over the next couple of days, as an area of low pressure approaching the pacific northwest. hopefully that will bring in a little bit more cooling next week, but as we look at our seven-day forecast, we'll see mostly upper 80s. our break from the upper 80s will be tomorrow and friday, but other than that, it's still going to be really hot. san francisco staying in the mid-60s throughout the next seven days. mike, you're updating a

couple of crashes. >> that's right, one in the south bay, the other one in concord we continue to follow that one and the big backup. over here, not such a big backup. 101 is starting the typical pattern where speeds recover here north of the 06680/280 interchange. the crash at oakland road cleared to the shoulder and not providing additional problems so that's the good news because that camera does show your traditional pattern just in the approach and the rest of the south bay peninsula looks great. 880 there say crash on tis a cr shoulder. this has been the problem all morning, contra costa county south 242 that crash still blocks two lanes at willow pass road that has traffic jammed up and then slowing for highway 4 the build as well as folks avoiding the area. on our waze system, this is from waze's calculation a 15-minute delay. we can save you 15 minutes the purple route. the other one, 25, 28 minutes through the slowdown. willow pass road is an option.
