fate of ecigarettes a fordable housing and taxing rideshares. plus -- >> a number of vehicles, three of them in particular that were shot and one of them was set fire. >> developing right now, american citizens, including children, ambushed and gunned down in mexico. new details on the family killed plus what officials say led to the horrific attack. and for several years in a row now, more people are leaving california than moving. a live report on who is leaving and why. "today in the bay" continues now. and good morning to you on this tuesday. thanks so much for starting your morning right here with us. i'm marcus washington. >> and i'm laura garcia. let's get straight to the forecast right now. we have kari. >> and we have some nice weather, as we go into the day. we're going to start out with some patchy fog. we're seeing that right now, as we take a live look in oakland. once all of this clears within the next three or four hours,
5:01 am
we'll see some sunshine, and it will lead into a nice day. if you're about to step out the door headed to the fruitvale b.a.r.t. station we're going to see the fog through about 8:00 and sunshine, temperatures making it into the upper 60s. we'll even see a few low 80s in the north bay, up to 82 in clearlake and 82 in morgan hill. so we'll get a look at the rest of the week's forecast. mike, you have a couple of things to point out in oakland. >> that's right, one of them is what you showed from the coliseum shot. you see up here by the bay bridge as well some low clouds floating around. there may be a fog issue. keep those lights on. your standard beams if you come across some fog. we don't have all the cash lanes open. look at that one, still closed for the morning. should be open the next few minutes on both sides of the fastrak lanes which are filled in. so there we go. we talked you through the things that are changing over there. we have the early tuesday start for the commute, building at the toll plaza, but not a problem for contra costa county. little blips with the yellow highlighting, we're showing fog registers on our road weather

index. no problem for the commute south bay, east bay or peninsula. back to you, marcus. >> thanks, mike. in parts of the bay area, voters head to the polls today. san francisco in particular has some important issues hanging in the balance. "today in the bay's" pete suratos is live for us at the city, with those details. pete? >> reporter: good morning to you, marcus. a number of propositions up for a vote today here in san francisco, covering a wide range of important issues. we want to touch base on some of those big propositions that we're talking about. let's begin with proposition 8. proposition 8 is to allow the city to sell $600 million in bonds for affordable housing, an important issue often discussed here in san francisco. if passed, that would be the largest in san francisco history. let's talk about prop c also on today's ballot, aims to overturn san francisco's rules suspending the sale of ecigarettes not approved by the fda. of course this is capturing a lot of interest nationwide, with cities and states mulling the
5:03 am
possibility of an ecigarette ban. voters say yes to this prop, the ban would replace regulations supported by ecigarette giant juul. finally there's proposition d, which would impact everyone who takes an uber or lyft into the city of san francisco. if approved it would tax customers an extra 3:25 more for most trips and 1.5% more on pool rides. more election coverage in the next half hour including the race for mayor and the race for district attorney, a lot to unpack there. we'll have more of that in the next half hour. reporting live, pete suratos for "today in the bay." >> all right, pete, thank you. be sure to check out our website, nbcbayarea.com, to find out more of that up to the minute election results. we'll also be pushing out results through our free nbc bay area app. 5:03 for you right now. we are following the developinger toy at the u.s./mexico border, where at least nine americans, including six children, are dead, after a
5:04 am
highway ambush. this happened in sunora near the arizona border. a relative of the victim says the remains were found in a burned out suv. he says the group had been driving in a convoy from their home in mexico to arizona, when they were attacked. they were headed across the border for a shopping trip, along with nine people killed, eight children survived by hiding and sneaking away during gunfire. >> my understanding, there were some children that was able to escape out of the vehicles unharmed. >> the family member says one of the children walked about 14 miles to get help, after hiding the sibling in the bushes. he also believes a drug cartel is behind the attack, and this may have been a case of mistaken identity. >> 5:04. a new turn this morning, the search for answers after that halloween party shooting in orinda which left five people dead. nbc bay area learned investigators are tying the killing to a shooting years ago
5:05 am
in san francisco. "today in the bay's" bob redell joins us live from orinda with more on the police investigation along with the key vote that's happening tonight to crack down on so-called party houses. bob? >> reporter: correct, laura. yes, first about the investigation, we are learning more about a possible motive into that shooting that left five young people dead here in orinda, this of this past halloween night last thursday. nbc bay area learned two of the victims in thursday's deadly shootings may be tied to a killing in san francisco back in 2015. "the chronicle" is reporting one of the victims from thursday was the younger brother of the defendant in that 2015 shooting. . the paper reports law enforcement is looking into whether thursday's shooting was an act of retaliation. here in orinda, thursday's shooting that killed five young people as i mentioned is forcing the city here to rethink how they should handle airbnbs in the future. the city council will discuss ways tonight to deal with airbnbs including making sure the home is occupied by an
5:06 am
owner, polilacing a two-day minm on airbnb stays and possibly eliminating airbnbs all together. orinda requires short-term rentals to register with the city annually and pay an occupancy tax and maximum occupancy of 13 people which was clearly violated during a halloween party last week which had over 100 people in attendance. we spoke to the city manager and some residents about the steps the city is taking to prevent an incident like we saw on halloween. >> there's a range of things you could do to try to eliminate the kind of thing that occurred the other night. the thing that occurred the other night was not in accordance with the ordinance. you're not allowed to have more than 13 people. you're not supposed to have parties. there's all kinds of things that got violated. >> it's really unfortunate, but the reality is that, you know, people, things like this happen and with something new, it's inevitable that it happens.
5:07 am
just like autonomous driving cars, right, it's just about catching it. it's about being aware of it and really asking like everybody, how do you feel about it. >> i think it's a good thing. i think they should also look at the people who are renting the houses out, and do a little more background on those people. seems unnecessary we should have houses that get purchased and all of a sudden are airbnb rentals. >> reporter: in response to the incident, airbnb put new measures in place to ban "party houses" on its platforms. the city of orinda is not expected to take any immediate action tonight. the meet something at 7:00 at the public library auditorium. reporting live in orrin da, bob redell, "today in the bay." >> thanks, bob. 5:07. happening today, san jose's police chief is expected to provide new details oen a deadly halloween police shooting. officers responded to mckee road about a block from interstate 680 where they say a man with a
5:08 am
gun ignored officers' orders and appeared to draw his weapon, when an officer fired. police later learned the gun was a replica. happening today, on capitol hill, we should get our first look at more closed door testimony in the president trump impeachment probe. transcripts are expected to be released in the recent depositions of america's eu ambassador gordon sunday lan and u.s. envoy kurt volker. it follows monday's release of testimony from two other career diplomats, former u.s. ambassador to ukraine marie yovanovich. she said last month president trump pushed for her removal. scott mcgrew will have much more on what revealed in his "checks and balances" segment. california may be the golden state but seems to be losing some of its shine for some folks opting to leave, migrating to
5:09 am
other states. "today in the bay's" kris sanchez joins us live with one of the reasons why people are leaving. kris? >> reporter: laura, i bet your first guess is high housing costs, and you would be right, that is one of the main reasons people are giving but not the only reason. it is the seventh year in a row that california lost more population than it added. more than 86,000 people left california last year for texas. nearly 70,000 left for arizona. about 55,000 left for washington state, and the trend might continue, according to census data. also according to a new uc berkeley poll, 52% of registered voters polled say they've considered leaving the state, some of them seriously. 71% cite the high cost of housing, 58% cite the high cost of taxes, but look at this, 46% say it's the political culture here in california, particularly conservatives who say the state's policies are not in line with their own. while california might be losing
5:10 am
population, according to the legislative analyst office, california is adding population in some really high income brackets, so there is, there are folks coming in and they're coming in at a higher salary, and another guess here, where do you think they're moving, they're moving to the bay area. in san jose, kris sanchez, "today in the bay." good tuesday morning. right now at 5:10, as you get ready to head out, here is what we're talking about, all of that traffic and people having to deal with pretty long commute, so as you're headed through dublin, we're seeing some all clear skies and also cool temperatures. if you're about to leave from antioch, expect it to be at about 46 degrees, and then we'll go from 46 to 71, as we warm it up by noon today eventually reaching into the low 80s, in parts of the inland east bay as well as the north bay. we'll get a look ahead to the rest of the forecast coming up and mike, now you have a traffic break on the peninsula. >> i can change that to past tense. we had a traffic break,
5:11 am
northbound, things were jammed up right here, just shy of willow. whatever crew they had there has cleared now. looks like everybody got off at the willow off-ramp and everybody else continues now north. we may see a little blip on our speed sensors but not a major problem. we'll check on the crash in san jose coming up next. back to you. >> thanks, mike. still ahead for you here on "today in the bay," san francisco leaders are talking about taking a dramatic new step to keep walkers and cyclists safe. what that plan is, coming up for you at 5:25. i know it sounds crazy in the bay area, but there are parts of your life that are cheaper than they should be. i'll explain, coming up. and there's a cat on the field, in case you missed it, coming up, how the cat who stole monday night football made its grand escape, as millions watched live on tv. you're watching "today in the bay." poor cat. looks frightened. >> look at him go. scaredy cat. ok, network inspection. -ok.

good tuesday morning. at 5:14, a live look in the south bay and get a look at our temperature trend for santa clara. it's going to be another cool start, with some upper 40s, but it does warm up here quickly. at noon we're at 71 degrees. i think that's perfect. we'll see where we're headed for our afternoon highs and talk about the rest of the week, and the outlook for the rest of november, that's coming up in less than five minutes. and these drive times are great, getting toward the bay bridge toll plaza, but you do have a backup forming right now at the toll plaza, off of the maze. you may find some low clouds and
5:15 am
some fog there. you will find it for 101 across the golden gate bridge and we're now finding slowing throughout parts of the north bay. and good morning to you, very happy tuesday. dow 30 industrials, the nasdaq, the s&p 500 will all open at historic highs this morning, after it became more and more clear the u.s. and china had reached the combination of a trade deal. we also get a look at the current trade deficit today. it's been growing, despite the tariffs. san francisco's uber opened its books to investors and once again today it was losing money, a lot of money, more than $1 billion. uber has never made money. one bit of good news, the actual rides themselves seem profitable, that's good news, because the worry around silicon valley is lots of the things that you have come to enjoy, a ride with uber, a meal delivery, a scooter ride, they're all relatively cheap, because they're subsidized by the company's venture investors.
5:16 am
companies like these lose money making you happy. if they were charging you the real price for the product, you'd be paying a lot more. your life in this case is cheaper than it should be. now the other thing to watch, the lockup on uber shares ends tomorrow, that means uber employees can sell some of their shares, so if you're a real estate agent, get up early tomorrow. they'll be calling. if you're an uber investor, you may see the price fall as shares flood the market. if you prefer driving yourself around town, ford is giving us a ne sneak peek of the ford bronco. they say it will look similar to this racing truck and yes, you'll be able to take the roof off and believe it or not there will be a hybrid model, which is strange and guys, another week, another new episode of my new podcast, i talked with a scaled venture rory driscoll this tweak. he and i are about the same age and we talked about getting to the age we are, we think we know
5:17 am
everything and resistant to new ideas. >> if you find yourself recoiling against the new and dismissing it, you need to quit. you're done, to be brutal. >> sand hill road anywhere you find your podcast, apple, spotify, stitcher and participating pop eye's chicken outlets. if you be patient they'll give you the podcast. >> there you go. >> 5:17. the new york giants not having a lot of luck these days, even before last night's monday night game against dallas, on a four-game losing streak, before a black cat moseyed in. this happened in the middle of the second quarter, and it even got radio broadcasters excited, as it headed for the paydirt. take a listen. >> he's walking to the 3. he's at the 2. and the cat is in the cdw red zone, cbw people who get it, now a policeman, a trastraight troo
5:18 am
has onto the field, the cat is in the end zone, that is a touchdown. >> that's kevin harlan of westwood 1 radio. the cat was last seen hightailing it through the stadium title. the giants lost their fifth straight game 37-18. >> cat better entertainment. >> under the ladder in the tunnel, where someone was trying to hang a mirror that fell. >> friday the 13th. >> i'm thinking who brought a cat into the football stadium? >> it probably snuck in. >> somebody did it on purpose. >> poor little kitty. >> the world will never know. all right, let's start out this morning, getting ready for this tuesday, with a look at a layer of fog covering san francisco. right now that fog is pretty shallow, only at about 500 or 600 feet and so we are going to see it linger for a couple more hours before it clears out for the rest of the day. the other issue will be the air
5:19 am
quality. we see fog near the coast, we're also getting some drifts of smoke, coming in from a wildfire, farther to our north, and so it is creating unhealthy air quality. you'll see a layer of haze across the bay area today and if you have breathing problems, you do want to limit your time outsite. as we check out our current temperatu temperatures, another cold start for the north bay, cooling off a few more degrees. in concord 47 degrees, palo alto at 48. 48 in san jose. if you're about to head out to the warm springs b.a.r.t. station, expect it to only be at about 46 degrees. you do need a warmer jacket to start out, but the rest of the day you'll have to carry it around as our temperatures warm up and it will feel nice at noon, at 71 degrees. our south bay high temperature heads up to 82 degrees in morgan hill. these temperatures are well above normal. we should only be in the upper 60s. we're up to 81 in concord, as well as 81 in danville. oakland reaching 74 and mid-70s
5:20 am
for san mateo. san francisco in the upper 60s, and in the north bay, we're up to 82 in clearlake. as we look ahead to what we're expecting for the rest of the month of november, high pressure setting up, and it's giving us some well below average rain chances. this put out by the climate prediction center, showing very dry and also very warm conditions for the whole state of california. this takes us through about the end of november, but it looks like it may even extend beyond that, until that high pressure moves out of the way. so we are going to be dry and warm going through the next seven days, especially for the afternoons where we reach into the low 80s inland. in san francisco, stays mostly in the upper 60s. mike, are you just seeing what you've been waiting for? >> that's right, not the backup at the bay bridge. i knew that was going to come but we expected a backup to form because the metering lights were reportedly turned on early. this backup has filled in quite nicely. it's been on the regular schedule aside from just a little bit of backup and we've been waiting for that last cash lane to open and it has.
5:21 am
so that's good news for folks traveling over, but the bad news is that everybody else is also waiting there. as we look anywhere south of the bay bridge we have a smooth flow of traffic, but right there, you notice that blip in san jose, just by the airport, sjc northbound 101 reports of a crash around trimable. sounds like everything should be off of the roadway. there may be a crew that's blocking one lane. i'll track that with the update from chp, where 101 and 87 meet and that is a typical spot that's tough timing for the build for the morning right now. we'll track that closely as well. now we have about 25 minutes, and building here, southbound vasco out of brentwood and byron headed down from marsh creek road to 580, starting to slow down for the morning, typical commute as well, the early drive out of the altamont pass shows 580 slows a bit as well. toward the bay bridge a smooth drive through contra costa county. a note here, this is the golden gate bridge there, proving it's a live shot, there is some fog so be careful. back to you. >> thanks, it's 5:21. coming up a fight over a

popular pop eye's chicken sandwich turns deadly, it happened in maryland. up next, what authorities caused one man to stab another. but first our team is always on social media, check out these photos mike inouye shared on facebook. over the weekend, mike took part in the 100th celebration for japanese language school on the peninsula. be sure to follow mike on facebook, twitter and instagram. mike inouye. you're watching "today in the bay."

5:24 am
5:24 for you right now. the excitement over the now widely popular pop eye's chicken sandwich apparently boiled over into a deadly event, this happened last night at a pop eye's in oxen hills, maryland, a d.c. suburb. police say one man stabbed another, killing him, after a dispute that began as they both waited in line.
5:25 am
apparently one man cut in front of the other. >> this individual was in line, a line specifically for the sale of the sandwich, when another customer and he got into an altercation, and that ended with the victim being stabbed outside of the business. >> police are still searching for the man with a knife. you may remember that chicken sandwich returned to pop eye's stores sunday after debuting in august and a lot of people wanting to get it. >> 5:25 right now. happening today, san francisco leaders plan to draw new attention to efforts to keep walkers and bicyclists safe. supervisors plan to declare a city state of emergency. supervisor matt han haney introd the measure in july. now to space, and the next space station astronaut may also be a five-star chef. >> that's because nasa is expanding its cuisine. a case of french wine arrived.
5:26 am
researchers want to test how weightlessness and space radiation affect wine's aging process. the bottles will be stored for one year and yes, we all want to be there when the tasting takes place. for the first time, there's an oven at the international space station, it went up along with the wine. the crew will test the oven, using chocolate chip cookie dough. nasa hopes the home baked space cookies can provide the crew physical and mental benefits and hopefully they can wash it down with some milk, not the wine. >> that's interesting. huh. >> always amazes me. >> remember space ice cream? >> i don't remember hearing about that. >> i'll get some, it's interesting. >> is it good? >> it's like freeze dried and melts in your mouth. we'll try it. >> we will. and we'll continue with "today in the bay," 5:26 for you right now. coming up for you, the top stories we're following on this tuesday morning. polls open in just 90 minutes across the bay area. san francisco mayor london breed is on the ballot.
5:27 am
we'll take a closer look at the race and her re-election chances in a live report. and you already know this, people spend way too much time commuting to and from work, but this morning, new data is out on exactly how long american workers are stuck behind the wheel. that's coming up next. and speaking of crazy commutes, looking here the backup there at the bay bridge toll plaza. no surprise there. mike is going to have a look at that commute. kari's going to get us up to date on what we can expect from the forecast today. you're watching "today in the bay." announcer: 5 million kids use e-cigarettes. it's an

epidemic fueled by juul with their kid-friendly flavors. san francisco voters stopped the sale of flavored e-cigarettes. but then juul, backed by big tobacco, wrote prop c to weaken e-cigarette protections. the san francisco chronicle reports prop c is an audacious overreach, threatening to overturn the ban on flavored products approved by voters. prop c means more kids vaping. that's a dangerous idea. vote no on juul. no on big tobacco. no on prop c. a very good tuesday morning to you. thanks so much for joining us. november 5th, election day for six local counties.
5:30 am
i'm xwrs, go. laura garcia. >> and i'm marcus washington. a lot of people are wondering what the weather will be like headed to the polls. meteorologist kari hall has that for us. >> it will be a cool start and leading into a warm day but as you get ready to head out right now in palo alto, make sure you have a nice warm jacket. we'll be dropping down into the mid foerts 40s. 46 degrees at 6:00 and up to 71 degrees at noon today. it's going to be a warm one, reaching well above normal, especially for the inland areas. 80 in livermore. 81 in napa and in oakland today reaching 74 degrees. we'll talk more about what's ahead for the rest of the week and mike, you're trying to show what's happening at the east shore freeway. >> trying. over here we're looking at, pointed at the berkeley curve, you can see the lights. there are well spaced tail lights that that disappear into the low clouds. between the camera and freeway
5:31 am
in emeryville the low clouds are hovering around, maybe fog touching the golden gate and the bay bridge at times. use that as a word of caution. the metering lights are on at the bay bridge and they were turned on early, with an early backup. the fastrak lanes are moving nor smoothly. they may have been turned on because of some of the fog drifting through. just a note for folks there. the tri-valley shows a nice drive but there's a fender bender in the altamont area westbound 580 just about north flynn, so we're tracking that, but things -- looks like there was another one that popped up. we'll check on what's going on for livermore. no problems for the silicon valley or peninsula. back to you. >> thank you, mike. voters head to the polls across the bay area today, and in san francisco two key races will decide the direction of city leadership. >> "today in the bay's" pete suratos joins us live in san francisco with a look at the details. pete? >> good morning to you, guys. voters in san francisco will get a chance to head to the polls in about an hour and a half, the polls open at 7:00 a.m.

among the things to vote on, who will be the next mayor of the city, as well as the next district attorney. so talk about the mayoral race. current san francisco mayor london breed hoping to keep her title as mayor of san francisco. she does face five challengers in her re-election bid. mayor breed was elected in a special election last year, following the sudden death of former mayor ed lee, that's, he passed away back in 2017. also on the ballot you have the race for san francisco's district attorney four candidates in the race are working to replace george gascon. suzy loftus is among the candidates running, the current interim district attorney for san francisco, and according to political analysts eric jay, this race is catching national attention as well. >> how far are we going to go when it comes to criminal justice reform are? we going to elect a prosecutor, are we going to elect a public defender?
5:33 am
you couldn't get a clearer choice. >> reporter: the polls open for voters at 7:00 a.m. and close at 8:00 p.m. you have several hours hopefully to get that vote in, if you're a voter in san francisco, but we'll have more election coverage in the next half hour. reporting live, pete suratos, for "today in the bay." >> we'll check back with you, thanks, pete. nbcbayarea.com will post up to the minute election results and will also push them out on our nbc bay area app. 5:33 right now. there's still no sign of a verdict in the case of a bay area real estate heiress accused of murder. jury deliberations resumed in the trial of tiffany lee. prosecutors say she arranged to have her ex-boyfriend keith green killed. he was the father of her children and they believe she was scared about losing a custody battle. investigators testified she worked with her then boyfriend ,to plan green's murder but her attorneys argue she's been wrongly accused and green was killed in a botched kidnapping.
