famer as cooperstown prepares to welcome derek jeter to the place of baseball heroes >> derek jeter got elected to the baseball hall of fame today. yay! the hall of fame announced jeter got in at 6:00 p.m. but somehow the houston astros knew about it earlier. >> a busy wednesday ahead as "early today" starts right now good morning i'm phillip mena >> and i'm frances rivera. the stage now set for a high-stakes historic clash on capitol hill as opening arguments began in the impeachment trial of president trump. senators burned the midnight oil in a 13-hour marathon session debating the trial rules democrats introduced amendment after amendment seeking witness testimony and documents. all 11 attempts were struck down in party line votes including an amendment to subpoena former national security adviser john bolton throughout the night tempers flared over the methodical approach by democrats.

following the bill clinton impeachment model that allowed each side 24 hours to make its case >> the process was good enough for president clinton and basic fairness dictates it ought to be good enough for this president as well. >> reporter: but democrats objected to a key difference from the clinton rules new limits that would force each side to make those arguments over just two days, meaning sessions lasting late into the night. >> why don't they want the case to be presented in broad daylight on something as important as impeachment the mcconnell resolution is nothing short of a national disgrace. >> reporter: then a surprise after at least one pivotal republican raised concerns a pair of last-minute handwritten changes allowing three days for opening statements and the documents from the house will be put into evidence. that small group of republican moderates could be critical on another flash-point, whether to call witnesses democrats demanding a vote now

including on former national security adviser john bolton >> a trial without evidence is not a trial. it's a cover-up. >> reporter: but republicans argue house democrats refused to subpoena bolton when they had a chance and that the vote on witnesses will come after opening arguments. another key republican who democrats were counting on is sticking with mcconnell's plan the democrats say that republicans are engaged in a cover-up right now your response to that. >> well, i think it's important to hear from john bolton and perhaps other witnesses. obviously from both the defense as well as the prosecution the right time for that vote, that decision, is after the opening arguments. >> reporter: later, with the chief justice presiding, both sides taking turns trying to persuade the jury. house democratic prosecutors insisting the rules are unfair >> i believe the most important decision in this case is the one you will make today. will the president and the american people get a fair trial? >> reporter: and saying it would have taken too long to go to court to compel witness

testimony. >> the president may not defeat impeachment or accountability by engaging in endless litigation >> we're acting as if the courts are an improper venue to determine constitutional issues of this magnitude? that is why we have courts >> reporter: and for the first time the president's legal team, which was not part of the house proceedings, now making its case, dismissing the democrat case as partisan politics. >> why are we here are we here because of a phone call or are we here before this great body because since the president was sworn into office there was a desire to see him removed? >> reporter: inside the chamber it was unusual to see all 100 senators sitting at their desks silently as jurors i saw many of them taking extensive notes. there was no talking allowed i saw some of them passing notes from one to another before

they're ultimately asked to render a verdict frances? >> all right, peter, thank you one key question hanging over the trial is what role will chief justice john roberts play? well, we got our first glance overnight when he admonished both sides after a heated exchange >> in the 1905 swain trial a senator objected when one of the managers used the word "pettifogging. and the presiding officer said the word ought not to have been used i don't think we need to aspire to that high a standard, but i do think those address the senate should remember where they are >> for those of you at home without a 19th century dictionary handy, pettifogging means placing undue emphasis on petty details. now, for more on what we can expect today let's go to nbc's tracie potts in washington tracie, all pettifogging aside, it will be the house managers who make their case first. >> exactly and now that we know that each

side will have 24 hours over three days, not two days, let's take a look at what this schedule will look like. so for the rest of this week it looks like the prosecution will be making their argument assuming they take their full three days and 24 hours. and then on saturday they're working the weekend. the trump team will pick up, wrapping up their arguments on tuesday, leaving a couple of days in the middle of next week for q&a, written only, by lawmakers. and then by the middle of next week we could see that vote on whether or not there will be witnesses. this was the revised schedule after senate majority leader mitch mcconnell bowed to pressure from his own party, handwritten changes, to try to get those changes done meantime, the house managers tipped off a little bit of what they'll be talking about today, focusing on the evidence >> yeah. we're making it hard for you we're making it hard for you to say no we're making it hard for you to say i don't want to hear from these people, i don't want to

see these documents. we're making it hard it's not our job to make it easy for you. it's our job to make it hard to deprive the american people of a fair trial and that's why we're taking the time to do it. >> reporter: we also got a bit of an idea what the trump defense will be as they focused on the idea of abuse of power not being a crime. phillip? >> all right sort of sleep-deprived arguments we've got in store for us today. thanks a lot, tracie as the drama continues to you unfold in d.c., president trump is conducting business in davos, switzerland another busy day at the world economic forum is just getting under way. the president will return to the white house later today after a few more meetings with world leaders. nbc's keir simmons joins us now from switzerland keir, how is the trial here at home impacting the president's trip overseas? >> reporter: well, president trump meeting with business leaders here in davos today. thousands of miles away from that senate impeachment trial. and i think he likes it that

way. trying to give the impression that he's doing business while back in america it's the same old politics he gave a speech that even for him was strongly worded with the environmental activist greta thunberg in the audience, president trump questioning the claims of global warming and even suggesting that america has the cleanest air and water in the world. take a listen. >> it's a hoax it goes nowhere because nothing happened the only thing we've done is a great job. that whole thing is a total hoax so i'm sure it's going to work out fine thank you very much. >> how long will it last >> reporter: it is the second time the president has been here at the world economic forum. i think likes it here because of course he likes being at the center of attention, being perhaps a member of the club with all of these world leaders. he's going to head back there, though, and back to reality today. >> day two picking up steam.

the impeachment trial. keir simmons for us, thank you there is a health alert in the u.s. this morning as a mysterious pneumonia-like illness known as the coronavirus continues to spread. and now the u.s. has been hit with its first confirmed case. the virus has killed at least nine people and sickened over 400 others in asia later today the world healed organization is set to hold a meeting on whether to consider the outbreak a public health emergency. for more on this outbreak we turn now to nbc's correspondent janis mackey frayer who is in wuhan, china where it's considered ground zero for that virus. so janis, what do we know about this very first confirmed u.s. patient? >> reporter: well, the patient visited china recently, returned to the united states, showed no symptoms when they returned, and then went to visit a doctor to be diagnosed with this particular coronavirus he's in washington state, is said to be in stable condition but this has set off alarm bells

for officials in the united states for expanding screenings to five airports now and all passengers coming from wuhan will have to go through those five airports to be screened no matter where they were planning to go in the united states. meanwhile, officials here admit this virus could still mutate and spread even further. this is a huge concern for them ahead of the very busy travel time for hundreds of millions of chinese for the lunar new year they're pulling out all the stops, urging people to take these precautionary measures so that they can try to at this critical stage get the virus contained and prevent more cases from being reported. that number now climbing towards 500. phillip? >> we're all hoping for that containment. all right, janis, thank you. let's turn now to the weather and the day ahead and here's nbc meteorologist bill karins hoping for a little relief at

in today's top stories opening statements and first witness testimony will begin today in the trial of harvey weinstein. the hollywood producer is charged with five sex crimes including rape and sexual assault stemming from encounters with two women prosecutors will also prevent testimony -- or present testimony from four other accusers in all, more than 80 women have accused weinstein of sexual misconduct going back decades. a jury of 12 will hear the case in a new york courtroom. the trial is expected to last about two months weinstein has pleaded not guilty and denies all allegations of non-consensual sex news for migraine sufferers. the makers of excedrin are halting production on two types of the drug.
