2019. from nbc news, this is "today" with savannah guthrie and hoda kotb. live from studio 1a in rockefeller plaza. >> hi, everybody, welcome to "today," t "today," thank you for joining us on this thursday overdrive now. >> certainly is, yeah. >> we're going to get to the highlights of the night in a moment. we have this breaking news to start with, this deadly shooting, it happened at pearl harbor. >> a u.s. sailor opened fire at the base killing two workers, wounding a third before he took his own life. an incident that's raised security concerns ahead of the 78th anniversary of the attack on pearl harbor. nbc correspondent miguel almaguer has the latest on this. good morning. >> reporter: good morning, joint base pearl harbor hick am has reopened after gunshots shattered what witnesses say was

a calm wednesday afternoon. the navy leading the investigation into the tragedy. an active shooter forcing the historic military base into lock down, an apparent witness describing the scene to nbc affiliate khnl. >> i was at my desk, and i heard, like, loud pops, and i kind of recognized that as, you know, gunshots, and i looked out the window, saw three people on the ground. >> reporter: a navy official says a u.s. sailor opened fire at a dry dock killing two civilian shipyard workers and injuring a third before taking his own life.

>> this is certainly a tragedy for everyone here but certainly our sincere thoughts are with the families of the victims and everyone involved. >> reporter: so far, the military has not identified anyone involved or provided a motive but it did say the gunman was assigned to the uss columbia, a submarine that was at the shipyard for maintenance. >> we'll be looking at every aspect of it, what lessons we can learn, what additional, you know, security procedures would be needed. >> reporter: the shooting unfolded across the harbor from the iconic memorial commemorating the japanese sneak attack on the base during world war ii. sailors there set to mark the 78th anniversary of that raid in just two days. >> so shocking, miguel, and where does the investigation go next? >> reporter: well, authorities have said they are interviewing up to a hundred witnesses and are still looking into a possible motive and what kind of weapon was used. we do know that personal weapons are not allowed on the base.

the governor of hawaii says the white house has reached out offering help from federal agencies, and ahead of this weekend's anniversary events, officials say it's unclear if security protocols will change. savannah. >> miguel almaguer on this breaking news, thank you. another big story this morning, the president back in washington where he's facing with new calls for his impeachment, this after a tense week with fellow world leaders at that nato summit in london. we have two reports this morning. we'll start with nbc's peter alexander at the white house for us. hey, peter good morning. >> reporter: savannah, good morning to you, for more than 8 hours a panel of legal scholars testified before the house judiciary committee, the very lawmakers who would draft articles of impeachment. the three experts invited by democrats arguing that the president's conduct regarding ukraine is exactly what the founders had in mind when they wrote impeachment into the constitution. the republicans witness saying the president's call with ukraine's leader was anything but perfect but arguing this is not how you impeach a president. president trump back at the white house this morning as the

fierce partisan debate intensifies over whether his the president engaged in abuse of power undermining our national security and jeopardizing the integrity of our elections. it comes after a debate over whether the president's actions toward ukraine qualify as grounds for impeachment. >> if we cannot impeach a president who abuses his office for personal advantage we no longer live in a democracy. we live in a monarchy or under a dictatorship. >> the three legal scholars arguing the president committed impeachable offenses. >> if what we're talking about is not impeachable then nothing is impeachable. >> a president who has doubled

>> reporter: well, good morning, that's right, george zimmerman has filed a hundred million dollar lawsuit against trayvon martin's family. the prosecutors and others involved in the high profile case in the lawsuit he claims that that he conspired to try to get him convicted. this morning, george zimmerman, the former florida neighborhood watchman has filed a $100 million lawsuit against the family of trayvon martin the 17-year-old he shot and killed back in 2012. zimmerman, who says the shooting was a case of self-defense after martin attacked him was eventually acquitted on second-degree murder and manslaughter charges the verdict divided the nation in the suit, zimmerman claims he was the victim of conspiracy, malicious defamation it alleges the prosecution's key witness, trayvon martin's girlfriend rachel jeantel who testified she was on the phone with martin right before she was caught was quote an imposter and

fake witness >> suddenly the phone hang up. >> reporter: she tells nbc news her testimony at trial was accurate and her relationship with trayvon martin was however she defined it the suit alleges martin's real girlfriend, a woman named brittany diamond eugene was actually on the phone with him but was unwilling to testify, so martin's legal team found a fake replacement. zimmerman's attorney larry klayman says the new evidence was revealed to him by the director of a new documentary style film called "the trayvon hoax." >> you're not in any way dragging a family who lost a child through the court system again. >> unfortunately many members of the family dragged an innocent man through the court system and if he had been convicted he would be doing life in prison, and that's a serious offense. >> and he deserves $100 million. >> he deserves more than a hundred million dollars. >> reporter: the film's director joe gilbert said he located who he calls trayvon martin's real girlfriend, brittany diamond eugene

gilbert admits when he met her he never asked her about what happened. >> you don't go to the subject of the investigation and say can you tell me your role in this thing, i'm investigating that would be very naive. >> you never go to them, because you didn't >> i did not because it wasn't necessary. i got all the information necessary. >> reporter: benjamin crump responded to the lawsuit writing in part this plaintiff continues to display a callous disregard for everyone but himself, re victimizing individuals whose lives were shattered by his own misguided actions. nbc news reached out to all the prosecutors who were named in this lawsuit but we have not heard back the film was supposed to be shown at this theater here in coral gables, florida, today, but once they found out what the movie was about, management cancelled the screening. gilbert

the movie producer here, joel gilbert compares himself to another film maker, michael moore, but he says gilbert is a conservative in this case, the previous productions that he has had have been filled with all sorts of false claims including that barack obama's father was a columnist in chicago, that paul mccartney is dead and that elvis is still alive guys >> okay. all right. kerry sanders. thank you. well, we do have some good news this morning, former president jimmy carter is now recovering at home after being released from a georgia hospital on wednesday mr. carter was admitted over the weekend and treated for a urinary tract infection. a carter center spokesperson says the former president is feeling better the 95-year-old has been hospitalized several times this year, mainly for injuries sustained in falls.

[door bell] another one for mother rose? ♪ ♪ good morning. 7:26 right now. i'm kris sanchez. investigators are trying to figure out what sparked this house fire that killed an elderly woman who lives there. someone passing by reported the fire around 10:30 last night. novato firefighters arrived to find the home was engulfed. and while the fire chief stopped short of calling this a hoarder situation, he said that the amount of items inside the home was a lot more than you would expect. the burned debris is keeping investigators from getting inside. a look at the weather forecast for you. meteorologist kari hall has been tracking a little bit of fog and news of rain. a look at patches of fog in oakland.

you drive in and right back out. that shows how your visibility can drop in a short distance. by tomorrow this storm arriving by the afternoon especially in the north bay and pushing into the rest of the bay area as we go into the evening. it will bring this another round of some high wind and rain and it's going to also bring the potential of about 1 to 3 inches of rain throughout the weekend. so we're going to see it coming in waves. off and on rain friday, throughout the day saturday and tapering off on sunday. we will get a chance to dry out early next week. how are the roads moving, vianey? we are seeing a morning slow commute through the south bay. i have a crash along the -- i should say a stalled vehicle along the san mateo bridge. a bit of a traffic hazard. the westbound lanes, the number three lane remains blocked and is impacting the drive times. look at westbound 84 to the dumbarton bridge. a 70-minute drive time.

morning. a u.s. sailor opened fire at the naval shipyard, before taking his own life. the shooting forced the historic military base pearl harbor into lock down. military officials say the gunman was assigned to the uss columbia at the u.s. shipyard for maintenance. no word on a motive. good news about those annoying robocalls that light up your phone all times of day, sometimes at night well, the house on wednesday passed a bill aimed at cracking down on those automated calls. it requires phone companies to verify where those calls are coming from and let consumers block them for free. it also enforces harsher penalties for violators. the bill is expected to clear the senate and get the president's approval. we have dramatic video to show you, it looks like it came out of the fast and furious movie. it happened at a car dealership in florida watch as a car comes flying into the picture. eventually it does come to a stop hitting several vehicles along the way. officials say show somehow the driver became dizzy, hit an embankment and that caused the vehicle to fly almost 140 feet into the air before it landed in the parking lot. the driver was treated for non-life threatening injuries. >> i mean, you see that video. that's remarkable to think no one was hurt, the driver or anybody else on the ground. also this morning, we have

good thursday morning. right now it's 7:56. we've been watching patchy, dense fog moving across parts of the bay area. that's a live look outside in san francisco. we are going to mostly see a dry day today but then our new storm will be arriving tomorrow. we can see the large storm system on satellite imagery and all of this will take pretty much the whole weekend to work its way through the bay area. so today we're getting prepared with raking up the leaves and getting outside. and then by tomorrow we start to see the rain spreading from north to south and to the afternoon and evening hours. at times this rain may be heavy along with some gusty winds that will continue throughout the day on saturday coming in waves. then it gradually tapers off. our skies may clear by sunday afternoon into the evening. then next week we're looking at more dry weather as our

surfaced in every single state. and now doctors have found yet another way that vaping can damage the lungs. nbc medical correspondent dr. torres is here. we have heard about how vitamin e played a role and there's another culprit. >> vitamin e is the culprit we have been looking at, and in california doctors look at a case of a woman, a 49-year-old woman, typical vaping systems, she had been vaping thc, shortness of breath, and wheezing and what they found is the damage pattern she had was this one we usually see in heavy metal workers and what they think is happening is the coil inside the vaping device, it has to get heated to a very high temperature. when it does, it starts leeching heavy metals into the liquid which which gets vaporized in her lungs. they found cobalt, nickel, aluminum, and lead, and those are the ones that were then getting into her lungs and that's where they think the injury pattern came from unfortunately for her, it's

charged with sexually abusing patients is set to appear in court today. >> nbc's natalie morales sat down with three accusers in los angeles. hey, natalie, good morning. >> good morning to you all, dr. james heaps was named one of hollywood's top doctors in 2015 and he came highly recommended as a gynecologist with a specialty in oncology and that's why the women we spoke with say they trusted him and why they believe ucla health didn't stop him sooner >> i sat there thinking this is a gynecological oncologist, much more training and education than most doctors i see i knew it felt uncomfortable, but i should trust him. >> ellen cater, gabby vasquez, and julie say they went to see dr. james heaps because they were told he was the best. >> you were going how frequently >> four months, three months, he kept giving me diagnoses that scared me. i never walked out of that

office without crying. >> i was told i could get cancer and die, and since seeing another gynecologist, i learned i'm not at high risk he put fear in me to guarantee that i would keep coming back every few months. >> can you describe what he did, i know it's difficult to talk about the details. >> he had his hands all over my body, using his entire hands, the palm of his hand, all over, lingering for too long and looking and telling me that my breasts were beautiful. >> vasquez, a medical assistant at ucla health said she expressed concern during her exam when he directed the chaperon to leave. >> he was introducing the ultrasound, he was simulating as he was having sexual intercourse with me. this is not okay this is not right. i immediately went to my supervisor and i reported this to her and nothing was done >> vasquez said she told her supervisor in january of 2017 but it wasn't until another patient's complaint in december

of that year that ucla began an internal investigation and these were not the first complaints against heaps. >> we are aware that at least as of 2014, there were allegations of sexual misconduct with patients by dr. heaps. there was no further action with regard to that. >> reporter: ucla says it is looking into the handling of one 2014 complaint they acknowledged receiving and was unaware of another allegation posted on yelp a year later until its investigation was under way. however, heaps continued practicing at ucla health until june of 2018 ellen cater said she saw the doctor just two days before his office closed. >> i was allowed to walk into the room after sitting in a waiting room full of other women waiting it see him i walked in, got undressed, he sexually assaulted me again. >> a week later, she along with

heaps' other patients received a letter announcing his retirement with quote mixed emotions. >> ucla, i deeply believe, absolutely knew at that point. >> reporter: the results of the internal investigation completed by the ucla title 9 office and released in november found there is sufficient evidence that dr. heaps engaged in behavior that constituted sexual assault when he examined the 2017 complainant. also in the report, some of heaps staffers defending him a medical assistant present during the exam in question stated she has never witnessed nor heard of anything inappropriate during exams now, in the after math of the investigation, ucla tells nbc news, dr. heaps did retire while he was under investigation and it regrets the way his departure was characterized. heaps attorney says dr. heaps has no doubt of his innocence, as do hundreds and thousands of former patients and dr. heaps never did a transvaginal

ultrasound for any purpose other than medical, only touched patients during examinations for medical purposes and never made comments or asked questions for nonmedical purposes, adding that he would never ask patients to come in for appointments more than necessary or overstate anyone's risk of cancer. >> i have flash backs to this day. >> as one of the highest paid employees at the university of california, at one point making over a million dollars a year, his accusers are demanding to know what took so long for ucla health to publicly acknowledge their accusations. >> ucla needs to be held accountable for putting him first, before us >> heaps was charged with sexual battery and surrendered to law enforcement in june 2019 and is out on bail. these women are not part of the

criminal case, but have filed civil lawsuits against dr. heaps and the regents of the university of california they join about a hundred women with similar allegations, including eight ucla students, five of whom say they endured sexual abuse by dr. heaps when he treated them at the school's health center where he saw patients between 1983 and 2010. >> it felt very lonely because you don't have anybody to turn to who has a similar story and yet, we do, we just don't know each other. >> well, dr. heaps has pleaded not guilty, and his medical license was suspended. ucla has already settled some cases involving allegations against dr. heaps for nearly $4 million in a statement it says an independent review is examining what occurred and whether our policies and procedures are consistent with best practices and that as an institution we recognize that we must do more to provide the safe, supportive and respectful environment our patients and staff expect and deserve. guys
