not yet opened the last of the cash lanes. this car will have to change lanes because that last cash lane is not yet open. let's look over here, what has opened up is getting away from the bay bridge, the disabled vehicle off of 580 right near 980, that is cleared now. no problems coming in up from 580, 880 through oakland. a smooth drive on both sides of the bay. there is a little fire off of 680 reported in the police leas area. we'll talk about that coming up sxwloop a . and here are the top headlines from the election yesterday. district attorney's race is too close to call because of rank choice voting. only 240 votes separate the two with suzy loftus leading chesa boudin. it could be days before a winner actually emerges there. in the meantime, mayor breed is cruising to another four years

in office . she has 68% of the vote. san francisco voters also decided some key propositions. pete suratos is joining us with those details. >> reporter: good morning. those propositions ranging on issues of affordable housing and the ecigarette ban. that did garner national attention as folks were keeping a close eye on those results. let start with prop "a," voters in san francisco approving prop "a" this allowed the city to sell $600 million in bonds for affordable housing. that makes it the largest sale of its kind in san francisco history. when it comes to prop "c," voters said no to overturn the rule suspending the sale of ecigarettes not approved by the fda. and finally voters said yesterday to proposition "d," that would impact everyone who

takes uber are on lyft into the city. this would be a tax for customers is for most trips. 1.5% on pool rides. that charge is based on the overall cost of the trip. now here is how some in the city are reacting to these results. >> ride share has been shown to increase traffic in the city and decrease support for public transportation. as somebody who rides their bike, i'm very happy to see rides even ones that i use taxed. >> i'm actually really excited that prop "c" failed. board of supervisors already passed an ordinance rejecting vaping projects here in san francisco. >> reporter: another closely contested race as you mentioned was the district attorney race for san francisco. two close to call at this point between loftsuzy loftus and che

member. the new ordinance will require that owners of short term rentals be present when renting the property. the property owner was not present during the party thursday night. airbnb has said that the renter was deceptive and violated the no house party rule for that rental. or they already require an occupancy tax and there a maximum occupancy of 13 people which was clearly violated thursday night in which they had over 100 people in attendance. last night the city council considered other restrictions including an outright ban on short term rentals and requiring a minimum number of days for short term rentals. >> i think just having more regulation isn't going to work unless there is real rigid enforcements. >> just ban them all, the chief doesn't have enough police officers to deal with this. >> reporter: law enforcement has not yet made any arrests in

connection with thursday's shooting. but as we have been reporting, nbc bay area has learned that two of the victims might be linked to a 2015 shooting in which four people were killed. bob redell, "today in the bay." handing todaytha happening case over a new state law aimed at forcing president trump to release his tax returns. governor newsom signed a bill that forced him to do so if he wants to be on the march ballot. in september a judge temporarily blocked it. the president's lawyers argue that the law was unconstitutional because the federal government has jurisdiction over requirements for candidates running for president. a live look at capitol hill where house impeachment investigators are preparing to hear from a high ranking state department official this morning, this comes a day after a key witness revised his

testimony setting off new skirmishes between democrats and republicans. coming up at 5:45, scott mcgrew will have much more in his checks and balances segment. the relatives of the six children and three women killed in the deadly ambush in mexico are calling it a massacre and demanding changes to improve the safety for those who live there. new video to show you showing mexico's foreign minister at the crime scene. he says mexico's president has already spoken about the attack with president trump. it all happened on monday in the northern next dan state of sonora not far from the border. among the dead, 8 month old twins. mexican say drug cartel attacked a convoy of three suvs. a close relative says their family has been there for years but you cartels are taking over and something must change.

>> it is not working. there needs to be something else. i'm not sure what it could be, but it used to be beautiful down there. >> eight children survived, five are being treated in u.s. hospitals. one of the children, a 13-year-old boy, walked 14 miles for help. right now authorities are still searching for the gunman. firefighters are still on track to have the kincade fire fully contained by tomorrow. the number of acres burned is still holding steady at about 78,000. at last check, it was 86% contained. nearly 400 structures have burned, a few hundred remain threatened. according to pg&e, hundreds are still without gas due to the fire. happening today, the towns of sor will hold its first city council meeting since it started and it is expected to approve a move that will allow people, restaurants and wineries the

ability to file insurance claims. the claims would be for the losses attributed to the power being shut off because of the fire. council members also expected to publicly thank firefighters for their hard work. b.a.r.t. is debuting a new extra wide gate today. the platform fare gate allows for wheelchair users to swipe in and get directly to the elevator. it will be at the montgomery street station. b.a.r.t. also plans to expand its he will swrater attendant program to two more stations. they will work to keep the elevators clean and accessible for those who need to use them. they first introduced them at the powell street and civic center locations last year. oakland says that it will negotia negotiate as the team looks to buy the city's half of the coliseum. according to the mercury news, last month the city sued blocking the team from buying the share of the complex. as want to give the city $85 million to redevelop the land.

in return the team wants the city to drop its lawsuit against ala alameda county. city council says that the city has not dropped its case. the dmv is under fire for allowing other government agencies to access the personal data of thousands of people. >> it is not a major breach suns it is your information. kris sanchez is joining us live in san jose with what we need to know. >> reporter: good morning. this is by far not the dmpt mv's biggest data breach, but it is the latest hit to the confidence of the people who have to use this agency. we're talking about 3200 people, their information was spro xlo miced over the last four years at least. if you are one of them, you should be getting a letter detailing what of your information was accessed. the dmv blames an error for allowing access to seven different agencies including

vault t novato, 76 in livermore, san jose 71. upper 70s today keeping in mind that for san jose, normal high is only about 67 degrees. we'll be about 10 degrees above that today. and another warm afternoon if you want to get out there and enjoy sushlgs see a lot of sunshine. and this evening temperatures do cool off quickly. but we've also had some drifts of smoke. this shows the smoke coming in from the ranch fire that is just south of redding. and so most of that smoke has been coming into parts of the north bay, you can see where it went yesterday. and parts of the east bay as well as san francisco may have had some hazy skies. we'll see the same thing again today. and it is all because the weather pattern hasn't changed. high pressure still in control just off to our west. and it is also blocking our rain chances going into the next several days. even as we look farther out and what is coming down the pike, still more storm systems that

will steer to the north of the bay area so no rain in our forecast. we're looking at well above normal temperatures. and san francisco the mid-60s today with patchy fog but clearing out this afternoon. a predictable pattern right now peninsula, south bay, no problem. a good deal coming out of the south county. maybe a little slowing out of is an mart teen but nothing unexpected. and now we have this getting in toward 580, a little more slowing as volume builds. about a half hour on the 580 off of marsh creek road and that is to be expected. a little slowing right here pittsburg and bay point. and there is the build at the toll plaza.

5:25 for you right now. and two escaped inmates who are murder suspects from monterey county are still on the run this morning. law enforcement last night surrounded this motel 6 after getting a call that one of the men might be inside. but the room was empty. they were facing murder charges in unrepresented cases.

investigators say that they escaped over the weekend by cutting a hole in the bathroom ceiling. two bans on ecigarette sales are moving forward. it will apply to unincorporated areas. the final vote is expected later this month. san mateo county leaders also approved a similar ban for all of incorporated areas. final vote schedule for next week. the new ban would take effect next month. today ellen is paying tribute to ten brave men and women who have been on the front lines of california wildfires. >> i love all of you. >> we love you. >> i love firefighters. >> who doesn't? these are southern california firefighters who helped save homes in places like simi valley near the getty center. and ellen has a big surprise planned for the group. tune in at 4:00. and if you can't be home, set your dvr.

the foggy weather. >> it is drifting around this morning and even making it into parts of the east bay. here is a live look at fremont. we will deal with low availabili advisability and cool temperatures. we'll see the fog clearing out throughout the day and temperatures warming up too. we're heading in to the mid-70s for much of the inner bay, inland areas reaching upper 70s and it will be another nice one. we'll talk about this and what is ahead for the weekend. mike you're watching the bay bridge. >> we expect the metering lights to be turned on and they are. and there is the backup that we expect. you see the low clouds hovering around. but visibility on the span is just fine today. and that is great right now. fog drifting around. of course yesterday had a lot of slowing across the san mateo bridge and really hit the dumbarton bridge late morning

commute. so far it is trending great. along 680, no problems. new for you this morning, a teenage girl is dead and a teenage boy injured. this is after a double shooting in antioch. police responded to shots fired in a neighborhood south of highway 4. when they arrived, they did not find any victims but a short time later two 17-year-olds somehow managed to get themselves to an emergency room. that girl died. police say that the gunman is not in custody. and the results are still coming in in some of the bay area election races. others including san francisco's mayor race are already easily decided. >> pete suratos is live looking at a race that had everyone's attention. >> reporter: yeah, definitely has a lot of people's attention. and that is the district attorney race for san francisco. and at this point, it is still too close to call. it comessuzy loftus and

chesa boudin. loftus is a former prosecutor and was president of the police commission. she was appointed as interim district attorney by london breed. the former district attorney decided to run for the same position in l.a. boudin's background is a public defender and he represents a more progressive position 13e k specifically in the area of criminal justice reform. just before midnight, boudin had more than 2,000 vote than loftus, but after rank choice voting which is a system that allows voters to rank candidates to eliminate the need for a runoff, loftus took the lead at 50.13%.

now, this marks the first d.a. race in more than 100 years where there wasn't an incumbent candidate. we expect to get another update at 4:00 p.m. we'll have more election recap in san francisco in the next half hour. pete suratos, "today in the bay." so keeping track of san francisco's mayoral race, london breed easily locked up that re-election with 100% of precincts reporting. she had 68% of the vote. she won a special election last year to seven out ed lee's term. she took a moment to thank supporters but that there is still a lot of work to do. >> i'm excited but i'm also anxious to continue to get the work done because i want them to be proud of the decision that they made. i want them to see a difference and be happy about the conditions of san francisco. and that will take a lot of work. >> we're updating our website with the latest numbers as they come in.

1980s. both clergy members worked closely with the oakland diocese but neither was a member of the diocese and both have now died. also both of the clergy members have also been with the diocese considered credibly accused of sex crimes. san francisco leaders have declared a state of emergency in response to a surge in deaths of walkers and bicyclists in the city. it happened despite recent safety improvements. during yesterday's hearing, they also talked about a number of deaths. this year as of october 22nd, 24 people died in traffic-related accidents in san francisco. 134 vehic 14 with were walking, nine died in crashes. city leaders still want to reach a goal of zero traffic-related deaths by the year 2024. i love my job, but that is the worst part when i find out about a fatality.

same spot where a woman flipped her car after hitting a utility pole. voters in brentwood shooting homes.well-known plan to build the hotly debated proposal would have expanded the city limits to add low income housing west of highway 4. nearly 80% of people said no. opponents claim the measure would bring bumper-to-bumper traffic for residents who already make long commutes. it has been the talk of the town for months. a whopping 32% of registered voters showed up to the polls. and in el cerrito, measure h will extend a par are shal tax. the tax covers parks and rec spending and need as two-thirds majority to pass. new this morning, fighting fires on the front lines and online. more and are more scientists are being called in to help

development in the impeachment inquiry. >> a key witness who said that there was no quid pro quo has changed his mind. >> to remind you, gordon sondland is the u.s. ambassador to the european union. he was one of the first to testify behind closed doors to the three congressional committees. at the time of his first testimony, he said that there was no quid pro quo. president trump was not trading military help to ukraine in exchange for ukraine investigating the bidens. but after sondland testified, others testified. so you had sondland and then you had bill taylor acting ambassador to ukraine undermining some of sondland's testimony. and then lieutenant colonel vindman said that he notified white house lawyers about the quid pro quo. well, after these testimonies, sondland's memory was refreshed and he updated his spoken testimony with new written testimony saying that he now

recalls a discussion of an investigation into biden. president trump has said the other people who testified he made a deal with ukraine were never trumpers and disloyal. sondland is a big trump campaign contributor. he could not be painted as a never trumper. it is a problem for trump's allies in congress who took that there was no quid pro quo and said see, that proves it, case closed. lindsey graham one of the president's closest allies has responded by saying he is refusing to read any of the testimony. republicans also smarting from a walloping in virginia where statehouse elections there pushed the republican majority out of both sides of the statehouse. so the governor and statehouse both sides will be democrats. >> i'm here to officially declare today november 5 that virginia is officially blue. congratulations. >> so tipping the democratic for the first time in decades, they only had to win a few seats to

the day will start out with some fog. it is clear in dublin right now. we've had some cool temperatures to start and it is not as cold this morning. but we're still dropping down to the mid-40s here. we'll see the temperatures heating unfairly quickly. 7 72 at 1:00. the "7-day forecast" is at the bottom of the screen. you're highs today, 77 in east san jose and the east bay also reaching the upper 70s with concord up to 79 degrees. we'll max out at about 72 in redwood city with san francisco reaching 64. and north bay, highs up to 78 in napa and 81 in uhe couldkiah. you may be comfortable with light long sleeves. as the day goes on, it will feel so nice outside.

so make sure that you go for a walk or even park the car away from where you are heading in and wear comfortable shoes. and we're getting ready for the raiders game for thursday night football. if you are going, you have great weather. mid afternoon, we're at 72, but be prepared for the temperatures that will drop off quickly by halftime, upper 50s there. so we're stuck in this weather pattern with cool mornings and warm afternoons. high pressure will steer all you of the storm systems well to the north of the bay area. no changes here going into the weekend as well as next week, even possibly the week after that. there is a lot of rain out there in the pacific, but it will stay well clear of the bay area. we'll continue our dry pattern going into early next week with our inland temperatures mostly in the upper 70s, low 80s. san francisco expects upper 60s over the next few days and we will see some patches of fog

rolling in. it is 5:51 and we expect this westbound commute across the san rafael bridge. and it has been backed up at the bay bridge when the meerting lights go on. so typical pattern driving westbound. just north there is a minor crash but not really affecting the flow heading toward the crossing for 880. we'll keep tracking the low clouds. but so far, fog has not been a major part of your commute. about 35 minutes from marsh creek road down to 580. and 580 behind me coming out of the altamont pass, typical slowing into livermore.
