well as napa, and then we start to cool off tonight once again. this will be the last really warm day before we get a cold front moving in, so i'll have more on that and what's ahead in the rest of the forecast, as we get ready to head over to mic tracking an overnight traffic alert. >> the good news is the traffic alert in the last few minutes has just cleared up as we look over southbound 101, it has cleared there the disabled rig. it was blocking one lane but there are only two there. it rippled toward petaluma boulevard. you see the orange at the bottom of the screen, a lower drive there should clear as well. the north bay does have a little patch of fog here and there. you'll watch that coming across the golden gate bridge so just be warned, folks seasoned drivers know about that possibility. smaller crashes around the bay but nothing major, nothing like cleared in petaluma. south bay along the area looks great as well. we'll show you how things are shaping up over there but the bay bridge toll plaza has the

cash lanes as usual. back to you. >> thanks, mike. in a few hours the supreme court will hear one of the most consequential case this is term, justices will hear arguments about whether so-called dreamers should be allowed to remain in the u.s. "today in the bay's" bob redell live for us at uc berkeley, which filed one of the first lawsuits in this case. bob? >> reporter: marcus, you'll recall uc berkeley the state of california, city of san jose, the county of santa clara and others they filed lawsuits against the trump administration to stop the president from ending the daca program, which protects children of immigrants who came to this country illegally. judges in san francisco, new york and d.c. they issued injunctions in those and other lawsuits and upheld daca, which stands for deferred action for childhood arrivals, also known as the d.r.e.a.m.er program. today the trump administration is appealing those rulings to the supreme court. the nine justice also hear

arguments for and against for 80 minutes. they're not expected to issue a ruling until june of next year. the trump administration ended the daca program back in 2017. the president has argued that daca is illegal, that it interferes with the enforcement of immigration laws. president obama established the program in 2012 to allow children between the ages of 16 and 30 to work and study here in the united states and at schools like cal without fear of deportation, even though their parents brought them here illegally. currently there are about 660,000 dreamers nationwide including a couple hundred dollars thousand here in california. >> i think what we fight for in daca is our basic human dignity. a university degree should not justify your humanity, should not justify you. >> reporter: a number of rallies and marches in support of daca are scheduled for later today n places like san francisco, san jose, santa cruz, half moon bay and other places throughout

california. reporting live here in berkeley, bob redell, "today in the bay." >> all right, bob, thank you for that. a live look for you this morning at capitol hill, that's where tomorrow the first public testimony begins in the president trump insquimpeachmen inquiry. before that he's promising to release a transcript of his first phone call with ukrainian president volodymyr zelenskiy. president trump tweeted "i'm sure you'll find it tantalizing." his actions with ukraine are the focus of tomorrow's public hearing. at 5:45 on "today in the bay," scott mcgrew will take a closer look at who is testifying this week, coming up in his "checks and balances" segment. >> it is 5:05. today, victims in the gilroy garlic festival shooting are expected to announce a new lawsuit against event organizers, a story that broke late last night. "today in the bay's" kris sanchez joins us live from christmas hill park with what we know so far. kris? >> reporter: hi there, laura.

we just found out about this right before the 11:00 news last night, but five victims say that lax security at christmas hill park by the organizers of the gilroy garlic festival was a big reason why that gunman was able to access this park as it was full of people who were there at the festival. as you might remember, three people died in the july shooting, 17 others were shot. there were metal detectors at the entrance to the festival grounds. if you've been here before, you know that and a fence around the perimeter. but the gunman, who we are not naming, bypassed the security measures cutting a hole in the chain-link fence and got in with an ak-47 assault type rifle which he purchased legally in nevada weeks before the shooting. we are covering an 11:00 press conference this morning about this lawsuit, naming the 41-year-old gilroy garlic festival association and alleging negligent security measures. attorneys are filing on behalf of five victims.

we don't know which victims they are at this point. also at this point, this is the only lawsuit filed in this massacre. however, we do know that the gilroy city council did hold meetings early on about a month after the shooting, talking about what the city's liability might be because this park is owned by the city, though the association puts on the event. stay tuned for the details of this lawsuit. we will cover in our midday newscast and also put it up on nbcbayarea.com. in gilroy, kris sanchez, "today in the bay." >> interesting development. happening today, vallejo leaders welcome the city' next police chief. seany williams in september was hired to oversee what's recently become an embattled police department. he previously served as deputy chief for san jose pd. today at 11:00 a.m. williams will be sworn in at vallejo's city hall chambers. from the get-go, chief williams will have a lot to deal with including sunday night's deadly shooting by an officer

from another department, it happened at a gas station parking lot, when an off-duty richmond police officer shot 38-year-old eric reason. he tide at the scene. witnesses say it started as an argument over a parking spot. the officer's attorney says reason went to his car, got a gun, then came back towards the officer's car, and that's when the officer opened fire. richmond police association believes the officer did nothing wrong. happening today, san jose's police chief is expected to provide more details on a deadly police shooting there over the weekend. it happened on highway 85, and officers on saturday stopped a car near saratoga avenue. police say that passenger got out and then pulled a gun when officers fired. they say that man had an outstanding warrant. the driver was not hurt. amid the ongoing housing crisis, a new apartment complex and homeless center is moving forward in san francisco. the six-story development would be built near market and sixth street. according to "the examiner" the

project is nearing the final approval with construction set to start in january. supervisor's budget committee will vote on the project tomorrow and the full board could vote as soon as next week. 5:09 right now. 49ers fans waking one a lot of woulda coulda shouldas. >> talking about last night's tough loss to seattle. the game had a little bit of everything. seattle was up 21-10 in the fourth quarter when the niners defense came up with a game changer. deforest buckner returned the fumble for a touchdown, which actually followed a russell wilson fumble. each team traded field goals, including a last-second 49ers field goal that sent it into overtime. but in o.t., niners rookie replacement kicker chase mcloughlin missed a 47-yard field goal. on the last possible play of overtime, the seahawks made that field goal, beating the niners

we have a few clouds moving by, but no fog to start out in the south bay. as you get ready to head out the door in pleasant hill, do you still need a jacket. we are feeling some cool air moving in with some upper 40s this morning. as we go through the day we're going to see some more clouds moving in, some peeks of sunshine, as our temperatures warm up but it will still be a warm day, reaching into the upper 70s inland, and some upper 60s along the coast. mike, you were concerned about a couple of crashes. >> i am, kari. it's not the two things marked down here. i think they're both the same crash. take a look at your drive, folks, give you the big map first, mostly green, almost everywhere. we may see some more slowing northbound 101 approaching union, that's where i think that crash is located, maybe five vehicles in the initial report. another crash at camden but it does sound like they're the same, where we'll see some slowing headed up toward 17. we'll track that one and sudden slowing for highway 4, contra costa drive, jammed up around

good tuesday morning. we are making it now at 5:15, starting out with some cool temperatures and mostly clear conditions. in cupertino, expect it to be right at about 59 degrees at 9:00. we won't see all clear skies today, in fact the sun will kind of peek out from behind the clouds but temperatures reaching into the mid-70s. we have some changes ahead, some cooler air moving in. we'll talk about that and what else is in the forecast, in less than five minutes. >> there we go. we're worried about the early slowing for highway 85, a crash in san jose, and causing more backup than we expect at this time. we're looking at the bay bridge what we expect in the backup we expect at this time. we'll show you how things are in between and north. and good morning to you. very happy tuesday as well. a san francisco biotech company

called 89 bio debuted on the nasdaq monday. did really well in its first day of trading. uber is back in the news after its ceo did an interview with axios sunday night and the reporter asked about uber's connection to the saudis. uber took a huge investment from the kingdom. the murder of american resident and journalist jamal khashoggi came up in the interview. the uber ceo said we all make mistakes and can be forgiven. uber made a mistake when it hit and killed a pedestrian, you see video of it there. the report said hold on, that car accident involved a bad sensor, bad software. the other was an ordered assassination. uber's ceo has since clarified the assassination of khashoggi was not a mistake, it was a crime and shouldn't be forgiven or forgotten. now the question by the journalist was a legitimate one. uber took a huge investment from the saudi sovereign fund and a member of the saudi kingdom sits

on the uber board. all money and all decisions in that kingdom flow back to mohammad bin salmon. the american government says he's the guy who ordered the killing. uber is not alone trying to figure out how to deal with money from sovereign funds. on a much happier note, the happiest place on earth is now inside your tv set. disney launches its streaming service, hundreds of movies, "star wars" "national g geographic" and "the simpsons." nbc has one coming soon. >> what's probably going to happen is people have to choose where their loyalties lie. most surveys indicate people pay for between three and five subscription streaming services so that means you have to choose between whether you want netflix, your disney, you want hbo, it has to come down to what your household really puts a dollar value on. >> looking around netflix i can't wait for "the crown" to start.

at noon. it's going to be another warm day with our south bay high temperatures reaching into the mid to upper 70s, and a mix of sun and clouds today, some upper 70s for the east bay, with danville reaching 78 degrees. san mateo up to 70 today, some upper 60s in san francisco, and novato today reaching 76. we still have this high pressure that's been in control keeping us dry but it's now moving off toward the east so some changes ahead going into the end of the week. it will cool down before high pressure builds once again. so we'll have a nice little taste of fall and then warming up this weekend, but look at what happens by early next week. we'll be watching this system that will be close to northern california with some rain, but it doesn't look like it brings us any of the showers. our seven-day forecast will stay dry with more clouds today and tomorrow and a cooldown especially on thursday with breezy winds, feel like fall on friday and the weekend we're warming back up again.

mike, you're concerned about a number of developments. >> a busy ten minutes. over here toward the bay bridge toll plaza with the backup forming right on schedule for the metering lights over there. we have a crash before you get to the carquinez bridge so slowing at the peak when things start, not the peak but when things start at vallejo. highway 4 jams up toward port chicago highway. kirker pass road is okay as an alternate. two lanes are blocked there and northbound 101 we heard this approaching the cutover toward the richmond or san rafael to richmond bridge, counter commute but big rig blocks all lanes temporarily until they clean up radiator fluid. we'll track the issues north of the bay bridge and 85 approaching union a crash is causing slowing, two lanes are blocked there as well. back to you. >> always keeping us in the know, mike, thanks. 5:22. coming up here, a peninsula

strong new policies against high school students. >> the store is limiting the amount of teenagers inside. the cvs store located across the street from palo alto, management says the teens rush in during their lunch breaks and shoplifting during that time has gone up. so now only five students are allowed in at one time. some students say that's not cool and with them, some of the grownups were conflicted about that policy. >> because i feel like the kids that don't do anything are being punished for what other people would do, so i think it's kind of unfair. >> i think limiting anyone to enter a store is pretty strange. if they have issues with shoplifting they probably need to get better security in there. >> i totally understand it. >> so now according to the store, since the policy was put in place, shoplifting has gone down. just in, ricky grivas is

good morning to you on this tuesday. thanks so much for starting your morning right here with us. i'm marcus washington. >> and i'm laura garcia. let's get to the forecast with kari. a nice day ahead? >> it will be a nice day and as we check out our temperature trend for this morning in los gatos we're going to see a start in the mid-50s. another mild start but we will also see some changes as we go through the day. the sun will peek out from behind the clouds. we will have an all clear day and temperatures head into the mid-70s here. we have some upper 70s for the inland areas from morgan hill, over toward the east bay, and the tri-valley, into the north bay, we'll see some upper 70s, while san francisco today will stay in the upper 60s. headed over to mike now, you're not starting with the traffic alert? >> no, but we have one. i want to start with the very unexpected slower drive here north 85 between camden and union, we have two crashes, one involved up to five vehicles on

the initial report and one may be off its wheels. this is the slow stretch headed up toward highway 17, just a shout out. look at the rest of the area, we don't see the south bay commute really kick in for a while. mild slowing for 101 and nothing else north of there until you get to the bay bridge where the metering lights are on, we showed that to you before the break. here is the traffic alert north 101 approaching 580. we have two lanes blocked now. the other three are open, a spill going on after a crash headed up toward 580. back to you. >> thank you, mike, it's 5:32 right now. the first steps in the road to recovery begin today for north bay neighbors ravaged by the kincade wildfire. pete suratos joins us outside one of hundreds of buildings destroyed in the fire to explain what's going on. good morning, pete. >> reporter: good morning to you, laura. we're standing in front of the soda rock winery outside healdsbu healdsburg, affected by the kincade fire. it is this recovery process, the cleanup process and it's a

two-step process that begins today. now that first step starts with the hazardous waste cleanup. that's going to be in today as i mentioned and this will be a sweep of all hazardous waste on properties and that's going to be done by sonoma county at no cost to property owners. this is essentially looking for anything that may pose a health threat so we're talking about pesticides, batteries, asbestos siding and paints, just to name a few things. once this wraps up, the debris removal process will begin. owner also have to go through an application process through the county, as well as hire a licensed and qualified contractor to remove the debris from the property. i do want to point out what's different this time around from a couple years ago. unlike in 2017, an aftermath of the wildfires we saw sweep through the north bay, there will be no state or federal funds to assist these homeowners with debris removal. essentially the cost will completely fall on that property owner. as far as the damage left behind from the kincade fire, 374

structures were destroyed, including 174 homes. the fire ended up reaching more than 77,000 acres. the cause of the fire is still unknown, but as far as today's waste cleanup, it's expected to take up to three weeks. reporting live,s. s. for "today in the bay." >> you feel for the people there, thanks, pete. the company tied to this summer's deadly diving boat fire in southern california is facing a new lawsuit this morning. the fire killed 34 people, including several from the bay area, and the widow of one of those victims is filing a claim against the santa barbara-based boat owner, true aquatic is, a counterclaim to another suit preemptively filed by the boat's owner to protect them from liability. investigators have still not announced a cause of that fire. and happening today, oral arguments start on a case involving president trump's border wall. san francisco's ninth circuit court of appeals will hear from lawyers starting at 9:00 in the

morning. the trump administration is pushing to use $2.5 billion in military funds to pay for construction. the sierra club and a group of southern border communities are suing to stop that. now the appeals court previously upheld a lower court order permanently blocking the use of emergency funds to build the wall. happening today, former president jimmy carter is supposed to undergo emergency surgery any time now. he was hospitalized yesterday at emery university hospital in atlanta. doctors will relieve pressure and bleeding on his brain, caused by two recent falls. the 95-year-old former president is said to be resting comfortably with the former first lady, rosalyn carter, about by his side. leaders in san francisco's chinatown will bring attention to what they call a surge in crime targeting seniors. the latest incident caught on video saturday night in the square. robbers hit three men in their 60s who tried to stop them from stealing someone's cell phone. the victims were all treated at a hospital. the attackers are still on the

loose. a contra costa city is growing and looking to increase its ranks for police officers. brentwood police looking for approval to fire five more police officers and two dispatchers. right now the police department has 66 officers. a typical hiring process for a police officer or dispatcher can take anywhere from 12 to 18 months. >> this morning highway 101 in san martin is back open following a fuel tanker truck crash. it took nearly 12 hours to clean up the in's in the southbound lanes. the crash happened at 11:30 yesterday morning near mattson avenue. lanes were not fully reopened until nearly 11:00 last night. that made a nightmare of a drive through the bay area. as you can see from nbc bay area sky ranger, traffic was backed up for miles. the driver of the truck was taken to the hospital. >> 5:36 for you right now. prepare for dreamforce in san francisco. the yearly convention doesn't start until next week, but street closures start today.

so listen up. howard street will be closed between third and fourth street, we're talking about hundreds of thousands of people attending that convention every year. >> always gets so busy there. >> that's important for folks heading out, afternoons, evenings especially. the reason they're starting the closures, they continue with the closures not just for the crowds but they also have concerts out in the area. you might get a free concert if you hang out over there near howard. we're looking over here toward san francisco, that's where dreamforce is going on but we have this crash going on approaching the carquinez bridge, jamming you up through vallejo out of american canyon. westbound highway 4 getting worse, pittsburg, bay point toward the crash at willow pass road, sorry, port chicago highway, pch and that is blocking two of the four lanes and this traffic alert, those two weren't officially alerts, north bay 101, instead of having only two lanes blocked we have only one lane open now, four of your five lanes just declared closed as you approach that cutover toward 580. you can also cut over sir

francis drake which should get you out of most of the backup but it will cause traffic on the much smaller roadway. keep that in mind if you're leaving san rafael headed toward richmond. the rest of the bay i'm tracking highway 85 with the crash coming up toward union. so here we go on a tuesday, but thinking about the weekend. >> and it's going to be a nice weekend, actually we started out warm and we'll cool down and start to warm up for the saturday forecast. our inland areas reaching the mid-70s with sunshine. it's going to be really nice to make plans to get outside. the coastal areas will be in the lower 60s, and on sunday, expect high temperatures up to about 76 degrees in the inland valleys. the bay reaching 71 and the coast staying in the mid-60s. so as we make plans to get outside, if you will be going to some of the beaches around the bay area, it's going to be cooler for friday, but then by sunday, we're warming one more sunshine. we'll be up to about 69 degrees so maybe sunday is the best beach day. if you're going to lassen

families in california and the argument from the trump administration. 5:44, public hearings in the impeachment inquiry get under way tomorrow. >> scott mcgrew, for weeks the news has been full of details and testimony by a lot of people we've never heard from before. >> kent lyovanovitch, taylor, vinman, no way any of us heard those names before. i thought as we are a day away from the public hearings let's get out of the weeds and start over. why are we here? for some of you this is old hat, but here we go. ukraine, it's a country that is on the teeter totter between our side, the west and our enemy, russia. we want ukraine to come our way, seducing ukraine into the modern world has been a major part of american policy for years. the russians do not want ukraine to go our direction. in fact, they've sent forces in to ukraine to take parts back. there is an active war in ukraine. ukraine versus russia. you remember the shoot-down of malaysia flight 17, that was

part of that war. so we the americans took this very big step of deciding to send money and arms to help our friends the ukrainians fight the russians. congress voted on it, both sides said yes, except the president didn't send it. not right away. instead, the president dangled the military help as he asked the president of ukraine to investigate things that would help trump win the next election. two things that had the potential to make democrats look bad. one was a nonsensical theory it was the ukrainians, not the russians who interfered in our 2016 elections and the other investigation was an investigation into hunter biden, the son of his political rival joe biden. you investigate, get the arms, this for that, or in latin quid pro quo. that, democrats say, is an abuse of power and impeachable offense. to make problems worse for the president, a whole cadre of his own staff, people who work in the white house, some of them

>> it will be some great dog walking weather or whatever you have planned today. get outside and enjoy it. a live look outside in walnut creek we start out with mostly clear skies. we will see some clouds moving in today, but the thin, high clouds will just give us a filtered sunshine today and temperatures in the upper 40s this morning. you do need to bundle up as you head out the door, but then the rest of the day it will feel nice and comfortable with our temperatures in the mid-70s at noon. you want to take that lunch outside. if you're about to head out in san francisco, looking at our transit forecast, we're going to see temperatures in the mid-50s, and then some low 60s going into late morning into early afternoon eventually reaching about 67 degrees. high temperatures for the north bay up to 81 in ukiah. napa today reaching 78 degrees. 77 will be the high in antioch today. livermore reaches 77. we'll see san jose reaching 76 degrees. that's a live look in san jose right now, as we go into the start of the day, it's cool, of course. we've had a lot of these

mornings so grab a jacket as you head out. the rest of the day you'll be comfortable with a t-shirt, short sleefves or long sleeves whatever you makes you comfortable. high pressure is moving off to the east, keeping us dry. this may mean a slight change in the pattern. unfortunately still no rain. we're still going to see those areas of low pressure and those storm systems moving just to our north and that rain staying to our north, going into the weekend, there will be another area of high pressure moving in, and those northerly winds will keep it dry, and also warm up our temperatures a few more degrees. we'll have a couple of days of some fall-like weather. notice what happens by the beginning of next week. there will be a system moving in, here is some rain but it's just to our north, so it looks like we're just going to be missing out on yet again another chance of rain. i'll keep an eye on that. we're going to see our temperatures in the mid-70s for today and tomorrow. upper 60s by the end of the week. maybe we can break out some

sweaters, but the weekend we're back to short sleeves once again as our dump tiers warm up. mike, you're starting with a problem in the south bay. >> that's right, the slowing we saw early and pretty significant and definitely unexpected for northbound 85, approaching union, there were a couple of crashes in the stretch between camden and union. we still have two lanes blocked shy of highway 17. there are surface streets and traffic is moving well around the rest of the south bay so you have a chance to catch up. give yourself another ten minutes through the area, perhaps 15 just to stay a little calmer. 101 shows a little build there and the rest of the south bay, peninsula and east bay right on schedule for the rest of the commuters, anywhere south of the bay bridge. north of the bay bridge we have a significant issues here. first of all, north of the golden gate we jam up north 101, you're down to just one lane as you approach 580, but remember, you can cut over there, it's winding and a little more narrow but be careful on sir francis drake, that will get you over toward the bridge to richmond but that san issue with the continued traffic alert for the

north bay. counter commute for what we typically see as the southbound commute direction. over here in vallejo as well as over here in concord we have two issues, the rest of contra costa county looks great with the metering lights on at the bay bridge. let's call it on our waze system, our partners have shown us some timing over here. westbound your commute direction on highway 4 just shy of 242 you have a crash, waze times it out saying there's a 27-minute delay, allow a half hour extra if you need to. chicago highway as one alternate and nearby in vallejo, as you come down toward the carquinez bridge jammed up from highway 37. this is reported by our friend astro the nautz and wazer also help you wherever you go. back to you. >> thank you, mike, for your help as well. happening now, exciting news for animal lovers and conservationists. a tiny deer-like species thought to be extinct has been found after 30 years.
