it will soon, we just have to make it through today and tomorrow and then we'll have relief. today one of the hottest days of not only the week but the year. the heat advisory starts at 11:00. a look at our microclimates, up to 103 in antioch this afternoon. we'll talk more about this and that cooling that will be coming soon in a few minutes. mike, how is it looking for the early morning commuters? the last 15 minutes i've been watching slowing coming into cupertino south 280. we see where the arrow is, within the last 90 seconds that slowing cleared. down to the construction zone where you will have two lanes blocked.

we'll see slowing out of the altamont pass starting out early. they're doing overnight paving work. c california this week experiencing a sea of change in reopening for business. leading the way governor gavin newsom who talks exclusively this morning with the "today" show about a wide range of topics. that includes his vote by mail plan for november which is being met with lawsuits and opposition from president trump. let's take a listen. >> we want to prepare to keep people safe and allow them to have their constitutional rights protected, the constitutional right to vote without putting their health at risk. >> california's new guidelines to reopening houses of worship. bob redell is following that part of the story. he'll have more for us coming up at 5:00. so phase three means that

salons and barber shops are able to see clients again. but only three bay area counties have the green light to move forward. we want to show them to you -- napa, solano and sonoma counties. they have to follow new guidelines including screening everyone for symptoms and make sure everyone wears masks, gloves, eye protection like goggles or glasses for stylists. things like shaving, waxes, threading, eyelash extensions and manicures are not. well, today the first indoor mall in the bay area will reopen to shoppers. the solano town center in fairfield reopens at 11:00 this morning and shoppers will soon see some changes. not just people but cars must social distance. they'll have to be parked at least six feet apart. also a limited number of restrooms will be available for those shoppers. masks aren't required inside the mall but individual stores may

insist you wear one. an alert this morning from the south bay. the state and santa clara county health department are keeping a very close eye on morgan hill after a covid-19 outbreak at a fish packing company. "today in the bay's" kris sanchez joins us live with more on these growing concerns. kris? >> reporter: well, hi there, laura. we're talking about a cluster of 40 different cases in just one work place, so clearly there is reason for concern here in santa clara county. this is a fish processing plant. this is a material that is going out into the public. the girlfriend of a driver at lusa america foods says her boyfriend knew people were testing positive for covid-19 but was too afraid to raise concerns about continuing to work there. he was afraid to lose his job. she and others are calling for the plant to be shut down. >> they should shut down their company, test everybody.

he was out in the public. he was always told that he would be fine, just to continue wearing a mask and do the proper precautions. >> the county stood up testing in collaboration with the company and over the course of a day tested everyone there and identified 38 more people who were positive from the company. >> reporter: company officials release aased a statement sayin that, quote, all employees at the facility have been tested. the majority are asymptomatic and those tested negative will be retested as a precaution. we do know there is more testing scheduled for lusamerica foods later on today. kris sanchez, "today in the bay." 4:35 for you this morning and our next story, we want to warn you some of the images you're about to see may be disturbing. there is continued outrage this

morning. this is coming out of minneapolis and really across the country over the death of a black man who died while in police custody. that's a protest happening in minneapolis. this is the video we were talking about. a bystander captured this incident. it appears to show that officer kneeling on george floyd's neck as he begged for help saying he couldn't breathe. moments later he went limpless, he wasn't moving. four police officers have been fired over this incident and death. however, lawyers for floyd's family say it is not enough. >> the family believes as many of us that the findings by the police chief and the mayor was the first step to justice, but they want them charged to the full extent of the law. >> the fbi is now on this case and, of course, we're going to keep a close eye on what's happening and will bring you those developments as they happen.

more coronavirus news from the bay area. new cases keep popping up. there have now been nearly 13,000 cases. there's actually a surge we're seeing in alameda county with 112 cases reported. alameda county remains the hardest hit in the region. a new testing site is opening in santa clara county today. it is right off central expressway in mountain view. testing will start at 9:00 this morning. it ends at 1:00 this afternoon. no appointment or insurance is needed. another testing site will be available at a shopping center off story and king road in san jose on friday. happening today santa clara county leaders will sound the call for more help in getting their contact tracer program off the ground. contact tracing is considered essential for slowing the spread. but a new "mercury news" report finds the county has only filled about 57 paid positions it planned to fill. they want to get those hires in place by july.

the push is on adding volunteer help. san francisco mayor london breed is under fire this morning from homeless advocates with the posting of text messages showing her ordering police to conduct homeless sweeps. advocates obtained those texts through the sunshine ordinance request. some of them to police chief bill scott and written candidly and seemed to contradict claims san francisco does not do sweeps. a spokesperson for the mayor's office tells "the examiner" the mayor is in contact -- constant contact with various department heads including social services and police. 4:38. coming up on "today in the bay," a step forward. l.a. makes progress in reopening. the big tourist spots now open and what's still closed. plus, disappointing news for sharks fans, why the team won't hit the ice when nhl games resume. before using olia...

bridge am check out the live camera. didn't see any problems but looking for what's going on further south coming through the presidio. you will have an issue coming up. good morning, i'm frank holland at cnbc headquarters. here are today's top business headlines. wall street is set to open higher, stocks rallied although they closed off the highs of the session. continued optimism about the reopening of the economy and the hope for a potential coronavirus vaccine despite concerns about rising tensions between the u.s. and china. the dow jumping 530 points snapping a two-day losing streak. the index on track for its second straight positive month. millions of recently unemployed americans are dipping into their retirement savings. a new survey by rank rate finds more than a quarter of working or recently unemployed adults have tapped into their retirement funds as an immediate source of income due to the pandemic. nearly 20% are contributing less to retirement accounts.

or spicy popcorn chicken combo for just $5.99. good wednesday morning to you. taking a live look dark and early out of palo alto as we get started with the day. what you can see, those warmer temperatures. kari, tell me if i'm right, looking at our screen it says 71 degrees right now. yeah, and when we think about it it's usually a lot cooler than that to start out in the morning, and so we only have a couple of hours to get in those outdoor activities before it heats up fairly quickly as we get a look at our air quality that's also been another issue. we will see slight improvement today. a little bit more of a breeze but high levels of ozone so if you have breathing problems you may want to limit your time outside, moderate air quality as we get a look at our temperatures and the way the day shapes up, we talked about how fast it heats up and look at the

bright pinks we see for the inland areas. by noon, lunch time, we're already at 92 degrees in antioch and we'll see those temperatures reaching into the triple digits today for the inland east bay, but it will stay cooler along the coast with half moon bay at 72 degrees for the rest of the afternoon. we're going to see it cooling off. and then as we go into this evening still a very warm night. this dangerous heat starting to back off by tomorrow as we watch a storm system move up the coast and it will also bring in a chance of spotty showers on saturday. still lingering clouds on sunday, and we'll have to watch out for a chance that it could bring in some isolated lightning but, of course, we'll be watching that as we get closer. we're just trying to make it through the heat. as we see the peak of the heat today still really hot tomorrow. friday is looking better but with the cooling and the rain chances this weekend we are looking at big improvements at least over the next few days

once weep hit the weekend. heading over to you, mike, how is it looking for the commute? i feel badly because, as you said, it's warmer than we have overnight. the crews in cupertino are getting started. south 280 on the map shows you the slowing heading down to 285. it was in the red zone. now just clearing. again, it only lasted about five. they're moving some equipment, i do think, getting in place because they have two lanes blocked as they have the last couple of days through the early morning commute. a smooth drive, though, shouldn't be a major problem. as you drive through the area there's still road work. i believe the southbound side is closed. northbound should have a reopen. watch through the presidio. highway 24 over the caldecott tunnel has cleared from the right bore westbound. back to you. thank you very much, mike. 4:49. a scare in san francisco's north

beach where a falling tree branch struck five people including a 2-year-old. it happened yesterday afternoon at washington square park where a witness posted a video. all escaped serious injury. happening today the start of a pivotal phase of pg&e and its effort to emerge from bankruptcy with a confirmation hearing getting under way in san francisco. now this is considered the final litmus test for the utility and its $58 billion reorganization plan. it will have to be approved for pg&e to exit bankruptcy by july 1st. businesses won support from a majority of wildfire victims, but critics wonder if pg&e will be equipped to increase safety going forward or if rate payers will be left to foot the bill. new details in a victory for environmentalists in their battle to make oil companies liable. federal judges rejected a bid by oil companies to move california's litigation into

federal court. cities and counties like san francisco and oakland want compensation from oil companies. judges ruled state courts should hear the cases which some believe may be less sympathetic to big oil. time is ticking for california lawmakers who are trying to tackle the state's massive budget deficit. california faces a $54 million budget shortfall. this is because of the coronavirus. yesterday governor newsom presented his budget proposing a 10% paycut for state workers. cuts to public education and health care. the state assembly criticized the plan and offered another making cuts to high-speed rail projects. the state has until june 15th to approve that budget. l.a. county is actually starting to move a lot deeper into its second phase of reopening calling it a good day for los angeles. mayor eric garcetti, as of this morning, says that stores can reopen if they meet certain guidelines including limited

>> reporter: good morning. we've heard from a lot of folks including abby, rob, marie and tim. now there's a class action lawsuit. people expect a refund for a show that's not happening. the san francisco law firm that filed the class-action suit says ticketmaster changed its policy as the pandemic took hold. here is what the suit says. on march 13th, the ticketmaster policy says refunds would be available for a canceled, postponed or rescheduled event. as of march 14th only canceled

shows get refunds. with those tickets to postponed events, those folks have to wait. ticketmaster says it has to see what the promoter or performer allows. >> ticketmaster is the company that made the representation to consumers, set the policy for the ability to get a refund and took consumers' money. >> reporter: ticketmaster says it doesn't comment on pending litigation. ticketmaster announced it would give refunds for postponed events put on by live nation. other events, however, remain in limbo. we made a flow chart showing your options. you can see it on our website, nbcbayarea.com/respond. taking a live look at s.a.p. center. the nhl is announcing its plan to return to the ice but not for our sharks. nhl commissioner gary bettman says that after a short training camp the league will head straight into the playoffs. the top 12 teams will play in a
