and good monday morning to you. august 26th. taking a live look out in san jose, this is downtown, getting started with our monday morning. thanks for starting your morning here with us. i'm marcus washington. >> and i'm kris sanchez in for laura garcia. we want to get a first look at that forecast so you know what to wear as you head out the door. >> starts out nice and cool but it's going to be a hotter day. right now we're in the lower 60s with clearer skies headed over to santa clara. we'll hold steady at 63 degrees through 7:00 and we'll start to see our temperatures warming up but overall a nice morning ahead, but then our high temperatures this afternoon will be hot once again, reaching into the upper 90s in the inland valleys and a few spots reaching

100 degrees, so i'll talk more about that coming up. mike, you said there was a fire reported in richmond. >> with the hotter temperatures we're always concerned about those going on but it's a smaller roadside fire from what i can understand. look at the green sensors all around the entire bay, a little bit of slowing out of theality month traditional. right here around central off of 580 reports of a fire you can see from the freeway that will affect folks to or from the richmond-san rafael bridge which is moving smoothly, very clear. we'll get a live look and show you the golden gate bridge where there's a little bit of glow for these lights and so you may encounter some low clouds around this area but no problems obviously light configured for the overnight traffic flow. over here looking at slowing of course the cash lanes, this just happened over the last seven or eight minutes. westbound 80 at the oakland side, we have the cash lanes typical pattern. back to you. >> thank you very much, mike. breaking news to tell you about, as an investigation has been under way overnight. right now you're looking at what

is going to be a press conference this morning in el cerrito because an off-duty san francisco police officer shot a man overnight in el cerrito. there has been an investigation throughout the night. we are expecting to hear from police at any moment about details surrounding that shooting. of course we are going to stay on top of this story throughout but again this happened overnight as an off-duty san francisco police officer shot a man in el cerrito. we're trying to get the details surrounding why the shooting happened, what led up to that shooting, but of course we're staying on top of that press conference that should happen at any moment and we will bring that to you live. in the meantime police in the south bay are looking for three men who robbed a jewelry store and set off a mass panic among shoppers. >> "today in the bay's" bob redell live outside of the great mall in milpitas. we know that police just gave some new information this morning. >> reporter: and that fact is that the mall is reopened but hundreds are -- ready to be

reopened. hundreds of panicked shoppers, a number mistakenly thought there was an active shooter on the scene. cell phone video shows some of the people running away from the property, others hid inside storage rooms in the back of the stores. shoppers tell us they heard loud sounds around 7:30 last night near a jewelry store. someone yelled "gunman" which started a chain reaction. people posted there was an active shooter at the great mall which added to the chaos and confusion. as it turns out there was no active shooter but three men did go into the diamonds by klary store smashed the displays and stole jewelry. >> everyone went on lockdown and everyone was running in the hallways look a stampede. it was kind of scary. >> i was trying to get away from that area. i just, you know, i felt like i was in a movie. i felt like, you know, we see all those, everything on the news. i just didn't want nothing to happen to my kids.

>> reporter: milpitas police did lock down the mall for a few hours and with the help of the santa clara county sheriff, san jose police, chp and mall security, they conducted a sweep of the property to see if anyone was hurt or if there was an active shooter. again no active shooter. they cleared the mall around 10:40 last night. law enforcement is still looking for the three suspects. reporting live in milpitas, bob redell, "today in the bay." thank you very much, bob. oddly this was one of three cases involving similar scenarios hours apart across california. in modesto four men shattered jewelry store glass at vintage fair mall and shoppers mistook that sound for gunfire and people ran for their lives, happened about 5:00 in the evening. after the mall was evacuated police determined no shots were fired after all. earlier in the day in southern california smack and grab robbers targeted a people innen marc

neiman marcus store. officers made two arrests in connection with that robbery. happening today, one of four people accused in a shoot-out that sparked chaos at san bruno's tanforan mall is due in court for a plea hearing. this happened in early july. four people were injured. authorities eventual lay rested three juveniles and one ult. that adult, 18-year-old deandre gant, is due in court today in redwood city. with another hot day on tap, fire concerns will remain high and new overnight this grass fire happened in fremont, this started around midnight near interstate 680 just north of mission san jose. for a time, two southbound lanes of the highway were closed. firefighters had it out in less than an hour. it did burn two acres before that. >> back to breaking news we have for you this morning where the off-duty sf police officer shot a man in el cerrito. let's take a listen. >> officers circulated both areas and found somebody that had been shot behind me in the residential area.

that man is in his 40s. i don't have his identifying information right now. he sustained gunshot wound injury, does not appear to be life-threatening. through the investigation, we determined that the person who shot him, the off-duty police officer from san francisco police department, that invokes a protocol here in contra costa county whereby the contra costa county district attorney is summoned, basically automatically because it's a police-involved incident, as well as criminalists from the contra costa county sheriff's crime lab, and they have police detectives and crime scene investigators throughout the evening. as we said earlier, the san francisco police department is also involved. really do not have any information as to the outcome or what happened in the confrontation between the two of them. there is a very active investigation. people are still been interviewed, so we really don't have much information as to why these things happened just yet,

but as of now, the police are investigating thises is a possible criminal investigation. as far as administrative things about the san francisco police department and their employee, i would have to refer those questions to the san francisco police department. >> how is the officer doing? >> he seems to be fine. >> was the suspect armed? >> not with a firearm. another type of weapon we won't describe just yet. >> what did the officer say? >> i will not be able to discuss that just yet. still actively being investigated, still in progress as we speak. [ inaudible question ] >> i don't know what his work schedule was yesterday, so it is possible, but i didn't hear that he was getting off of work exactly. >> reporter: is there a chance he was arrested or does it appear to be a justified shooting? >> not ready to go there yet. they're literally still

interviewing him. >> reporter: does the officer live around here? >> i also won't comment on where he lives. >> reporter: do you know exactly [ inaudible ] through your investigation? >> it is for the most part just outside of that apartment building with the red car in front of it, basically in the sidewalk area in front of it. >> reporter: can you describe this area? do you have many robberies in this area? >> we've been listening to el cerrito police for an officer-involved shooting investigation that happened overnight. a little convoluted this morning. this is the bottom line. there was a san francisco police officer who was off duty in el cerrito, when some sort of confrontation happened between him and another man who is in his 40s. the result is that man in his 40s who was armed with something other than a weapon other than the gun was by a san francisco police officer. because it was a police officer-involved shooting that automatically triggers a protocol. the contra costa county district attorney's office now gets

good morning. i'm contessa brew ear the cnbc headquarters. here are today's top business headlines. despite friday's sell-off, wall street could see a positive taupe kick off the trading week. dow futures are up 300 points right now. this morning, president trump was speaking on the sidelines of the g7 summit in france. he says china called u.s. trade officials last night indicating they want to get back to the negotiating table though china says it has no evidence of such calls. the president's comments come days after he called on u.s. companies to abandon china. as trade tensions continue, a trade dispute with japan could be cooling off. president trump said yesterday the two countries have agreed in principle to a trade deal that calls for the japanese to buy surplus american corn. if finalized, u.s. trade representative robert lighthizer says the deal will open up the markets to more than $7 billion

in the dog days of summer the aspca says it's a way to encourage more people to adopt dogs. with more than 6 billion animals sent to shelters each year, about one-third will be euthanized. nbc tries to encourage adoption with our clear the shelters program, now in its fifth year. in that time, we have found forever homes for more than a quarter million pets. so imagine the exponential happiness. >> that's a lot of kibbles. >> that is a lot of kibbles. today and this past weekend was a nice time to get out with the dogs. >> it was nice along the coast. inland it looked hot. >> i was on the coast, it was nice. >> that's the way it always is. this is a beautiful look of san francisco. isn't that nice? a little bit of fog moving by, this is from our san bruno mountain camera. it's mostly clear over were of the city and as you head across

the bay a few clouds if you're headed to the fruitvale b.a.r.t. station, expect some upper 50s this morning and then we'll see our temperatures slowly climbing throughout the day. it's also going to be comfortable as we head into late morning, into the early afternoon. let's look at all of our microclimates, because we know we'll still have a wide range in temperatures. at 8:00 we're in the upper 50s in san francisco, but it's already 74 degrees in antioch. livermore 69 degrees, and here is our noontime temperatures for much of the inland east bay, the north bay and the south bay. we'll want to make sure we're staying in the air conditioning for that lunch hour, and then some upper 90s in antioch at 3:30, in fairfield it's 95. san jose reaching the low 90s, and then coming down while we still see those cool temperatures along the coast, so as we go into the next couple of days, it's going to be pretty hot inland, but also we're seeing some clouds and fog remaining near the coastline, going into the rest of the week we'll gradually start to see our

temperatures come down. as it does so, humidity goes up, so even though our temperatures come down a few degrees, it's still going to feel very hot as the humidity stays high. that's mostly from tonight through tomorrow as well as wednesday, and then we come back into some upper 80s for the end of the week. so no extreme temperatures here, but today will be the hottest, reaching into the upper 90s inland, and some low 70s for the coast, and we'll bring it back to the low 70s by the end of the week, as well. as we head over to mike, you've been looking at oakland. >> i was taking a look, kari, traffic flow is really nice right now. we're looking past the coliseum, no closures. the overnight roadwork looks like it's not there this morning, just over at high street. there are patches, places like highway 4 over at 680, right over there, there may be one connector that still has some work going on. there was a closure overnight but now everything is moving smoothly between 242 and 680, over on highway 4 and you could have cut that corner anyway but

you don't have to. getting toward the bay bridge we have that little fire reported off of 580 over at central avenue. we've seen no slowing and no expansion of that report. there was a small roadside fire reported kind of under the overpass there. no car is at risk and a smooth drive to the south bay and along the peninsula as well. a nice easy drive, the slowing typical out of the altamont pass. just 20 minutes from the altamont over toward 680, the dublin interchange. a little brake tap one or two places along 84, so we'll make that yellow instead of green but it's nice. and no problems for the early transit reports. we have four b.a.r.t. trains, probably six by the time i get back to my desk, an easy ride for capitol corridor. back to you. >> thanks, mike. this morning, southern california evacuations are being lifted as crews gain the upper hand on brush fire near downtown los angeles. this started yesterday afternoon in glendale and burned more than 25 acres. it also closed part of highway 2 and highway 134.

here is a tweet from one of our nbc bay area employees who was watching the dodgers game yesterday afternoon. you can see the cloud of smoke, from dodger's stadium. so far, no reports of structure damage. santa clara county this week may become the latest bay area jurisdiction to declare a climate emergency. supervisors will debate the resolution tomorrow and it would demand immediate action to reverse the causes of global warming. the county would join other local governments including san francisco, oakland and berkeley in making similar declarations. 4:51. modesto police said everything remained relatively peaceful after dueling demonstrations over the weekend. supporters from the group called california straight pride coalition look to the streets. they gathered in front of the planned parenthood but they were met with opposition. members of the lgbtq community and their supporters showed up to counter the coalition's message. they chanted no hate, no fear,
