2020. >> announcer: from nbc news, this is "today" with savannah guthrie and hoda kotb, live from studio 1a in rockefeller plaza. >> hi, good morning, welcome to "today" on a wednesday morning. good to have you with us and if you're watching the impeachment trial, it was a late night for you. if not we'll tell you what happened overnight. just before 2:00 a.m., the first day ended. senators finally approving the rules for the trial and the vote went straight down party lines. >> the marathon opening session lasted nearly 13 hours and saw 11 democratic proposed amendments to subpoena new documents and testimony, despeetdespeet defeated by republicans. >> well, all of that sets the stage for opening arguments from house prosecutors. that's supposed to start this afternoon. we have complete coverage of what happened overnight and what we expect to happen today. we'll start with nbc's peter alexander. good morning. >> reporter: hey, savannah, good morning to you.

if last night was any guide, this is going to be a bitter partisan trial. literally ending just a matter of hours ago. ending at 2:00 in the morning. chief justice roberts saying there was a lack of decorum. for now, the rules are set. republicans largely approving the rules on their terms, blocking democrats' efforts to take the subpoena of witnesses and new testimony, decisions that will be made later. the president addressing it all this morning from overseas, as we prepare for opening arguments to begin with the house democratic prosecutors. overis see oversees at the economic forum in davos, switzerland, the president brushed off what was happening at home. >> it's a total hoax and i have a great respect for the senate as a body. >> the ayes are 53, the nays are 47. the resolution is agreed to. >> reporter: those comments come after hours of contentious

debate, tempers flaring after midnight. >> i'm struck by what we have heard from the president's counsel so far tonight. they complain about process, but they don't contest the serious allegations against the president, and they lie. and lie and lie and lie. >> he's been making false allegations against the president. the only one who should be embarrassed, mr. nadler, is you. >> reporter: chief justice john roberts scolding both sides. >> i think it is appropriate at this point for me to admonish both the house managers and the president's counsel in equal terms to remember that they are addressing the world's greatest deliberative body. >> reporter: at that point, lawmakers were grappling with the trial's ground rules, voting along party lines. the republican controlled senate rejected the calls to allow the subpoena of additional witnesses and new documents. after both sides make their arguments, the issues may come

up for another vote. still under pressure from at least one moderate republican, senate majority leader mitch mcconnell made some last minute handwritten changes allowing each side three days for opening statements instead of two. >> the senate will convene as a court of impeachment. >> reporter: with all 100 senators serving as jurors required to watch in silence. >> all persons are commanded to keep silent on pain of imprisonment. >> reporter: adam schiff said that the president violated oath of office by pressure iing ukra, and while withholding nearly $400 million in military aid, all for his personal political benefit. >> does the commission of the high crimes and misdemeanors require the conviction and removal of the president? we believe that it does. >> reporter: on the charge of obstructing congress, democrats arguing president trump did not stonewall lawmakers to protect the presidency.

he did it, they say, to protect himself. >> president trump's complete and total obstruction makes richard nixon look like a choir boy. >> reporter: the president's lawyers, who were not a part of the house hearings, for the first time, making their case at the capitol. attacking the impeachment process as illegitimate. >> believe me, what has taken place in these proceedings is not to be confused with due process. >> so we could be in for another long one today. walk us through what you expect to happen next. >> reporter: on tap today, the opening arguments scheduled to begin at 1:00 eastern, with the house democratic prosecutors. remember, they get 24 hours to make their case, to be spread out over three dais. however they choose to use that time. the president's defenders will begin making their case this saturday with up to three days and 24 hours of their own. the president saying he'll be watching it. savannah? >> peter alexander leading us off. kasie hunt watched every moment of the trial's opening day and

night and morning. kasie, good morning. i know it was a late one. >> reporter: around the clock indeed, savannah. you know, we can take you inside the chamber to a certain extent. there are rules that prevent photographers from coming into the chambers. to show you behind the scenes moments, we have to turn to sketches from artists who captured some of the moments i was able the see from sitting in the gallery. we caught a couple senators falling asleep notably senator risch of idaho was napping. this is, of course, a very late night for them. mitt romney one of the moderates we're watching taking very careful notes throughout. but some of the president's allies like lindsey graham seemed to get back in the chairs, looked a little bored. there's also the day to day life of trying to get through this i while you are on camera on the senate floor some senators wearing apple watches on the floor there's technically a ban on electronics.

we talked about how they have to put their phones in cubbies. there may be a way around it there was a candy desk no food is technically allowed on the senate floor. but there is one desk, pat toomey of pennsylvania stocks candy if there are people ca eat if they get too tired. also, we didn't spot any glasses of milk on the senate floor, but that's the only drink that is allowed. aside from water it's a quirk of the senate rules. of course, all of this sort of -- all these atmospherics really underscoring the serious moment in time, the fact that they have to be here and we're really watching for these witnesses, this witness vote, kind of big picture. we saw some surprises yesterday and my sources on both sides of the aisle are telling me we could see surprises in the future around the major question of whether we'll hear from people like john bolton. >> long one, and it is just beginning. kasie, thank you so much we'll have the latest from the capitol throughout the morning and nbc news will live coverage

entitled to, you know, her point of view. with my focus, it is on -- it's on outside of the impeachment trial, doing everything i can to defeat the most dangerous president in modern american history. >> reporter: last year, clinton raised eyebrows when asked if she'd consider running again. saying this to bbc radio >> i, as i say, never, never say never. i will certainly tell you i'm under enormous pressure from many, many people to think about it. >> reporter: still a 2020 bid was not in her plans for his part, sanders is trying to turn the page on clinton's latest comments. >> what do you think the secretary is still talking about in 2016? >> that's a good question. ask her. thanks very much, guys >> okay. >> so there was some criticism as well from some sanders supporters because it seems like she was hedging about whether she would support bernie sanders if he were the 2020 democratic nominee. >> right well, initially, she said that she would not go there so she was kind of hedging leaving it out there and then 12 hours later, she did tweet the number one priority for our country and our world is

retiring trump. as i always have, i will do whatever i can to support our nominee. >> so she said i won't go there yet, not going to endorse anyone yet >> exactly that's raising questions and fears among some democrats are we going to see the democratic party tearing each other apart again and will this only help donald trump >> what's behind this? i mean, just out of curiosity. >> it's hard to say. whenever she's asked a question she seems to feel now that she can be out there and be very honest about it. but this is a political campaign and she's such a major figure it could potentially overshadow the current contenders >> and the documentary was shot i presume months ago, but just coming out now, on the eve of caucuses andrea, thank you. meantime, the cdc is expanding airport screenings for that mystery virus outbreak that started in china this after the first confirmed case here in the united states and overnight china's officials said they're seeing more cases there as the death toll rises to at least nine.

nbc national correspondent miguel almaguer joining us this morning from the airport in seattle. >> reporter: hoda, good morning. this is where the first american case, the passenger exposed through here, perhaps exposing others after arriving from wuhan, china when he got to the u.s., there were no additional screenings at this airport now, it's all changing the male victim in his 30s is in good condition still hospitalized here at providence regional medical center outside seattle health officials say he's being treated for pneumonia like symptoms in isolation after traveling through busy sea-tac airport. the first confirmed american case of the contagious coronavirus. >> i'm definitely concerned about how this virus is spread we need to ask this gentleman a lot more questions to fully understand where he was and who he had contact with when he was in china. >> reporter: when the victim arrived in seattle the infected

american wasn't showing any symptoms and was never screened for the virus, but this morning a change all planes and passengers coming from wuhan now have to land at one of five major u.s. airports. los angeles, chicago, atlanta, san francisco or new york. where heightened screening will be in place. cdc says the extra layer of screening should help. >> right now we think it's very safe for people to fly we have no reason for concern right now about americans traveling abroad. >> reporter: in china, authorities say they're committed to containing the outbreak with emergency measures already under way. including screening on airplanes, at train stations and on city streets. our janis mackey frayer is in wuhan. >> this is a busy city of 11 million people so crowds are a fact of life and people are worried so they're wearing masks and taking whatever precautions they can to stay safe >> reporter: the virus is capable of spreading person to

nbc's stephanie gosk has the latest on it good morning. >> good morning, the jury is set and the trial against harvey weinstein begins in earnest today. the prosecution and defense making their opening statements. it's the first opportunity jurors have to get a sense of everyone side's case and the trial, they could put the infamous movie producer behind bars for life >> reporter: after a career winning over hundreds of millions of moviegoers around the world, harvey weinstein's fate now lies in the hands of seven men and five women in new york city. >> good morning. >> reporter: he pleaded not guilty to multiple charges including rape, stemming from the allegations of two women his defense team telling the judge on tuesday that they have dozens and dozens of emails showing the two women were involved in a consensual relationship with the movie mogul. >> harvey weinstein's defense attorneys will be arguing that harvey weinstein is the victim, that all of these women who have

accused him of sexual misconduct consented to those sexual encounters to try to advance their careers. >> reporter: while prosecutors will set out to prove a pattern of sexual assault including from the two women who pressed charges, along with four others' testimony. a rape allegation by annabella sciorra is too old to prosecute. but she is expected to take the stand to help distinguish the serious of the charges, predatory sexual assault the trial is expected to last weeks. already there have been demonstrations by some of weinstein's accusers. >> i stand in solidarity with the brave survivors who will take the stand against harvey weinstein in this trial. >> reporter: and a flash mob organized by a feminist group. the 67-year-old has faced scrutiny for using a walker to help get to and from work after he was injured in an august car

columbia a new country but they say they're still being hounded by the paparazzi. something that's been at a fever pitch since their wedding. now they're threatening legal action as the smiling prince harry steps into his new life in canada, this morning he also has a stern new warning for the paparazzi. after these photos were snapped of his wife meghan walking with his son and dogs on a park in vancouver island he sent a letter to media, threatening legal action, saying the paparazzi made multiple attempts to snap the royals inside their 11,000 square foot mansion here using long range lenses the couple's every movement tracked by paparazzi permanently camped outside the home. their attorneys call these tactics serious safety concerns and a risk to life harry's disdain for the paparazzi began with his mother diana.

the princess famously pursued until the fatal crash. he spoke about it to i-tv. >> every time i see a click or a flash it takes me back. >> reporter: after her death, the uk passed stricter regulations, banning press from pursuing or harassing the royals british royals avoided publishing official photos of harry and william as children. harry blamed the media for his decision to step back as a senior royal. >> when i lost my mom 23 years ago you took me under your wing. you looked out for me for so long, but the media is a powerful force. >> reporter: now meghan's estranged father is criticizing the couple's decision to leave royal life, speaking out in a new documentary. >> they're turning it into a walmart with a crown right now it's ridiculous. they shouldn't be doing this. >> reporter: harry and meghan who came here for a life out of the royal spotlight are facing

just as much media glare as ever and a news conference tuesday, canada's prime minister justin trudeau said there's no agreement with the uk on who is covering costs for the couple's security detail. canadian officials say, so far, they're not providing any security for harry and meghan. back to you guys >> all right, joe, thank you we are joined now by royal commentator victoria arbiter good morning you always answer our burning questions. i think it's interesting because obviously the press is one of the reasons that meghan and harry decided to leave the uk. but i mean, there is a very healthy paparazzi industry around the globe surely, they knew that, look a how celebrities in los angeles or various places get followed do you think they didn't anticipate this? >> i think they definitely expected it but perhaps they were naive in thinking how voracious the appetite would be. harry and meghan have been victims of a negative press. that was a huge part of their

decision to leave. they haven't dealt with the paparazzi on this level. because in england, post diana, very strict rules were put into place in an effort to control the paparazzi. there's been an agreement between the palace and the paparazzi that private life is off limits of course some of the pictures slipped through but they haven't had people camping outside their house. they have had the odd run-in in central london but no people hiding in bushes or stalking them in the car. >> so the answer is a strongly worded letter, basically saying, please stay away from us well, isn't the press sort of allowed to take pictures if you're out in public how much is that letter going to deter the photographers and stuff? >> well, it will deter perhaps the british newspapers because that's the only jurisdiction harry and meghan have at this point. how do you begin to regulate potentially foreign photographers selling pictures to a foreign press you can't regulate the whole world, nor members of the public with a camera phone. that'll be the other issue i think this letter was sent because it's harry's warning shot

just reminding everybody if you cross this line i will come after you. because for harry -- this is why people have missed this little bit. harry doesn't distinguish. there isn't legitimate media, legitimate photographers, paparazzi photographers. it is all the same thing, and all is toxic to him. >> what is it about this particular photo, these particular photos, that triggered the fact of legal action >> the fact that archie is in there. this would have immediately reminded harry of his childhood. because anyone who was around witnessing diana saw the scrum of photographers that was constantly chasing her harry witnessed that, as well. the minute his wife and child are in the fray, he's going to be like a papa bear with a sore head >> what? >> papa bear with what >> angry. >> sore head >> oh, i thought it was an englishism i like that, that's why you're here

tv's dr. oz who is cited for his work in the cbd industry said he is denying the endorsement, writing in part, this is a fake and misleading advertisement intended to take advantage of consumers. the ads are part of a billion dollar fraud industry according to the better business bureau. in november, sandra bullock fought back aggressively against mul multiple false ads for beauty products, along with ellen degeneres, filin a lawsuit along with ellen stating con artists are exploiting their images to attract and dupe unwhitting customers. savannah dealt with it last year. >> when i saw the articles i could understand why people believed it because it looks real. >> reporter: according to the better business bureau the companies often have no available contact info and if they are caught by authorities simply switch names like the two different companies in the tom hanks scam making it challenging for authorities to shut them down for good. >> there's a whole army of people who are difficult to find that are using changing sets of

but the newer versions are being sold at fast food places and millennials love them but the generational split is shrinking. people are saying i don't want to eat cardboard, but i can do this. it can taste good by itself. >> it's not like it's low fat or something, right >> no. it's not low fat it's a lot of ingredients. and there's no fiber in meat so it has that benefit because you have fiber but net-net, i don't think you should consider it a healthy food but the average person in america is 2 1/2 burgers a day >> no way. >> that's what it comes out to do half as vegetarian versions half as regular. >> there's a good compromise. >> we have the chicken - >> it's not chicken, it has a face. >> no chicken here chicken strips, patties, nuggets. >> what is if it's not chicken what are they sticking in there? >> they use different kind of protein, like soy protein. they can make it taste like regular chicken because it's healthy for you. it's what you put on them.

this morning on "today's" consumer, the value of unpaid work things like cooking, cleaning, things like child care, according to a new report by ox fan women in the united states typically spend two hours more per day than men doing the tasks and they ran the numbers to show

what it adds up to here to break it down for us, nbc's senior business correspondent stieephanie ruhle. so i think a lot of folks probably weren't surprised by the findings i think folks would be surprised by the extent to which women are outworking men in the house. >> well, just think about it historically, culturally, women are the moms, we're the care givers, we're the homemakers that's something we're proud of, being the heart and soul of the family but we also end up being the labor force. the unpaid labor force and one of the other reasons is economics. even today, though we have made great strides economically, historically, business wise, educational wise we haven't had the same opportunities that men have even in 2020 we're making 79 cents to the man's dollar so when a family has more and more responsibilities at home, the decision becomes pretty easy the person who earns less goes home when you're that person who takes on unlimited work at home, you can end up lonely, depressed. you don't get to put yourself

first and that burnout is real. >> for the first time in a long time, as i understand it, women make up the majority of the workforce in this country as well, right? >> well, that's the thing. we make up the majority of the workforce, but we're still doing the work at home think about this two 2.1 hours more a day than men. we go to work and then we go home and work. so put this into perspective you and i both have careers. every day we show up to a running race but i have to run two more miles than you do to beat you. but nobody ever acknowledges those two miles. that matters because those two miles impact things especially as you look at higher earning jobs. the corporate ladder was designed with this idea that all you have to do is be an executive and succeed and there was this other person in your life to do everything else a spouse, maybe a grandparent. remember yesterday carson was talking about going to his grandmother's house every day after school now less and less people live close to their parents, so there's no grandparent factor and the last one if you're not going to either of those routes

you're going to pay someone to do that work at home you know what that is, super expensive. >> i know. yesterday, you talked about stay-at-home moms and this is something that affects them disproportionately. >> this is hugely important. you've got to acknowledge the work that they do. while it is an honor especially long term to get that time at home, the work those mothers have to do is endless. and i want you to factor in many women who stay at home choose to but a lot don't. many jobs don't offer you the opportunity. once you have kids, tell me how many jobs can you find that coincide with a school schedule, family emergencies if you have to be the primary person to tend to your family at home, it limits what you do. my grandmother always said to me, think about who your boss is don't share your bed with the same person you're getting your paycheck from. marriage is hard enough. it really complicates things so you are giving up your financial freedom when you have a person who stays at home.

>> so it's a significant problem. we just put graphics on the screen there that i think drive the point home it's a significant problem what are the solutions, what can we do that we're not doing to fix this >> that unpaid work adds up to $1.4 trillion we are not getting paid for and twice the defense budget it's not an overnight solve but ox fan actually said paid jobs can help the unpaid work more companies that are offering paid benefits. sick leave, medical leave and maternity leave, paternity leave. companies that are addressing the gender pay gaps, starbucks is the most recent example 100% gender pay parody the end of last year when that flattens out, it takes the social and the economic pressure out of the mix. >> i read some article about a guy who was paying his wife for work around the house. >> he was. he was. >> to take care of the kids. that seems like it might be a bit extreme. >> listen for some families who can afford to, maybe that spouse can say i'm going to pay you to do that work at home >> yeah.
