thousands of costly unexpected bills. a very good morning to you. thanks so much for joining us, tuesday now. i'm laura garcia. >> and i'm marcus washington. mike will get us through the morning in a bit. first we want to start out with a cold start with the weather for this morning. meteorologist kari hall? >> it is a cold morning and we'll have another really nice day. as we take a live look in the south bay overlooking san jose, we're going to head over toward mountain view, a look at our temperature trend for the morning, we start out at 46 degrees and then we lead into some mid-60s by noon. overall, a nice day shaping up. we'll talk about this and a warmup in the forecast. mike, a couple of updates for contra costa county. >> traffic is light so we'll show you overall the bigger map, not a major issue, south bay, peninsula. over here highway 4 in pittsburg at railroad avenue the on-ramp there may be a crash on the side of the roadway. i see a tiny blip, maybe a signsign tiny slowing. 680 southbound at north main a

traffic break going on, a little bit of slowing off 242. looks like it's okay once again and the slowing here at the bay bridge toll plaza, only on the left lanes, but notice, they still haven't opened that last cash lane on the left side. we'll track that and when it does, it will clear. laura? >> thank you very much. breaking news that we're following in hong con, these are live pictures in the past few minutes we have seen a lot of chaos involving police and protesters on the streets. this is in the wake of a large anti-china rally on the day the mmunist party celebrates 70 years of rule. here is how it looked just a few minutes ago, we could see tear gas canisters, they were flying, police in riot gear trying to disperse the crowd. we heard people calling for they wanted water, also reports of protesters in hong kong being shot in the chest by a police officer several hours ago. we're also hearing protesters in some cases tried to throw toxic fluid on police officers. subway stations across the city have also been closed.

we'll continue to monitor everything that's going on in hong kong. 5:01 for you right now. now to the latest on the impeachment inquiry in washington. this morning congress is demanding president trump's lawyer turn over evidence detailing his ties to ukraine. "today in the bay's" tracie potts live with the latest on capitol hill this morning. tracie? >> marcus, good morning. good morning, everyone. rudy giuliani is speaking out, overnight, in an interview, he said he's got some things that lawmakers might want to see. >> i'll get all my evidence together, i'll get my charts. i don't know if they let me use videotapes and tape recordings that i have. >> reporter: rudy giuliani tells fox news he's not sure he'll testify. democrats have subpoenaed documents from the president's attorney about efforts to dig up dirt on opponent joe biden in ukraine. >> i think he's in trouble. i think he knows it, and i think he's going to do everything in his power to slow walk this at best and delay.

>> reporter: meantime, president trump's focus on the person. >> we're trying to find out about a whistle-blower. >> reporter: who exposed details of his conversation with ukraine's president. the state department confirms secretary of state mike pompeo was on that call. >> and i believe that secretary will receive a subpoena. >> reporter: democrats want the whistle-blower protected. >> we need to make sure there's not reprisals. >> put him or her in the federal witness protection program. >> reporter: if all this adds up to impeachment, one of the president's closest allies confirms there will be a trial. >> i would have no choice but to take it up. >> reporter: and now, questions about another phone call president trump connecting attorney general william barr with australia's prime minister to figure out how the russia investigation started. >> there's nothing wrong for barr looking into this. >> reporter: the white house says the justice department asked for that introduction. meantime, we are waiting to see if that phone call will now

become part of this impeachment inquiry. no official word at this point, marcus, if it will or if it won't. >> thank you, tracie. in the bay area, representative eric swalwell is holding a town hall meeting to discuss the impeachment inquiry. john dean, richard nixon's white house counsel, during watergate will attend the event and talk about the issue. tonight's meeting is at 6:30 at james logan high school in union city. critics say they're blowing smoke but san francisco-based juul lab said it will no longer fund its yes on prop c campaign. the proposition is aimed at stopping an upcoming ban on vaping products. "today in the bay's" sharon katsuda joins us live in san francisco with the latest developments on this one. >> reporter: laura, this comes as juul faces intense scrutiny from local and federal levels based on the vaping related deaths and lung injuries. the san francisco company brought in a new ceo, it has spent millions of dollars trying to get prop c passed in san

francisco but late last nigh a statement from that new ceo says in part "question must strive to work with regulators, policymakers and other stakeholders and earn the trust of the societies in which we operate." as part of that effort, juul says it will stop active support of prop c. prop c aims to prevent a ban on ecigarette sales in san francisco, that goes into effect in january but the campaign presented it as a crackdown on ecigarette sales that would protect kids and use by young adults has skyrocketed. the no on c campaign says it is skeptical of juul's announcement because it says the campaign has been less than truthful. >> we've got a lot of work to do to educate voters. this can't come off the ballot, so if it's true, it's a welcome sign. hopefully it won't be as contentious a campaign. >> reporter: prop c will still be on the november ballot.

juul says the television ads and ilers it has paid for should stop in the next few days. the no on c campaign says it will continue to work on defeating the ballot measure and the cdc continues to collect data, the 15th vaping related death just reported in nebraska. reporting live in san francisco, i'm sharon katsuda, "today in the bay." >> sharon, thank you. a follow-up for you this morning, it turns out san francisco's new resolution declaring the nra a domestic terror group doesn't actually have a lot of ammo behind it, according to a report this mo rng rning in "the examiner." it calls for the city to cut ties with businesses that do business with the gun rights group. the memo states no department will take any steps to assess such relationships or restrict any business, that's in part because the resolution is not an actual ordinance.

even then, it would need to survive an inevitable legal challenges from the nra. 5:06 right now. still developing, a bay area man is accused of spying for china. you're looking at surveillance video used to build a case against edward pong. investigators say it shows him taping bundles of money and important information to the bottom of a drawer in a bay area hotel for another secret agent to retrieve, but there's a twist. the u.s. attorney says that the chinese spy working with pong was actually a double agent working for the u.s. >> the precise information conveyed was cleared and controlled by the united states for passage to the prc. >> pong was arrested at his home in hayward on friday. the u.s. attorney and the fbi say that this case began in march of 2015. next week marks two years since the deadly north bay firestorm and later this

morning, sonoma county supervisors meet to assess recovery efforts. at the same time, "the press democrat" is reporting thousands of victims are getting cleanup bills in their mailboxes sent by sonoma county. some of the bills exceed $300,000. the county tells residents not to be alarmed. the cost will be covered by insurers in a federal and state emergency plan. the search is on for a man in concord who tried hard to steal a coin machine. it happened last tuesday at a car wash off of clayton road, this is video concord police posted to facebook. the man in the video attaches a chain to the truckbed and the coin machine below the camera, tries several times to pull it out, dislodge it, but it doesn't work. someone reported that truck stolen a few hours before. it's a black 2000 toyota tacoma. in the south bay we're waiting to learn if some south bay high school students will

face criminal charges. police are investigating an alleged sexual assault between members of the gilroy high school football team. the victim told police it happened last week after practice in the locker room. >> we really need to drill down and find out specifically what exactly happened, the motive and the intent behind this contact, certainly was unwanted. once we get those facts we'll determine what if any charges are appropriate. >> you think they have schools, people, the kids are safe, you know? wow, that's sad. >> the man you just heard from right there is a man we spoke with on campus. gilroy unified said it took disciplinary action against the students involved but won't say if they've been suspended. the district says that it will not cancel the football season. 5:09 and happening tonight the gilroy police department will hold its national night-out celebration. it was postponed in august following the deadly mass shooting at the garlic festival. tonight's event is happening between fifth and sixth streets. also happening today, a

little before noon, if you hear the roar of fighter jets in the skies above san francisco, the blue angels are not here early for fleet week. the united kingdom's red arrows acrobaticeam i flying over the golden gate and christy field part of a u.s. tour of two n cities. the crew will land at oakland airport. the red arrows will not stay for fleet week, which actually starts next week. they're just kicking off things. >> absolutely. i guess this will be a good day to practice, kari, seems like it will be clear today. >> it's going to be clear. we have some great weather, no matter what you're planning to do. it is a chilly start. here is a live look in oakland as you get ready to head out the door. we are feeling temperatures in the upper 40s for many of our microclimates right now, as we take a look at our temperatures, we're down to 41 in half moon pay. it's 40 in napa and santa rosa and livermore. 42 degrees. as we go through the day, we will be warming up, here we are at noon, seeing mostly some mid to upper 60s.

ahead as we continue to warm up, that's coming up in less than five minutes. and a pretty mild commute as well, the san rafael headlights traveling southbound 101, winding their way down through central san rafael with an easy drive. we'll show you how things are shaping up as you get closer to the bay. good morning. i'm rahel solomon at cnbc headquarters and here are today's top business headlines. wall street is set ten higher this morning as we kick off the final quarter of the year. stocks rising yesterday ending the third quarter on an upbeat note. investors continue to focus on u.s./china trade developments. the treasury department has no plans to limit stock investments in china at this time. reports the government was considering that idea rattled stocks on friday. today's watch list, reports on manufacturing, construction spending and auto sales. americans are in a buying mood. the annual holiday survey says most consumers expect to spend as much or more than last year

with many turning to physical stores for inspiration, expected to spend an average of $637 with men spending about 15% more than women. gift cards, clothing and footwear top the list of planned purchases. amazon is in talks to license a technology that powers its cashierless ghost stores to other retailer. sources tell cnbc possibilities include movie theaters, mini marts and airports and concession stands at sports stadiums. amazon believes it can install the technology in as little as two weeks and have hundreds of stores using the scan and go checkout by next year. all totalled, it could give amazon another source of revenue without having to build an entire store. marcus and laura, back to you. >> innovate of it. >> we'll see how this works, thanks, rahel. 5:16. new this morning, google is launching a new car safety app for its pixel smartphones. the app can determine if the user can in a crash based on the location if their vehicle

suddenly stops moving. it uses readings from motion sensors and sounds from the microphone. if it suspects something is wrong, it will sound an alarm and ask if you need help. the app will call 911 if you don't respond. you can also set emergency contacts and share your status with them, just in case of an accident. lots of nutritionists and health experts are calling out a new red meat study saying it undoes years of research. it found there is no need to cut back on red and processed meats, saying higher intake does not lead to higher health risk. an independent group of scientists conducted that study. critics say they used inadequate research methods. nutrition experts asked the annals of internal medicine to hold the study because it needs further review. they say evidence clearly shows less red meat cuts down on heart disease and lowers death rates. trending this morning, today is the day to apply for a chance

liking this. here is a live look outside in san jose, as we start out, all clear skies. we're going to get a lot of sunshine. the seven-day forecast is already up at the bottom of the screen so come on over and look at that, as you make plans for the rest of the week. let's get you out the door for the morning, if you're about to head out to the fruitvale b.a.r.t. station, it will be in the upper 40s as you're out there on the platform. probably not so much liking this cool weather, as we go into the rest of the day. it will start to feel much nicer with some mid-60s and we're also making plans to head out to the park around santa rosa, it's a cool start. look at that, 42 degrees at 8:00, but then by 11:00, it's feeling nice, 62. a lot of sunshine throughout the day, breezy winds, as we make it into the low 70s. we'll be in the mid-70s in napa today with oakland reaching 69. san jose reaching a high of 72 degrees, and 75 in antioch, half moon bay reaching 62 today. here's what's ahead for the rest of the week. so we've had a nice cool start to the month of october.

we're going into the end of the week, it will be starting to heat up as high pressure builds across the pacific. it's going to provide us with a northerly wind and that's going to also at times blow offshore. when we get an offshore wind, it gets very dry. we don't have our wind coming in from the ocean, so it's going to be dry and that will increase our fire danger, especially for the inland hills, as our temperatures go back to summer. we're in the low 70s today, upper 70s tomorrow, and you can see the way our temperatures are going straight up, headed into the weekend. upper 80s for some of our warmer inland spots. san francisco will be in the mid-60s today but then some mid-70s by the end of the week. mike, you spotted a new crash in dublin. >> i did, kari. from the speed sensors over there, it's not presenting a problem, but want to give it a shout out. looking at the speed sensors all over the bay, which look great for your commute right now. westbound 580 your commute direction at airway as you come through livermore there is a crash reportedly blocking part of your slow lane, should be off

to the shoulder but at least a distraction for these folks coming out of the altamont. slowing north 680 past vargas, typically an overnight crew there. i haven't heard about any problems though. southbound vasco, you see the slowing here as you narrow it down to one lane, that last stretch before 580 but the slowing off marsh creek road is clear but at marsh creek road all the folks joining brentwood, slowing things down a bit. you know it's just the pattern for the morning commute. a smooth drive through the rest of contra costa county at speed for highway 4, 24 and the bay bridge toll plaza you have the backup forming at the toll plaza, and the metering lights, and we have some slowing right now as you make that bend around toward treasure island. we should have things right on schedule, back over out of oakland. back to you. >> thanks, mike. major changes ahead for you, 5:21 right now. next on "today in the bay," how the tsa is preparing for a new deadline that will impact millions of travelers. dangers at the ball park. the rising number of foul balls landing in the crowd and the

5:24 right now. it has been two years since the deadliest mass shooting in u.s. history. two years ago tonight shots rang out over the route 91 harvest festival in las vegas. police later discovered the rapid gunfire was coming from a hotel room. 32 floors above. 58 people were killed and hundreds of others were injured, several events are planned for today in honor of those who lost their lives. now to a follow-up for you, all four ohio inmates who escaped from a small jail are back behind bars this morning. the third was the captured overnight, the man overpowered two female correctional officers early sunday morning and drove off with the help of at least one person on the outside. that escape in ohio town of

galipolos is the third since august. here's something you don't want to see when you look ought your airplane window, the catering cart spinning out of control at chicago o'hare airport. a passenger shot this while waiting on the tarmac. the cart finally stopped when a worker used a plane tag had to just try to knock that cart over. american airlines says a stuck accelerator may be to blame. no one was hurt. the tsa will hold a news conference about the real i.d. requirements. the 1st of october marks the one-year countdown to the final enforcement deadline. we told you about this yesterday on "today in the bay," the real i.d. compliant drirs license will mark by the star on the top of the card. starting october 1st of 2020, individuals must show a real i.d. or some acceptable alternative such as a u.s. passport to fly on commercial aircraft or access federal facilities. individuals who are unable to verify their identity will not

be permitted to enter the tsa czech poi checkpoint and will not be allowed to fly. baseball fans receipting gd for the post season. some of the buzz has to do with foul ball dangers. nbc's investigative reporter vicky nguyen is looking deeper into the rate of fan injuries from foul balls, in one case last year, it even led to a fan's death. she spoke with one fan who suffered a head injury in 2014 that required surgery and still affects him. >> all it takes is one pulled line drive or one being late on a ball and a lot of balls are shooting over jodugouts, that's the danger zone right there, where they're coming off over 100 miles an hour. >> you can see the full story lug which seats are most susceptible on today's show, this follows "today in the bay" at 7:00 a.m. 5:26 and playing catchup on

for joining us. i'm laura garcia. >> and i'm marcus washington. right now let's head over to meteorologist kari hall, she's been tracking those conditions for us and it is a cold start. >> it is a cold start but by this weekend, summer will come fighting back so let's enjoy the cool weather while we have it. here is a live look in palo alto. as you get ready to head out the door, 47 degrees and we are going to see some upper 40s throughout the next couple of hours, warming up into the mid-60s by noon, eventually reaching 73 today. we'll see 75 for the high in antioch, also in napa with san francisco reaching 66. mike, there's no surprises at the bay bridge toll plaza? >> no surprise party, just a headlight party. a smooth drive and a backup over here once you get there. metering lights were turned on right about 5:20, a couple seconds before that. the slowdown means the span we showed you earlier bunching up around the treasure island tunnel is now moving smoothly, a little lighter traffic. slowing for south 242, there's a potential for some construction crews but they didn't enable tonight so i'm not sure why

there's slowing. i'll watch that portion of contra costa county. a new crash in fremont around dixon landing road. >> thanks, mike. breaking news out of asia. this morning, take a look at this video. it catches the moment the towering arch bridge collapses, this is in eastern taiwan, the collapse sends an oil tanker truck falling on to boats, in the tiny but busy fishing village. ten people were hurt in the collapse, six being treated for major injuries. the bridge is a tourist attraction for that area. >> 5:31 right now. another possible way to get over the bay bridge, a lot of people think that would be nice. >> new this morning the head of one of the bay area's largest transit industries is calling for a new tax. the question is would you pay for it? >>ed i ed i"today in the bay's" redell joins us live outside the dublin b.a.r.t. station with more chatter on this new crossing. bob? >> reporter: laura and marcus, b.a.r.t.'s general manager,

robert powers says a second b.a.r.t. crossing across the bay is the most important transportation project for the bay area over the next several decades, making these comments in a recent report with the bay area news group an interview he conducted there. look at your tv screen, we put this map together so you can see the current crossing across the bay for b.a.r.t. is the trans bay tube indicated by the red line between oakland and sf obvio obviously. transportation leaders are considering a second crossing a bridge south of the tube indicated by that yellow stripe. that second trans bay rail crossing would possibly be shared by caltrain, ace, high speed rail on their own set of tracks parallel to b.a.r.t., since b.a.r.t. trains run on a wider gauge. to pay for this and broader improvements for bay area transportation organizations like the silicon valley lead irship group and the bay area council are trying to put together a ballot measure

possibly for november of next year, that will raise $100 billion in taxes over the next several decades, something b.a.r.t.'s gm supports. if that measure were passed, b.a.r.t. would use that money to pay for discounted fares for low income riders, new ticket gates to prevent fare evaders and the new rail bridge across the bay. right now the tube they're talking about a second crossing bridge. would you be willing to pay more in taxes for something like that? >> eh, like i said, i'd have to see everything, go over everything and look -- maybe, yes. it's perfect. >> yeah, that would be great. commuting's a nightmare around here. we need something better to get us to the bay. the ride on the workforce from the valley, help everybody out and get everybody to work. >> reporter: you'll recall b.a.r.t. was in the news last week, announced that construction of b.a.r.t. to san jose could be delayed four years until 2030 because of an updated underground design that will

take longer to complete than expected. b.a.r.t.'s new general manager is launching a listening tour this month, robert powers will be meeting and greeting riders tomorrow morning between 8:00 and 9:00 at lake merritt b.a.r.t. and 3:00 and 4:30 at the montgomery station in sf. reporting live here in dublin, bob redell, "today in the bay." police tell us they plan to look further into a violent all the vasion outside oakland arena saturday night involving a security guard when a man with a hotdog cart. it happened at the end of the rolling loud music festival. the guard can be heard telling the seller to move and leave. the woman who recorded the incident said that the guard became more aggressive even though the seller was already moving along. the video shows a police officer at the scene but we don't know what that response was. the security company did not return our calls. happening today, the homeless man seen in video attacking a woman as she tried to enter her san francisco condo building will be back in court for a hearing.

this is video of austin vincent reportedly attacking the woman and this went viral last month, reigniting controversy about a navigation center being built nearby along the embarcadero. vincent is charged with attempted robbery, false imprisonment and two counts of battery for the attack. his attorney said vincent was having a mental health crisis at the time of the attack. despite recently losing support from the mayor's office, two san francisco supervisors today unveil their bold plan to overhaul the city's mental health system. the proposed measure called mental health sf is supposed to appear on the ballot next spring. critics argue it would negatively impact long-term mental health care patients. the measure's authors insist recent compromises make it a more workable plan. >> 5:35. santa rosa city councilmembers will vote on raising the minimum wage to $15 an hour in line with many other cities around the bay.

north bay city could join a statewide push to increase pay for low income workers. if passed the change would take effect in 2023. several other bay area cities already passed measures raising wage, that includes san francisco, oakland, sonoma, petaluma and san jose. google has reportedly snapped up more than real estate in the area where it plans to eventually build its massive downtown san jose campus. here is the area where so much of that property has alrea been purchased. "the mercury news" reports this morning the latest land is just north of the s.a.p. center on north montgomery street. google wants to develop a transit village in that area around s.a.p. and diridon train station including some 5,000 homes. google wants to locate about 25,000 workers there. this next story is certainly a sign of the times. listen to this, a san jose man is subleasing a carport with a car and a futon has living quarters. an ad on craigslist boasts a low

a new incident highway 101, that just came up in through menlo park in the last few minutes and the crash south 880 at dixon landing road looks like all lanes are clear there. some of your major street southbound 242 was slow for some reason the construction crew was supposed to be going northbound but the southbound side shows slowing. a number of sources 242 has slowing. no scheduled construction but it's starting to improve for the speeds getting toward the bay bridge. the rest of these folks are doing fine, just the metering lights of course. >> of course. >> of course. okay, so it's tuesday, which means we're inching closer and closer to the weekend. you got the ticket, the forecast for us. >> it's going to be a great weekend, and it's going to be warming up if you are missing summer, it's coming back. look at the temperatures. >> wow. >> inland in the upper 80s and some spots i wouldn't be surprised if we hit 90s.

identified. >> in the meantime, this antioch man, 28-year-old pedro meres, is now in police custody, accused of stabbing another man to death in his home. it happened early friday night on alpha way in antioch. police say the suspect had recently met a 61-year-old man who he suddenly stabbed three times in an unprovoked attack. like a scene right out of oceans 11, a burglar scales a building and makes it to the register and realizes his only way out is the way he got in. the owner says the store was covered in shattered glass and blood. police are looking for that injured suspect. one of the world's best known athletes is talking about california's new ground breaking fair play to pay law signed yesterday by governor gavin newsom. >> he signed the law on "the

police are investigating an alleged sexual assault between members of the gilroy high school football team. the victim told police it happened last week after practice in the locker room. >> we really need to drill down and find out specifically what exactly happened, the motive and the intent behind this contact, certainly was unwanted. once we get those facts we'll determine what if any charges are appropriate. >> you think they have schools, people, the kids are safe, you know? wow, that's sad. >> the second person was a parent we spoke with on campus. gilroy unified said it took disciplinary action against the students involved but won't say if they've been suspended. the district says that it will not cancel the football season. happening today two of president trump's asylum policies will be heard at the ninth circuit appeals court in san francisco. judges are considering a policy that requires some migrants to wait in mexico for the duration of their immigration proceedings along with the policy barring migrants who illegally cross the border seeking asylum.

nbc bay area learned some immigration officials did not follow their own policies when they deported u.s. military veterans who got into illegal trouble. >> our investigative unit is uncovering layers of the story for years. here's senior investigator stephen stock. >> left behind by the country they served, we found more than 300 u.s. service veterans who have been kicked out of the country under a policy first enacted under bill clinton's administration. i.c.e. has special procedures for handling immigrant veterans but th report by congressional investigators shows i.c.e. did not consistently follow its own policies when deporting veterans who are not citizens. nor does i.c.e. electronically track those vets either. according to the government accountability office or gao, i.c.e. did not consistently follow its own policies involving veterans. in some cases, agents were unaware the policies existed and
