right now at 5:30, an overnight fire rips through a south bay apartment building sending families out into the cold street. plus this morning there is growing tourism concerns in san francisco. the new steps city leaders are taking to try to keep high-profile conventions heading there. good morning and thanks for joining us. i'm laura garcia. >> and i'm scott mcgrew in for marcus washington. starting with a live look across the bay area into san jose and san francisco and walnut creek. it is a chilly start as you head out the door this morning. kari hall is timing out our tuesday forecast. >> you could see at the bottom of the screen, upper 30s there. and we're going to see also a

clear sky as we start out on this tuesday. in san jose some low 40s through 5:00. and then we'll hold steady through about 8:00. and then throughout the day, mostly sunny sky. it is going to be nice. but then clouds move in later this evening as the storm system that we're seeing just to our north starts to make its way closer and there could be some rain in the north bay as early as tonight so i'll talk more about that coming up in a few minutes. mike is tracking the drive to work. how is it looking. >> there may be one area, not the rain you're talking about tonight, possibly in the north bay, i'm talking about right now over the tri-valley. there may be a slick roadway southbound 680 into the sunol grade. reports of a oil slick in a lane after what sounds like a fender-bender. i'll double check with the chp and get more detail. we don't see slowing on the sensors, i'm worried about traction. so be careful as you head toward the mission north exit there. now toward the bay bridge,

contra costa, upper east shore freeway same thing, in the last five minutes i've seen the cash lanes start to back-up so more traffic flow. it was easy until about 4:is a and we'll track that pace. and new overnight in santa clara county, 17 people including five children out of their homes this morning after a fire in gilroy. happened at about 12:30 this morning at an apartment building not too far from santa teresa boulevard. the flames were confined to a bedroom in an apartment unit. one resident who lives across the street heard an explosion and he ran out to see what happened. >> we saw smoke coming out and we saw it looked red. it didn't look like fire. just red smoke. >> no one was hurt. the cause of the fire still

under investigation. some scary moments many san francisco caught on camera. police say you're looking at an suv full of burglary suspects speeding down union street and slammed into a meter maid vehicle. the suspects took off. that started a police foot chase. >> jean elle was in the city with how officers tracked the suspects down. >> reporter: dash-cam video captures the moment an suv driven by a car burglary suspect slammed into a parking control officer vehicle sending it flying and four men inside of the truck take off running. >> well i heard the big crash. >> reporter: elias heard the crash and watched the suspect run up franklin from union. police eventually arrested all four men. >> it took them a while to catch them because they were hiding. >> he saw them go up the back

staircase and thought we were getting robbed but they were trying to run from the cops. >> reporter: at least one suspect was hiding on alex's roof. video from the citizen app shows officers taking that man into custody after he slid down a light well. >> it is a little scary. i think that things have gotten worse in san francisco. >> reporter: witnesses say police found the other suspects in backyards. sfpd said the suv was known to be used in car burglaries and before the crash they stopped the car at hyde and green but he took off. witnesses say it was a relief to see he didn't seem seriously hurt. >> he stood up. they took him out of the car and he was okay. >> reporter: jean elle, "today in the bay." now called projectile alley, an object was thrown at an suv

near dumbarton road. no one was hurt but the driver's window was shattered. it is the 68th projectile to be thrown or shot at cars in the last few months. this is video of the previous incidents. the chp is offering a $14,000 reward to find whoever is responsible. the tourist industry is making it clear when it comes to conventions, the city is still open for business. heat has been on oracle decided to move the huge conference to las vegas. san francisco's filthy streets listed as one reason why. the city is hosting a convention planners convention, ironically enough today. the chronicle reports the tourism bureau wooing the convention planners on the benefits of the miss coney center. state assemblyman trying to drum up support for the

richmond-san rafael bridge. mark levine tells the chronicle that the crumbling is a sign the new bridge is needed. he believes it might not survive a major quake and caltrans determines if it is time for a new structure. and renewed ban offer on flavored tobacco and the federal government extended the nation ban and now california lawmakers want to ban the flavors not included in the the federal ban. jerry hill introduced the bill yesterday. >> i didn't know it was this bad until all of the stories started coming out and it is true. >> menthol cigarettes would still be legal. as harvey weinstein returns to the courtroom facing charges from coast to coast. would you ditch your car and take uber and lyft.

another nice day ahead but there will be more clouds and rain moving in by tonight. we'll talk more about that coming up in a few minutes. and looking at your tri-valley drive times, a smooth drive out of the altamont pass. the number 680, be careful you're at speed but we'll talk more about what we've learned about the sunol grade. good morning. i'm rahel solomon and today's top headlines. stocks staging quite a u-turn yesterday to close in the highs of the session and the biggest comeback in three months. the dow had been down 200 points but closed up nearly 70 points. investors appearing to shrug off concerns about the rising tensions in the middle east. as the watch list reports on the services sector and factory orders and the trade deficit. two-thirds of car owners who use ride hailing services like uber

or lyft would consider giving up personal vehicle over the next decade. a new survey by a censure found that consumer satisfaction with ride hailing company is strong in part to reliable pickup and dropoff times and ease of booking and payments. the vast majority of people expect to maintain or even increase spending on ride hailing this year. now despite that, customer loyalty is illusive as half of people say they switch between brands. burger king will test out a plant-braced breakfast sandwich in select markets later this month. it includes a patty from impossible foods but it is not vegan because it does have eggs and american cheese. the test market are are savannah, georgia, albuquerque, new mexico and springfield, illinois. 38% of diners are trying to add more plant-based food to their diet and 90 percent of the

the south county but starting out with mostly clear skies. it is just cold and that is what >> a blanket to keep warm. >> heater on inside of the car. but if you are heading out to be picked up, it is definitely one where you have to add the layers. upper 30s in antioch. and then we'll stay there as we go into between now and into 8:00. and then gradually warming up. we will see some sunshine today but a few more clouds mixed in due to the storm system moving closer to the bay area. bringing a lot of rain and even snow to the upper elevations in parts of the pacific northwest. as that moves in, here it is going to weaken but still bringing a chance of rain. we're going hour-by-hour to show you how the bay shapes up into the afternoon. still mostly clear but by 8:30, 9:00, we see spotty showers moving into the far north bay and into the rest of the bay area during the overnight into tomorrow morning.

we'll see a slight chance of rain. most of us won't see the rain for areas south of the golden gate bridge. but there will be that chance that we could see the rain moving in and then another wave comes in early on thursday. and this looks like a better chance that more of the bay area could get in on some wet weather. then as we head toward the weekend, saturday another weak system moving in. and then we'll also be watching a couple more waves going into early next week. but with this first wave of rain, we're looking at about a tenth to quarter inch of rain. and looking at the seven-day forecast, it does stay unsettled with upper 50s, cooling down for the weekend and of course we're watching the timing of that rain for the saturday game of 49ers here at levi stadium for the playoffs. i'll have more updates on that once we get past the initial wave. >> and i'm curious about the now storms heading to the tahoe area where you were this last weekend. >> at lake level there is

basically no snow out there. and that is the concern. but looking at our snow pack we know that in the upper elevations we've had a decent snow pack. we're at 83%. so not quite where we should be. last year at this time we were at 67%. so better than last year at this point but remember we ended last season at 201% of normal. so you just have to wait and see how things shape up. a couple of things happening here. so you have snow melt and also sublimation, that is where it goes from straight from snow to gas gas, like what we experience from ice cubes in the refrigerator and they shrink and 85% of the sierra snow melt flows into tehachapi which is a water supply but that supplies about 60% of the water. remember last week when they were giving us snow surveys,

they said we were at 97%. right now we're at 83%. so we've lost 15% of our statewide snow pack in just five days. but the good news is there is more snow in the forecast with the next couple of systems coming in. we're going to see about a foot to maybe a foot and a half. i posted some pictures on my facebook page. this is one of them. i went up to hope valley and snowmobiled at about 7,000 feet. send me your pictureses of the sierra and see more. >> thank you about knowing the sublimation so i know what happened to my ice no problems on the road, no major problems. something new over here and it is disturbing. report of a wrong-way driver. i want to talk about that. it is off the roadway.

give you more details in a second. but i do want to share this. oil is on the roadway, confirmed by chp in your fast lane. there is also a rig there. erin drove through the area and said there is a rig that looks jackknifed but not that severe for the drive. mostly a visual distraction blocking the past lane but other activity because there is a minor oil spill toward the mission grade scales. so be prepared. we'll track that because the tow truck was supposed to be there an hour ago and i haven't heard about them hooking up the truck yet. the commute will start to build in the next 20 minutes. over here, that wrong-way driver was going off of the on-ramp and drove on to the shoulder of the roadway so it is not affecting traffic but it is a zaks once chp gets there to have a little discussion. over here the bay bridge toll plaza, back-up in the cash lane and one more cash lane has yet to open. back to you. new this morning, a potential setback for the white house and the plans to send some

asylum-seekers to guatemala while court cases play out. reuters report mexico is rejecting that proposal. looking for better options. homeland security wants to implement the plan first approved it last summer. it would allow asylum-seekers to apply for protection in guatemala which is probably more dangerous than mexico. new legal troubles for movie mogul harvey weinstein as his criminal trial will play out in new york city. prosecutors in l.a. yesterday charged him with sexual assault and rape. tied to two incidents involving separate women in 2013. in new york, meanwhile, jury selection begins for his criminal trial. he faces sexual assault charges tied to two women in cases seven years apart. he said in each case the sex was consensual. >> 4:51, a judge allowing a $215 million settlement with former patients of a former usc gynecologist to move forward.

18,000 women accuse dr. george tyndall, that number seems high, of sexual assault while he worked on campus. the pursuit will provide $2,500 for parents atients and up to ar million for those accused to be booz boozed -- abused by him. he faces up to 53 years in prison if convicted. 4:52, state lawmakers are back from vacation and whatner doing is rolling out the version of the green new deal. the specifics weren't released but it would set new climate requirements and deadlines. a state mep told the "sacramento bee" they plan to have a different version of the bill in the coming weeks. another bill aiming at helping the environment, the bottle bill encouraging for sites to drop off recyclables.
