welcome to tuesday morning. it's august 20th. taking a live look outside, palo alto, looks like folks are already up and out the door. if you're just waking up, thanks so much for starting your morning with us. good morning. i'm laura garcia. >> and i'm kris sanchez, in for marcus washington. ten times the traffic that we had earlier this morning. it really builds at 4:00 in the morning. it is nice and cool outside. >> it's cool. it's going to be our last day to enjoy mother nature, because a warmup is already under way. right now in san jose, we're comfortable, 62 degrees. wind speeds light at 7 miles per hour and as we head in towards the afternoon once again any cloud cover in inland areas will begin to clear right around

9:00. 10:00 a.m. we'll get more sunshine. temperatures in the upper 60s by 11:00 a.m. and climbing into the 80s for the tri-valley but guys, come tomorrow, high pressure rolls around and then we return into the 90-degree temperature mark. i'll let you know which day is expected to be the hottest. let's head over to mike. >> we're not looking forward to -- time' not looking forward to the 90s. green sensors around most of the bay. we look at a fire that's been reported tesla at cross, that's not far from poppy hills so we're checking that out. a lot of dry grass in the area and wineries as well. meanwhile we're also looking at eastbound 80 getting away from the bay bridge headed north, across the span of the carquinez bridge, reports of a crash that might be affecting your slow lane. we'll track that. the bay bridge toll plaza a light backup for the cash lanes and eastbound to southbound 880 that connector just reopened from overnight construction. back to you. >> we'll check back with you. thank you. in just a few hours the first full day of deliberations

with the rebooted jury in the ghost ship warehouse fire trial. the judge yesterday dismissed three jurors for undisclosed reasons. >> some people wonder if yesterday's bombshell decision will speed up or slow down the path to a verdict. cheryl hurd is tracking the linering questions. >> reporter: it will feel like the first day of school for 12 yoor jurors after ten days of deliberations, three women were unexpectedly dismissed from the jury. now the jury is made up of seven women and five men, with only one alternate. >> in a high-profile case, jurors are dismissed frequently. what makes this so unusual is that you lost three all at once, apparently for the same reason. >> reporter: in another high-profile case, 15 years ago, one juror was dismissed in the scott peterson trial for speaking to his murdered wife's brother at the courthouse security checkpoint.

in this case, no one knows why jurors were told to go home. >> because there is no safety net any long we are having only one alternate left, jurors may feel pressured to make a decision when they otherwise would not have. >> reporter: legal analyst steven clarke says if things don't work out with new jurors, there could be a mistrial. that's something victim family members and friends are afraid of. >> i hope that this new jury does a good job and yeah, i can't comment on it because of what's happened. >> i don't know. we're just going with the flow. >> reporter: cheryl hurd, "today in the bay". >> in court yesterday the judge told new jury members to give her in writing the dates of any big events that might become a cop flikt for scheduling. ahead in our next half hour a live report of what's coming up today. steven clarke will join us to talk aboutle chaenings the new

challenges the jurors face. a man was caught attacking a woman entering her san francisco condo is due in court today after charged yesterday in connection to a second crime. austin vincent is held on $100,000 bail. authorities charged him in the second case dating back to february when he threatened two people with a knife. one of those victims identified vincent after seeing his booking photo follow last week's embarcadero attack. vincent cess attorney says he's now in treatment. >> they were attacked by mr. vincent with a knife. those individuals called for an uber ride and the uber ride arrived, and they were able to get into the uber and leave the scene. >> he takes this situation very seriously. he's also taking his treatment very seriously. >> last week's condo attack is sparking renewed debate about the planned homeless navigation center going in a few blocks away.

>> in the bayview district a and a half navigation center battle was met with anger and frustration. critics point to navigation problems at another center a mile away. >> we need it. they got to start somewhere and once they get housing, you can start working with the other issues. >> when our crew drove by bayshore we saw signs of people living on sidewalks and garbage left behind. city leaders hope to have the new bayview center open by next spring. the call for new gun control measures hits mountain view. last night dozens gathered along el camino reale as part of a protest they call is sensible gun legislation following the most recent mass shootings including the one in gilroy. organizers say something has to happen. >> mitch mcconnell and the senate are not acting. every day i go out in public and i'm a little bit scared of guns.

i don't knhat's going to happen and we want sensible gun control now. >> a recent nbc news and "wall street journal" poll shows 89% of americans favor expanded background checks on all gun sales and gun transfers. a motorcyclist is recovering this morning following a crash in east san jose t happened just before 9:00 last night at tully road and capitol avenue. police on scene say a honda hatchback was turning left at the light and collided with the motorcycle. the motorcyclist suffered serious injuries. the driver of the honda was also taken to the hospital but is expected to be okay. still no word on what sparked a massive junkyard fire yesterday in the north bay. it sent thick plumes of smoke skyward. people in the surrounding area were advised to stay indoors and go elsewhere for about three hours. the fire burned in southwest santa rosa near scenic avenue. luckily no one was hurt. this video might be all the warning that you need as you head out on a hike. people visiting a popular south bay hiking spot say they're on

good morning. i'm frank holland at cnbc headquarters. here are today's top business headlines. wall street is set to open up slightly lower this morning after stocks rebounded yesterday. treasury bonds continues to ease the ongoing concerns about a recession. the dow is less than 150 points away from reclaiming all of last

wednesday's 800-point loss. on today's watch list, earnings from retailers home depot, kohl's and tjx, the parent company of tjmaxx and home goods. a group of state attorneys general plan to move forward with a probe of anti-trust lawsuits. it's likely to focus on whether a handful of dominant tech firms use marketplace powers to stifle competition. it could dove tail with the plans by the department of justice which announced last month its own review to focus on firms including google and facebook. apple has committed to spending more than $6 million on original content for its upcoming video streaming service. "the financial times" reports the company expects to launch apple tv plus within two months that will beat disney plus to the market november 12th. apple has not announced a price for apple tv plus but a separate report says the company is considering a price of $9.99 a month with a free trial period.

which doesn't include shipping costs to bring it back from down under. there's no amazon prime on that one. >> can't drive it either. that's a long bridge. >> water locked. vianey, in the commercial break we were talking about the temperatures that will be heating up. we should enjoy today. >> you should enjoy today and get prepared because the roll around of 90s is going to be making a comeback which means safety concerns over heat exhaustion will make their return and of course being mindful of just how hot it's going to be outside. right now, current temperatures still comfortable, 60 degrees in fremont. 51 degrees in mill valley. san francisco in the 60s. san jose 61 degrees and the thing that's been keeping us cool the past couple days has been a sea breeze and also a marine layer. that's going to start to decompress. once that happens we have the high pressure that's building in from the west and that's going to warm up our temperatures. i want to make sure you get your day out started right.

alum rock union school has their first day. welcome back to class and let's get you set out the door. by about 7:00/8:00 a.m. in the 60s. a combination of sun and clouds. a sweater is okay but notice by 12:00, 1:00 recess time lunch time warming up into the 70s. we're talking low 80s for the san jose south bay area. so have a great first day of i don't know, what is it, parents, i hope your kids have a great day of school. i'll wait until 6:00 to say good morning to your kids. microclimate highs in the 80s. 86 degrees in morgan hill. 82 in san jose and in through the east bay, 73 degrees for oakland. concord 86. notice our temperatures into the tri-valley went up just one or two notches today. it's not noticeable the warmup but come tomorrow you'll notice it. 79 degrees in redwood city, up through mission area 68 degrees. still going to keep some of the breeze in through san francisco so you get another chance to enjoy kind of that sea breeze that's been keeping the coastal areas nice and cool. overalthough your microclimate

highs are going to be comfortable for the next couple of days. looks like this graphic wanted to come on back again and repeat itself, but we're talking about upper 70s and 80s and here is what i was talking about with the warming ahead, starts tomorrow. valleys see 90s and we'll get a little bit of cooling as we head in towards friday and saturday. i mean slight, and then sunday it gets hot again. over the next seven to eight days. as far as the speed sensors are doing it's great. i told you about the fire in the tri-valley on tesla, we have more detail, we'll talk about it over here. the tri-valley interchange there the dublin interchange is just fine. tesla at cross, not far from poppy ridge from what i understand. the fire may have been started by a car fire. there's a car down in the ditch. i'm curious about the details on that. we'll follow that. so far that's tesla at cross, just a little north of poppy hill.

a couple of wineries in the area and no structures involved but we'll follow up on the detail there is. eastbound 80 the slows has cleared as you get up into the north bay across the carquinez bridge. i believe they've cleared all the lanes from all the activity, a couple of cars got into a minor crash counter commute. bay bridge we have the construction crew blocking the transition off the bay bridge to south 880 that has cleared and small roadside fire reported 101 at cesar chavez. no slowing and no lanes blocked, this is off of the freeway. getting in to san francisco there's the golden gate bridge, a smooth drive and you can see the span and the two towers, that's great news. we can see light traffic in both directions and we're showing one delay for ace train number one leaving stockton, there's about 10, 12-minute delay, some train controller issue that may ripple back to the other three trains this morning but we'll track that, that's the only line that's affected. back to you. >> thanks so much, mike.

4:50. traffic alert for drivers in east contra costa county. construction project is now under way on el portal drive between the richmond city limits and san pablo dam road. it includes reacg traffic signals and pavement markings. if you're driving in the area officials say expect is a-minute delays. construction is expected to be completed in late october. >> always feels longer than 15 minutes. commuters on the peninsula have one more option this morning, an ex-press bus service that debuted yesterday, connects foster city to san francisco, stopping at several major hubs in san francisco. it operates during weekday commute hours. if you want to try out the foster city commuter express, it is free through the end of the month and then it will cost you up to $4 to ride, depending on where you board >> it is 4:51. the search is on for a killer in southern california after a retired administrator was found stabbed to death on the fullerton state campus. dogs combed that scene yesterday

after authorities discovered the body. police believe steven sheck chung chan was targeted and may have known the killer. they're not talking about a motive. it happened as the campus is getting ready for the fall session, starting next week. new this morning, so far this year has been better when it comes to damaging wildfires in california. state forestry department says 95% fewer acreage has burned so far this year, compared to the same time last year. the number goes up to 90% when you take into account the combined average of the last five years. calfire says improved weather conditions helped and the most deadly and destructive fires typically happen in the fall. southern california jewelry store owner fighting back against would-be robbers. surveillance cameras caught a sledgehammer wielding suspect breaking the glass case of a jewelry shop in santa monica. very aggressive. the owner jumped into action there, grabbed that suspect,

all right niners fans, good news and bad news this morning. >> the good news is jimmy garoppolo is finally playing again. the bad news? he looked a little rusty. >> uh-oh. still looks cute though. >> i didn't say he didn't look good. maybe there's more good news. last night's game in denver was a preseason game. jimmy g. didn't play as well returning from last year's knee injury. 1 for 6, only completion went for no yards. after the game he seemed even keeled. >> unfortunately we don't get to play the who game so you only get so many plays. you wish you could be out there for more so you could bounce back and everything but it is what it is. the preseason right now so just got to take it in stride. >> there you go. the rest of the game it looked like the niners had better backups than the broncos. the niners won 24-15. warrior staff steph curry may be known for his big assist on the basketball court but his latest assist may have a lasting
