final vote expected to acquit the president on those two articles of impeachment wednesday just hours after president trump is scheduled to deliver his "state of the union" address. we have it all covered this morning, and we are going to begin with our colleague right now, nbc's jeff bennett. he is on capitol hill. jeff, good morning. >> reporter: peter, good morning. the senate has set the stage for the final push toward the senate impeachment trial for president trump with an acquittal set for mid next week. this morning president trump's impeachment trial entering its final stages. senators overnight agreeing to proceed with a plan to vote to acquit mr. trump next week. the lawmakers have this weekend off. a chance for the four democratic presidential candidates who have been stuck in washington to get back on the trail ahead of the iowa caucuses. on monday the house managers and the president's defense team present closing arguments. that's followed by speeches from the senators themselves. all of it leading up to a final vote on the articles of

impeachment scheduled for wednesday at 4:00 p.m. eastern, a day after president trump is due to deliver his annual "state of the union" address. the senate pushing forward after republicans rejected democrats' last ditch effort on friday subpoena former national security advisor john bolton and acting chief of staff mick mulvaney. the vote 51-49. >> the motion is not agreed to. >> reporter: two key republicans voting no. alaska's lisa murkowski condemning the house democrats' case as rushed and flawed. and tennessee's lamar alexander claiming the president's actions were not impeachable. >> i agreed he did something inappropriate, but i don't agree he did anything akin to treason, bribery, high crimes and misdemeanor. i think there's a big gap there. >> reporter: alexander suggesting voters should decide mr. trump's fate, not the senate. democrats pushing back. >> look, the bottom line is when the president does something so egregious as my colleagues have

said, you don't look the other way. the very charge goes to the fairness of our elections. and very few people doubt that he would do it again and again and again. he's already tried several times. >> reporter: adding to the drama, the president's impeachment lawyer, white house counsel pat cipollone, is named in yet another new report about john bolton's forthcoming tell-all book which nbc has not yet reviewed. in an article published on friday "the new york times" published on bolton's account of an oval office meeting in early may in which mr. trump directed him to help with his pressure campaign to distract damaging information on officials. bolton said cipollone attended the meeting with the president along with mulvaney and trump's personal lawyer, rudy giuliani. the president denying it, writing i never instructed john bolton to setup a meeting for rudy giuliani. that meeting never happened. >> yet another twist there.

>> reporter: meantime nbc news has learned that former ambassador to ukraine marie yovanovitch who emerged as an unwitting central figure in the impeachment saga has retired from her post at the state department. she had been a career foreign service officer for some 33 years serving in six presidential administrations, both democratic and republican. and she was removed from her post in may after she had been smeared and side lined by allies to president trump, kristen. >> and jeff, let's just talk about the remarkable timing of all of this, this vote that is going to happen next week. the "state of the union" is on tuesday. the vote is expected on wednesday after the "state of the union." so is the white house upset about this timing? >> reporter: well, white house officials would have liked to have had this trial over by the time of the "state of the union." but i'm told they've resigned themselves to the fact when president trump delivers that annual address to both chambers of congress he won't be doing it as an acquitted president

because that trial will still be under way. the bottom line is this time line republican leaders have effectively settled on, that was really the best they could do. and we've learned senate muiority leader mcconnell before the senate agreed to the time line called president trump and got his okay, kristen. >> jeff bennett covering all the angles. thank you for that. >> hans nichols is traveling with the president this morning. >> reporter: look, the president isn't declaring victory just yet. he's focusing most of his ire on the house. he hasn't weighed in on these latest developments in the senate. he didn't stop for cameras as he left the white house yesterday evening down here. that's becoming a bit of a pattern for him. and on twitter he's focusing on the number of witnesses on the house side. no mention though of the senate decision essentially not to call any additional witnesses, basically assuring his

acquittal. and as jeff mentioned senator mcconnell majority leader had a conversation with the president, read him into his plans, explained the calendar. and if that calendar and schedule stands the president will be giving his debut address on tuesday night in the middle of all this addressing the very senators that the next day will be deciding his fate. peter? >> in fact, several of those witnesses were ones republicans wanted to hear from. and hans, there was also a security scare at the president's mar-a-lago estate on friday. what do we know about that? >> reporter: well, a woman is in custody and this all started with the breakers about 3 miles north of the president's resort. she was behaving erratically, she drove south, breached one security barricade, plowed through another checkpoint and was actually driving towards the entrance of mar-a-lago. both local police and secret service opened fire, the lady actually then fled that scene. now, no one was injured. police have been very clear this isn't terrorism and the

259 people have died and nearly 12,000 have been sickened. this morning coronavirus now classified as a public health emergency prompting drastic new measures. >> beginning at 5:00 p.m. eastern standard time sunday, february 2nd, the united states government will implement temporary measures to increase our abilities to detect and contain the coronavirus. >> reporter: among those measures foreign nationals who visited any part of china in the last two weeks will be barred from entering the united states. and any u.s. citizen who's been to the epicenter will face a mandatory 14-day quarantine. including the 195 u.s. citizens evacuated from wuhan. now being held in mandatory quarantine at marks air reserve base. >> about every 12 hours someone does a health check on them. >> reporter: the cdc warning even individuals who have been

exposed and tested negative could still develop symptoms and become contagious. american airlines, united and delta suspending flights. the u.s. scrambling to charter emergency flights for nearly a thousand americans still trapped in wuhan. back home health officials are investigating hundreds of cases in 36 states including a newly confirmed case in santa clara, california. and in chicago doctors continue to monitor a woman who traveled home from wuhan and infected her husband. the family telling nbc news the man's 1-year-old grandson is now also being tested for the virus after developing a fever. with more than 10,000 confirmed infections worldwide and more than 250 dead, this morning americans are waking up to growing concern over a possible pandemic. as bad as this is public health officials continue to remind us far more americans have died of the flu this year than

coronavirus, and there is no reason to panic. peter, kristen? >> good reminder. thanks very much. meantime a woman who claimed she was raped by harvey weinstein will be back on the witness stand monday after an emotional day in the courtroom on friday. nbc's stephanie gosk has more on that. >> reporter: harvey weinstein is on trial for rape based on jessica mann's allegation. she took the stand recounting three separate assaults at times sobbing uncontroly. from a small town and troubled home manm wanted to become an actress when she met weinstein in l.a. afterwards they entered into a real relationship and it was degrading. she says the encounters were consensual but they never had sex. until a meeting one morning in 2013 at a new york hotel. mann says they argued in his room, telling the court i tried twice to get out and leave, and he blocked the door both times. i gave up and undressed

describing how the producer allegedly raped her. the relationship continued. mann describing flattering e-mails she sent. she said his ego was fragile telling the jury i wanted to be perceived as innocent and naive and not a threat, worried she said that he might hurt her. months later in l.a. mann accepted a job weinstein got her at a hotel where she says he raped her again after learning she had a boyfriend. through sobs she told the jury, i i said no and he said i don't have time for games. in 2017 mann told her story to police, her accusations leading to tlooel of the five sexual assault charges weinstein has pleaded not guilty to. the defense accusing her of lying about the relationship, arguing every incident was consensual. you met harvey weinstein at a hollywood oscar party the

forecast coming up. >> 7:00 a.m. we will see you then, thanks. the bay area now has its first confirmed case of coronavirus. a south bay man is being treated right now. he is the seventh case in the u.s. in california. authorities say not to panic but they are explaining what to do if you have the symptoms. doctors say a self-identified man flew into san jose one week ago from wuhan china and then developed symptoms. he has been self quarantined in his home. and a few people came in contact with him and although there is one case, they want people to know there is a much higher risk of getting the flu. >> this one case in fact does not change the risk to the general public. our assessment is that the public at large is still at low risk. >> the u.s. government is taking action this weekend, starting tomorrow. all ports of entry will be closed to foreign nationals who have traveled through china, in

first confirmed case of coronavirus. the south bay man is being treated right now. he is the seventh case in the u.s., the third in our state. officials are urging people not to panic. they are also saying what to do if you do have the symptoms. doctors say the unidentified man flew into san jose one week ago from wuhan, china, and then developed the symptoms. he is being self-quarantined inside his home. health officials say a few people came in contact with him and now that there is one case in the bay area, they want people to know there is a much higher risk of getting the flu. >> the one case in fact does not change the risk to the general public. our assessment is that the public at large is still at low risk. >> the u.s. government is taking action this weekend, beginning tomorrow, all ports of entry will be closed to foreign nationals, who have traveled to china in the last few weeks. now to another developing story, a shooting just before 9:00 last night, in the parking
