faith to not go to church. but we have got to be clear wit the only vaccine we have to fight thisy virus. >> well, the good news is that easter sunday services will be made available online at many bay area churches. both mayor breed and shaf are encouraging families to stay home and come up with new easter traditions at least for just this year. well, it is a common site these days, people wearing masks and wearing gloves when they're out in public. but are gloves giving us a false sense of safety? the cdc is recommending everyone wear some kind of face covering, but the agency has not make the same recommendations for gloves. we spoke with an infectious disease doctor who told us gloves aren't a bad idea, but you need to be aware of the surfaces you touch when you are wearing them. >> if you don't maintain social diloves on, for example, i'm

wearing some gloves now and say i touch my iphone or the surface and then i accidental touch my face to my nose, i can transfer that, you know, that bug from my iphone into my nose and mouth. >> doctors say the best thing to do, we've heard this before, wash your hands with soap and water and maintain your social distance. well, our dear state of california is once again sending help to other states, sending ventilators earlier this week and now some doctors and staff from ucsf are heading themselves to new york to help with the surge of coronavirus cases there. governor gavin newsome says the state is able to lend a helping hand because californians are practicing social distancing and flattening our curve. >> we have a good sense of how effective our order has been and how extraordinarily impactful all of you have been

in terms of your practicing physical distancing. >> the governor says everyone needs to continue to be patient to get through this. starting today, the city of oakland will have a new look and a new flow, as in traffic flow. the city is making a dramatic move. it will close down 74 miles of city streets to cars. you are looking at a map showing the proposed roads in purple. it will be called the slow streets program. the idea is to give pedestrians more room so folks can maintained the required six feet of separation and keep everyone safe. >> if there will be people, children in streets and frankly oaklanders haven't driven with the thought that at any moment a child could pop out between two parked cars. and that's how we should drive all the time. >> oakland says it's working with neighbors and community organizations to post signs and barricades along designated slow streets. people who live on those streets

can still drive in and out, but they should slow down. and this morning we have some breaking news out of new york city where the city's public school system, the largest in the country, is announcing its closing until september. mayor bill de blasio just announced that this morning. so back here locally, what is considered an essential business and what is not? this morning there is a bit of confusion over what qualifies and what doesn't. some exceptions to the rule have some business owners and some customers confused. today in the bay's tom jensen explains. >> reporter: a woman making 500 masks was shocked that she couldn't get the orders she made online for material at this joanne fabric store. closed by the santa county sheriffs office because

employees were getting too close to customers when they came to pick up orders. the manager confirmed it. >> my understanding is they were not in compliance with the system, the shelter in place and social distancing. >> reporter: this store has strict protocols in place to make sure there is no contact between customers and workers and they remain open. the manager of this nursery just down the road thought he was doing everything right, too, practicing the same social distancing rules. >> we're operating as curb side pickup only. >> reporter: but he got the word he has to limit his business to delivery only. >> from the district attorney's office saying we were not considered an essential business. we have already had to cut our staff back quite a bit and as far as delivery service, i don't know if that's going to cover the bills that we have. >> reporter: the essential business list does make exceptions for certain

welcome back. we are all making sacrifices right now to help stop the spread of the virus. hospitals are as well by postponing elective surgeries. but we found some hospitals not complying. >> reporter: procedures that generally can wait. the patients and staff at unnecessary risk of getting covid-19. doctors and nurses tell us those procedures are still going on and hospitals are turning a blind eye to the danger possibly

to pad their bottom in a classic surgery department, four tell us a surgeon continued to do elective breast reconstruction surgeries. >> we were all, the nurses and skrab techs and staff, were surprised. >> reporter: one agreed to speak with us anomaly. >> we would express to each other concern these cases were happening. >> reporter: the cdc instructed doctors to stand down on surgeries that can wait until after the pandemic to preserve hospital resources and reduce covid-19 risk within hospitals. thbl health issued a public order saying fail to comply caused an imminent threat and created an immediate menace to public health. >> but many of us felt that

there wasn't enough scrutiny to making sure that the cases that were being booked actually were true emergency. >> reporter: staffers became more worried when someone in the operating tested positive for covid. >> this is absolutely the wrong thing to do, to do elective surgeries. >> reporter: we had a look at a list of procedures performed by a plastic surgeon during the pandemic. this is a list we got from a source inside the hospital and had sutter review. if you can give a yes if yes we have to do these right now and no if no these can wait. >> okay. >> breast tissue expander to implant exchange? >> no. >> breast tissue expander insertion? >> no. >> breast with implant removal and breast lift. >> absolutely not. that's an aesthetic procedure.

>> he says not just unnecessary but potentially dangerous. in an average surgery that patient will probably touch in the health care system 40 or 50 within a few hours. >> reporter: a study out of wuhan university in china found out of 138 patients, more than 40% were infected while in the hospital. nearly 30% of those infected were medical staff. >> why would a surgeon continue to do these kind of surgeries? and why would a hospital allow it? >> well, you know, there are financial rewards for health systems. >> so you are saying it is about money. analysis of more than o million medicare cases shows hospitals earned on average $700 more on each patient for an elective procedure than those admitted through the emergency department. postponing elective surgeries could cost hospitals billions of dollars. >> the health systems or the surgeons that continue to choose

to operate are probably trying to mitigate the fiscal impact. so that's irresponsible and in my humble opinion unethical. >> we reached out to other hospitals and both kizer and uc davis freely admitted they are doing elective surgeries but said they are following cdc guidelines and only doing procedures that are time sensitive. their hospitals are rescheduling surgeries that can be postponed. they are moving forward with elective surgeries that they decide are urgent. now, the decision on whether a surgery is urgent or not is made by doctors and patients and then reviewed by an independent contractor who is also a physician. with the investigative unit, nbc bay area news. we have much more ahead on today in the bay coming up. they have insurance they thought would cover them during the pandemic, but that is not the case. i'm chris gamora. nbc bay area responds next. we're all doing our part by staying at home.

welcome back on this saturday morning. on an ordinary weekend you may be running out the door to grab breakfast. some business owners tell us they bought insurance to cover their losses at a time like this, but they're finding the insurance companying won't pay them. so they're turning to consumer investigators chris and his responds team for help. >> small stores and restaurants often carry business interruption insurance. it is supposed to be a lifeline to cover expenses like rent and payroll when operations are interrupted. but the owners of luke's tap room say their claim that has been denied. >> i was very unhappy about it, but i wasn't surprised. we have made, you know, a few claims over the years and in general we get denied. so it is a shame that, you know, that they're not there for us right now. >> we reached out to travelers which owns their insurance company.

they wouldn't comment. their policy says virus or bacteria will not be covered. but business owners argue the health order is the real cause, including the french laundry in napa. keller is shuing. >> i decided to file national litigation around the country to determine what the truth was. because i knew the insurance companies weren't telling the truth. >> we recently told you how some travel insurance companies are granting exceptions to their pandemic clauses. why not business insurance? they told us paying virus claims will destabilize the entire insurance industry, which includes homeowners and car insurance. it is worth noting, though, they reported a surplus of $800

well. >> most of the bears are painted on the plywood of boarded up businesses. finch hopes it helps make the empty neighborhoods feel a little less, in his words, depressing. it certainly will help there. and now to something good. a family-run business in the tri-valley is doing something good to help local kids in the area. a popular mexican food restaurant and even though it's taking a hit right now, the owners are helping struggling families in livermore. look at that. the restaurant made 50 boxed lunches every day this week, which also happened to be spring break for students. the restaurant then donated the lunches toamilies of local school kids. now. i mean, there is so much bad news right now, but we have been so privileged to be able to bring these stories as good news happening in this time. and speaking of good news, our nbc bay area mascot is joining
