the only way they can try is through impeachment. >> reporter: president trump is complaining the democrats never even saw a transcript of the call before acting while pelosi is demanding the administration turn over the whistleblower complaint tomorrow frances? >> all right peter alexander to start us off. thank you, peter all right. let's bring in next news legal analyst danny cevallos now thanks for joining us early this morning here what comes next here what's the difference between impeachment inquiry and proceedings? >> traditionally the judiciary committesenate did the recommending but that's not required. congress has a lot of leeway congress could take it up themselves or they could dole out the responsibility as it sees fit once they decide to essentially indict, because that's what an impeachment is, then it moves to the senate for a trial they need only a majority to accuse or indict the president and then it moves to a trial in the senate where 2/3 is required to convict and then remove

i was just following orders of the state department it's a little unusual because he's not a member of the state department he's not technically a government official. he's a private individual. but nonetheless, if he was ordered or asked to do something by the state department, in his mind that probably ratifies it and insulates him from criminal liability. but keep in mind all of the immunities that the president enjoys and the powers that he enjoys to conduct foreig affairs, rudy giuliani does not. so from the outset he is always exposed more than the president is to any potential criminal liability. >> in your article on nbcnews.com right now you say that singling out joe biden's son could ultimately compromise the president's potential defense. what do you mean by that >> the president has broad foreign affairs powers, and sometimes he can even withhold foreign aid if the statute allows it. so if the president wants to withhold foreign aid to a country and arguably just say look, your corruption in your country is affecting my country,
