. good sunday morning. it is 7:00 on the dot. here is a live look outside, beautiful skies, as we look over downtown san jose. maybe a little bit brighter than we're used to at this time. it's normally 8:00 right now, that's probably what your oven and microwave say. hopefully you enjoyed that extra hour of sleep. thanks for joining us. i'm kira klapper. vianey arana has a look at our microclimate forecast and it's the extra hour hasn't woken you up you were saying the chilly morning will. >> hopefully you're nestled up underneath your blankets, a nice cup of coffee.

i like opening the window and a breeze blowing in. 45 degrees, we have the birds flying overhead. this is what i mean when i say it's cold. in the north bay and through some of the interior valleys, santa rosa 36 degrees. livermore 39. through half moon bay 39 degrees. so it's going to be a cold start, but by the afternoon, our temperatures are going to warm up rather quickly, and it's going to be rather i would say above normal for sure, about ten degrees above normal, where we're supposed to be at for this time of year. upper 70s, a couple of low 80s through the north bay, but look at all of that sunshine. we are well into our stretch of what i'm going to call calm weather, and it's also going to be warmer, but how long is this going to last? i'll have the details coming up in about 15 minutes. >> we were both talking about how beautiful yesterday was. and we'll see you around 7:15,

thanks. we begin with a family in mourning. a father is remembering his son who went to a halloween party in orinda and never returned home. as investigators continue to search for who is responsible, the families of the victims from the orinda shooting continue to grieve. skrid yo posted on social media shows after shots were fired. here is "today in the bay's" sergio quintana. >> reporter: one of the first victims identified in the halloween night shooting was 24-year-old omar taylor jr., his father, omar sr., got a startling call his son was at the party deejaying and shot. >> i thought about hurrying up to get to him. >> reporter: he drove to an area hospital where he found out his oldest son it not survive. omar jr. had been pursuing his dream of being a deejay over the last few years. >> he was just always trying to

bring everybody together. he loved deejaying. he loved playing, making the party move, that was his thing. >> reporter: his son's death affected the whole family, including his second oldest son omari, he showed up to school friday. >> he was crying pretty good and told me that his brother got shot and killed and i just, i was strong, obviously blown away. >> reporter: omari played friday night, his teammates dedicated the game to his big brother. residents of orinda, people have been leaving cards and flowers for the victims at the driveway to the party house and near downtown. >> we're just looking for ways we can help and this is nothing, so small, but just a way we could give some support to the families grieving tonight. >> reporter: omar sr. says the support has been helpful but he's still in shock his oldest son is gone. >> just the thought of never being able to have a conversation with my first born kid is just crushing to me.

>> reporter: sergio quintana, n"nbc bay area news." we are also mourning the name of another victim, o oceana tompkins died at the hospital. friends tell us her smile could light up a room. friends and relatives held a memorial. she was an organ donor and in her final act helped others. airbnb is announcing changes. the company's ceo and head of community, brian chesky tweeting, starting today, we are banning party houses and we are redoubling our efforts to combat unauthorized parties and get rid of abusive host and guest conduct, including conduct that leads to the terrible events we saw in orinda." the company, based in san francisco, also is expanding manual screening what have they all high risk reservations, flagged by risk detection technology. they're creating a dedicated party house rapid response team,

and taking immediate action against violators, including complete removal. we spoke to people who survived a similar party shooting in san jose. they tell us they support airbnb's new changes but do have doubts about how effective they will be. >> i think it's the right direction but i still at the end of the day think people are going to do what they're going to do go f they can make money renting out houses. >> the ceo has formed a new team to speed up the development of the new safety initiatives. he says he hopes airbnb will implement most of the new safety measures within ten days. we'll bring you the latest developments on air and online, as the search for the shooters continue. we enkrnlg to you visit nbcbayarea.com for the most up-to-date information. now to some serious concerns in san jose after dozens of san jose police department uniforms were stolen. it happened friday morning on rebecca way.

someone carjacked a dry cleaning van that had 60 uniforms inside. police eventually were able to find the van and the uniforms. they are now looking to see if any uniforms are still missing. there is concern about people being police imposters. police are still searching. police did arrest a man for allegedly starting fires near hayward. the fires were reported just before 5:00 yesterday in guerin regional park. firefighters say eight small fires scorched about ten acres of the park. this is the suspected arsonist, roman montalvo. a witness identified him as he escaped the area. a team doing helicopter water drops spotted him trying to get away. police arrested him shortly after. firefighters are making headway on the kincade fire. it's been burning for ten days in sonoma county. we have the latest information from calfire, it is now 74%

contained. most evacuations have been lifted. nearly 78,000 acres have burned, more than 300 structures destroyed, including 175 homes. many people are returning home after many evacuations were lifted in sonoma county but there's a new hurdle for those people. they're being required to check in with an environmental health officer before doing any cleanup on their properties because of health concerns. some homes and businesses now have their power restored but still don't have gas. one pizza place uses wood-fired off on it make fresh, hot pizzas, a limited menu but decided to open for folks anyway. >> in a time of crisis, sometimes you have to come out and have a good meal but we weren't sure how it was going to be but we've gotten a lot of people coming in. >> the hotel healdsburg has had a few guests return but hoping to be back up and fully running by today.

people in the north bay aren't getting any breaks. they were rattled by a pair of small earthquakes yesterday morning. the first quake measured a magnitude 3.7, it hit just after 7:00 a.m. that quake was starred near the geysers on the northern perimeter of the kincade fire, and then three and a half hours later, a smaller 2.9 quake struck just west of cobb. there have not been reports of injuries or damage from either trembler. friends and family of two people missing for more than a week in northern california plan to come together to pray for them this weekend. a vigil for justin winfrey and kayla rodriguez is set for this afternoon at third baptist church in san francisco. the two took off from novato in winfrey's small plane bound for shelter county. they were seen having dinner there but shortly after, the plane dropped off radar, five miles off the coast of mendocino

county. winfrey grew up in san francisco and was very active in his community. rodriguez was a labor and delivery nurse in san francisco. it is no secret, living in the bay area is expensive. san francisco mayor london breed is now pushing a $1 billion plan to deal with just that. the mayor is taking her case to the online site medium, in her op-ed, she says the billion dollars will go towards housing investments like rental subsidies, development, and revamping the housing authority, and she says $600 million is coming from the affordable housing bond, the largest bond in the city's history. that will get construction off the ground for nearly 3,000 affordable housing units. the remaining $400 million is from the city budget for the next two fiscal years. mayor breed says that pot of money will buy up land to build new homes and go towards keeping rent-controlled housing that

welcome back. political analyst larry gerston is heres awe also welcome chuck todd live in d.c., the nbc news political director and moderator of "meet the press." hi, chuck. thanks as always for joining us this morning. >> hi, kira. happy sunday. >> happy sunday to you. we know that you just announced new number this is morning from our nbc news/"wall street journal" poll showing 49% of people surveyed are for impeachment and removal of president trump, but very

closely 46% against. chuck, what do you think it says about the president and the upcoming 2020 race? >> well, as one of our panelists pointed out, that 49-46 split looks awfully familiar. it's about what the split was in the 2016 general election, right? essentially 46% with trump, 49% essentially with hillary clinton, so in some ways the more things change, the more they stay the same. my takeaway from the poll the country is as wided as congress is, in some ways congress is reflecting the divide in the country. i think what you see in our poll is political strength for the president that can survive impeachment but political weaks than makes me question whether he can survive re-election. so yes, the party's united behind him, which is why he probably survives this impeevement process, but then you look at another part of our poll and you have 46% of the country already saying they're going to vote for anybody that

runs against him, with another 17% saying it depends on who is running. my word, 46%, you don't need much of that 17% there in order to get your majority there. so it is a fascinating poll in that it both simultaneously explains why the president is strong enough to survive impeachment while at the same time makes you wonder whether he's too weak to survive re-election. >> wow. very interesting. >> chuck, in a few days, the three house committees meet in closed session about the ukraine matter, will release interview transcripts. what impact is this likely to have on the impeachment process? >> i had a long conversation with tom cole, republican, in leadership, he was sort of, he led the house floor vote on behalf of the republicans during the impeachment inquiry, and he said, look, he hasn't read all the depositions. he hasn't totally closed his mind. he's not going to sit here and

say there's nothing that would somehow that could somehow come out that would convince him to vote for an article of impea impeachme impeachment. it's possible when you see the depositions when they're laid out, then you animate them with the people that gave these depositions that testify in public. it's possible more folks are persuaded. a lot of people, veterans of watergate will say hey, the public wasn't there in impeachment until the very, very end so anything is possible. but i will say, i think with our political calendar, as scrunched as it is with the impeachment calendar, i don't know if you're going to have the time for the democrats to lay this all out and have this presidential election get started in iowa all at the same time, and sort of have an open mind in the country politically. that's the part of this i can't envision. >> so back to the calendar you're discussing, assuming a trial, some senate republicans may frame the quid pro quo

allegation in advance, as poor judgment by the president rather than an impeachment offense. if so, how would this approach affect the credibility of these guys during the trial? >> well, i think that at end of the day, it's a reminder why we always tell people, there is no legal standard for impeachment. it's a political standard, and that is something you're going to hear the "l" word thrown out. that's not legal, that's not this. well, look an impeachment it's a political standard, pure and simple. so it looks like republicans are getting at least in the senate they can't bring themselves to defend what he did, so at the end of the day, they want to go with lapse of judgment perhaps. look, i do think a powerful argument, the most powerful argument the republicans have is not defending the president's actions, it's simply saying let's leave it to the voters to decide in november. ultimately that's probably their most powerful talking point, because it's one that doesn't

camp fire. families say football is a good thing for the entire community to be a part of. >> it's emotional. uhm -- i'm really proud to be here and i'm really happy to have my son on the team. we've been through a lot. >> the team vowed to win the state championship to honor the fire victims, and it appears they still have a good shot at reaching that goal. wow, a great, happy ending for them. let's check in with vianey arana for a look at our forecast. yesterday was pretty perfect. >> it was, because the temperatures aren't like hot but comfortable and sunny. we'll get another round of that today. it's cool right now. before you leave and you think it's hot, grab your jacket. you'll need it for the next couple of hours. it will be one of those california days where you think you're going to be whipping out all those boots and coats and by the afternoon it's too hot for the boots and the coats.

right now 45 degrees in san jose. beautiful views there and our current temperatures throughout doing pretty good. san francisco is one of our warmer spots, 53 degrees, nice clear skies over san francisco though. i was out there yesterday, and it was a perfect night as well, i was out there late and it was still nice and comfortable, but current temperatures in napa 37 degrees, santa rosa 36. it's really cold and keep in mind that unfortunately a lot of these folks up here still might not have enough power in terms of having a heater on, so just keep that in mind, when you're headed in to bed to tnight. if you have power to turn on the heater you may need it the next couple of nights. livermore 39 degrees. san jose 45 degrees. 46 degrees in palo alto. half moon bay 39. there are no frost advisories in police a. remember yesterday we had a frost advisory in effect through 9:00 a.m. not so much today. let's look at your microclimate highs through the afternoon, you can get a good idea of what you're expecting, 80 degrees in los gatos. san jose 78.

cupertino 77, down through gilroy also in the 80s, and in through the east bay, we're talking 78 for walnut creek, 78 through concord, all the way down through livermore, similar conditions as well, pleasanton 80 degrees. near oakland we're talking 72. sunshine is really going to be the trend. i want to you notice also the humidity. in addition to it being warm it's also going to be really dry today so you might feel like your skin, hands or ladies the face, the men, too, you might need a little extra moisturizer because that high pressure is holding on so tight over the bay area, that it's really drying out the air, which makes it feel so dry. 72 degrees in mission. 70 degrees in embarcadero and up through the napa area, we're talking 76 degrees, novato 77. 78 and then up through clearlake also in the upper 70s. so here it s we're talking about the dry pattern. we've got that high pressure, it's moving inland, which is bringing some of that warming, which is why we're about ten degrees above normal, where we're supposed to be at this time of year. fast forward in the time line

"today in the bay's" garvin thomas shares their story in this morning's "bay area proud." >> reporter: a mother's love can take many forms, including apparently this one, and this one, and even this one. >> do you see that? >> yes. >> yes. >> reporter: the love we're talking about is what shelly jiminez feels for her son, chris, and this incredible halloween display out front of their willow glen home is just her latest way of showing it. >> i thought i've got to do something to bring some happiness to him. >> reporter: chris was born with severe medical challenges, that he's lived 24 years is something of a miracle, that he'll make it

to 25 may require another one. >> i have it on my mind every second of every day. as i see him, you know, slowly progressing, getting weaker, and more tired, i get scared. you like petting him, huh? >> reporter: and so with chris' vision just about to fail, shelly wanted one of the last things he's able to see to be something he won't soon forget, so she went all out this year. >> this is the biggest i've ever done. do you hear that? >> yes. >> yeah. >> as expected chris loves the display. >> we have some visitors. say hi. >> reporter: what shelly didn't expect is just how many others would, too, a post on their neighborhood facebook group has spread far and wide and is bringing crowds each night to see not just a halloween

lied to the homeowner about their intent, claiming they needed the space so family members with asthma could get away from the smoky air in the north bay. marianne favro, "nbc bay area news." >> of course we will continue to track this story and bring you the latest developments both on air and online. go to our website, nbcbayarea.com, any time for the most up to date information. now to the 49ers, they're reviewing how they use fireworks, after a fan was hit before a game, it happened last sunday at levi's stadium, as the team was getting ready to face the carolina panthers. after the national anthem, fireworks display, a golf ball sized piece of debris fell out of the sky and hit a fan on the shoulder. he suffered minor injuries. the team released a statement "while this has been described to us as a rare incident, the safety of our patrons is our ultimate priority. we will continue to work with our public safety partners and the pyrotechnics vendor to confirm necessary safety protocols are always followed in

order to ensure the safety and security of our patrons." firefighters are making headway on the kincade fire burning in sonoma county. we got new numbers just about five minutes ago from calfire. the kincade fire is now 76% contained, that's up from 74% yesterday. most evacuations have been lifted. nearly 78,000 acres have burned, and more than 300 structures are destroyed. 175 of those are homes. help is on the way for victims of the kincade fire, the nor cal emergency response team held a donation drive in the south bay for fire victims. it was at el portal elementary in morgan hill. the group accepted new clothes, hygiene products, bedding and even food for animals. >> this community down here in morgan hill, gilroy, san martin has been great. i've been doing this, this is my fifth year and i haven't had a problem getting truckload after

truckload to any of the fires throughout california. >> wow. organizers then drove all the supplies up to the north bay, where they are being handed out today. turning now to decision 2020, the iowa caucuses are now just three months away. democrats are hoping to take on president trump next year. they are crisscrossing the state, trying to connect with voters. former vice president joe biden is sharpening his message, that his experience is what sets him apart. but in the latest "new york times" sln college poll senator elizabeth warren is leading the pack, stressing that ideas not opposition to president trump will win the white house. >> i'm not running some consultant-driven campaign with some vague ideas that are designed not to offend anyone. >> meanwhile, president trump

president's account and the findings include the fact that trump's staff wanted his tweets on a 15-minute delay earlier in his presidency. more than half of the president's more than 11,000 tweets are attacks, and the "new york times" reports he rarely follows back. his feed comes from just 47 accounts. the investigation of president donald trump reached a new level this past week, when the house of representatives adopted fact-finding rules that could lead to the impeachment of the president, all but two members of the democratic majority approved a set of procedures while every single republican voted in opposition. nbc bay area political analyst larry gerston is here again to guide us through the next steps. if you can, remind us sort of the time line of how we got here. >> it's a quagmire, isn't it? there are some things. this much we know as facts. about three months ago,

president trump called ukrai ukraine president zilinsky to congratulate him on his election. he called on him to investigate crimes by then vice president joe biden and his son hunter during the clinton administration. earlier probes of trump's games were investigated by the american authorities and found to be without merit. mean whil president trump denied military aid for the ukrainians in a life and death battle with the russians. just about everyone on all sides subscribes to the facts including president trump in a summary of the call he released to the public. that's the quick update. >> devil's advocate. if there is widespread agreement on the facts, why would the democrats investigate those facts? >> well, the now famous whistle-blower to authorities, that account he wrote to the authorities a long letter alleging several potential misdeeds by the president and others, among them that the president denied military aid

for ukraine until zelenskiy complied with his request. if so, this would be the much discussed quid pro quo which many consider improper if not illegal. there were other questions that emerged over circumstances revolving around the phone call, among them, why was the phone call summary provided by president trump as noted in the three dots that followed many paragraphs before moving on to the others. moreover, if the phone call was as innocent as the president claimed, why was the full transcript stored in a high level computer file typically used for the most sensitive national security issues? democrats demanded and received answers to many of these questions and others, which have been provided by individuals testifying in those very important closed sessions. >> so if democrats have been satisfied by the committee hearings, the answers they're getting, could they or why don't they call for impeachment now? >> it takes time.

it takes time, for the past few weeks really, three i think the three committees have held closed door fact-finding interviews not open to other members of the house to shield participants from attacks and even any ecreate information relating to national security safe but now, but now the house of representatives is about to go public, and in this next step, the intelligence committee will hold public hearings now, public that include testimonies from most of the closed session participants as well as others. as was the case with closed hearings republicans will have the same opportunities as democrats to question witnesses. one other thing, in addition, representatives of the president will be allowed to dispute findings claimed by the democrats. the president's representatives will also be able to ask their own questions of witnesses appearing in the public hearings but perhaps the most important reason, kira, for the public hearings, will be the ability of

the public to watch for themselves, to get a handle on the issues surrounding the president's behavior, questions so profound that they are likely to produce a house vote on the impeachment by the hearings end. >> so the process seems long, which i presume is a good thing. it can be more thorough. so all of these steps are necessary for an impeachment vote and then a trial in the u.s. senate? >> yes, and we can't say this enough. impeachment is an incredibly serious business. the steps we've discussed up to this point have been necessary for the house to carefully gather the facts before deciding whether to move forward to the public component, only after the public hearings will the house decide whether to impeach the president, and if the house does impeach president trump, we can expect an even more dramatic moment or two, when the trial occurs through the senate. you know what we'll save that discussion and all the drama with it for another time. >> yes, and don't we always save

hour. the big topic of conversation these past couple of days have been those cold nights and those cold starts to our day. look at santa rosa, 36 degrees, napa 37, in through concord, right about 44. there are no frost advisories in place for the north bay. we did have one yesterday, but it's still very cold, down through livermore talking 39 degrees. check out oakland 46 and san jose 45 degrees. your microclimate highs for today, keep in mind we still have that high pressure that's dominating over the area, which is why the air has been feeling so dry, that's what kira and i were talking about. you may feel like you need extra hand lotion that's the reason why. temperatures above normal for this time of year. concord a high of 78, oakland 73, and in through san jose 78. so it's going to be a cold start, dress in layers, because right now you need a jacket, but by the afternoon, once we start climbing into the upper 70s, you're going to want to shed that jacket for sure, and that's going to continue to be the trend for the next couple of

days. we're kind of going into this calm weather pattern. squaw valley beautiful view in lake tahoe. we have the clear skies, if you're head ted out there today the temperature trend nicely in through the 60s. topping out at about 64 degrees and keep in mind it's always pretty chilly up there so overnight lows once again dipping down into the 40s, maybe some 30s to start tomorrow. plan on heading back tomorrow you're not worried about weather conditions getting in your way, a lot of sunshine for beautiful photos. the dry pattern continues, the high pressure continues to move inland. we have the warming and the high pressure is going to hang on so tight that if i take this time line all the way through november 10th, look at what happens. you can see this low pressure system just off to our north, that is rain but this high pressure system is blocking it from making it into our area so that rain stays well off to the north, and we're not expecting a chance to see any rain for the first two weeks of november, best possible chance somewhere between the 15th and the 19th,
