"today in the bay" continues right now. and a very good wednesday morning to you. thanks so much for joining us. i'm laura garcia. >> and i'm marcus washington. mike will get us through the humpday commute and kari hall has the weather. >> and we are starting out with some patches of fog and cool temperatures. as you head out, wanted to show you the view in san francisco. not much of a view because of the fog blocking the upper decks of the towers of the city and some of the high rise buildings. as we head inland to concord, we'll be in the upper 40s, but a quick warmup headed our way. some upper 60s by noon, low 70s by 1:00 and eventually up to about 77 there. we'll get a look at all of the microclimates coming up. and mike, you're tracking the backup at the bay bridge? >> that's right. and we also seem to have sort of the cloudy backdrop which doesn't let us see the upp emer

see the emeryville area. so on the deck where you are driving, it is okay. low clouds are drifting around. getting off the lower deck, it sounds like the solve raoff-ram blocked by a big rig. and the berkeley curve, we may have a car fire off on the shoulder. i'll get more updates on that. highway 4 shows slowing near the bridge but south of there is just fine. election results are coming in, here are the top headlines. the san francisco district attorney's race is too close to call because of rank choice voting, only about 240 votes separate the top two candidates with suzy loftus bchesa

boudin. could be days before a winner emerges. mayor breed is leading with a 68% of the vote and claiming victory. >> i'm excited but i'm also anxious to continue to get the work done. i want them to be proud of the decision that they made, i want them to see a difference and be happy about the conditions of san francisco. and that will take a lot of work. >> san francisco voters also decided some key propositions that in some cases are receiving national attention. pete suratos is live with the impact this is having even if you don't live in the city. >> reporter: that's right. good morning. those propositions ranging from affordable housing to that ecigarette ban which got a lot of attention. so let's talk about the results of some of these key propositions. prop "a," voter alls the city t sell $600 m bonds for

affordable housing making it the largest of its kind in san francisco history. when it comes to prop "c," there was a much different result as voters said no to overreturning the rule suspending the sale of ecigarettes not approved by the fda. and finally, voters said yes to prop thin prop position "d" which is a tax for ride sharing customers. the charge would be based on the overall cost of the trip. here is how some in the city of san francisco are reacting to those results. >> ride share has been shown to increase traffic in the city and decrease support for public transportation. as somebody who rides their bike and believes in micro mobility, i'm happy to see it passed.

>> i'm excited that prop "c" failed. the board of supervisors already passed an ordinance rejecting vaping products. >> reporter: and as you mentioned, another closely contested race is race for district attorney of san francisco. too close to call at this point between loftsuzy loftus and che boudin. i'll dive deep he cann deeper i numbers in the next half hour. and of course we're updating all of the results on our website throughout the night overnight and the latest local numbers as they come in. that at nbcbayarea.com. of course we'll also be pushing out the results b area app. new overnight while you were sleeping, emergency action to ban short term rentals after five people died at last week's halloween house party shooting. bob redell is joining us live with the next steps in when this

do take effect. >> reporter: city council here is expected to formally approve the so-called urgency ordinance that would ban unhosted short term rentals. this is in an effort to stop the kind of party that led to the deaths of the five young people this past halloween night. last night in front of a packed house, city council unanimously showed support for the measure, again for him formal approval is expected november 19. it would require owners be present when renting their property. airbnb has said that the renter was deceptive and violated the no house patty rule frty rule f rental. they already require an okay

pa occupancy tax and they violated the maximum occupants of 13. they also considered other restrictions including a ban and requiring a minimum number of days for a short term rental. >> i think just having more regulation isn't going to work unless there is real rigid enforcement. >> just ban them all because chief doesn't have enough police officers to deal with this. >> reporter: law enforcement has not yet made any arrests in connection with thursday's shooting. but as we've been reporting, two of the victims might be linked to a 2015 shooting in which four people were killed. here in orinda, bob redell, "today in the bay." oakland says that it will negotiate with the ass at team looks to by the city's half of the coliseum. last month the city of oakland sued alameda county blocking the

team from buying the county's share of the complex. they want $85 million to the tants the city to drop its lawsuit against the county. despite the new negotiation agreement, city council members say that the city has not dropped its case. dmv is under fire this morning for allowing other government agencies to access the personal data of thousands of people. not a wide spread bleach, but important if it is your information. kris sanchez is live with what we need to know. >> reporter: this is not by far the dmv's biggest data breach, but it is the latest hit to the agency that is trying to go convince people that they should have confidence that their private information is protected. the data of 3200 people was compromised other than the last four years. so doesn't sound like a lot of people, but if you are one of them, you should be getting a letter detailing which part of

your information was accessed. the dmv blames an error for allowing access to seven different agencies including homeland security, the irs, district attorney and more. we have reported previously on i.c.e. agents using dmv data to track down undocumented immigrants. but in a statement the deputy director of communications says this is not that, nor is it an issue of sharing or hacking but one of access. anita gore says they immediately began correcting the error following a compliance review and insured that no additional confidential information was disclosed and has implemented several additional layers of review. you should review your credit scores if you are one of those affected by this data breach. chris sanchez, "today in the bay." new for you today, a big win for former endangered species. 15 years ago, these foxes were

objecting to their decision to include breitbart in its trustworthy news section. and an investigation by our sister network cnbc has found problems with the san francisco based company the real real. real real sells or resells brand name fashion and is just opening up its first brick and mortar store. cnbc found not everything that real real sells is authenticated by experts. and employees work under striqu that could lead to fakes being sold. the ceo says that there are absolutely no fakes on that site. this has gotten to be a huge industry, this reselling of things. posh mark is another one. but the fakes have gotten so good that it is sometimes hard for experts to tell. and if you haven't got an expert

decorated. >> lights on? >> lights on. >> my neighbor has lights all other than the place. very nice. and i want to show you a beautiful shot we're starting out with this morning above the clouds in san francisco. take a look at this, it is amazing. we are starting out with a nice sunrise but also drifts of smoke and of course that makes the sunrise more colorful. and we're getting ready to go ice skating today with a safeway ice rink opening this morning in union square. we'll be in the upper if it's. we will make it up to about 62 with mostlyies. h 79 in concord.

oakland reaching 68. we have low 70s for parts of the a peninsula and half moon bay will make it up to 59. low 60s in most of san francisco. a high of 78 in napa today. so we've seen the smoke coming in, you can see it on that sunrise picture. is this a look at the past couple of days and the upper level wind pattern that shows which direction the smoke is coming in. and it is from a fire just to the south of redding called the ranch fire, it is blowing some of the smoke into the north bay mostly, but we have had hazy conditions. high pressure stays in place just off to our west providing that northerly wind that will continue to push the smoke in. and then going into the a stormm rides up and over the high pressure which usually blocks the rain. it will keep it away even going into next week.

so more dry weather in the forecast. and high temperatures reaching into the low 80s. inland areas reaching into the low 80s even through early next week. and the morning temperatures start out cool with mid-40s. san francisco mid-60s throughout much of the forecast. mike, you spotted a tow truck at the bay bridge. >> and that is not uncommon, but this one was in the parking lot. i think that is what removed one of the disabled vehicles that was in the chp report. we saw the early lanes that are now once again building. no major you approach the area and that disabled vehicle cleared. no problem getting across the lower deck out of san francisco. we may have slowing though approaching tennessee for westboun westbou westbound 880. a crash possibly blocking a couple lanes as a result of an earlier crash that may have a

motorcycle involved. and approaching whipple, a crash is causing slowing back being folks up down to the san mateo bridge. we're watching for the flow on the bridge. dumbarton bridge is lighter. south bay we do have one crash northbound 101 at trimble. a couple others did pop up. i don't think that they are panning out to be crashes. we'll watch the traffic pattern. you are still getting up toward the airport for san jose. and a live view of palo alto shows traffic moves nicely. back to you. still ahead for you this hour, shocking accusations in contra costa county, a soccer coach is charged with raping a former player. coming up, reaction from families and other players and details on what happened. they put money down for a promised bryce price on a new c the dealer didn't deliver.

cloudy skies. looking at the peninsula, some patches of fog. we'll head in to the upper 70s. 123r5 san francisco will reach 65 and east bay reaching north bay will see highs near 80. just north of our camera where the taillights are headed up, reports of a crash. everything should be moving off to the shoulder but folks are tapping their brakes. even more slowing north of 880 up toward trimble where those three crash reports sound like they are all the same thing just in the area of the trimble off-ramp which is now cleared. the activity has cleared. build starts slowly in the south bay and more traffic speeding across that san mateo bridge. southbound 880 is slowing past an earlier crash. back to you.

new for you this morning, a teenage girl is dead and a boy injured, this is after a double shooting in antioch. this is video of the shot up car after it arrived at the hospital with the victims inside. police last night responding to shots fired south of highway 4. when they arrived, they didn't find the victims but a short time later the two 17-year-olds somehow managed to get to the emergency room. but the girl died. results are still coming in from the election races. one contest that didn't take very long to settle was that for san francisco mayor. with 100% of precincts reporting, london breed cruised to a victory. there are other races that have a lot of people's attention and at least one is way too close to call. pete suratos has the details.

>> reporter: yeah, that race is for the next district attorney. that is still too close to call. it is down to two candidates, it will be suzy loftus and chesa boudin. loftus is a former prosecutor and president of san francisco's police commission. and she was also appointed as the current interim district attorney after the departure of the previous district attorney who decided to run for the same position in los angeles. now boudin's background is as a san francisco deputy public defender and represents a more progressive option specifically in the area of criminal justice reform. as far as those numbers go, just before midnight, boudin had more than two,000 raw votes than loftus, but after the rank choicevoting, loftus took the

shocked. >> whenever you hear about something like that, it is always heartbreaking. any parent especially a parent of daughters, my heart goes out to the young woman. >> police say there is no evidence that there were any other victims but if there are, investigators would like to speak with them. the relatives of the six children and three women killed in the deadly ambush in mexico are calling it a massacre and demanding changes to improve the safety of those who live there. the mexican foreign minister says that the president has already spoken about the attack with president trump. it all happened on monday in the nof northern mexican state of sonora. among the dead, 8 month old twins. they say drug cartel attacked the suvs and it may have been the case of mistaken identity. a close relative says that her family has been there for years

but the cartels are taking over and something must change. >> it is not working. there needs to be something else. i'm not sure what it could be, but it used to be beautiful down there. >> eight children survived, five are being treated in u.s. hospitals. one of the children, a 13-year-old boy walked 14 miles for help. authorities are still searching for the gunman. b.a.r.t. is debuting a new extra wide gate in san francisco. the platform fare gate allows for wheelchair users to swipe in and get directly to the elevator. it will be at the montgomery street station. b.a.r.t. also plans to expand its elevator attendant program to two more stations. they will work to keep the elevators clean and accessible for those who need to use them. those will be at the montgomery and embarcadero stations. they first introduced them at the powell street and civic center locations last year.

so while we look toward changes at the b.a.r.t. stations, there are no delays reported this morning. south bay and east bay, clearly stand out as we take a big look around the bay. everywhere else pretty much a green commute. south bay continues with the build pushing north. 101 is seeing the most volume change and we have a crash at oakland road. and at 3rd, that is clearing over there just north of the airport. we'll track that. 280 a much easier route. southbound 880 jams up past hayward down towards fremont. crash still blocking left two lan lanes at whipple road. thek rest of it is already toward

the bay bridge. and metering lights are on. >> and you know what is around the corner? the weekend. we're almost there and a lot of the ice rinks will be opening this weekend. they are kicking off the holidays. we'll see temperatures in the low 80s, so it will fooel still feel like summer as we reach 81 inland. bay reaching 75 and the coast in the upper 60s. we'll see more of the same saturday with our high temperatures up to 80 degrees in the valleys. so we will have warm weather, we're opening up the ice rink in walnut creek. it will be beautiful, we'll start out with some upper 60s, but look at how warm it gets in the middle of the day. you can ice skate with short sleeves on. and in san francisco, you might want long sleeves there as we'll stay in the upper 60s. but we do keep it dry throughout the weekend. as we take a live look at squaw

to seven other government agencies on over 3,000 people believed to be under some type of of criminal investigation. however, the agency determined that wasn't the case. officials say it was unclear if the information was used to investigate the driver's immigration status. followup while you were sleeping, orinda council members have agreed to limit a ban on short term rentals. that ban will apply to rentals when the owner is not present. last night the vote came after a long night of debate where dozens spoke. it follows the halloween house party shooting that left five people dead in a home listed on airbnb. last night people had a lot to say. many called short term rentals more trouble than it is worth. >> i think just having more regulation isn't going to work unless there is real rigid enforcement. >> just ban them all because chief doesn't have enough police officers to deal with this. >> after the meeting do ing cou

members approved the emergency ordinance. the second vote is in two weeks. back to the election coverage. brentwood voters shot down a controversial plan to build 2400 new homes. the hotly debated proposal expa. 75% said into to it. opponents say that it would bringer-to-bumper traffic to brentwood. people on both sides collected signatures and picketing at intersections for months. 32% of registered voters showed up to the polls. and in el cerrito, measure h will extend the parcel tax first approved in 2000. 79% of voters giving the thumbs

up for this one. it covers parks and rec and needed a two-thirds majority to pass. two proposed bans on ecigarette sales are moving forward. santa clara county supervisors unanimously approved the ban that will applay to in-unincorporated areas. and san mateo county leaders approved a similar ban. final vote there is scheduled for next week. the new ban would take feblgt next month. there has been a major development in the impeachment inquiry. >> a key witness who said there was no quid pro quo has changed his mind. >> he's had his memory refreshed. to remind you, gordon sondland is ambassador to the european union. he was one of the very first people to testify behind closed doors to the three congressional committees. at the time of his first testimony, he said that there was no quid pro quo. president trump was not trading military help to ukraine in exchange for ukraine

investigating the bidens. but after sondland testified, others testified. so you had sondland, then you had bill taylor, he is acting ambassador to ukraine who undermined some of sondeland's testimony. you had tim morrison as well. lieutenant colonel vindman said he notified white house lawyers about quid pro quo. tim morrison is the top adviser to russia testifying that sondland had talked to him about the deal. well, after all of these testimonies, sondland's memory was refreshed. and he updated his spoken testimony with new written testimony saying that he now recalls a discussion of an investigation into biden. president trump said that the people were never trumpers. sondland is a pick trump campaign contributor so can't be painted as a never trumper.

his allies said that the original testimony says it proves it, case closed. lindsey graham has said that he now refuses to read any testimony. republicans also smarting from a walloping in virginia where statehouse eleiohere pushed the republican majority out of the statehouse so the statehouse and governor all democrat. >> because i'm here to officially declare virginia is officially blue. congratulations. >> virginia tipping for the first time in decades. the democrats only had to win a couple seats. the republican majority was very thin. one of the newly elected representatives who made that tip is an indian immigrant and the first muslim to serve in the virginia statehouse. the president traveled to kentucky on monday to rally for the governor there saying republicans needed to show the world impeachment was fake, don't lose he said. you can't let that happen to me, he said. well, governorship. the republican incumbent hats
