this is beautiful foster city as we check out our temperature trend. we are going to start out with temperatures in the upper 50s. some 50s and 60s near the coast. we'll talk more about this in the forecast coming up. any issue for drivers heading out? >> still in the tri-valley for those just joining us, the bad news it's jammed up through pleasanton. the good news is we have one lane open again. southbound 680 jammed up to the sunol boulevard. folks taking foothill down to where it transitions. i believe you can jump back on the freeway there. a lot more people, some folks are passing the dublin interchange and going through livermore. you may want to stay on 680

because you can get through. everything else is clear. we want to talk about the big bump this morning in the bay area's road to recovery. this after governor newsom ordered businesses to shut down for the second time to stop the spread of the coronavirus. bob redell is back at the same gym in san jose where you reported from yesterday. they were gearing up to open and talked to us live. now they're gearing to close back down. >> reporter: it's not clear if they will reopen today. they reopened yesterday at 5:00 a.m. here we are in downtown san jose, the lights are still off, the doors are not open. this has been whiplash for a lot of the small businesses especially for the ones who spent the time and money to make sure their businesses met the safety guide lines for reopening. governor newsom announced that all indoor operations in places like restaurants, wineries, movie theaters must close.

counties like contra costa on the state's watch list must close places like gyms and nail and hair salons. the owner in martinez can't believe this is happening. installing plexiglas dividers, reconfiguring stations and got the green light to reopen less than three weeks ago. >> having a hard time wrapping my mind around how covid can be spreading here with all the precautions we're taking. scary and sad for the business, but it's nothing in comparison to human life. >> reporter: this past friday night alameda county put the kibosh on outdoor dining. it couldn't have come at a worst time for alameda. they gave pedestrians more space to window-shop and dine outdoors.

permission to allow the county health officers to hand pick which activities can still safely continue. reporting live in downtown san jose, bob redell, "today in the bay." >> thanks for the latest there, bob. breaking news overnight as well. the supreme court ruled that the first federal executions can take place now in 17 years. "today in the bay's" tracie potts joins us live from washington this morning to explain the immediate impact from this decision. tracie? >> reporter: the immediate impact when the execution at the federal prison in terre haute, indiana, will actually happen. the supreme court in a narrow 5-4 decision overturned a lower court that put the brakes on that federal execution. the prisoner, daniel lewis lee, convicted in 1996 of killing a gun dealer, his wife and his 8-year-old daughter. he was set for lethal injection

monday afternoon, but that was postponed. lawyers argued that could not happen and interestingly the victim's family says this is not what they wanted. there have been concerns about doing this in the middle of a covid pandemic that has run rampant at the prison. we're still waiting to get word on when that execution might take place. laura? thank you very much, tracie. a tell-all book written by president trump's niece, mary trump, hits shelves today. "too much and never enough: how my family created the world's most dangerous man." that's the title of the book. the trump family fought to have it released. the judge lifted the temporary restraining order. it paints the president as a habitual liar, an inept businessman. mary trump is a clinical

psychologist who diagnosed the president as a high-functions psychopath. decision 2020 in a run-off republican primary today in alaba alabama. tommy tuberville, the same senate seat sessions once gave up to become attorney general. >> as california and other states shut back down dr. anthony fauci is optimistic even though he's at odds with the white house after sounding the alarm. dr. fauci says the nation is a new crisis now because we did not shut down entirely earlier. he says, quote, we have not begun to see the end. as for some hope, the doctor says we can actually still turn the tide. >> i am confident we can if we

step back. you don't necessarily need to shut down again but pull back a bit and then proceed in a prudent way. >> dr. fauci says closing back down like california is doing now and reopening will be tough but it can slow the spread of the virus. happening today an update on california's effort to get testing resources to those most in need. at the start of the outbreak a shortage of supplies led to limited testing. this is with the state setting a modest goal of 8,000 tests by the end of march. testing now surpasses 1,000 per day. health and human service leaders today will give a status update. well, of course, a lot of bay area school districts are trying to nail down their fall/summer plans with school resuming about a month from now. today san francisco leaders will discuss the recent recommendation to reopen with more of that distance learning that we've been talking about. also, santa clara union schools

will inform parents about its recent distance learning plans as well. schools in the north bay looking at three options including resuming with 100% distance learning. leaders plan to make a final decision depending on infection rates. the plan is to ramp up slowly with improved remote programs. more efficient safety measures become available. the first day of school there, august 17th. workers in san francisco affected by the pandemic may soon get some extra protections. not to threaten workers who request time off after testing positive or quarantining after being exposed. the proposed law would also ban employers from asking about or requiring coronavirus testing

before extending a job offer. a quick follow-up for you in the south bay. the wildfire near gilroy is now 100% contained. it burns 5,500 acres destroying one building after starting ten days ago. the cause still under investigation. >> still have to watch the dry conditions though it feels slightly cooler this morning. >> hopefully you'll have a chance to get out for a little walk. as we look at our pollen count everything has been looking good here as well. we're looking at the tree count, grass, weeds and mold, and they're all low at this point. as we make plans to get outside and enjoy fresh air, a slight cooldown with willow glen in the mid-50s and throughout the morning.

making it into the mid-80s which is still about normal for this time of year. we'll talk about what's ahead in the forecast going into the rest of the week and the weekend coming up in a few minutes. the good news pretty much all of our commute looks like you would expect, very light. they go together. the bad news is there's one section in the tri-valley that continues to continue. things start to jam up down to sunol boulevard with one lane open, a crash left sand and gravel in the roadway. your left lane is the only one open. but notice over on the right side that is 84 westbound heading through livermore in towards sunol. i've seen a lot more traffic slowing through the area. going on 680 and taking vineyard over to 84 when they might head

headlines. wall street is set to open higher after stocks gave up big gains yesterday. the reversal came as california announced it's rolling back reopening plans shutting bars, indoor dining, gyms and more as virus cases surge in the state. the nasdaq swinging from a gain to a loss by the close as big tech names that have led the market for months fell. tesla had been up 14% but closed down 3%. the dow giving up more than a 500-point gain. we'll hear from jpmorgan, chase, and wells fargo. profits are expected to be hit as banks set aside money to cover loan losses. american airlines is planning to warn employees about potential furloughs. the latest carrier to prepare workers for job cuts as the pandemic hits the travel industry. the terms of the $25 billion in federal aid prohibits airlines from laying off workers or cutting pay through september. weak demand is forcing airlines to get ready to make cost cuts.

>> absolutely. hopefully we don't need that protection to keep us safe. a look at our live view in san francisco. we've seen the fog rolling back in the past couple of days. it's a pretty deep marine layer that will keep us cool as we go into today even at times some mist and drizzle moving through. right now looks clear but we will see the drifts of fog coming through and our temperatures there only reaching into the mid-60s today. we're in the upper 50s in half moon bay. i don't think the fog will lift from the coast in that area. as we head over to oakland, the low 70s. palo alto up to 80 degrees. 85 in san jose and some upper 80s for the inland east bay. let's talk about what's going on out there in the pacific. we're always monitoring what's happening and we're seeing the warm blob, an area of some warm weather that's warm water along

the surface of the pacific. along the equator, la nina is developing. what happens it drives the storm track further to the north so we're seeing that cooling there that may continue. we've seen it happen the past couple of months. for southern california below average rainfall. but for us here in the bay area this could possibly lead into some slightly higher impacts in terms of rain with near normal to above normal rainfall going into our water year. right now it's a weak event. there's a 50% chance of it developing from the fall to winter with near average rainfall potential and the last one we had was a couple years ago. we'll be talking more about this as we go into the next several months seeing if it's developing. right now, though, mike gets you out the door with a look at your

confident ghislaine maxwell is due in court. her attorneys want her released from jail due to the coronavirus. prosecutors say maxwell is a flight risk. she has millions of dollars in overseas bank accounts. they also say when she was arrested last week she ran from officers and a cell phone wrapped in tinfoil was found in her home in an effort to avoid detection. people flying into new york from out of state will be met by health enforcement teams. air travelers from california and 18 other states now have to fill out contact information including where they're going and coming from. if travelers leave without providing the information, they face a $2,000 fine. a 14-day quarantine for all

nice warm-up there and our high temperatures for some spots will be quite warm as we will reach the upper 80s in antioch. oakland will be in the low 70s and mid-80s for san jose, san francisco in the mid-60s this afternoon. we'll get a look at what's coming up. how is it looking for the commute this morning? we have a disruption for the tri-valley. it's what we've been following on our maps. most of the bay looks great. out of the altamont a lot of traffic and folks heading through the dublin interchange. south 680 still only has one lane open, backup forming just south. you see your alternate, some folks, i believe, eastbound on 580 heading back cutting around it and more traffic through livermore to sunol. others are jamming up around foothill deciding if they're going to take that. just past there a stall. thanks, mike.

now to an up-to-the-minute look at the bay area counties on governor newsom's watch list. all but san francisco and san mateo counties, you see them here in the yellow, all are shut down right now. and there is some confusion for a lot of people in santa clara county because governor newsom's restrictions mean businesses are shutting down for a second time. right now live to bob redell out there at a san jose gym just opening yesterday for the first time in months, bob, and now not even 24 hours no the opening they find out they're going to have to shut down again. >> reporter: yeah, they just reopened again this morning here in downtown san jose but, yes, they are supposed to be shutting down tomorrow as all gyms in santa clara county are. yesterday's late afternoon announcement by governor newsom sparked a lot of confusion and disappointment for businesses that just reopened here in santa clara county. like i said gyms like westcott and hair and nail salons opened for the first time in months.

as covid-19 cases has spiked santa clara county is back on the state's watch list, and those same businesses will now have to close again by tomorrow. >> when i got the call from you i thought it was a prank. we're shutting down? we just opened up. it's very depressing. this is what i know. this is all i know. >> reporter: coming up at 6:00 the action one county will take to keep some of its businesses from closing. reporting live in downtown san jose, bob redell, "today in the bay." >> all right, thank you very much, bob. it's 5:34 right now. we're finding that smoking appears to be a really big problem, a risk factor, when it comes to young adults and covid-19. these are some new findings from ucsf. check out these statistics. one in three young adults is at risk of contracting a severe case of coronavirus. of that number smokers leave

themselves 100% vulnerable of catching covid-19. compare that to about 16% of nonsmokers. about the same percentage of young adult women and men are left at risk. santa clara county is opening three new and free coronavirus testing sites today. two locations are in san jose. the other in gilroy. now they're all considered pop-up sites offering free nasal swab tests, no questions asked. testing is available today through friday from 10:00 a.m. to 3:00 at the county service center auditorium and at independence high school in san jose. gilroy's pop-up operation is at the south county annex from 1:00 p.m. to 6:00 today through friday and select hours on saturday. san francisco's supervisors may be poised to call on the state to reduce san quentin's prison population where there's been a major outbreak of covid-19. today they are going to discuss a resolution asking the governor's office to reduce california's prison population

and move some of san quentin's inmates elsewhere. about half of the inmates are now infected amounting to about 1,500 cases. at least ten inmate deaths are now tied to the virus. happening today we could soon see history made by an east bay police department. berkeley possibly becoming the first city in the nation to stop its police from enforcing traffic stops. "today in the bay's" cierra johnson is in berkeley to break down the proposal and what this could mean for drivers if it passes. >> reporter: it would mean traffic stops in berkeley would look a lot different. i want to start by pointing your attention to some of the graffiti on the police building behind me. we were out here yesterday getting video of the building in preparation for this story. and since we shot that video there is an array of chalk and spray paint on the building, a lot of it too inappropriate to say on television but mentioning defunding the police, an array of messages. i did want to point that out.

that ahead of today's meeting, the meeting they will discuss the proposal to remove the responsibility of traffic stops from the police to civil servants. now this idea for the city to create the department of transportation would be under the plan of taking traffic, parking enforcement, crossing guards and shift to the newly created department. writers of the proposal explain the move would reduce the need of interaction with civilians. >> it's fine to rethink and for everybody to talk about and be aware of what's going on. i think that can only be good for everybody including the police because they're too much involved in civil service stuff and maybe they would not like to be involved that way. i think it's a long process everybody should be talking about it. fine with me. just keep talking about it.

>> reporter: so those who drafted the proposal acknowledged reshifting some of the resources would cost money although they did not specify that upfront cost. councilmembers will discuss this proposal at tonight's meeting and because we are still in the middle of the pandemic that meeting will take place over teleconference. everyone is able to join in. the link is on the city's website and it takes place at 6:00 tonight. we are live in front of berkeley pd, cierra johnson for "today in the bay." >> all right, thanks very much, cierra. 5:38 right now. happening today a north bay school district will discuss possibly renaming sir frances drake high school in san anselmo. there was a meeting demanding the name change. protesters say sir frances drake was involved in the slave trade. the school is committed to ensuring diversity and equity. happening today leaders

across the bay area will consider proposals to help people struggling to make it in the bay. san francisco supervisors will consider a plan that would ban rent increases during the pandemic. meanwhile contra costa county leaders are going to discuss extending similar bans and continue its countywide eviction moratorium. oakland city leaders will consider placing limits on how much landlords raise the rent on other tenants. 5:39. time for a look at weather and traffic together. whether you like it or not, the day is beginning. hopefully a nice one on tap for us, kari. yes. the light might start to come through the blinds this morning as you're waking up, the sun is rising. let's get a look at the view from the coup earp tino hills looking over the south bay and a look at our temperature trend that looks very comfortable for today. we're going to warm up heading into the low 80s by early in the afternoon. all of our micro climates pretty spread out with 50s near the

right now at 5:43 let's head over to concord and check out our temperature trend. we'll be in the upper 50s to start out, and as we go into today we're going to see our high temperatures staying fairly mild, but it's going to be a nice and comfortable morning. a look at all of our microclimates and we'll talk about la nina developing in a few minutes. well, heartbreaking new details emerging this morning in the drowning death of "glee" star naya rivera. recovery teams found her body yesterday six days after she drowned while swimming with her 4-year-old son. investigators say her son told them she had just enough energy to boost him back into the rented boat. they say that he turned back to see his mother and she disappeared into the water. >> the idea the boat started drifting. it was unanchored and she mustered enough energy to get her son back onto the boat but

not enough to save herself. >> investigators do not believe rivera took her own life calling this a tragic accident. she was not wearing a life jacket, but they did find one on the boat. >> so sad. now to southern california and the naval ship fire that injured dozens of sailors over the week. the fire still evident with smoke still billowing over the san diego skyline. a lot of health concerns there. it happened on sunday on the "uss bonhomme richard" after a fire in the lower cargo hold. more than 50 sailors were hospitalized with minor injuries. new this morning, a pair of earthquakes that rattled southern california, the largest, in fact, in about 20 years, could actually now say -- they're saying it could create a domino effect and trigger an earthquake along the san andreas fault line. researchers say the magnitude 6.4 and 7.1 earthquake that hit

ridgecrest last year makes a future earthquake along the nearby fault a lot more likely. if a big enough quake hits the fault it could trigger the san andreas fault as well. there's a 1 in 87 chance of something like this happening in the next year. in southern california orange county's school board has just voted to open schools next month without masks or social distancing. that 4-1 decision was made after the discussion with a panel of medical experts. it's believed to be up to the individual districts to make that ultimate decision. meanwhile, the state's two largest districts, l.a. and san diego, well, they will not reopen campus this is fall opting for distance learning. >> older drivers can hold off on going to the dmv another year. the dmv granted another extension for drivers 70 years and older from visiting the offices during the pandemic. people older than 75 are some of the most vulnerable to covid-19.

air conditioning in the inland east bay and the tri-valley as well as farther to the north as we see a high of 98 degrees again today in ukiah, and you head over to concord, up to 85 degrees. oakland in the low 70s and san francisco in the low 60s. in the pacific waters we're always monitoring the blob, an area of really warm water in the pacific, but we're also looking over towards the equator where we're seeing a slight cooldown in those temperatures looking at the sea surface temperatures which means that a weak la nina is developing and usually that drives the storm track further to the north. for us that could mean a little bit more rainfall over the next couple of months. so looking at those sea surface temperatures once again near the equator in the pacific we're seeing a slight cooldown there. so what does that mean for us as we go into the next several

months? with this weak event near average or slightly above average rainfall going into the water. that's something we'll be watching as we go into the late fall and early winter. we'll see if a real la nina event develops. now as we look at our temperatures here over the next seven days, once again this is our break from those 90s, but we're looking at upper 80s and then we'll go back to some very hot temperatures as we go towards the end of the weekend and early next week. how is it looking for the morning commute right now, mike? kari, we have one spot expected to be slow. another region unanticipated. first the change in the south bay. northbound 101 right on schedule about ten minutes ago started with this slowing and it's sticking around today. traffic tuesday for what we do have as we look at the map. it's slower north 101 from 680 up to oakland road. now the unanticipated slowdown is in the tri-valley on the right side resuming 680 and the update chp has just given us is

that all lanes of 680 are blocked once again. remember, there's a sweeper on scene taking care of sand and gravel across the lanes. my hope is they've closed all lanes because they're getting ready to open at last two more. we've had only one causing this big backup. a lot of folks are going eastbound, i believe, on 580 adding to the slow drive you see out of livermore in to sunol. others are passing by the dublin interchange hearing about that crash and then they're trying to get off foothill road. we're confused because they don't normally take that route. eden canyon has been cleared the left two lanes and that's better news. >> good to know, mike. thank you. happening now for you, jetblue says it will keep its distancing rules in effect at least until after labor day. that means middle seats on its larger jets and aisle seats on the smaller planes will remain empty. three passengers from the same household can request to sit next to each other. united and american are among those who stopped distancing on flights.

it is 5:56 right now. an outpouring of grief for an east bay doctor who was shot and killed while offroading near sacramento. last night mourners held a vigil for dr. ari gershman at his danville home. he leaves behind a wife and three children. his widow is battling cancer. last night people surrounded the gershman home with twinkling electric candles and messages of love and support for the family. >> the idea of this is surrounding the house and his family, his wife and his three kids, surrounding them with love and support so they know they're not alone.
