as epstein's attorney. >> thank you very much and for more we turn to our nbc news legal analyst ar ari melber and clint watt. how in the world did this set of circumstances happen when you have a very valuable federal prison inmate who apparently tried to take his life a few weeks ago but is no longer under suicide watch and here we have this result? >> it's remarkable that's why you saw attorney general barr make public comments right away this is a disaster the most valuable prisoner probably in the prison system, he's already attempted suicide he's on suicide watch. he's taken off of it quickly at the same time he's not being monitored with video he doesn't have a roommate, which is also mitigation technique they use how are these decisions made and then it comes down to is this negligence or is this something else i'm sure that's what they're going to be looking at today there has to be an

investigation into this. again we go to the facility. they have people working overtime, some say 60, 70 hours. they may be at a 70% capacity in terms of prison guards how do they implement these steps? which speaks to the greater problem, what is it like in our prisons, whether it's whitey bulger we cannot keep prisoners safe, even when alerted to this type of stuff. >> what happens now? does a lot of it go away because of his death or no >> he was charged on conspiracy which tends to include other people they didn't name those individuals. we are hearing from th prosecutors in new york could still pursue other people. but this was a huge are you kidding me moment for the bureau of prisons and the justice department bill barr and donald trump talk about what they don't like here. the buck stops with them they're responsible for this craig and savannah, this was a case from when it began under the obama justice departmentnd

now to the trump justice department there has been mismanagement and questionable calls all around >> the u.s. attorney here in the was handling this prosecution had a pointed statement to suggest this case can go on, they are looking at conspiracy people should come forward if they have information about enablers and others around epstein. what about people like the woman i interviewed who are looking to file lawsuits against jeffrey epstein? can a civil lawsuit go forwards against the estate? is there any hope they'll get that kind of justice >> the fact he's dead does not distinguish otherwise valid claims you run into the questions we always have about how old they are and what the state deadlines would be yes, you can sue the estate. >> this is the same facility that housed el chapo, bernie madoff was apparently held in the same facility. a lot of high-profile prisoners who come to new york, this is where they go. are there cameras all over the us glean what happened or what did not happen >> there are cameras, there

a year after biden was out of office a biden campaign official said the former vice president was referring to the sandy hook shootings, which took place in 2012 but with public opinion now overwhelmingly in favor of expanding background checks, president trump now says meaningful things on background checks will take place. >> the republicans are looking at it very seriously, and i really believe that the nra, i have spoken to them numerous times, they're really good people they're great patriots they love our country. they love our country so much, and, frankly, i really think they're going to get there also. >> reporter: but skeptics say the president promised action on background checks after parkland and again after las vegas. until the nra weighed in pete buttigieg arguing democrats must fight harder. >> my party's got to get out of the defensive crouch that has us thinking that we're in the minority on these issues america is with us in demanding common sense gun safety.

>> so andrea, what's the likelihood here that president trump and congress both support and pass legislation that would expand background checks this time around? >> you know, it's very, very difficult to think that they're actually going to do it. here's why, despite all of the emotions in el paso and dayton in the last week, wayne lapierre, head of the nra has already spoken to the president and the last few times he's been persuasive the nra is weaker than it was in the past and been under investigation but, still, they're very powerful with congress the senate has had house passed legislation on background checks since last february and has not taken it up. will they come together now? they have not come back from their summer break it's really hard to think it's going to happen this time. >> sounds unlikely andrea mitchell for us in washington, thank you. now a tragic story breaking out of erie, pennsylvania. a devastating fire in a home that operated as a day care. five children were killed, the

youngest just 8 months old kathy heart joins us with the latest on the investigation. kathy, good morning. >> reporter: savannah, good morning to you this is a tragic story that has taken up this community and become personal for these firefighters who learned some of the victims were in fact the children of a fellow firefighter. this home was registered as a day care center, which they explain why there was so many kids inside. this morning investigators sifting through the ashes of a pennsylvania day care center, trying to determine the cause of a fire that killed five children, three of them the children of a firefighter. >> our firefighter, three of his children perished in that fire. >> jones was responding to another call in the city and had no idea his own kids were trapped just blocks away. >> unthinkable and, like i said, it's really beyond comprehensive. >> engine six, engine eight, report of structure fire with entrapment >> reporter: firefighters rushing to the scene early

sunday morning neighbors said they heard the screams of two teenagers who escaped through a second story window yelling there were babies trapped inside one man struggling to help pushed back by the intense smoke and flames. >> i tried to go inside and made it to the open living room and i couldn't go any further. it's tragic. >> reporter: firefighters ultimately pulled seven people from the building but only two survived records show the house was registered as a day care center. the most recent inspection of the home was within the last year calls to the harris family day care by were not immediately returned now a makeshift memorial set up outside the home as the community mourns lives cut short. the investigators are looking into the cause of the fire and focusing potentially on an electrical issue

they're also adding they only found one smoke detector in the attic of this home savannah, craig? >> it's awful, kathy thank you very much. to tennessee where a dangerous prison escapee is back in custody this morning after five days on the run break in the manhunt coming from an alert couple and their doorbell camera. nbc's gabe gutierrez joins us with the details good morning. >> good morning. the folks who live in the rural farm community an hour north of memphis had feared the inmate killed of killing a prison official during his escape might kill again but that's until they got a tip he was caught on a home surveillance camera. >> it is a good day because curtis watson is in custody. >> reporter: this morning the manhunt for curtis ray watson is over five days after he escaped from prison, the 44-year-old captured sunday after he was spotted on a ring video doorbell system appearing hungry,

mosquito-bitten and covered in ticks, watson raided an outdoor refrigerator at the home of harvey and ann taylor. the couple inside awakened by the ring and was watching every move. >> we pulled it up on the screen so we could see it in the house. we looked out and there was this guy in our refrigerator. once he closed the left side of the refrigerator, my wife could see his face and recognized his beard. >> reporter: the taylors called 911. by the time police arrived, watson was gone. seven hours later two officers with the department of corrections found watson hiding in a soybean field watson, who is serving a 15-year sentence for aggravated kidnapping went missing wednesday from the prison 50 miles northeast of memphis he's accused of sexually assaulting and killing 64-year-old debra johnson, an administrator who lived on the prison grounds. >> i thank god he was captured before her funeral because it gives us added relief that we can really bury our mother >> reporter: in the five days he was on the run, watson had covered only ten miles

good monday morning. i'm meteorologist kari hall. it's a busy start in oakland as you head out the door. schools coming back in session today. our temperatures as you head out the door will be in the low 60s, and then reaching into the upper 70s as we go into the afternoon with our south bay high up to 89 degrees. some mid 90s for the inland east bay. san francisco today will see a high of 74 degrees. and it's going to get even hotter for the valleys going into the middle of the week with some upper 90s. and then it starts to come down in time for the weekend with some mid 80s by saturday and sunday. san francisco reaches into the mid 70s. over the next several days, then we come down on thursday. the fog returns, we'll have our mid 60s for highs returning for the weekend. let's head now over to mike for an update on the commute.

identical twin boys. >> bode, we don't have to get in the whole long story, but you kind of had a premonition about this when you were a young, young man about having twins >> yeah, somehow i always knew i would have identical twin boys obviously after losing emmy, i think we both were sort of thinking it would be girls or hoping it would be girls and i found out and my midwife was like they're boys. you have to tell morgan. i was like no, no, you're telling morgan no chance i'm telling her. >> a lot of boys in your house. >> a lot of boys. >> how is easton doing, by the way? we see he's a great little swimmer but how's life been? >> he is amazing and he reminds us so much of emmy and he's got this amazing personality and he's so happy and he's just such a perfect addition to our family it's like he was waiting for us to bring him into this world. >> he's been floating now and he started getting actually really

excited for it you see him splashing and playing and he comes up from floating and all proud of himself. he knows he did it right it's really cool to see that process of isr come to fruition. it is a little bit in the beginning, you're like oh, my god, my kid is trying to learn to float and he can't talk or crawl or do anything else. now it's cool it see him successfully navigating such a dangerous situation we were worried about. >> you and i have known each other for a little while and i've always been struck by your courage. i mean all the more so to put easton in this isr, which is infant swim training, that's hard for any parent to watch but having gone through what you have gone through, to do that, it's so important but i'm sure it took a lot of bravery >> it definitely took patience and bravery and grace with ourselves. there were moments where it was a trigger. but we've had two sessions now this summer and we've had over

80 kids go through these two sessions and so to have other parents kind of walk down that path with us hand in hand has been really helpful. to see other kids successfully learn to float and swim is a dream, you know. it's everything that we wish we had done before that we now get to provide for so many parents. >> you've been doing this in your neighborhood, right, bode you guys have had people over training -- >> our house is just a revolving door of kids all day and it's good. i think it's also cool we have the coral drowning detection system in our pool and it's actually been a natural, nice wait for parents to sort of be introduced to obviously under extreme circumstance the way we do things now, they ask about those and while they're watching their kids learn to float, they're looking at how we sort of tried to protect our pool it's been really cool to see that as we talked about, the intensity of the conversation being the number one cause of

injury-related death, being able to provide awareness as we tried to do and now solutions, i think ultimately will change the statistics a bit. >> i mean, it's just last june you lost emmy. of course, you had easton, you were pregnant at the time. now you have easton. now you're having twins. when i look at everything you've gone through with such grace, just the complexity of loss and life and hope and grief. how have you managed to hold all of these things simultaneously >> yeah, i don't know. i guess supporting each other. we have a really good network of family and friends i think staying busy and staying focused on, you know, the future and solutions and the present of enjoying our kids. the kids kind of pull us forward. >> definitely. >> they demand interaction and they have a great way of healing and obviously, you know, we've sort of re-evaluated and doing a really cool kind of move or

splitting time between california and montana, which we love california, but being able to go to the mountains for me has always been kind of healing and being outside and, yeah, i think it's been -- we're sort of trying to rely on our family and friends and sort of -- because there are still even now, i mean there's moments where it's just really tough i think for each of us and you know, do you have to -- it takes a village not just to raise kids but to support each other through things like this too. >> yeah. you have to fight for it every day for your hope and your happiness. >> every day is a choice on how we want to continue forward and make sure that our kids are getting the best of us, of life, and not to say it's easy it's a battle every day to get out of bed but to see them and see the joy through their eyes and to live vicariously through all of their

good morning. 8:26. i'm marcus washington. firefighters quickly put out three small fires, these are grass fires burning near electrical lines. before the fire was out, pg&e cut power to the areas surrounding the fire. the impact was felt for sometime. the fire burned along southbound 680 near andrade. we later learned from firefighters it was started when a dump truck struck a power pole about a mile away and it caused the line to surge and send sparks flying. this is nbc bay area sky ranger flying over the truck. no one was injured in either the crash nor the fire. how is the backup?
