bridge trafficologist as i am, a lighter commute, as we talked about the morning commute will be here but it will be different than your typical monday. we have folks reporting to work but over the last ten minutes seen the cash lanes ease up a bit because some of the remaining cash lanes have opened. the earlier crash still on the off-ramp there as you get toward san pablo past highway 4 but the freeway itself moves smoothly. here are the patches of fog i was talking about in the north bay and reported by chp coming through alamo and diablo. be careful the 068 corridor. the speeds are all green. that's good. back to you. >> thanks so much. back to that breaking news an air force veteran fighting back overnight in:can cloud cover county, after armed robbers stormed his convenience store. this morning one of the robbers is dead. >> "today in the bay"s athom jensen is live in bay point and we want to warn our viewers they may find the video we're about to show disturbing. hi, tom. >> reporter: good morning. yes, and this happened just about 11:00 last night. i want to set this up and warn

viewers about that video, because it does show this robbery taking place. so stick with us on this video. we're going to let it roll a little bit but you're going to see a robbery in place, you're going to see this veteran, working as a clerk in the store, get pistol whipped by the gunmen. one goes to the back and holds a manager at gunpoint while the other one goes around the corner in the store here and robs the clerk and that's what you're going to see in the video right now. >> give me everything. >> ow [ bleep ] [ bleep ]! got a gun, bro. >> reporter: now you saw both of those gunmen run out the door, the one in the light gray coat who had the manager in the back and the one in the black coat where you saw that white flash, that's where that air force veteran, the clerk in the store, fired a shot with a .9 millimeter, using a hollow point round and hit that robber in the back. he did make it all the way out of the store. this is not confirmed by the contra costa county sheriff's department, which is on the scene, but confirmed by the store's owner who has interviewed both the clerk and the manager.

the gunman, the robber who was shot just died around the corner from the store in the parking lot here. the medical examiner's office and sheriff's detectives are still on the scene. again, they're not confirming exactly what happened but you can see what goes down, the two men come in about 11:00, they hold up this store and only one of them gets away. they're still searching for that second gunman. detectives not confirming this right now but we hope to get more information later on today from public information officer at the contra costa county sheriff's department. for now we're live in bay point, thom jensen, "today in the bay" >> what a frightening night for that store clerk. thanks for the latest, thom. now to a live look at capitol hill. members of congress are back home for the holiday week but the battle over impeachment rages on this morning, interest surrounding one possible witness is growing. lighting there. traffic flows smoothly on the peninsula, not that bad, i again zoomed in. we'll talk about what's going on at the bay bridge, you might be surprised. good morning. i'm rahel solomon at cnbc headquarters and here are today's top business headlines. wall street is set to open modestly higher this morning in a pre-holiday trading. markets are coming off another positive week. the dow and nasdaq both up for the second straight week. the s&p 500 for its fourth street. the s&p on pace for its best december also since 2010. on today's watch list a report on new home sales. as you head out on the roads to friends and family this week you may be paying a little less to get there. the average price of gas dipped four cents over the past two weeks to $2.61 a gallon. that is 18 cents higher than a year ago, and the bay area gas is much higher, averaging $3.68 a gallon. analysts say prices are unlikely to continue dropping as retailers around the country face higher costs. if you still have a few more

>> i have to catch it on dvr. >> there you go. >> xfinity. >> yes. >> at your own pace when you want it. maybe a good day to stay indoors or no? get out and enjoy the dry weather? >> you need to bundle up because it is cool. let me show you temperatures we're feeling around the bay area. visibility in san rafael, i've been watching patchy fog in parts of the north bay. right here in the section of highway 101 we're looking good. it is very cool out there with some low 30s in parts of the north bay. we're down to 33 degrees right now in santa rosa, livermore 38 degrees, and san jose 42 and it's 37 in half moon bay and the seven-day forecast is up at the bottom of the screen, as we look at our morning start in antioch. we're going to see some clouds moving by at times, some patches of fog. temperatures in the low 40s, and a slow climb in those temperatures only about 52 degrees at noon today. if you're headed out shopping in the tri-valley maybe trying to get some of the last-minute

deals you'll see temperatures there only reaching into the low 50s today, so you may be wearing that coat and lugging it around to all the stores all throughout the day. now at least we have dry conditions and we don't have to bring along the umbrella. we are going to see some light snow showers still continuing for parts of the sierra. a love the heavier rain moving across parts of southern california from l.a. down to san diego, we'll be watching that, moving away from our area as we go into the day and our rain moving in on christmas, still well off to the west, it will get her late christmas eve. we'll see mostly sunny skies today and clouds tomorrow. rain moving in late tomorrow night with some scattered showers and this won't be a big storm but it will be cooler which could give us some snow on some of the bay area peaks from mt. hamilton toward mt. diablo and parts of the north bay. it only looks to bring a quarter inch of rain from many of our

microclimates and going into the rest of the forecast we'll dry out after christmas, temperatures in the mid-50s. morning temperatures dropping back into the upper 30s and mike, you have an odd view out of oakland. >> look over here, in the middle that's not your odd view, that's your everyday mike. over here the bay bridge toll plaza a lot lighter, it's 5:20 in the morning, we usually have the metering lights turned on but remember, this is christmas eve eve. so this week a lot of folks have taken the day off. we'll see the fastrak lanes likely fill in before the cash lanes do because we have folks who make that regular commute with fastrak going into the city. the cash payers more intermitte intermittent. a smooth drive, a little fog registered up in the north bay and pockets throughout the diablo area through alamo. watch the 680 corridor. we've seen patches develop. over here looks like they may have just reopened or be reopening the off-ramp at pinole valley road. the speeds are going good and our map partners have taken the sign off of the roadway so the earlier crash no major injuries

welcome back. a scary shark encounter looks like a scene from "jaws." the u.s. coast guard posted this on his twitter page. a 37-year-old man surfing south of santa barbara where he was attacked by a shark. his friend saw atig9÷ tack and rushed to call rescue crews. you can see the main being air lifted from the water with a tourniquet wrapped around his leg. he is expected to be okay.

this morning, a man is behind bars in connection to a shooting in chicago that left 13 injured. it happened at a house party early yesterday morning. police say people had gathered for a memorial for someone who was killed back in april. the chicago police chief said cameras in the area showed two men firing weapons during a fight. a second person of interest in the shooting is among the wounded. investigators are saying this morning that fog and icy conditions may have played a role in this 69-car pile-up. this happened yesterday morning state police confirm at least 51 people were treated and transported. two people have life-threatening injuries >> it may takeqqxoz days for th to get back to normal at sacramento international airport. internet problems over the weekend forced flight cancellations and delays. at&t says a crash knocked over some of its cables, causing the internet outages at the airport. workers had to manually check in

kasowitz reaches up and tries to pull a gun as the robber is still getting the cash out. there he goes for the gun and you can see him then wrestle for that gun, the robber and kasowitz. you saw the flight flash, where the clerk fired back at the robbery suspect and you see he does run out of the store after being shot and gets around the corner, and then dies outside the store, just around the corner. you can see the manager come up and check on the clerk, on mark kasowitz to make sure he is okay. after talking to mr. kasowitz, hea=d5 is feeling okay, a littlt sore. his head was opened up with a gash from being pistol whipped. he went to the hospital, he got a couple of staples in the head and he said the adrenalin is still pumping.ozig right now butkp! detectives ar still on the scene. we saw them going over where i gun go off, the -a!ususpect's o

heard the suspect who pistol whipped him say hey he's got a gun and that's when he thought there must be somebody else in here also with a gun and said he had to protect himself and the manager and that's why he fired that shot. >> so frightening, incredible video to see how it played out. thanks, thom, for the latest there. 5:35. this is a holiday shopping nightmare, police say two men shoved a woman to the ground and dragged her across the parking lot while trying to steal her purse, happened 11:00 yesterday morning at the walmart in fremont. police say the attackers got away with her purse and took off in a black bmw. the woman was scraped up but not badly hurt. happening today, sonoma county supervisors are set to tackle the issue of a growing homeless encampment. the camp along highway 12 in west santa rosa is growing controversial. more than 200 people are living there currently. supervisors could approve a plan to send $12 million on potential

solutions, but even the fastest fixes are months away. community leaders are calling it a public health emergency. today marks an important decision regarding the future of the oakland coliseum, the alameda county board of supervisors is set to vote on approving a deal to sell its half interest in the coliseum complex to the oakland athletics. the move gives the a's a fallback petition if the proposed stadium on howard terminal falls through. supervisor nate miley says it's the best option for the city of oakland. >> the city lost two professional sports teams so i think it would be in the public interest and public good to secure one team to remain in the city. i think this is going to be a win/win for everyone. >> supervisor miley predicts the proposal will pass. the a's have six months to review the purchase before the sale is finalized. as the raiders gear up to move to las vegas

next season fans are saying they won't be able to see their team play. they say they're priced out. season tickets at the new allegiant stadium cost between $650 to $3,000, according to the "las vegas review journal." as of october, 96% of the tickets had already been sold. many long time raiders fans say those costs, along with travel expenses mean they won't be going to many games. >> 5:37 right now. san francisco's escooter company scoot is becoming more accessible. scoot told the "sf examiner" it's offering cash payment options to help low-income families. the decision was made to help low income families who might not have access to bank accounts. the company says you can pay for fares at local stores like family dollar, cvs or 7-eleven. lime and spin also offer cash payment options. if you're driving for the holidays, there is some relief at the pump across the country, the price of regular grade gasoline dipped four cents peri gallon to çu$2.61 over the past

morning and normally we're up to 57 but won't make it there today. we'll talk about this and the rain moving in on christmas eve coming up in less than five minutes. there's more traffic coming across the bay bridge but nothing dramatic and no metering lights. we are looking at this, a lot more slowing and we got an update, looks like the crash is closer to diablo road, all lanes currently blocked as they clear cars north 680 headed up toward the walnut creek interchange. we'll talk about that affecting your commute coming up. >> thanks so much, kari and mike. it's 5:44 right now. an arrest of a former daca recipient by i.c.e. agents is spreading fear among the immigrant community in l.a. county. 23-year-old daniella ramirez was taken into custody early friday morning at the marriott hotel where she works. ramirez and her sister came to california from mexico when she was just 10 years old. both became daca recipients but ramirez didn't renew her status two years ago out of fear.

elizabeth warren was a distant third with 8%. millionaires who were surveyed cited the economy as the main reason they support president trump. more than 60% polled say they see bernie sanders and elizabeth warren as bad for the economy. this morning the coast guard is under scrutiny for exempting some boats from strict safety rules that, included the "conception" diving boat in which 34 people were killed in a fire during labor day. some of the victims were from the bay area. u.s. coast guard records show eight diving boats in the state were given exemptions from the 1996 safety standards rule which means they didn't need to add bigger escape hatches and advance fire prevention systems. no word from the coast guard as to why. federal investigators are still looking into the dive boat fire. this holiday season. this is a delivery truck full of

packages on fire, just days before christmas at the beginning of hanukkah. this happened over the weekend in fullerton, south of los angeles. the fedex driver picked up his shipment and was headed to san diego when he noticed the truck on fire. look at that, some packages, some gifts. the driver wasn't hurt. many packages were destroyed. no word on what sparked that fire. new this morning, the u.s. department of housing and urban development released its report on homelessness and found homelessness in the u.s. increased nearly 3%. one of the biggest reasons why is california. the study found that more than 21,000 people in california became homeless this year. that's a 16% increase from last year. better numbers were seen across the nation, 29 states, in fact, saw a decrease in their homeless population. one of the bay area's

largest toy drives is under way. sacred heart community service in san jose, look at that, all geared up and ready to go, the bicycles are made, they're handing out boxes filled with toys, books and stocking stuffers. they'll go to over 6,000 san jose kids in need. the giveaway will last until tomorrow morning as well, and you know what? this is a great time to give, because there's still time to donate any new, unwrapped toys. they got a fleet of bicycles out there but it's so great to see. one of my really favorite stories of the year. >> great that there's time to donate so for anyone looking to donate, there is your chance. and shifting gears just a little bit, from donations to just utter whackiness. if you ever conderd how much it would cost to light up your house like clark griswold, finally he gets his house display to work finally.

this topic. i'm not doing this. >> yes, with the dense fog in the tri-valley headed out the door having to deal with that and cold temperatures, all right, we've made it down to freezing in santa rosa, we're now at 32 degrees, bundle up as you start out today and heading out for work. you have to turn on the heater inside the car and san jose we're at 42, and 42 in san martin. clear visibility in palo alto. as we head through the day temperatures going from 40 degrees to the low 50s by noon. and if you're going out tonight for the lighting of the menorah in union square, it's only going to be at about 51 degrees and we'll hold steady there with mostly clear skies tonight. we've been looking for chances to get out to christmas in the park in downtown san jose. it's going to be in the upper 40s there and getting even cooler as we go into the evening. if you'll be traveling across the state, there's still a lot of heavy rain across southern california while we are drying out and light snow for the sierra. for us, our next chance of rain

comes in late christmas eve into christmas day, as that storm system arrives, as we time it out, looking dry today as well as much of the day tomorrow. but then going into late tomorrow night, we start to see that rain reaching in to the coast, and spreading inland, with some cooler temperatures. notice this area here the snow will most likely be over mt. hamilton and north bay peaks and elevations above 3,000 feet and going into christmas day, we'll start to see that rain tapering off. this will bring us some additional light amounts of rain anywhere from about a quarter inch of rain to closer to half inch of rain for parts of the south bay. as we go into the rest t forecast, we'll be drying out. we're looking good after christmas day and temperatures reaching the mid-50s. morning temperatures in the upper 30s and san francisco will be in the low 50s all throughout the week. mike, you were tracking three problem spots. >> that's right, kari. none of them are the been beay . the toll plaza light with no metering lights. we have lighter commutes during
