right now on nbc bay area news, the verdict is in, and the reaction is now. one defendant not guilty, the other defendant a hung jury. so what's next in this high profile ghost ship warehouse trial. goo good evening, thanks for being with us on this prime time edition of bay area news, i'm raj mathai. >> one man set free, the other went sent back to jail. derek almena, and max harris, creative director, both charged with 36 counts of involuntary manslaughter.

one for each person killed in the warehouse fire. a jury acquitted, three hours ago he walked out of the santa rita jail. the jury deadlocked on almena, ten of the 12 jurors thought he was guilty. you need a unanimous decision to convict. we have had multiple reporters on the story throughout the day. we start tonight with melissa colorado, you have been following this since the beginning. you were in the courtroom when the verdict was read, melissa. >> reporter: it was an emotional day for everybody involved in this trial, and tonight, seven women and five men can finally talk openly aboutha jury, and earlier today, the jury foreman did tell the court that, yes, there was some movement in the final hours of the deliberation process but it was not enough. two people refused to budge, and refused to change their mind. >> we're in shock. we're just in shock.

i mean, disbelief, total disbelief. >> the verdict is in, head to the courthouse in oakland now, that was the message family members who lost sons, daughters and in the ghost ship warehouse fire received this afternoon. david gregly pinned a picture -- gregory pinned a picture of his daughter on his hat. >> reporter: he's talking about justice for the 36 people who died in the 2016 warehouse fire. prosecutors spent nearly five months trying to convince a jury that master tenants derek almena, and his number two in command, max harris turned the warehouse into a death trip. shortly before 3:00 p.m., the court clerk stood up in front of a packed courtroom, and read out loud, the jury finds max harris not guilty of all 36 counts of involuntary manslaughter. >> he tried to stop me from crying, and you know, he was emotional, and we were all emotional. >> family members of the victims wiped away tears and braced themselves for the next announcement. that's when judge trina thompson

signalled there was a deadlock, and asked the foreman directly, how many times did the jury vote on alninmena, 12 times. 10 people thought he was guilty, two people thought he was not guilty. >> i'm pained, anguished, i'm frustrated, but we will win next time. >> reporter: the judge declared a mistrial and thanked the tired jury for the their hard work. he doesn't blame the two jurors who refused to budge. >> they had a tough job to do. >> reporter: he's directing his blame elsewhere. >> i feel that it's because of the city has so much to do with it that they couldn't just find these two people guilty. that's my opinion. >> derek almena is still in custody and his next court date is going to be on october 4th. we can see a number of possibilities play out here, number one, the prosecution could try him again. they could also offer him a plea deal, and we know the defense team is going to try and lower his bail so he can get out.

i spoke to some family members of the victims who tell me they will be back here on the isot o. back to you. >> melissa, yes, this was a stinging defeat for the prosecutors. the big question now, will that alameda county da choose to retry derek almeda. or strike a plea deal. this would avoid a retrial. >> we are going to evaluate and the facts and evidence that came out in this case. we're going to take into account discussions that any jurors may have had with our trial lawyers, and we will evaluate that and forward. >> a lot of issues at play. prosecutors are expected to consult with the victims families if they are up emotionally for another trial that might not begin until next year. >> these are the faces of the 36 people who died in that fire, their deaths a tragic loss for

their families and after enduring months of graphic and painful testimony, many of them feel that justice eluded them. nbc bay area cheryl hurd joins us in oakland. a huge disappointment for so many of them. >> it was indeed. almost three years of heart ache and five months of a trial inside this alameda county courthouse in oakland for these victims families. we talked to many of them tonight and they say that this verdict is leaving them in shock and angry. >> i'm sorry, i'm done. >> we don't want to talk right now. >> reporter: family members leaving the oakland courtroom disappointed and hurt. >> i don't have anything to say to you right now. >> i'm shocked and saddened it. >> reporter: other family members a little more vocal. >> we're still kind of in shock, to be honest. there's nothing we can do. >> reporter: judy and brian huff's son travis died in the ghost ship fire in december

2016. he was 36 years old when he became trapped by the fire. >> we're deeply, deeply disappointed. and we just hope that justice will some somehow be served. >> the only thing i hoped for was that none of this ever happened. there's no -- i mean, i don't know. i just want my son back. >> reporter: lisa slattery is one of the victims. she supports acquittal but thought almeda. >> others believe max should not have spent any time in jail. derek is a different human being. i do find him responsible. >> reporter: family and friends overwhelm tonight. i overheard one mother saying to another, we lost our children

and they are never coming back. reporting live in oakland, i'm cheryl hurd, nbc bay area news. just after they did until the days after the fire, people stopped outside the memorial where the ghost ship sat, others brought candles, others stood silently, paying their respects to the 36 people who died there. we know why three jurors were dismissed from the panel without warning. derek almen a's attorney said the jurors were let go because one spoke to the firefighter about the case. that juror shared the information with two others. the firefighter was not a witness in that case. that firefighter told the juror if they had gone into the ghost ship warehouse, they would have been required to respect it. that's outside information that the judge feared would taint the entire jury. afterut harris is a free man. his lawyer said he's probably going to have a nice vegan meal not made by the santa rita jail.

robert handa is at that jail in dublin with the latest. >> reporter: that's right, and we did not get a chance to him as he was driven away by the sheriff's department from here at around 6:15 p.m. or so. sergeant ray kelly took him to family members, and he declined to do any interviews tonight describing him as happy but emotionally drained, which was also the mood for family and friends. >> max harris left the courthouse and santa rita jail cleared of all charges in the ghost ship fire and was quick to leave the jail where he was in custody for 2 1/2 years. a supporter expressed relief. >> i have thought about this day so many times, that i feel like i have lived it a thousand times. i could have never predicted how it would feel to hear them just repeat not guilty, not guilty. >> i talked by phone with harris's aunt who had been

attending the trial saying she was also relieved but not celebrating for the sake of codefendant derek almena and the victim's families. >> my first reaction is i literally got down on my knees and thanked god. >> reporter: harris's attorney said his client had mixed families but harris planned to enjoy his freedom. >> it's going to start with a nice vegan meal that's not served by santa rita jail, and we'll take it from there. >> reporter: it's important to emphasize that everyone we talked to said that their reaction of the victims' families had a big impact on them. we'll have more on that in our 11:00 newscast. live in dublin, robert handa, nbc bay area news. october 4th is a pivotal day in all of this. the district attorney's office will evaluate the facts and evidence from the case and assess the future for almena, the prosecutors will review jurors comments with trial lawyers as well as meet with

when i have some and it becomes appropriate, you will all get it. that's it for today. >> that's headache for the ra raiders. brown posted this letter he received from mayock, the team fined him $50,000 for missing practices and meetings during training camp in napa. the oakland school district announced today it will hire an outside investigator after three teachers came forward to expose a cheating scandal involving educators at an east bay high school. nbc bay area's ali wolf has more. >> reporter: the oakland unified school district is denying a cheating scandal at castlemont high school. >> we have found no evidence to support the allegations. >> reporter: that statement followed our investigative report where three teachers came forward with allegations of cheating and falsifying transcripts. they say it was an effort to boost graduation rates at the high school where roughly 30% of

students failed to graduate between 2015 and 2018. >> we would set them up to fail. >> i would describe it as lying. >> reporter: the district launched an internal investigation, after several teachers had complaints, centering around online courses to make up for failed classes, the district admits to being too vague with the guidelines. >> we found issues with the way we administrate across the district. >> reporter: they told us they noticed students getting passing grade for courses they could not have possibly completed during the short time they were enrolled in the online classes, the district contends because some online courses were taught partially in person. >> many teachers told us day use apex in a blended learning environment. >> reporter: dozens of students were e-mailed answers to tests before their exam. the district denied that but admitted teachers can sometimes tweak student responses to online tests. >> teachers have the right and responsibility to go in and find

almena, making it a hung jury, forcing the judge to declare a mistrial. ten jurors thought almena was guilty. two believed he was innocent. this is video from an exclusive interview we conducted with him nearly three years ago. the prosecution must decide how to move forward, will they retry the case or try to strike a plea deal. >> it was a huge sigh of relief for some people but bitter disappointment for others. the long awaited verdict triggering a depth of emotion for families that lost their loved one in the fire. >> nbc bay area's anoushah rasta spoke with family and friend. >> reporter: an answer for families. >> i want my son back. >> reporter: brian and judy huff's 36-year-old son died in the fire and when the huff family learned one of the men

accused of being responsible was acquitted and a jury couldn't make a decision on the other defendant, they were shocked. >> i don't have anything to say really except that we're deeply, deeply disappointed, and we just hope that justice will somehow be served. >> reporter: many family members of the fire victims left court without saying anything to reporters. some of them visibly upset. ghost ship creative director max harris walks away a free man tonight. he was facing 36 counts of involuntary manslaughter, and up to 39 years in state prison. even though lisa slattery's best friend jennifer mendiola. >> i feel max doesn't deserve to be incarcerated. >> reporter: she blames the other defendant. >> i believe he's guilty. he created this environment. he set it up for 36 people to die, and i think that he should be found guilty. >> reporter: almena will be back in court in october after jurors deadlocked on his fate, with ten

voting guilty but two saying he is not. in oakland, anoushah rasta, nbc bay area news. it was a painful three years to arrive today. the fire broke out december 2nd, 2016, at 11:20 at night during a dj party at the ghost ship warehouse. the building not permitted for housing or entertainment use but the artists were living there. the fire began on the first floor and quickly trapped party goers on the second floor. it took crews five hours to get it out. six months later on june 5th, 2017, derick almena, and max harris were arrested and charged with felony involuntary manslaughter. the owner of the building was not charged. prosecutors reached a plea deal, almena and harris agreed to plead no contest to all 36 counts. almena would receive nine years in prison and harris six years. family members were so upset that the plea deal wasn't tough

enough. august 10th, the judge threw out the deal, saying almena, and harris did not accept full responsibility and show remorse. july 31st, 2019, of this year, the jury began deliberating. today the jury finally decided it could not agree on a verdict for almena, as you heard, and let max harris go free. you can find more coverage on the ghost ship trial on our web site, it couincludes interviews with the families of the victims after the verdict was reached and a more detailed time line of the case is also there at nbcbayarea.com. our other headlines, cash for patients, that's what federal prosecutors are calling an $8 million health care kick back scheme. the u.s. attorney announced criminal charges against 28 people. 13 of them are doctors. investigators say the hayward based amity home health care and advent care gave doctors millions of dollars in cash in exchange for medicare referrals.

>> our health care system depends on the integrity of the doctors who make referrals for patients to the care that they need. they refer those patients or are supposed to refer those patients based on their need, and not on any improvisations. >> according to the complaint, every single defendant was recorded by law enforcement officers either offering or accepting or approving illegal payments for patient referrals. a crack tonight in a million dollar cell phone robbery case. police say an ex-raider is actually one of the thieves. isaiah langley is among the 12 people charged in the crime spree in the bay area and central california. police say the robbers were holding up ups and fedex drivers making deliveries at cell phone stores. according to court documents, the group could be responsible for more than 60 robberies in the last nine months. last week, officers arrested eight people in the east bay, and seized several guns including an assault rifle and other stolen phones. be warned, thousands of

government workers could walk off the job? santa clara county, the union for janitors, clerks and social workers has authorized a strike. damian trujillo reports from the county government center. >> reporter: both sides are still negotiating but there are no indications that those negotiations are making significant progress. a reported sick out of the cooks and servers at juvenile hall left them scrambling. they had to bring in boxed lunches for the staff that did show up for work . >> it's a necessary job. they watch the kids while they're incarcerated. >> the union contract for 12,521 employees expired in mid june, and while negotiations are ongoing, there seems to be little progress. the county executive responded to the sickout, saying we have experienced sporadic work actions at various county facilities. we've been able to mitigate any

impacts to client services. we continue to negotiate in good faith, we hope to reach an agreement soon to continue serving the community. sources telling me the worker will be required to produce a doctors note. >> everything is fine instead? >> yeah. >> reporter: in a statement, the union said quote, the workers are committed to reaching an agreement that will address the county's lack of investment in services that children, seniors and low income families of color depend on to survive. instead, the county's band-aid approach has led to turnover and short staffing, impacting hospitals, foster care, senior services, among others. >> your money doesn't last like it used to in the old days. >> reporter: service workers are being squeezed out of silicon valley. >> we used to say it was very hard to buy a home. now it's even very hard to rent a home. >> reporter: sources tell me the county has told supervisors not to authorize any vacations in the coming weeks anticipating a

possible strike. damian trujillo, nbc bay area news. >> an arrest warrant gone wrong in san francisco today leading to the death of a dog. it happened around noon on polk street on knob hill. deputies were serving an arrest warrant when the suspect's aggressive dog, according to the deputies got too close. one neighbor saw what happened. >> he refused to open the door, and the dog was a pit bull, the police officers executed a forceful entry, the dog reacted and the police officer shot him. >> reporter: the sheriff's office says the suspect was also hurt but it's unclear if it was from the gunfire or a dog bite. that suspect is expected to be okay. the search is on for a man who groped a woman at uc berkeley. police are showing this video of him. campus police say he groped a woman while she was drinking from a water fountain. it happened last month in the student union building. investigators are hoping someone will recognize the guy and come forward. the pentagon is the latest

governmental department losing money to president trump's border wall. the defense department is now delaying more than 100 military construction projects to pay for a piece of the wall. here's nbc's alice barr. >> reporter: it was a signature campaign promise for candidate donald trump. >> kwhowho's going to pay for t wall. >> mexico. >> exactly right. they will. >> reporter: not exactly right it turns out. the u.s. not mexico is footing the bill. now the pentagon is diverting $3. $3.6 billion, putting 127 military construction projects on hold to pay for part of the border wall with mexico. critics, including utah's republican senators and many democrats say the move undermines military readiness. >> you're pulling money from those critical projects to put it towards a wall that is being driven by politics, not actual need. >> reporter: the list includes projects in 23 states, both republican and democratic controlled. plus three u.s. territories, and

tnch take a look, an overturned big rig spilled hundreds of chickens on to the freeway in the east bay. it happened on i-80 around 3:30 this morning in san pablo, the downside here, some of the chickens were killed, but there is a silver lining, hundreds of the chickens got away from the crash area and survived. >> we've never had anything to this amount of quantity, and certainly it's really sad, but, you know, we're going to do what we can to salvage what we can, and euthanize as quickly as possible, the animals that aren't salvageable. >> hundreds of the chickens did

if you want to grow crooked, it is going to cost you, potential new rules for driving down lombard street, forcing drivers to pay a toll. now, governor newsom will make the final decision. the city says the toll will cut down on crime and traffic in the area. drivers will have to make a reservation for half hour windows that cost $5 on weekdays, ten on weekends and holidays. that money will go toward paying staffers who will check the

we have mostly clear skies and a high of 87 today. right now, we are down to 69, and we have more cool 60s moving on in with some clouds through tomorrow. here's the good news, if 87 was not enough of a drop for you today, kwoowe're going to take down even more by about 10 degrees as we hit the upcoming weekend forecast. we're going to have more details on that. the changes are beginning at least right now. they're slow, but if you happen to have your window open right now, you know what i mean, you're starting to get the breeze filtering in. we have the oce bthe west at 13 and it's taking this foggy air and moving it right through the bay area. 9 in livermore, the fog rd tomorrow morning will be thicker near the coastline, and some of the clouds rolling back into concord, walnut creek, far off to the east of livermore, freemont as well, and there through the peninsula of redwood city and san mateo. sunshine building through the afternoon and that will set us up with a nice day.

let's get you ready for those temperatures. i think tomorrow morning, upper 50s and low 60s. it will feel good to you as you step out the door. 61 for the south bay. lots of upper 50s for the east bay, san francisco and the north bay, and while we have those patchy low cloud to start as we talked about, we'll clear on to the sunshine, and it's going to feel good. this will put us at 79 in downtown san jose. 86 in morgan hill. right through the east bay, we're trying to drop it a little bit more, 85 in pleasanton. to oakland, 73, along the peninsula, 79 in pow wow, and san mateo, 75. a little bit of a wind out of the northwest at 10. but it's definitely going to be gustier in san francisco, wind out of the west at 19, and the colder wind will have us in the 60s from the embarcadero to engelside. 83 at sonoma, 85 in napa. if you like tomorrow's forecast,
