outside in fremont, the roads are wet as you head out for that morning commute and temperatures are fairly mild as we start out with some low 50s. it will be slow to warm up as the sun peeks out today. we'll have more on this coming up in a few minutes. vianey tracking the morning commute. as you heard kari say, the roads are still wet. you may want to take some extra time. good news we're starting our morning off fairly quiet on this thursday. no big accidents. one fender bender down to the south bay has cleared out. nothing to worry about through there. right to some of the drive times. maybe you're heading out nice and early, westbound 80 to the bay bridge about seven minutes. to the dumbarton bridge about 11 minutes. a live look in oakland along 880 is already getting busy though it's 4:30. this is regularly about where it's at right around this hour. i'll have another update coming up shortly. president trump this morning waking up impeached. a live look at capitol hill where house lawmakers held a fateful vote last night. that vote followed hours of debate following the vote.

the president responded. representatives first approved article i, abuse of power. article ii, obstruction of congress, in the second vote. both votes came down on party lines, republicans voting unanimously against both articles of impeachment while only two democrats in the house voted against the first article. president trump later talked about it at a rally. >> the house democrats are trying to nullify the ballots of tens of millions of patriotic americans. >> now this historic vote makes mr. trump the third president in the united states history to be impeached. coming up for us at 5:00 here on "today in the bay," a live report on why he may not immediately see a senate trial. and new for you this morning, a bizarre accident in the south bay as a car crashes through the front of a check cashing store. >> "today in the bay's" roz slater with an update on the driver and the cleanup still going on right now. good morning, roz.

>> reporter: good morning. it is quite a mess here as you could imagine. a worker was putting up some boards over what was the doorway and one panel of glass here. i'm told that's transmission fluid. let's show you some video of what it looked like when this happened. we think it happened just after 1:00 or so this morning. apparently the woman, the driver, somehow lost control of her car and plowed into this storefront. now this is the cash one store near the intersection of capital expressway and 7 trees boulevard. police are investigating how this hammed and why it happened. it does appear the driver was the only person injured. she was taken to the hospital.

we do not know the status of her injuries or how badly she was injured. we'll get more of that information later. we also don't know whether or not they'll be able to open this back up. they're set to open at 9:00. that's their regular time. more details about whether that's possible. live in san jose. i'm roz plater for "today in the bay." >> thank you very much, roz. 4:34 for you right now. one of the men at the center of a high-profile bay area murder case may learn if he'll face the possibility of a new trial. in just a few hours prosecutors are expected to decide if they want to retry kaveh bayat, the ex-boyfriend of tiffany li who jurors acquitted last month. prosecutors argued bayat sayisted li in murdering the father of her two children. another man charged as an accomplice is still waiting to be sentenced as part of a plea deal. police are searching for a door dash delivery woman they believe stole packages from a

berkeley apartment building. the surveillance video shows that woman in the white shirt seeming to back up the claim. after entering the building delivering the food she can be seen picking up packages on the way out the door. we talked with the building manager who says this isn't the first time tenants have been targeted. >> we have posters of package thieves. >> while the woman has not been identified door dash has permanently deactivated her account. rebecca kaplan is talking more about an idea she recently floated to house the homeless on a cruise ship. her plan is reportedly getting serious traction and may be just the answer for a cruiseship that will soon be outdated due to new emissions standards. kaplan says in part homelessness has been rising dramatically and causing substantial human suffering. must respond to the magnitude of the crisis.

good morning. i'm rahel solomon at cnbc headquarters. here are today's top business headlines. wall street set to open higher. the dow and s&p 500 breaking a five-day streak. the longest stretch since july. report on unemployed and existing home sales. could be a case of the haves and the have-nots. a new report finds that half of u.s. workers did not see a pay raise in the last year. however, nearly 30% did get a pay hike. 12% a better paying job and 10% got both a raise and a better paying job. overall 49% of workers got some type of higher pay that's up from 38% in 2018. here's the thing, those with lower incomes and education

levels were less likely to see a salary increase in the past year. and facebook will run its first ever super bowl ad this year. the company bought a 50 second spot featuring chris rock and sylvester stallone. facebook has been seeking to improve the appeal of a social media network through a campaign called more together that showcases groups as a way for people to connect with like-minded users. last month fox said it sold out of super bowl ads and, think about this, companies are paying an estimated $5.6 million for a 30-second ad and, again, facebook's ad is 60 seconds. quite a bit of money there. >> i'm surprised we haven't seen one before. >> why would they need to, though? >> that's true. >> me, too. >> during halftime people are on their facebook app anyway so no one will see it during halftime. >> more public relations concerns so maybe that explains

some low 50s. we are also still seeing rain to the north, the waves of rain from ukiah and moving to the east and moving into the rest of the bay area. we can see there's a lot of clouds out there, a steady stream of clouds rolling right into the bay area. as we head into saturday we'll see this flow of clouds, our next storm system. it will start to move in by the end of the weekend. upper 40s and we'll stay there through about 8:00 as the sun rises, we'll start to see some peeks of that sun coming up from behind the clouds, a little bit more sunshine as we go throughout the day but a live look outside in san jose once again as you're getting dressed, another day for the layers, maybe a sweater. our ugly christmas sweater day so maybe you'll do the same. and not a bad day to also wear

some boots to stay nice and warm for the start of the day. we're going to see a couple waves of rain coming in so for this first one we'll see another chance of showers in time for the weekend. we've had pretty soggy weekends recently and this weekend will be no different. it does start out later, late saturday night and throughout the day on sunday, it tapers off on monday. we'll take a break on monday. there will be more rain coming in in time for christmas day and that will also bring us some more sierra snow. looking at the seven-day forecast, some off and on showers, watching those rain chances and the timing of that for the 49ers game on saturday. it will be broadcast right here on nbc bay area. if you're going to the game prepare for the chance of showers even if it's towards the very end. and then we'll still have rain chances going into early next week. vianey tracking the roads. we were talking about the roads still being a little slick.

>> yesterday that made an impact, a couple spinouts early in the morning. hopefully we don't see that this morning. i did notice that we have this accident that just popped up in the tri-valley along 580. i will find out what it is. for now let's check the tri-valley drive times. 580 from grant line road to 680 looking at 22 minutes. 680 from 580 to vargas road. about ten minutes. it's not necessarily impacting the westbound commute and your bridge drive times right now westbound 84 to the dumbarton bridge, 12 minutes. to the bay bridge about 8 minutes. so far our live cameras look pretty good. there goes the san mateo bridge. a live look. this tends to be one of our bridges around 4:47 but then gets busier around 6:00 a.m. an early commute through there and our busiest spot this morning continues to be 880 in both directions. stop and go. there are no accidents. it's just that regular traffic buildup driving through the oakland area. so if you have to head out,

leave now. back to you. >> thank you, vianey. now to decision 2020 and the sixth and final democratic presidential debate of the year will happen tonight in los angeles. the debate is set to happen as planned at loyola marymount. a labor dispute put the whole thing in jeopardy. seven candidates qualified to take part including andrew yang and pete buttigieg who has been seeing a surge since the debate last month. new details now this morning. california state bar is trying to deactivate high powered attorney michael avenatti, former attorney for stormy daniels who plead not guilty to stealing from several clients. that's him, not her. leaders believe avenatti will be disbarred but should no longer be able to practice law in the state. avenatti called the hearing, quote, a dog and pony show and a complete joke. 4:48. striking kaiser workers returned

to the picket lines in a five day labor action. mental health workers are on strike. the ceo says only 30% have come to work during the demonstration. the union says many patients waiting months due to staffing issues. kaiser says it is committed to keeping facilities open during the strike and have hired 500 new employees alone. more people across california are making sure they are covered, at least where it comes to california's health insurance. health leaders say 230,000 people signed up for insurance for the first time this year. that is a 16% increase over last year. and so far more than 1 million people signed up. californians have to sign up by tomorrow if they want to avoid being taxed for not having insurance at the start of the year. new for you this morning, one school district in sacramento has a cleaner and greener way for students to get to school. it has actually received five
