right now at 5:00, breaking news. s.w.a.t. teams with guns drawn shutting down part of roadways and a drone flying over a neighborhood in contra costa county. a live report from the scene. plus -- >> i think it is appropriate at this point for me to admonish both the house managers and the president's counsel in equal terms to remember that they are addressing the world's greatest deliberative body. >> fireworks on capitol hill. breaking down day one of the president's contentious impeachment trial. and a battle over a chick-fil-a comes to an end. the decision made. there, mike. what is going on. >> we had eastbound 580 closed. it is reopened. that is out of dublin and toward livermore. looking at a map and overall it is green. around the bay we'll talk about a slick roadway. kari will talk about the weather and the conditions out there. they are fine right now for driving except for this is the issue still. we still have the closure not eastbound 580 but slow past el charo and airway and the reason we heard about police activity. you see a little slowing on the sensors. i'll give you the note. el charo is your exitin said of airway but if you pass that loop around to city streets. if you get off at el charo head past the shopping outlets, the san francisco outlets. you see the flashing lights and that is a little distraction for eastbound on 580 but you can get through the area. the exit for airway is close the until further notice because there is police activity and bob redell is on the city streets

and getting more information as we speak and it sounds like we have bob now. it looks like you are getting set up. what could you tell us. i'm sorry to jump in on you like that. >> reporter: yeah. sorry about that, we're trying to get video of what we believe is a possible suspect in the ambulance here. we're on airway just off of 580 and this activity is now safe at the scene according to livermore police. within the past ten minutes they had a man surrender and we'll have the video as they surrendered to yell commands at him and had a k-9 dog and he came out with his hands up limping from his vehicle to a s.w.a.t. vehicle where they took him into custody. and as i mentioned, they're loading him into an ambulance. police had this car sur rund-- surrounded for 30 to 45 minutes because when i was driving in around 4:00 a.m. i noticed this activity was going on at the time. it is not clear why they

surrounded this car. when i tried to get in on the other side, a firefighter told me that it wasn't safe to be over there. this is in front of the airport on airway boulevard because it is possible the suspect was armed. this is according to the livermore fire department. that is the information that is not been confirmed with the police department but the fire department was concerned that even at that distance away if there was a gunshot you would be in an unsafe area. one car was surrounded. we know that one person was in the car. that man did come out of the car. and livermore police have said the sa-- the scene is now safe. now we're rying to figure out what led up to the surrounding of this vehicle and apprehension of this man. live in livermore, bob redell, "today in the bay." >> a lot of activity out there. okay. it looks like it is calming down. at least at this point. >> absolutely. we want to look at the forecast for you. rain in the forecast for today. >> the rain is clearing out. but the roads are still wet. we could see the clouds overhead

as we take a live look outside in san jose, heading over to willow glen, we'll see sun peeking out from the clouds and temperatures warming up. upper 50s by 1:00 and reaching 61 and 60 is the high in napa and in oakland and san francisco will see upper 50s and we'll talk about a little bit of time to dry out before the rain return ares. more on that in the forecast coming up in a few minutes. >> sounds good. we'll check in with you. breaking news in contra costa county where police surrounding a neighborhood in san pablo for hours. >> pete suratos joins us live. any new information, pete? >> reporter: yeah, good morning to you, still no new information from contra costa county sheriffs on the scene but behind me still an active scene here on o-hatch drive and o'toole. a call came in and they couldn't

give any information if they are looking for a suspect. this is a barricade situation but we know that s.w.a.t. team is on the scene and active presence here in the residential part of san pablo on the border area but still an active scene as we're working to get more information on this. but clearly a big police presence still here all morning long as we take you back out here live. we're working to get more information. we're going to continue to monitor things and we'll bring you new updates as they come in. reporting live, pete suratos for "today in the bay.." >> pete, thank you. developing for you on capitol hill, a historic day ahead as senate impeachment arguments begin later this morning. >> we have a live look in washington where the senate went late into the night in a marathon 13-hour session hammering out rules for the trial. "today in the bay's" tracie potts explains what the next phase of the trial will look like. >> reporter: this afternoon democrats begin presenting their

case against president trump under revised rules that give each side 24 hours over three days, not two. avoiding middle of the night arguments. >> they're hoping people are asleep. you know a lot of people are right now. all over the country. because it's midnight. >> reporter: mitch mcconnell bowing to pressure from his own party to make this trial look more like the clinton impeachment. the handwritten changes include accepting the house record of evidence and witnesses. but democrats want more. >> a fair trial requires witnesses. in order to provide the truth, the whole truth, and nothing but the truth. >> this all supposedly started because of a whistle-blower. where is that whistle-blower? >> the senate is adjourned. >> reporter: debate ended this morning after the senate shot down 11 attempts by democrats to subpoena documents and

witnesses. including white house chief of staff mick mulvaney and john bolton. the president's legal team. >> we have a great case. >> reporter: previewing the defense. >> abuse of power is not a crime. and so you don't need witnesses if my view prevails you get right to the vote and you acquit. >> reporter: under the new schedule the trump defense is likely to begin on saturday. tracie potts, nbc news, washington. >> stay with nbc news as the impeachment trial kicks off today. our coverage includes several special reports throughout the day. new fears about the spread of the coronavirus after the first u.s. case is confirmed. the virus affected hundreds of china and caused nine deaths. yesterday the cdc confirmed a case in washington state. the person returned from china recently. the center of the outbreak. we have new video of people in

china that have been out. they've been buying masks and many have canceled travel plans for the chinese new year. cdc said it is now screening passengers for the virus at two more airports, atlanta and chicago. screenings are taking place in san francisco, l.a. and new york. campbell leaders go late into the night deciding the fate of a proposed chick-fil-a restaurant. "today in the bay's" kris sanchez is live from the proposed location. so how did it turn out, kris? >> reporter: well, hi there, marcus. neighbors were able to get the city council to shut down a drive through at this location where there is a denny's restaurant. chick-fil-a proposed a 4500 restaurant here on bascom and east campbell down the street from the shopping center. opponents said it would draw more than 2,000 cars a day so

some foodies will be left wanting. >> we're twoing to have serious issues with parking and traffic and serious issues with pedestrian bike safety. >> i wouldn't mind having a chick-fil-a here. i think they need more eatery options. >> reporter: so at this location about a mile away the video here on your screen vocal residents with concerns over traffic and also shut down an n-n-out and in that case restaurant representatives lost an appeal. we'll wait and see if the chick-fil-a representatives might have the same opportunity to appeal as well. in campbell, kris sanchez, "today in the bay." >> thank you. a follow-up for you. berkeley leaders have approved a plan to develop a homeless camp on city-owned property. including up to 120 tents. one site under consideration is on university avenue near second street. it may be months before a final location is found.

according to berkeley side the late night vote was approved by all but two council members who did not vote. happening now, beach-goers should be on the lookout for sneaker waves until 9:00 this morning. there is a warning in effect up and down the northern california coast for dangerous waves and rip currents. everyone is reminded never to turn your back on the ocean. really have owe to heed the warning. kari, you better take it away. >> yeah, we're going to still have some clouds and of course that rip current warning and just watching out for some of the waves that may be high along the coast. but our weather quieting down now that the storm has moved away from the bay area. we're going to have a day still mixed with sun and clouds but the rain moving out. as you get ready to step out of the door in mountain view we're going to see our temperatures in the low 50s. it will hold steady there in low 50s through about 10:00 and then gradually start to warm up as we get more sunshine. we're heading up close to about 60 degrees there. i'll have a look at the rest of the forecast coming up, and mike, you're still tracking the

police activity. we have. and we have live pictures. bob redell continues to cover this at the scene. airway boulevard off of 580, you see the police activity. he was kept at a perimeter at a distance away just in case there was an issue as he was watching an arrest. and he'll bring more information as he gets that an confirmed with the police department but we do know confirmed by bob and chp is that the airway boulevard off-ramp is still closed off of eastbound 580 and slow approaching the scene. el charo is the exit for an alternate. if you pass by that, you have the closure at airway and then use north livermore to loop back past that crash. now past the police activity. now the commute westbound is just fine and not a distraction any more. once most of the flashing lights clear, you still see flashing light because of the closure there. the south bay and the peninsula and across the bay, all of the bridges do move well. the bay bridge toll plaza has slowing because of the back-up

coming back in less than five minutes. within the last five minutes they turned the metering lights on on the toll plaza. you see the jamup and the roadway still damp from the rain. so we're watching westbound 80 and also watching eastbound 580 with a problem heading in that direction into livermore. well good to you. happy wednesday. e-bay will cut jobs in san jose. we're seeing dribs and drabs of this. boeing once again pushing back the date where it expects to start flying the 737 max again. well into summer. broader markets fell over concerns of coronavirus. we've been reporting that that case reported in the united states. president trump is in switzerland at the davos conference. he said he's not concerned about the disease coming to america. he said, quote, we have it totally under con role and we have a plan. san francisco based cruz

automation unveiled a driverless car used as a taxi. uber has a similar plan. general motors bought cruz a few years ago for just under a billion dollars. that is really paid off for gm. you remember jeff bezos had his phone hacked and "national enquirer" threatened to publish details and it is originated from the saudis and there with new accusation that spy ware was sent to him by mbs himself. the crown prince bin salmon was video chatting when the file was sent and after the chat the amount of data emanating there from bezos phone went up hundreds of percent. in other words it was giving up all of its secrets. the saudi government calls the allegation absurd. remember our intelligence agencies say the crown prince was also behind the murder of a washington post writer. and we know mbs regularly talks

to jared kushner in the white house and we know kushner uses what's app. kushner has a very close relationship with mbs. a disturbing number of american officials use what's app to conduct official government business. we know that because we've seen the texts. for instance during the impeachment inquiry we learned the whole ukrainian affair was planned and discussed by trump's team via what's app so bottom line we have a lot of people in the white house using an app that the richest man in the world who knows tech backwards and forwards got hacked through. >> concerning so i'll go ahead and hand that over and say -- worrisome. >> thank you very much. this one will affect a lot of people. new this morning, a new fight over a drug you most likely have in your medicine cabinet. california health leaders are debating whether to call acetaminophen a carcinogen. it is found in tylenol, robity

>> i think that line was more the gift shop we had to interview people up from l.a. because they couldn't get merchandise and they came up to get more merch. >> people love them. and they are quite the performers. >> i can't decide which color hair i like best. >> that is crazy. all right. so at least the weather is calming down. rain moving out. roads may still be wet as you take a live look outside in oakland. getting out of the door to what will be a nice day. although we're starting out cool, especially in the north bay. we have upper 40s in santa rosa and in napa. elsewhere, some low 50s. which is actually a little bit warmer than normal thanks to all of the clouds that we have overhead. as we check out our high temperatures for today, in the south bay morgan hill you'll head up to 64 degrees as the sky clears for the afternoon and we'll still have a few clouds moving by but it is a nice day. as we get a look at our high

temperatures for the east bay, danville, pleasant on reaching 51 and then for san francisco reaching 57 on the embarcadero. north bay up to 60 degrees. so we'll pretty much be where we were yesterday as far as temperatures. but at least we won't have the threat of rain. now storm ranger showing that the rain has moved out and moved off toward the east. and if you are traveling toward the sierra, just a heads up there are still some rain and there will still be light snow flurries coming down. looking at what is coming our way for the rest of the week, more showers possible for the north bay late friday evening. but the rest of the bay area really won't see that. as we head into saturday, especially saturday night, we'll start to see rain returning more widespread rain moving in. and it will just be off and on throughout the day on sunday as the slow-moving system comes through. now it is going to bring us about a quarter to half an inch of rain. so a pretty good soaker,

especially after getting a nice amount of rain yesterday. but we will have a couple of days in between two dry out. we're looking at partly to mostly cloudy sky. and low 60s for the next couple of days. and then that rain returning late saturday night into sunday. mike, the roads once again still wet this morning. >> that is right, kari. and if it is a clear roadway, you tend to drive faster when you can. just note because there might be slick roadways and we have everybody operating close to the speed limit. we do have slowing of course in a couple of spots. one of those is eastbound 580 past el charo and airway and airway is closed from eastbound 580 and westbound is open but only about a hundred yards of roadway where they have the investigation. bob redell saw the arrest and getting more information. but you'll not use airway boulevard off of eastbound 580 and you exit at el charo.

scene as that story unfolds. >> plus what is next after a fiery first day of president trump's impeachment trial. the reason why the back and forth stretched all the way into early this morning. and up for debate. the push to make a bus-only lane on the bay bridge and how you can weigh in today. and a good morning to you. thank you for starting with "today in the bay," i'm marcus washington. >> and i'm laura garcia. let's look at the forecast. rain overnight, kari. now the rain is clearing out. as we check out the seven-day forecast, we'll still have lingering clouds today and clearing out as we head into the rest of the week. as we go into the weekend, there will be some more showers coming back and in san francisco we have some upper 50s today. we're staying in the 50s but we'll cool off slightly if that rain moves in. we'll focus just on weekend forecast in about seven minutes and talk about events going on. mike, your tracking a crash at the bay bridge. everything is off to the shoulder. i don't see a distraction or any disturbance to the flow of

traffic. which this is the flow. it is backed up because the metering lights are on. no problem out of the maze. wet roadways and we'll have slick conditions but no major problems on the freeways. a smooth drive developing as a slow drive develops for 101 through san jose and the note as we look at dublin, westbound and eastbound still have the flashing lights. the airway off-ramp is closed but the freeway is open. why that is closed we'll hand it back to you guys. >> thanks, mike. as he was just mentioning, there is still a lot of police activity in the east bay at one point it shut down major freeways. >> bob redell is live there in livermore where officers have now taken the man into custody but we don't know what he was doing, bob. >> reporter: it is not clear. and the livermore police department said a public information officer is on the way so we hope to get more information soon.

but behind me there is still a number of police officers here. we're at airway just off of 580 which is shut down at 580 about a hundred yards just before the livermore golf course and the airport. this is where that starbucks is just to give you a frame of reference if you're in the area and figuring out where we're at. there are still a large police presence but there is no longer a threat to public safety. look a tht video. this is the man who surrendered about 45 minutes ago. police in an armored car had surrounded him in his car. they issued commands to give up and had a drone hovering over his vehicle so they could see inside. you could see the man was limping with his hands up as he slowly made his way to the armored vehicle. and i could tell it you, he didn't surrender right away. this is going on for 30, 45 minutes. police checked his car to make sure no one else was inside and declared the scene safe. earlier i spoke to a firefighter who told me to leave the area at one of the blockades and said it

wasn't safe because there might be an armed suspect. that is information that has not yet been confirmed by police. this is the scene earlier in the 4:00 hour when chp shut down all lanes of eastbound 580 at areaway and then eventually pushed the shut back down to el charo to keep the public safe in case the police activity were to spill back out on to the freeway but that freeway is now reopened so if you are traveling to and from the livermore area, 580 is not affected by this. the only impact for the road closure is this section of airway which is right when you get off of 580 eastbound. bob redell, "today in the bay." >> thank you for that report. breaking news to tell you about. surrounding a home in the east bay. here is a live look at the scene on o'toole way and o 'hatch drive. this all started with a large

police presence. we're working to find out if there is a barricaded suspect or if police are looking for someone. pete suratos will have a live report in the next half hour. 5:34 right now. opening arguments in the impeachment trial begin today after an extremely long day that actually didn't wrap up until early this morning. new rules were decided giving each side 24 hours over three days, not two, to present the case. republican senators shot down many of the amendments democrats proposed. senate majority leader marianne favro -- majority leader vowing to look this look like more like the clinton impeachment. most of the changes were handwritten. changes include accepting the house record of evidence and witnesses but democrats say they want more. >> a fair trial requires witnesses. in order to provide the truth, the whole truth and nothing but

the truth. >> this all supposedly started because of a whistle-blower. where is that whistle-blower? >> president trump is still in switzerland at the world economic forum under the new schedule trump's defense team will likely begin presenting the case on saturday. meantime, the trial is proving difficult for four democratic senators running for president. they're supposed to be in the iowa campaigning today because they're now jurors at the impeachment trial, all four will be on capitol hill today. new released video showing the moment an off-duty police officer shot and killed a man in a vallejo parking lot last november. video shows the -- what led up to an argument between eric reason and police sergeant this is virgil thomas who is pulling up to a spot in front of reason. reason returned to his van and pulled out a gun and after more arguing thomas fires. he fires more shots as reason runs off.

vallejo police released the video last night after completing an investigation. any charges would now be in the hands of solano county district attorney. and a south bay nonprofit is offering a $20,000 reward to track down the person who shot and killed a man early yesterday in palo alto in a parking lot. it happened about 3:00 a.m. on san antonio road. officers arrived to find an unidentified man in his 50s shot in the stomach. doctors could not save him. so far they have no motive or information about a possible suspect. well now to a big move when it comes to tenant rights in oakland. city leaders are behind a proposal to ban landlords from asking about criminal history. it would also ban tenants rejected due to criminal record. applying to public and private housing. if it it passed it would be the strictest of that type of law in california. city council passed the rule unanimously last night. a final vote is scheduled for february 4th.

berkeley city council is expected to vote on a similar measure next month. well a live look at the bay bridge and you could picture it when -- with a bus lane only. can you? well transit leaders can. and today may be the first step in making that a reality. today they plan to debate the idea and draft a resolution. b.a.r.t. leaders this week plan to debate the idea which has been done before in the early '60s but leaders soon pulled that plug. happening today, the b.a.r.t. general manager bob powers will be in contra costa to continue the listening tour he's been on. a live look this morning. powers is working to get feedback from riders and will be at the antioch b.a.r.t. station and later will stop at the pittsburg bay point station. 5:38 right now. our unit is taking a look at what happens on b.a.r.t. we spent months riding trains and recording what we saw. it is really interesting. watch the entire six-part series at your leisure on your desktop,

it is nice to be calm and cruise into the weekend. let's talk about the weekend. we're almost there. we're making it. and our weather will start to clear out. but we will start to see more clouds moving in by saturday. and the rain won't be far behind. so enjoy your day outside on saturday as our temperatures warm up. inland into the low 60s. the bay will reach 60 and the coast up to about 57. on sunday, that is when the showers will be falling off and on throughout the day. and we'll see our temperatures coming down a couple of degrees in a few spots but overall it will stay fairly mild. if you're planning to go out to the oakland a's fan fest on saturday at jack london square, expect a lot of clouds and temperatures in the low 50s. warming up into the upper 50s as we go into the afternoon. we're also celebrating the chinese new year and we're also have the festival happening at east ridge mall. that picture is one i took of my family there. we're going to see temperatures cooling down into the low 50s and rain moves in, later in the evening you wait to go and the

witnesses. at least for the immediate future. good morning, democrats want to talk to the men at the center of the ukrainian affair, bolton, mulvaney and more and republicans don't want witnesses at all. that is the state of the impeachment trial after the completion of the first day which went late into the night with arguments overrules including those witnesses. >> the house calls john bolton. the house calls mick mulvaney. let's get this trial started, shall we. we are ready to present our case. we are ready to call our witnesses. the question is will you let us. >> to issue a subpoena to john michael mick mulvaney and i ask it be red. >> the democrats want mulvaney because he as mitted there was a quid pro quo on television twice before reracketing it. they want to hear from bolton because he had been disgusted by the whole deal calling it a drug deal. and they ask why they didn't

upgrade for the sharks ice complex in the south bay. the east bay times is reporting that the city is looking ato ad two ice rinks and doubling the size. right now there are four rinks at the solar for america ice rink. the barracuda, the hhl affiliate will play 34 games there and now they play at the sap center. the city council will vote on the project next week. this may mess up plans but we could play super bowl liv stage today but the niners take on the chiefs. crews have been working hard to get hard rock stadium ready. the only thing left to do are the end zone designs. they have hosted five previous super bowls but they explain the massive renovation since the last game in 2010. >> it is so different from even the last time we were here with all of the additional amenities and unique spaces, the canopy and even the grounds are just

to dry out as our temperatures reach the upper 50s. that is a live look in san jose. and we do still have the clouds overhead. it is kind of a jacket and pants kind of day. so it is a starting out cool but will stay cool with our temperatures that will reach into the upper 50s and low 60s. up to 61 degrees in san jose. and expect in napa to reach 60 degrees. the seven-day forecast is already up at the bottom of the screen as we look at a clear storm ranger across the bay area. now that the rain has moved off toward the east, it is still raining over parts of the central valley and the sierra. just a heads up if you are traveling today but for us here we're look good. as we go through the forecast, there still is lingering showers and athat is going to keep it cloudy over the bay area for tomorrow as well as friday. even into saturday as some rain moves through parts of the north bay. but the rest of the bay area starts to see that rain coming in late on saturday. most of the day on saturday is looking good but as we get toward 9:00, 10:00, the rain

moves in and it is widespread throughout the day on sunday and even into monday. we're not going to see a significant storm here. it is looking at about a quarter to up to half an inch of rain. maybe higher in spots like ukiah, farther to the north where we'll see the rain lasting longer. as we go through the forecast, we'll see some showers returning for the weekend. once again late saturday night, off and on throughout the day on sunday and into early monday and temperature-wise they will hold steady in the low 60s, inland highs up to 63 degrees. mike, you have a new detail. on the one of the bridges you see the back-up out of richmond and that is the problem, west 580 across the richmond san rafael bridge and this blackup is causing slowing on our sensors. there is a fender-bender past highway 4 for west 80. not much of slowing just a note

5:57 now. and a follow up for you. berkeley leaders have approached a plan and approved it to develop a homeless camp on city-owned property, including up to 120 tenants. one site under consideration is on university avenue new second street. it may be months before a final location is found according to berkeley side the late-night vote was approved by all but two council members who did not vote. and happening today, governor gavin newsom will be in san francisco's new trans-bay terminal visited with other governors as part of a national infrastructure summit. leaders are all looking at upgrading roads, bridges, mass transit and other large projects.

uc regents is putting the brakes on the vote for a fee hike because they were not fully transparent about the proposal. the vote was to happen today but the state law requires them to discuss with a uc student association before making it public. that did, in fact, happen. but the student association said they never talked about tuition hikes over five straight years. regents have now removed the proposal from the agenda but it is likely to return sooner than later. a stolen van that is used to transport bikes to schools to teach kids how to ride. howard cato said his van was stolen on monday night. the 2002 ford econo van was parked at 35th and kansas street and for the past five years the van has been crucial to reach out to kids in need throughout the bay area. >> in order for me to bring
