the justices ruling that it is illegal for workers to be dismissed from a job based on sexual orientation and gender identity. nbc justice correspondent pete williams joins us with all the details. pete, what can you tell us? >> well, this is a stunner, frankly, coming from this conservative supreme court that no longer has anthony kennedy among the justices, the man who wrote all of the gay rights decisions before. but today, the supreme court has ruled that title 7 of the civil rights act of 1964, which makes it illegal for employers to fire employees on the basis of sex, also covers sexual orientation. now, the lower courts had been divided on this, and the trump administration sided against this ruling, saying, no, that when congress passed the civil rights act in 1964, nobody was thinking about sexual orientation. it was simply discrimination against men or women. but today, the supreme court said, no, that's not the case.

sexual orientation is considered part of that 1964 civil rights act. now, this is a victory for an atlanta man, gerald bostauk, who worked for the county and was fired after his employer found out he was on a gay men's softball team. he sued and the court said sorry, you can't sue under the civil rights act, it doesn't cover sexual orientation. and the supreme court today said that's wrong. it's an issue that divided the lower courts. on the same day this was argued, the supreme court heard a separate case on whether it's also illegal under this same civil rights law to fire someone for transgender status. we don't have that decision. the supreme court, as you know, in this time of the pandemic is not actually in the courtroom. all this is happening virtually. and frankly, all we have so far of the decision is the very first page. but i'm told now that it's starting to line up. and the vote is 6-3 with neil

gorsuch, one of the trump appointees, joining the chief justice, john roberts, and the court's four more liberal members, to form this 6-3 majority. so, this is a huge thing. and i would just say one other thing about this, kate. gay rights groups considered this even more important than the fight for marriage equality, because while not every gay person in america gets married, most gay adults want or need a job. and as of just a few minutes ago, it was possible to get married on sunday and legally fired on monday, but no more. kate? >> and pete, you mentioned neil gorsuch. you had told us when we were preparing for this possibility today that he argued in the argument, you know, indicating that he might accept this argument, that these rights are covered by that statute. >> yeah, he said that, actually, more in the transgender argument, but he seemed to be among the conservatives the one

that was distantly possible to maybe be peeled away to join the majority, and that's what he's done here. we'll have to see what the logic is as this -- this thing is -- i guess there are so many people on the supreme court website that the pages are loading very slowly, but at least we know what the bottom line is, kate. >> well, why don't we let you read that, pete? and i'll jump over to nbc's peter alexander at the white house, who is with us as well. peter, this is a landmark ruling. any reaction yet from the white house? >> reporter: no, kate. actually, we just reached out to the white house moments ago. we haven't heard from them yet. the president's been tweeting on other topics over the course of this day. this has not been top of mind from him. but you know, lgbtq activists and allies have said there really has been this whiplash between the obama administration and the trump administration in terms of their policies on issues related to the gay community, so this will certainly be hailed as a victory in those communities. what the white house's position

on this will be will be interesting. we wait to hear from the president on this topic, as hear from him a little bit later. we know there has been a lot of focus on some of the other issues that the court's been reviewing as well, including issues as they relate to the president's taxes and the issue of daca. on this one, though, certainly, we're still waiting to hear from the president how he tries to frame this, even though his administration has been pushing to try to roll back a lot of the obama administration's efforts to provide new opportunities and rights to members of the gay community. kate? >> and let me go back to pete williams. pete, have you had a chance to read any of this yet? and does this now apply nationwide? >> yes. the answer is it does apply nationwide. now, some states, a small number of states, had their own laws that made it illegal for employers to fire people on the basis of sexual orientation, but now, this is the guarantee that applies nationwide. so, the majority opinion was written by neil gorsuch. so, clearly, the chief justice

assigned him the opinion, which gives it extra punch. and let me just read a couple of lines from what he says. he says, "sometimes, small gestures can have unexpected consequences. major initiatives practically guarantee them. in our time, few pieces of federal legislation rank in significance with the civil rights act of 1964." he talks about title 7, outlawing discrimination on the basis of race, color, religion, sex, or national origin. and he says, "today we must decide whether an employer can fire someone simply for being homosexual or transgender. the answer is clear -- an employer who fires an individual for being homosexual or transgender." so, now we know what the second case is going to say. "fires that person for traits or actions it would not have questioned in members of a different sex. sex plays a necessary and undisguisable role in the decision, exactly what title 7 forbids." so, now we know, even though we haven't gotten the second decision yet, we know what it's going to say, that title 7 not

only makes it illegal to fire someone on the basis of sexual orientation, but also on the basis of transgender status. now, this is a case that came from michigan. amy stevens, who worked for a funeral home, told her employer that she was going through a sexual reassignment and would start coming to work dressed as a woman. she was fired, and she sued, and she won in the lower courts. and now it appears, from what justice gorsuch is saying in this opinion, it now appears that he's going to side with her. she died of a kidney ailment just a couple of weeks ago, so she will not live to see this victory, kate. >> so, in other words, this is not just affecting one community, pete, this is affecting two broad communities. we're now talking about sexual orientation and gender identity being protected by that statute. >> yeah. and you know, this is -- the gender identity movement, this

is really a nascent movement here. it's just getting started. this is the first supreme court ruling ever on this question of transgender rights. there was one that came up here a couple of years ago of a student from a virginia school, but it ended up not being decided. the supreme court has never decided a transgender until today, and it's an opinion written, it would appear, by justice gorsuch, although we don't know -- we haven't gotten the second case yet. we should be getting it here in a few seconds. we'll see if he wrote it as well. but he turns out to be the key vote on that issue as well. >> and do we know, pete -- you mentioned states that already have their own state statutes, and this will now broaden that to other states. what happens in states where there's been resistance to this idea? what happens in states that have opposed transgender rights, for example? >> well, it's now illegal to fire somebody on the basis of transgender status. and of course, these laws are

administered by the equal employment opportunities commission. what usually happens here is if someone is fired and they believe that they were fired for being transgender, then they sue. and you know, depending on where you lived, up until today, you might or might not win, if you lived in a state that had that coverage or if you lived in a state that was in the federal circuit where the courts had said, you can't do that. now it's true nationwide. >> there will be so much reaction to this today. i'm sure it's -- i can't check my email right now, pete, but i'm sure it's already pouring in from lgbtq groups, advocacy groups. this is something they have, as you mentioned, been fighting for, perhaps even more important and significant than same-sex marriage was. advocacy groups had said all along throughout this case, a gay person can get legally married on sunday and get fired on monday. that was their point when this case was being considered.

>> and pardon me for looking away from you, but i'm awaiting -- we all are staring at the court's website for the next decision to come up. they're supposed to come every ten minutes, but it still hasn't been posted. but i can't emphasize enough what a stunner this is that -- you know, if anthony kennedy had still been on the court, then perhaps we would have expected this decision, but he's gone, replaced by a justice who's much more conservative, brett kavanaugh. of course, antonin scalia died of a heart problem, and he was replaced by neil gorsuch. so, you know, can you imagine antonin scalia writing this decision? i don't know about that, but here comes neil gorsuch. now, i will say this -- those people who were, what they call textualist, who believe that you decide cases based on what the law says, did put their hopes in neil gorsuch. because while it is true, indisputably -- both sides here agreed that when congress was debating the civil rights act in

1964, nobody on that, in the congress, was thinking about transgender status or sexual orientation. that's a for sure. okay -- >> do you think it reflects in some ways -- >> i'm told now -- i just realized now that it's -- the two decisions are combined together. so, now we know that, for sure, it is 6-3 on both cases. but the hope was that neil gorsuch would say, it doesn't matter what was in the mind of congress. all we care about is the words of the text of the statute. and that's why there was some hope that he might provide the controlling vote, and he has. >> right. not just the controlling vote, but actually written the opinion, you said. >> yes. well, and, not just the controlling vote, but given them -- you know, 5-4 would have won. 6-3 is a much bigger victory. >> right, right. does that speak to you -- you cover the court. you've covered the court for years, pete. does that speak to where we are as a culture right now? you know, can we read into this,

that perhaps, culturally and societally, we are more in favor of lgbtq rights? >> well, you know, i think, certainly, that was true for gay rights, because the supreme court has gradually gotten to that point where with, first of all, saying, you know, if a state passes a law singling out gays, it can't do that. and then finally, the decision on same-sex marriage, which was huge. but the transgender thing has moved much more slowly through the courts. it's really a much newer issue. and frankly, it's been fought mostly over the issue of bathroom access. remember, that's what tied north carolina in knots, and they finally decided to go in a different direction. so you know, this is a question that has not been chewed over a lot in the lower courts, and that is why it's somewhat surprising that the supreme court has sort of leaped ahead of all that. so, i think the simple answer to your question is yes.

>> and as someone who's covered the community and covered transgender rights, i can tell you that bathroom issue is something advocacy groups have really not wanted the focus to be on. they would much rather we be talking about these broader issues, as far as lgbtq rights. >> yeah, and -- >> pete, i'll let you go -- go ahead. >> it came up during the argument as well. the justices seemed to want to talk about it, but obviously, they got to the bottom line. >> just to recap, a 6-3 decision out of the supreme court today. a landmark ruling banning discrimination in the workplace against anyone who is gay, anyone who is transgender. we will have so much more on msnbc throughout the day, on nbc news now, our digital channel, and also a full wrap-up, of wra course, on "nbc nightly news." but for now, we'll return you to your regular programming. r said, there's no reason to postpone. >> high-risk people need to step back and everybody has to take responsibility of their own

bond on a spy mission. on reality they abducted mr. bean on holiday. my human rights are being violated, my life threatened >> reporter: paul whealen was arrested in moscow just after christmas 2018 his room was raided by the former kgb they said they found a thumb drive. with a list of classified employees from a russian security agency. paul whealen and his legal team say it was planted you think it's a political prosecution? >> political prosecution partly. >> reporter: they believe putin wants to use him for a cold war style spy swap with america. his twin brother saying in a statement the russian legal system has been found guilty of injustice. >> he's been held without evidence and due process. the way we expected in the united states. >> reporter: paul whealen's family now saying they plan to pressure the u.s. government to get his release. >> we will continue to fight until he's home.

months' long lockdown. just ahead we're going to show you how this region is slowly bouncing back. and we have new jersey's governor phil murphy live with us for an interview. but first the headlines. we do start this half hour with those 7:30 headlines. outrage growing this morning over the fatal police shooting of another black man this time in atlanta overnight rayshard brooks' death was ruled a homicide brooks died from two gunshot wounds to the back it happened friday night during the struggle with police in a wendy's parking lot. investigators say brooks grabbed an officer's taser and later pointed that taser at them the officer who shot brooks was fired. a decision on possible charges could come later this week an update now on a story we told you about last week "gone with the wind" will return to streaming service hbo max the movie was removed due to racist depictions and glorification of slavery the movie will now include an introduction by jacqueline stewart.

she'll place the film in its historical context and here's something we haven't seen in months check this out a sports stadium jam packed with fans temper your excitement, though this is new zealand. this was a scene over the weekend there. thousands of fans sitting shoulder to shoulder cheering on their favorite rugby teams you'll notice no social distancing, no masks in new zealand. that's because new zealand was declared coronavirus free last week and all social distancing restrictions were lifted savannah well, it's a different story here, but things are starting to open up in new jersey. in a moment we'll speak to the governor about the steps to fully reopening. but first stephanie gosk is with me down the shore. stephanie, good morning. good to see your face. >> good to see you as well president trump was at his bedminster golf club over the weekend and had the governor over what makes new jersey so great is you can live in a place like

this but work in new york city but that crowded commute made new jersey an easy target for the virus. >> reporter: the state is opening up their doors just a little bit wider among today's changes, restaurants can serve customers outside. asbury park wanted people to eat inside as well, but when governor phil murphy sued the city, they changed their mind. >> i'm going out of business and if we lose the local businesses, we lose asbury park. >> reporter: they're desperate to open by summer when business is best. right now, new jersey has the second highest number of covid cases in the country. over 166,000 and more than 12,500 deaths. the most densely populated state right next to the most densely populated city new york. when coronavirus took hold here, it spread like wildfire. on march 4th, the first case was

reported by march 19th, the state was shut down. on april 30th, 458 people lost their lives. the most in a single day >> we're in the fight of our lives and remain in the fight of our lives. >> reporter: the hospitals were overwhelmed. holy name medical center, the number of icu beds skyrocketed more than five fold. getting tested wasn't easy there were excruciating lines. people even told to get there the night before halfway through april, 95% of the long-term care facilities had at least one case of covid as deaths mounted, so did the economic toll. between mid-march and early june, over 1.2 million people filed unemployment claims. many restaurant owners couldn't keep paying salaries while they were shut down >> it's been totally crippling it's awful >> reporter: now as summer begins and the curve flattens, glimmers of hope for a state with true grit being tested like

never before so there were religious services held over the weekend in places of worship they had to follow those indoor gathering rules. 50% or 25% capacity depending which is the lower number. personal care businesses have to wait another week to open up >> thank you now we're going to do an awkward dance here we're going to bring governor murphy in here good to have you here. >> great to see you. >> we'll get into the details in a moment and there's some really strong feelings on all sides of this, but just symbolically, what does it mean to start having the jersey shore open again? >> this is a big day we're doing outdoor dining today. all retail not just essential. day care is opening. we've got barbershops and hair salons next week we're slowly but surely getting back on our feet >> you had to go to court, actually, a fight with asbury park

the local town wanted to have indoor dining restaurants starting last weekend. in the end you won in court. but the larger battle is going on literally as we speak there are business owners who are enraged that this reopening hasn't happened sooner >> yeah. i mean, listen you mentioned this we were the second hardest hit state in america over 12,600 fatalities the virus indoors is far more lethal than when it's outdoors we have to be very careful about opening things up that are inside, lack of ventilation, close proximity. we'll get there. no question we'll get there. we're just not ready yet >> look. i don't know if people can hear, we have a heckler who's yelling about this very thing. i mean, this rage that people feel about businesses not being opened fast enough, it's real. why aren't you moving more quickly? you know, a lot of business owners say it's kind of arbitrary. why can i walk to home depot with a hundred people but i

can't go have a meal >> yeah. this guy deserves to say what he wants to say, but honestly overwhelmingly the majority of folks get it we make the decisions. they're not arbitrary. they're based on facts and data. we've driven down the positivity rate, the rate at which the virus spreads are way down probably leading the nation right now. we've just got to keep it down inside is a lot harder than outside. but with this weather, this is as good as it gets we're opening back up and it feels great. >> have you thought about picking up the pace of reopening? >> i think we're comfortable where we are i don't think we can responsibly go faster. we'll get there to indoor dining casinos which are a huge part of the economy in our state in atlantic city, we'll get there but we've got to do it responsibly. >> we've seen the protests that have gone on you attended one protest you changed the rule so outdoor gatherings of more than a hundred people could go on some business owners see a double standard. >> listen, outside versus

inside i can't say it enough. the other thing about protesting, we understand the right to protest but wear a mask and stay six feet apart if you can. and get tested all of which is essential. >> the governor in new york said yesterday he would consider shutting it down again because he received in the state 25,000 complaints about businesses and individuals not sticking to the rules, not doing the social distancing we saw those crowded scenes in new york if it comes to that in this state, are you willing to go backwards there? >> you have to leave that on the table as a consideration i hope to god we don't have to we now test more than any other state in america we're building up our contract tracing and isolation plans. i hope if we see this thing god forbid come back around, we can drive it back into the ground. >> how worried are you about a surge either from the protests or other gatherings?

good morning >> reporter: hoda, good morning. this morning we are expected to see protesters take to the stat these images are capital. we're already seeing a steady ss behind us. we're learning more information about brooks' final moments. all of it played out on six different angles of video. we want to warn you some of these images are disturbing. on the streets of atlanta this morning, renewed calls for justice bearing a new name. rayshard brooks. the 27-year-old shot and killed friday by an atlanta police officer. overnight the medical examiner announcing brooks died from two gunshot wounds to the back. the death ruled a homicide. the charred remains of this wendy's set ablaze amid protests marked the spot where he spent his final moments. officers responded to a call that brooks, asleep in his car, was blocking the drive-through. body camera footage shows a

mostly calm interaction. brooks taking a sobriety test which investigators say he failed. but 43 minutes into the recording, as an officer tries to arrest him, chaos. >> stop fighting! you're going to get tased! >> reporter: this eyewitness video shows the struggle. investigators say brooks grabbed an officer's taser. here you see him running away from police and appearing to point the taser at them. an officer responds with fatal gunfire. hoda spoke with the brooks' attorney earlier this morning. >> they could have easily waited and caught him later or let him be blocked in by the officer that was responding. it was just unnecessary. >> reporter: brooks' wife tomika miller still cannot face that moment. so you still haven't watched that video? >> nope. i'm already in enough pain right now. so to see anything of my husband being shot down or -- i couldn't

see that. i can't stomach that right now. >> reporter: within hours of the shooting, the city's police chief resigned. the officer who opened fire terminated. a second placed on administrative duty. but city leaders say that's not enough. >> everyone knows that pulling a gun is one thing and then shooting. that just hit me, that disturbed me. and i couldn't understand why that happened. so that's why we need to review every single procedure, every single policy. >> nothing can heal the hurt, the pain. nothing's going to bring him back. again it keeps going on and on. i'm not the only one going through it. >> reporter: right now there are at least three separate investigations going on. to find out exactly what happened on friday night including one by the area's district attorney who says that he could announce his decision on charges as early as this

week. savannah? >> all right. blayne, thank you. here in new jersey, one of the supreme court ruled it is illegal to fire a worker because they are gay, lesbian, or transgender. pete william joins us. >> this is a stunning decision from newly conservative supreme court by vote of 6-3. the court said existing federal law makes it illegal for employers to fire them because they're gay, lesbian, transgender. they said it is illegal on the civil rights act. today, the court said while sexual orientation was not on the minds of anyone in congress when the law passed, it is the words of the law that count. firing on the basis of sex

orientation is a form of discrimination. gay rights groups consider this an issue. every lbgt needs a job. that same law makes it illegal to fire employees because they're transgender. what makes the decisions more surprising is they were written by donald trump's first supreme court appointee, neil gorsuch, joined by john roberts and other liberal members. 21 states had laws banning discrimination based on these factors, now it is the law of the land. more supreme court decisions yet to come. craig, back to you. for the first time in a long time, it was a busy weekend for sports. nascar hitting the track with some fans in the stands. and just days after the sport banned confederate flags. kerry sanders is at homestead, miami, speedway where that race happened.

we have 50 to 60 teenagers who work for us, this is their first work experience it's important i take that responsibility seriously i have to make sure not only the kitchen is safe with knives and fryers, but that register. i have to make sure that staff member is protected from the guests making sure they're wearing the masks, using hand sanitizer. it's a new sort of training that didn't come with other economic downturns. this one is a little bit more i have to keep you healthy as well >> yeah. it's a lot to handle before i let you go, caroline. you've been here a long time you both have. what would you tell people about coming to the jersey shore and visiting the boardwalk >> there's nothing like it there's nothing like it. we're not going to go anywhere we're going to get through this. you know, nothing's going to affect this. it's what the jersey shore is. >> you feel positive about the future, anthony? >> yeah. we're new jerseyans. we're strong this boardwalk will be here for a long time. when the live music comes back which is what we're known for, we expect to be at full steam.
