and hoda kotb. live from studio 1a in rockefeller plaza. >> hi, everybody, good morning, nice to have you with us on a wednesday morning, it's october. might feel like july to a lot of folks out there, getting really hot today. >> i actually broke out the shorts one more time this morning but al's going to update us on everything in the weather but we do start with our top story. former dallas police officer amber guyger could learn her fate today after she was found guilty of shooting and killing her neighbor in his own home. we're going to talk about what happened in court yesterday with our legal analyst in a moment, but first, nbc's gabe gutierrez is at the courthouse once again. hey, gabe, good morning. >> reporter: hoda, good morning, the jury considered manslaughter but ultimately convicted amber guyger of murder. in many case, this has been a shocking case, and we could find out guyger's punishment earlier today. >> former cop amber guyger is awaiting sentencing following a night in jail and a swift

conviction. >> we the jury unanimously find the defendant amber guyger guilty of murder as charged in the indictment. >> reporter: the family of the man guyger killed erupted in cheers. she sat silent. >> i ask god for forgiveness, i hate myself every single day. >> reporter: in testimony, guyger claims she feared for her life when she shot her unarmed neighbor in his apartment, her panic seen on body camera. in fact, she had actually barged into his apartment on the wrong floor. the key moment when guyger was cross examined with intent at the time. >> when you aimed and pulled the trigger at mr. jean shooting him in center mass exactly where you

are trained, you intended to kill mr. jean. >> i did. >> now the emotional sentencing is underway. >> botham was shot and he died. >> reporter: late tuesday jean's mother took the stand. >> my life has not been the same. it's just been the most terrible time for me. >> reporter: guyger faces 5 to 99 years in prison, her punishment will be up to jurors. prosecutors are showing them offensive text messages and social media posts from guyger's past including jokes about a martin luther king day parade last year and the meme about shooting to kill. >> it's a sad reality that this community waited on pins and needles to decide whether or not someone could be held guilty for killing an unarmed black man in his home while eating ice cream. >> reporter: guyger's defense team has insisted this case is not about race but simply a horrible mistake. today they will try to convince jurors to spare guyger from the harsher end of those sentencing

guidelines. savannah. >> gabe, thank you so much, we bring in our nbc legal analyst, ari melber. one of the most remarkable things about this case, it was striking that the prosecutor charged her with murder, not just manslaughter which would have been criminal negligence, but murder, a more serious charge andot theonviction. >> they added this charge, and i think this goes to the way these types of cases are being taken seriously. it's typically difficult to get jurors to go that far with an officer, we are seeing that here and they won. >> what evidence do you think made the difference here to get -- made the difference here to get that more serious charge, the murder conviction. >> on the physical evidence, it was clear that the jury accepted the finding that the individual appeared to be seated, crouching. >> the victim. >> did not do anything according to the evidence presented to appear to support the claim, i thought they were charging me or had a weapon.

numberwo saw in the reporting, the prosecutor was able to bring in other things the officers had previously said in a different context to be sure that didn't make her look open minded or good, that cut into the idea this was a quote unquote tragic honest mistake. >> you had those messages that had certainly seemed to be influenced by race, and then you also had explicit text messages that she had shared with someone she was having an affair with. that came into evidence. the prosecutors were saying sh is distracted, texting with this boyfriend. are you surprised that that was able to come into evidence and the jury was able to consider it. >> i think it's a great question. we have seen this go both ways in different cases. wait, it seems unfair to have so much thrown in. here i think the prosecutors were able to say this is relevant to understanding, was this a negligent tragic mistake, manslaughter or was this something that had that much higher requisite intent, a bad act done with the wrong state of

mind and that's why they were able to get that in. >> amber guyger, the officer took the stand, said she was obviously heartbroken at what had happened, risky move always to put a defendant on the stand but did they have any choice in this case but to have her tell her version of events. >> you're absolutely right. it's always a huge risk, especially here when the innocent victim looks so sympathetic. they may have felt their case looked so bad they had few other moves. >> thank you so much. we will await the sentencing hearing. we'll move to the impeachment investigation. overnight, the president escalated his rhetoric, accusing democrats of staging a coup against him and his lawyers threatening possible legal action. a key state department official is going to hold a highly unusual meeting with members of congress. we've got all angles covered this morning. we'll start with nbc's kristen welker. good morning. >> reporter: good morning to you. the standoff is intensifying

between the secretary of state and house democrats. democrats warning pompeo he runs the risk of obstructing justice, all as president trump sharpens his attack against the entire investigation. president trump ramping up his attacks on the impeachment inquiry engulfing his presidency tweeting overnight as i learn more and more each day, i am coming to the conclusion that what is taking place is not an impeachment, it is a coup. critics pointing out that impeachment is a legal process laid out by the constitution a opposed to a coup in a legal overthrow of the government. it comes as the secretary of state is pushing back against house democrats accusing them of trying to bully current and former state department officials into testifying. traveling in italy, pompeo

ignores questions about all of it including revelations he was on the july 25th phone call when president trump asked the ukraine president to investigate joe biden and his son. >> it was about helping the ukranians to get corruption outside of their government. and to help now this new government in the ukraine build a successful thriving economy. >> reporter: also under increased scrutiny, the president's personal attorney rudy giuliani who has hired his own lawyer, a former watergate prosecutor after house democrats demanded he turn over text messages and phone messages. overnight, giuliani giving details about how he plans to fight back. >> i had a couple of talks with civil rights lawyers, and here's what they are recommending, we should bring a lawsuit on behalf of the president and myself as a lawyer. >> reporter: this morning, there are mounting questions about the whistleblower at the center of the firestorm with the president stepping up his demands to meet the person, drawing a rare

rebuke from a top republican. senator chuck grassley writing this person appears to have followed the whistleblower protection laws and ought to be heard out and protected. and savannah, it could be a dramatic day on capitol hill despite secretary pompeo's pushback against democrats. the state department's top watchdog, inspector general will be on the hill after making a, quote, urgent request to provide information about the ukraine controversy. for his part, president trump could weigh in on all of this when he holds a news conference later today. on another topic, immigration, there's remarkable reporting out today suggesting the lengths the president was allegedly willing to go on this issue. what can you tell us about that? >> it is remarkable, this is according to "the new york times," during a march meeting in the oval office, the president suggested to slow down migrants by shooting they will in the legs. the white house defending the

president's policies. >> kristen at the white house, thank you so much. a key figure in the impeachment story, joe biden's son hunter, this morning, his business deals during his father's time as vice president are drawing new scrutiny. our chief white house correspondent hallie jackson has that part of the story. >> reporter: the revelations at the heart of the whistleblower complaint that president trump asked a foreign leader to look up information about joe and hunter biden involved ukraine, and now the president is trying to highlight with a different country, described by the biden camp as conspiracy theory. a 2013 trip to china getting new attention this morning not for what joe biden did but for who he brought with him, his son hunter joining the then vice president on the official visit to beijing, along with hunter's daughter finnegan.

hunter biden was forming a private equity fund, planning to raise money including from chinese investors. years later hunter biden acknowledged during the trip he met with a chinese banker which his spokesperson describes as a social visit, not a business one. ten days after the trip, shanghai authorities issued the funds business license, something president trump has seized on as he pushes back against the impeachment inquiry. >> when biden's son walks out of china with $1.5 billion in a fund and the biggest funds in the world can't get money out of china, and he's there for one quick meeting and flies in on air force 2, i think that's a horrible thing i think it's a horrible thing. >> reporter: according to hunter biden's spokesperson, the company itself filed its paperwork a month before air force 2 took off for china with the fund in the works for months prior. as for that claim the company was worth $1.5 billion, not even close his spokesperson says. more like just over 4 million, with hunter biden putting up

10%, and even that didn't happen until 2017, four years after the china visit, since biden was initially an unpaid board adviser, not a company owner, his spokesperson says. there have been no allegations of corruption or impropriety on the part of the former vice president. nbc's josh letterman traveled to china with the bidens on that trip. >> it didn't strike us as unusual to see hunter biden on the trip we didn't know he was meeting with a chinese banker that he was starting a private equity fund with. >> biden's 2020 campaign calling the president's claims a dismantled conspiracy theory, adding donald trump's degradation of his office is unacceptable and speaks to his recognition of what several polls have made clear, joe biden would beat him like a drum and biden advisers tell me having seeing the trump playbook in 2016, they want to make sure they are aggressively fighting back as what they see as baseless claims against their

candidate. >> hallie jackson, thank you. we have a lot more to get to including the intense fall heat wave that is shattering records, it's actually expanding today with summerlike temperatures expected across much of the eastern half of the country. al is here with a look at the forecast it was a warm one in new york this morning >> it's going to continue that way. 25% of the country will see temperatures above 90 degrees. new york forecast at 89. washington, d.c. forecast 96 last time they had a 95 degree day in october, 1941 tomorrow, the forecast for atlanta, 96, they could hit a hundred. the last time that happened? never happened this could be a real record setter and in fact, speaking of records, greenville, meridian, macon, and as we move to the north, see the heat expanding out. bridgeport, connecticut, may set a record columbus, jackson, danville, and norfolk. and while the heat will continue

one more day through the south with temperatures way above normal for little rock, nashville, cincinnati, valdosta, shut the front door on summer in the northeast. we're talking about temperatures in the next 24 hours, thursday, 20 degree drop in boston, new york city, almost 30 degrees philadelphia, 25 washington, d.c., minus 13 in 24 hours. you only have to put up with these one more day in the northeast, and hoda you have to put the shorts away. >> if you don't like the weather, wait a minute that's exactly what's happening. wait 24 hours. a new warning from the tsa and the nation's dmvs, you have less than 12 months to update your driver's license with a real i.d. or this time next year you may not be able to board a flight tom costello, remind us, why are we changing our driver's license? >> this dates back to 9/11 congress passed a law to maintain a minimum level of

security for every driver's license in the country but as you said it takes effect less than a year from now, and the concern is people will show up here not able to get through security because they don't have a real i.d >> ladies and gentlemen you have both sides available, please step down. >> reporter: 363 days until your tsa checkpoint routine changes won't be able to fly using your driver's license if it doesn't have a real i.d. star in the top corner >> you have the star on your i.d., make sure you have the star on your i.d. so you'll be in compliant with the real i.d >> reporter: the tsa is trying to get the word out but 73% of americans don't yet have a real i.d. >> the shot clock is on. it is time for everyone to get the star >> reporter: many state dmvs have opened mobile units and satellite offices to handle the surge of residents upgrading to

a real i.d everybody required to prove their identity with four forms of i.d. which can include a valid license, passport, social security card, birth certificate, utility bill, pay stub, rent or mortgage paymentgr or military i.d. >> i don't like long lines or waiting for hours on end, so i thought i would be on the whole year ahead. >> reporter: travelers who don't have a real i.d. by the deadline will be allowed to fly using a passport, global entry card or military i.d., but the tsa says there will be no exceptions. >> they don't have a passport or another form of identification, this means a very uncomfortable long process for them, largely resulting in a very bad day. they will not be able to travel. >> reporter: the worst case scenario, airports could be filled with people who have bought nonrefundable tickets or return flights home yet don't have the real i.d.s to get through tsa. >> are you going to wait until the last minute? >> no, now that you're asking me out loud, i won't. >> reporter: the advice from tsa

april very good morning to you. it is 7:26. i'm laura garcia. police in san jose vepinvestigag a deadly shooting 9:00 near williams and keltner where 2780 meets sap tomas expressway. police say someone opened fire on a man walking in that area. neighbors heard four to five gunshots and a sound of a car peel out. police say a friend of the victim ran outside and found him on the sidewalk. he died at the scene. so far police have not made any arrests. switch gears, check the forecast now kari. >> it's a chilly start to the day as many in the bay area get ready to head outside and a live

look outside in san jose, skies are all clear and we'll get more sunshine, warming us up a few degrees above yesterday reaching 75, and we'll see upper 70s in parts of the inland east bay as well as the north bay. today in santa rosa expect a high of 78 degrees. our inland forecast comes down a couple of degrees tomorrow as a cold front moves through with some breezy winds and we start the warming process as high pressure builds by the weekend. we were' going to see highs in the valleys in the upper 80s and coming down erm lyearly next we. we have some mid-70s for the weekend. how are the road moving, mike? >> they're all right. we had a couple of trouble spots. overall a typical pattern. we'll call out southbound 680, which shows a little improvement headed down toward mission south. slow from mission north and still a car in the middle of the roadway from what i understand. one more lane open over the last half hour and northbound 101 approaching the arrow, all lanes open. back to you. >> all right, we'll be back with

her own. the sentencing phase is underway jean's mother took the stand >> my life has not been the same it's just been the most terrible time for me. >> guyger faces a sentence anywhere from five years to life in prison. to a bizarre scene at the bronx zoo, check this out, a woman climbed over a safety barrier right into the lion's exhibit. it happened last week, and the video shows the woman just a few feet away from the male lion it looks like she's taunting it, raising her arms, wiggling her body like she's dancing. good news is nobody was hurt the zoo says the action was a very serious violation and it filed a complaint against the woman for criminal trespass. >> that could have ended a lot worse. now to the powerful stand being taken by prince harry and meghan markle against the tabloids the prince is suing over what he calls a ruthless campaign against his wife

kelly cobiella joins us with the details on all of this good morning. >> reporter: good morning, savannah, this comes at the tail end of a very successful tour of africa prince harry announcing this lawsuit in that strongly worded statement saying that a british tabloid has been bullying his wife meghan for months the royal tour of africa has been a feast of smiles and hugs so far >> everything is based on archie's feed time, so it's a full plate but we're making it work it's worth it. >> reporter: now the duke and duchess of sussex have come out fighting, facing down media critics and taking legal action against the mail on sunday, a british tabloid. saying the tabloid edited and published a private letter believed to be from meghan to her estranged father

in a statement as hard hitting as it was emotional. i cannot begin to describe how painful it has been prince harry writes, accusing the tabloid media of waging a ruthless campaign that has escalated over the past year. throughout her pregnancy and while raising our newborn son. in one story, meghan accused of supporting a group of women at a mosque linked to terror suspects after she shared recipes and her joy of cooking with survivors of a high-rise inferno. in other stories she's depicted as hailing from the mean streetp of l.a prince harry adding, i have been a witness to her private suffering, vilified for months they have been able to create lie after lie at her expense. e haveever seen ha speak with such ferocity >> reporter: this morning, the couple met with youth in a township outside johannesburg,

watching the royals. this isn't unprecedented but it's very unusual for the royals to strike back, to sue a british tabloid. is it a risky move >> it has the potential to be a risky move certainly you're absolutely right. the royals generally avoid any kind of legal action simply because in their view it tends to perpetuate the story further. they have been successful in 2017, william and kate were awarded 100,000 euro after a french magazine published a pua topless photo. but it can go against them as well what we have here with harry is legal action that he is taking on a beast with the british media. >> it seemed like a lot of women were probably giving him a good atta boy because he defended his woman, and we think that was pretty cool but what do you think this is going to mean for the british press now. you said they're aggressive, what do you think the result is

going to be. >> the tabloid media is not shy when it comes to defending themselves "the mail" on sunday says they deny the claims, the allegations harry made in the statement, and plan to defend themselves vigorously the media tends to stick together there are a couple of reporters tweeting that there's an atmosphere, harry and meghan appeared for the first time in public yesterday, and already there's a little tension for me, the timing is just so odd. here we are in southern africa this has been a massive success. they have championed women's rights, conservation, the empowerment of the youth it's been positive story after positive story and yet now this is what we're talking about. >> so people can understand, because we remark, in this country we don't see the press that she gets but apparently, if you can tell us, there's a lot of vitriol directed at her is it over and above what a

royal should expect from being in the public eye, is it so vicious? >> a lot of it has been very vicious. she's not the first member of the royal family to be on the receiving end of negative press but i do think this has been at an extraordinary level when meghan appeared at the british fashion awards, she wore a one shoulder dress she was described by some as vulgar the duchess of cambridge wore a one shoulder dress a few months later, described as a greek goddess, ethereal. that's where we're seeing this double standard. the question is the supply and demand, you know that with online media that's driven by ad revenue. stories.le are clicking onhese the longer people click on the stories, the longer they will be written. no one is being held accountable. that's what harry wants to change. >> it's a tough case because meghan markle's father is the one who gave the newspaper the letter and said print it so i mean, they have, look, the laws in britain are less friendly to the press, so maybe they have a stronger case there,

and pull up right next to you, but with startled pedestrians chasing after empty vehicles, tesla's latest cutting edge software is driving concern into high gear again. alarming videos continue to surface of motorists apparently in auto pilot asleep behind the wheel of speeding vehicles from massachusetts to california. with tesla imploring drivers in auto pilot to follow the rules of the road, for those using smart summon, the company says you are still responsible for your car and must monitor it and its surroundings at all times, but with some drivers having to pump the brakes on the new feature, tesla is already on a bumpy road. >> we reached out to tesla for comment, but tesla did not respond, and it's important to point out that tesla's smart summon is a beta feature, meaning the software is technically not finished and can

tackling online bullying. >> when i think about my experience, i was bullied in middle school and when i left school and went home, i wasn't bullied anymore. now kids are going home and taking this with them. is the solution to just get off of it over the course of the day. >> that's a good question. i was bullied in middle school, too and i think the fact that you don't necessarily have a reprieve from that experience is like a big difference between what it means to be a kid today, and what it means to be a kid when we were in middle school. >> tragically this week a 16-year-old boy in tennessee channing smith took his own life after intimate text messages he shared with another boy were posted on social media, including instagram. how do you go about trying to prevent something like that. >> it's a horrible story. my heart goes out to the family. i have two boys, i can't imagine what it would be like to go through what they're going through. what we try and do is the reminder of how important the work is prevent bullying from

happening on instagram and facebook whenever possible. >> today instagram is launching a new anti-bullying feature called restrict. it allows you to approve or decline nasty messages before they're posted to your account. all without blocking the person sending the messages. and without them knowing it. ideas that came directly from teenage users. >> we also started to ask them, well, why don't you use some of the tools available today. why not block someone who's bullying you. we heard consistently particularly from teenagers, often that can escalate the situation. >> there's been a big increase in depression and suicide among teenagers, do you think that social media is partially to blame for that? >> i think that the trends are long, and i think that we on social media, who work in social media, i'm sure have a part to play in the anxiety and the pressure that people, in particular, young people feel. i also want to make sure that we are honest about the fact that

given our scales, there's going to be some good and some bad that happens on our platform. >> but bullying is just part of the problem. a recent study found instagram will be the vehicle of choice for disinformation in the 2020 election cycle. >> there are always going to be sophisticated bad actors trying to leverage our scale. >> if you identify miss information, lying that are out there, memes specifically on instagram, what do you do with it? >> we try and reduce the distribution as much as possible. we also try to provide context to people so they can be more informed readers, what to share and what to trust. >> do you worry that there at instagram could be things you don't recognize that could be harmful and how do you stay on top of that and avoid that. >> i'm super worried about this sort of thing. if i wasn't worried, i would be more likely to miss something. >> the next step could be getting rid of instagram's likes

as you point out, that context is intriguing in light of recent events can you explain to folks so they understand what this relationship between ukraine and russia is, why it is that the u.s. gives money to ukraine. how does that affect our national security. >> russia invaded ukraine, which was bad. it was the first time since world war ii that another country in the range of europe has taken another country, a piece of it by force, and so we stood up for ukraine and said that's a bad thing that russia has done the rest of the world did too. we sanctioned them for that. russia ended up getting kind of nutty, they only were a little bit of an aggressive country, but they threw wild pitches. i got interested in this book, why is russia behaving so strangely, and it kind of turns out because they have no economy at all all they've got is oil and gas, and it turns out that's a bad thing to build your economy on. >> the book lays out this thesis that there are several countries

around the world that rise and fall on this issue of oil and gas. you have a quote from a saudi arabia official saying i wish we had discovered water. i wish we had discovered water i wish we didn't have these resources, they're a curse as much of a blessing. >> think about a economy that exists, the entire country is oil and gas. he thinks of oil as the excrement of the devil it ends up giving you a bad country and a weak rest of your economy, and in the case of russia, it made them use oil and gas as weapons against countries it wanted to control like ukraine which in part has led to this impeachment. >> your thesis is it threatens democracy itself, that those are the stakes explain. >> in countries where we've got oil and gas dominated economies, we end up getting oil and gas dominated governance, which

sucks. sort of the cure to that is when people stand up and use democracy in order to reclaim what works for them and what the country ought to be doing for itself, but where governance is captured by oil and gas, and you see it in big countries, rich countries and poor countries all over the world it's not just russia, small countries in africa i write about, state governments in the united states. governance suffers and to the extent that that can be pushed back, that people can assert democratic principles against those things, governance gets better and democracy thrives, and i think we have to face it when it comes to the climate crisis. >> it's a page turner, it may be vegetables, but you serve it with a spoonful of sugar you walked here, i have to ask you, on crutches, what happened to your foot, i hope there's a good story. >> i keep telling people, you ought to see the other guy but honestly what i did, in the morning -- i'm not a morning person for me, this is still nighttime, and i was going fishing, getting

>> not the black and white. >> we did the original, i was adamant, no photographs, we want tons of text, and it was a doorstop this is a little, it's not small, but it's a little more compact. >> very cool the food is great, and remains great, today we're going to do pasta three ways, what do we have here. >> all of these pastas have in common that they are cooked by absorption, we use the amount of water the pasta absorbs, so all the sauces are really creamy, they're guaranteed to be creamy but it's a kind of different technique. here we're using, the fundamental one has butter and here, we start with parmesan the one we're going to make here, we start with shallots, if you use long pasta, it's easier to break it first, so you can stir it. we add the pasta and cook it a little bit until it browns, it toasts a bit, and then it's like making risotto we add wine, as that evaporates,
