and it looks a little damp but we'll see our temperatures in the 50s. and a little bit more of the peeks of sunshine today. mike, you're tracking that police activity in livermore. >> i am. in fact we have a live look out here at airway boulevard, bob redell is following this and an arrest has been made and we hear it is an officer-involved shooting, the latest into the newsroom. in livermore off of 580. this is the reason why airway off-ramp has been closed and remains closed. he has a live report coming up. i want to show you the rest of the commute. that is a surface street and you'll use el charo and loop back. most of the freeways moving smoothly. a new crash around highway 4 causing more slowing and the bay bridge toll plaza has the lights on but we'll talk about the south bay coming up. breaking news in contra costa county where deputies are surrounding a neighborhood and in san pablo for hours. >> pete suratos has been live at

the scene for us trying to get some updates. still pretty active out there, pete? >> reporter: yeah, definitely. still an active scene in san pablo at o 'hatch and o'toole drive. contra costa sheriffs were still on the scene. we saw them bring plastic bags into the vehicle you see there. i'm not sure exactly how that is connected to what is going on but you could still see some very active scene. we'll show our viewers the video from this morning. the s.w.a.t. officers were here on the scene and now we were told that that activity is on o'toole way so that is just up the block there at a home in that area. and we're still working to get information if they're looking for a suspect. this is a barricade situation if anyone is hurt at this point we don't have that information. i did give a call to dispatch and they couldn't provide us with much information. but with we know this started overnight. back out here live to the scene,

you see a sheriffs deputies there. they did bring some plastic bags into that incident command vehicle that you see there. obviously a big scene if you have these vehicles out here. of course we'll continue to monitor things and give you an updates as they come in. reporting live, pete suratos, for "today in the bay." >> pete, thank you. well developing on capitol hill, a historic day ahead as senate impeachment arguments begin later this morning. the senate went late into the night last night in a marathon 13-hour session. hammering out the rules for the trial. "today in the bay's" tracie potts explain what is next in the phase of the trial and what it would look like for us. tracie. >> reporter: hi, marcus. good morning, everyone. the rule that they stayed up late to set and also some of the ideas from democrats that were rejected, they wanted to bring in more witness and more evidence. that is not happening right now. but the trial gets underway in earnest today which democrats

from china. the center of the outbreak. we have new video to show you of people in china. they've been buying a lot of masks there. many have canceled travel plans for the chinese new year. the cdc said it is now screening passengers for the virus at two more airports, atlanta and chicago. screenings are already taking place in san francisco, l.a. and new york. happening today, the fate of a cash-strapped south bay school district may come into a little more focus. advisers will recommend two schools be closed in the evergreen school district. a public input session is scheduled for today. it is still possible a third school could be on the chopping block. the district is facing lower enrollment numbers. a final decision is not expected before next month. well campbell leaders go into a late-night decision about the fate of a proposed chick-fil-a restaurant. "today in the bay's" kris sanchez is live from the

location. and kris, is it fries and nuggets or peace and quiet in the neighborhood? >> reporter: double that order of peace and quiet. the neighbors here in this neighborhood got the city council to shut down the idea of a drive-thru here at this location. if you're familiar with campbell, this is where the denny's is on south bascom avenue not too far from the prune yard. they were proprosing a restaurant here at south bascom and east campbell but opponents said it would draw 2,000 cars a day so some foodies will be left wanting. >> we're going to have serious issues with parking, serious issues with traffic and serious issues with pedestrian bike safety. >> i wouldn't mind having a chick-fil-a here. i think they need a little bit more eatery options. >> reporter: so at this other location on your screen about a mile away, vocal residents with concerns offer traffic and noise shut down an in-n-out between

highway 17 and winchester and many that case restaurant representatives also lost an appeal. we have yet to see whether whether or not there is a decision on this chick-fil-a on south bascom and the vote came with the approval of the planning commission, usually the planning commission said yes and the council says yes. so this is a break. kris sanchez, "today in the bay.." >> something we'll be looking to. and 6:08, become-goers beware for sneaker waves. dangerous waves and rip curbs are expected to last until 9:00 this morning. never turn your back on the ocean. because they could sneak up on you and take you under. and that is the case this time of the year. any time that we have storms rolling through, turns up the waters and then we have the sneaker waves and never turn

your back to the water. here is a live look outside in san francisco. it is still raining lightly and the roads are still wet but the rain is moving out. you don't need the umbrella if you're about to head out of the door. we'll see a mix of sun and clouds today. temperatures in the lower 50s leading into mid-50s by early this afternoon. and the city we're reaching 57. san jose up to 61. a little bit more sunshine compared to yesterday. but don't expect it to be sunny all day. we'll talk about what is ahead in the forecast coming up in a few minutes. and mike now you're tracking a crash in hayward. i am. and that is the only issue and i would say the only one on the map. i want to mention the south bay. 87 moves smoothly and so does 280 and 101. we typically see much more traffic at this time, 6:09 in the morning. so a good start. watch the slick roadways as well. hayward slowing out of san leandro and toward industrial.

bezos. you remember he had his phone hacked, "the national enquirer" threatened to publish embarrassing pictures and details of an affair. the guardian said the crown prince mohammed bin salman may have been directly involved. the newspaper reports mbs as he's known is video chatting with bezos when the pile was sent and after that chat bezos's phone up loaded gigabytes of data to somewhere. the saudi government called this allegation absurd. our intelligence agency said he was also behind the murder of a washington post writer. and we know mbs regularly talked to jared kushner in the white house and we know kushner uses what's app. kushner has a close relationship from mbs. in fact a disturbing number of american officials use what's app to conduct official government business and we know that because we've seen the text

forr for instance we learned it was discussed the trump team via what's app. it could clearly be hacked is a concern and secondly is we shouldn't be using private apps to conduct government business. both for archival reasons. >> so many people use it but when you think of government officials -- >> no. >> thank you very much. so many people love to go out to eat. >> yeah, they do. and another change on your bill. if you dine out in san francisco, it is going to a green cause. 1% surcharge will fund a new program called restore california. so what they will do it let you help farmers build healthy soil and pay for other green initiatives. people can opt out of the charge but environmentalists hope that diners will say yes. that program is expected to

more clouds rolling if and peeks of sun today but the rain is moving out. notice as we take a look at the live view, some of the streets are stitt we-- are still wet. as you are heading to school, our temperatures will be in the lower 50s. we'll start out with a lot of clouds but then as we go into the rest of the day, the sun starts to peek out and it will be a little bit warmer than yesterday. the seven-day forecast is already up at the bottom of the screen. as we check out our high temperatures for today. so in oakland, we're reaching 60 degrees. also 60 in livermore. and upper 50s in parts of the north bay like clear lake, up to 57. santa rosa reaching 59 degrees. so here is what is coming our way, a lot of clouds and even some rain farther to the north but most of us will be missing out on that rain. as we head into saturday, we'll start to see more showers coming back in. but it looks like it holes off for most of us until late saturday night. throughout the day on sunday,

off-and-on showers. so just be prepared that it is going to be quite soggy going through the end of the weekend. our rainfall totals will be from about a quarter to half an inch of rain and then as you head up farther to the north, it will be over an inch of rain. so a little bit more of a soaker there. for us, the next few days will dry out and get out. every now and then get sunshine. highs in the lower 60s. and then once again more clouds on saturday as that rain arrives late in the evening and then scattered showers throughout the day on sunday. mike, is it looking in hayward. we're going to show you the view from hayward. heading across the san mateo bridge. we'll show you westbound, tapping the breaks along the plat section. i thought there might be a crash. but the rush across san mateo and this might be added, the volume might be because of the crash that was here in hayward at industrial. just got word from chp that the debris has cleared and that means more traffic in union city

said brown and his trainer attacked him. officers took brown's trainer into custody. but they couldn't locate brown. the raiders and patriots drop brown this year after he left the pittsburgh steelers. new details about the 3-year-old boy attacked by a mountain lion we told you about yesterday. that boy is now recovering at his home with his family. that attack happened on monday in southern california while the family was on a hike. after the mountain lion grabbed the boy, the father quickly threw a backpack which made the cat drop the boy, grabbing that backpack and climbing into a tree. you could see right here. the deputies later euthanized the animal. new video shows a coast guard crew rescuing a woman from a cruise ship off the coast of the san diego. take a look. the helicopter was hovering above the grand princess cruise ship and hoisted the 28-year-old woman from the deck of the ship. she was suffering complications

i'm laura garcia. >> and i'm marcus washington. right now we want to check the forecast for you. kari hall has been tracking what we could expect. and looking nice out there today. no rain. >> the roads are still wet. it is still soggy. but the rain has moved out. and we're going to get a chance to dry out today with our high temperatures in the upper 50s. the next few days are looking dry but then rain will be back on saturday. continuing off and on on sunday. for san francisco expect upper 50s today and a little bit more in the ray of peeks of sunshine. we'll focus on the weekend and that forecast along with with some events going on coming up in about seven minutes. mike, you say one bridge is moving better. and everything else is seeing a slower. richmond sord san rafael that is moving smoothly and a little recovery in fak. the crash on the shoulder for west 80 on the hercules area and

concord and pleasant hill. the rest of the bay showing a nice build. typical pattern and not so bad for a typical wednesday. this looks average for this shot but remember over here in the tri-valley we have the airway boulevard exit closed off of eastbound 580. the freeway itself is open. el charo is your option and we'll tell you about that breaking news. >> there is still a lot of police activity in the east bay, at one point they had shut down a major freeway. >> bob redell first on the scene in livermore and we know more now, bob. >> reporter: livermore police have tweeted out this was an offer involved shooting. the public information officer is supposed to be here at any moment and we hope to get any information when they arrive. this is airway at kitty hawk and it is shut down and the off-ramp

is shut down and to just before the golf course and the airport. i direct your attention, there is a white vehicle and then in front of that where you can't see there is another vehicle. those are the two vehicles that were involved. we know that two men have been taken into custody. i want to show you video from the 4:00 hour. a man in the second vehicle, he didn't -- won't surrender initially. i could hear police issuing commands but he did finally come up and you could see with his hands up and limping toward the armors vehicle where police were awaiting and they also had a k-9 on stand by in case he didn't comply but again he was limping slowly and did make it to police and they went over to his car with a k-9 and if you could see the red lights hovering over the car, that was a drone, a drone hovering over the vehicle to see what else was inside but they did clear the vehicle and deemed the scene safe. within the past hour this is other video. another man being taken out of

one of the squad cars in handcuffs and we believe he's been taken away from the scene. we don't know if he's taken to the police station or booked into santa rita. the relationship between the two men is unclear and that is why we're waiting for the public information officer to come out here. again, this is an officer-involved shooting that did result in the shut down of eastbound 580 and this initially was all lanes at airway boulevard but then chp pushed that shut down to el charo in front of the san francisco premium outlets but all lanes of 580 have since been reopened so this is not impacting traffic on your commute. westbound or eastbound on 580 but the off-ramps to airway is shut down here at kitty hawk and the section of airway boulevard by the starbucks, a landmark that people are familiar with off the freeway. this section is shut down. as livermore police continues their investigation. two men many custody,

officer-involved shooting. reporting live in livermore, bob redell, "today in the bay." >> thank you. more breaking news to tell you about. police surrounding a home in the east bay. here is a live look at the scene on o'toole way and o 'hatch drive. it started around 9:00 p.m. where a swat team an a large police presence is still present. now we are working to find out if there is a barricaded suspect or if police are looking for someone. our pete suratos is at the scene and we'll have any updates for you as soon as we get them. and newly released video showing the moments an off-duty police officer shot and killed a man in a vallejo parking lot. this happened last november. video shows the lead up to the argument between eric reason and a police sergeant virgil thomas who appears to put in front of a spot in return and he returns to his van and appears to pull out a gun and then after more arguing thomas fires. he fires more shots at reason as he runs off.

vallejo police released this video last night after completing an investigation. any charges would now be in the hands of solano county district attorney. a $20,000 reward to track the person who shot and killed a man early yesterday in a palo alto parking lot. happened at about 3:00 a.m. on san antonio road. officers arrived to find an unidentified man in his 50s shot in the stomach. police say doctors couldn't save him. so far they have no motive or information about a possible suspect. now to a big move when it comes to tenant rights in oakland. a proposal would ban landlords from asking about criminal history. and also ban tenant being rejected due to criminal record. it would apply to public and private housing. if the new limitations pass it would be the strictest of that type of law in california. city council passed the rule unanimously last night.

a final vote is scheduled for february 4th. berkeley city council is expected to vote on a similar measure next month. in the meantime, tens of thousands of renters in san francisco have more rights. starting this week, people living in all buildings regardless of when they were built cannot be evicted without cause. the board of supervisors unanimously approving that rule last month. well live look at the bay bridge and toll plaza. and you could see pictures -- can you picture this, though. a bus-lane only there. transit leaders can and today may be the first step in making that a reality. later today a.c. transit directors plan to debate the idea and perhaps draft a resolution. b.a.r.t. plans to debate the idea which has bon before in the early 1960s but leaders soon pulled the plug. let's check that morning commute with mike. it looks like mass transit going okay. >> mostly okay. but a delay for b.a.r.t. we continue to track this. talked about it half an hour ago

and it maintains a 10 minute delay with an equipment problem and there might have been a fire on the tracks. at least smoke and they are single tracking through the area but since it is a short section we're holding at 10 minutes for the delay only affecting the stretch on the peninsula. everything else is moving fine but we continue to track all of your transit agencies and follow the roadways. slowing at 680 but walnut creek has an easy drive and more slowing through lafayette. and same thing for hayward. out of san leandro more slowing and maybe a burst of traffic so that should trickle down toward hayward and union city and across the san mateo bridge as well off of 880 west 92 build toward 101. >> building up to the weekend. here we come. wednesday and leading into friday. >> before you make those plans, we'll have some rain coming in. and it is not for the whole weekend. saturday is looking like the

best day. and we'll see more clouds moving in, temperatures actually quite mile reaching the low 60s. up to 63 inland. bay up to about 60 degrees. and a high along the coast at about 57 degrees. now sunday is when we'll see a lot of clouds off-and-on rain and the coastal areas in the mid-50s, upper 50s for the bay. up to about 62 for the inland valley. so if you're planning to head out to the oakland a's fan fest, the weather is still holding up for that. we'll see cloudy skies, temperatures in the low 50s. if you're out there in jack london square we're only going to see temperatures reaching the upper 50s. and every now and then the sun may peek out. we're also celebrating the lunar new year so i took this picture a couple of years ago at the east ridge mall. this is happening throughout the weekend. on saturday, later in the day you wait, the higher the rain chances. but we're going to see the rain starting to move in late saturday night. if you're going to the sierra this weekend, we have good

prepare for that before the sun has a chance to dry things out. we're following the slowdowns out there and talk about the changes for the upper east shore freeway. the impeachment of donald trump will go forward without witnesses. at least for the immediate future. good morning, democrats want to talk to the men at the center of the affair. bolton, mulvaney and more. but republicans don't want witnesses at all. that is the state of the impeachment trial after the completion of the first day which went late into the night. with arguments overrules, including those witnesses. >> the house calls john bolton, the house calls mick mulvaney, let's get this trial started, shall we. we are ready to present our case. we are ready to call our witnesses. the question is will you let us. >> to issue a subpoena to john michael mick mulvaney and i ask that it be read. >> the democracies want mulvaney

because he admitted there was a quid pro quo twice on television before retracting that. they want to hear from bolton because he had been disgusted by the whole deal calling it a drug deal. republicans blocking that and asking why the democrats didn't call bolton and mulvaney during the impeachment inquiry. but the president had blocked them from testifying. as you know, san jose congresswoman zoe lofgren is one of the impeachment managers, the prosecution. this is her third impeachment if you count nixon, she was involved in the '70s but this is the first time a woman has act as an impeachment manager in american history. chief justice john roberts is the judge in the case and after the two sides started bickering, roberts told them to knock it off. >> remember that they are addressing the world's greatest deliberative body, one reason it has earned that title is because

but overall we're going to have a nice day. now as you step out of the door, we have some upper 40s once again in the north bay. while in the east bay danville we're at 50 degrees. as you head to school, still maybe jumping over puddles during the walk to school. bup the day is going to fairly dry. even more sunshine but as the kids head out for recess, they still want to wear a nice warm jacket. upper 50s for late morning. i love this shot looking live in san jose. just a lot of clouds, still rolling over the south bay. we'll have a jacket and pants kind of day and you'll probably want to wear it all day. even though storm ranger giving us a clean sweep showing that the rain has moved out. well a lot of that has moved toward the east so if you are traveling toward the central valley toward the sierra, still lingering rain but our skies mostly cloudy and a dry day. still showers to the north of us. over the next couple of days, it

will keep it cloudy for the rest of the bay area. and then that rain starts to spread into much of the bay going into late saturday. so it looks like it holes off for most of the day on saturday. but then by sunday, well, this is when we'll see some soggy conditions throughout the day, off-and-on rain and then not clearing out until late sunday night. our rain totals, some of the monthels showi monthel -- some of the models showing a quarter to half an inch of rain for the north bay and higher for spots like ukiah and farther to the north. but our seven-day forecast gives us a chance to dry out for today and tomorrow as well as friday and maybe more sunshine by the end of the week. but then more clouds on saturday. rain moving in lane. scattered showers on sunday and that may linger into monday and we could still have rain around the area. mike you still have a wet commute for some. you could see that on the camera. like the san mateo bridge. that mist that kicks up and it

is in the air as well. the note here, even though traffic is slower, you see that mist in the area. and where it is moving more quickly, you have the water kicking up behind the cars and the tread sprays the car behind them so a couple of areas where you'll have that. the golden gate bridge, we saw the sheen on the roadway. the shot we had here at the toll plaza and then across toward the foster city side no problem. slowing over the san mateo as well. we talk about every 15 minutes you wait, another 5 minutes gets tacked on the commute. that is according to partners at waze. and tack on more time for the dumbarton bridge. but eastbound 580 and the officer-involved shooting where bob redell is at the scene. the rest of the bay shows a smooth drive and the south bay now kicking in. back to you. >> thanks, mike. it is 6:51. happening now. conversion therapy is banned in utah.

in the morning. he was limping. police haven't confirmed if officers injured anyone when they fired. police also say that no officers were hurt. we know another man was taken away in handcuffs but it is still not clear if the the two men are connected. well breaking news to tell you about. a large police presence in the east bay. here is a live look at the neighborhood now surrounded by alameda county deputies. this is at o'toole and o 'hatch drive, it started around 9:00 p.m. and they are not saying who or what they're looking for. new details in a cold case that once made national headlines after more than two decades, there may soon be more answers. case involved the disappearance of kristin smart, a calpoly student last scene in 1996. she grew up in the central valley. this week our sacramento affiliate was told by the faulk the investigation has taken a

major turn that can't be revealed yet. the news came from the fbi. but when the fbi was contacted they indicated sheriffs are handling the case. a california judge giving the green light to allow all sexual assault claims recently filed by lyft riders to be consolidated into one lawsuit. dozens of women from across the country have recently sued lift saying that they were sexually attacked by drivers. and they claim that the ride-sharing company failed to take any steps to protect them. if attorneys follow the ruling, the case may be heard in san francisco where lyft is head quartered. a rereport showed 18 drivers were accused and more than 100 uber drivers were accused. they have been working to make safety changes. and a live look at campbell where last night city council members hit the brakes on a chill filla drive-thru where a denny's now sits. she want it at the corner of
